The "Real Housewives of Beverly Hills" doc was spotted smiling and laughing with his three boys and a nanny on their way into Benihana last night.

A source close to the family tells TMZ that reports of a brewing custody battle with Adrienne are false -- and in fact, Paul only wants "what's best for his children." We're told Paul wants joint custody, and doesn't anticipate that being an issue.

As for Paul and Adrienne's considerable fortunes -- our source confirms there is a prenup that would protect them if they divorce.

We're also told that Paul does NOT want details of their breakup to become a plot line on 'Housewives' ... because he doesn't believe it will be portrayed fairly or accurately.

Sources close to Paul tell us ... "Dr. Nassif’s sole focus is making sure both Adrienne and the kids are as happy as possible in this very difficult time. His goal is to ensure the best interest of the children. He is going to stay focused on them and his patients."

The WWE has issued an full apology after an on-air personality joked that one of the wrestlers was "like Kobe Bryant at a hotel in Colorado ... he's unstoppable."

It all went down during a live broadcast of "Monday Night Raw" ... when a manager named Abraham Washington -- who was wearing a live mic -- was ringside for a match involving a wrestler named Titus O'Neil ... and during the action, A.W. let the Kobe crack fly.

The comment is an obvious reference to Kobe's 2003 sexual assault case -- when he was accused of raping a woman in his hotel room in Eagle, Colorado. The accuser eventually reached a settlement with Kobe and dropped her case.

A rep for the WWE has issued a statement to TMZ ... telling us, "A.W. made an inappropriate comment and WWE immediately apologized."

The rep adds, "WWE has taken appropriate action in the matter." It's unclear what kind of "action" the org. has decided to take.

Sources tell us A.W. "felt horrible" after he made the comment ... claiming he simply "got caught up in the moment" ... and realizes the comment could be hurtful to rape victims and their families.

A.W. immediately apologized to WWE honchos, including the McMahon family, and several wrestlers ... and has also vowed to refrain from making similar comments in the future.

10:20 PM PT -- Washington has issued an apology on Twitter ... calling his comments "inappropriate and insensitive."

TMZ has learned ... the Cincinnati Fire Department raced to the US Bank Arena moments ago after a fire broke out on the stage at WWE rehearsals for tonight's "Monday Night Raw."

A rep for the WWE tells us the fire began due to a "minor incident involving the show's pyrotechnics" ... and as a precaution, the "limited number of people in the building during the incident were successfully evacuated."

"Real Housewives of Beverly Hills" stars Dr. Paul Nassif and Adrienne Maloof are on the outs -- Paul plans to file for legal separation early this week ... TMZ has learned.

Sources tell us Adrienne and Paul have discussed the situation, and she is well aware of his intentions to file the paperwork.

We're told the couple -- married since 2002 -- has made multiple attempts to work out their issues, but ... no dice.

Paul and Adrienne have 3 sons together.

Bad news if you've ever wanted to sit in the booth where ex-murder suspect Robert Blake ate with his wife ... shortly before she was shot to death outside Vitello's Restaurant in L.A. -- TMZ has learned, it's being sold at auction.

The legendary Vitello's has undergone a complete facelift in recent months -- and a rep tells TMZ, the owners now only want "positive energy" to be part of the new restaurant.

As a result, Vitello's is selling off anything that might give off bad vibes -- including the booth where Blake and his wife ate the fateful night she was shot and killed outside the restaurant back in 2001

The auction will take place on eBay August 1st -- but don't expect to get the booth for cheap ... we're told bidding will start at $1,000.

It's a great piece of Hollywood history -- Blake and his deceased wife Bonny Lee Bakley ate in the same booth several times before the infamous murder.

In fact, the table played a KEY ROLE in Blake's alibi -- he told police he couldn't have shot his wife because he was inside the restaurant at the time retrieving a gun he left on the table.

The Wanted singer Max George is "heartbroken" and "very upset" over a new report in which a former lover describes him as a sex god. Seriously. He's upset about that.

The story emerged after George split with British soap star Michelle Keegan -- when an even older flame claimed she had been "sexting" George during his recent relationship with the actress.

And ... to rub salt in Keegan's wounds ... the older flame, Bobbi Aney, decided it would be a good idea to talk to the tabloids about the crazy sex she used to have with George during their 3-year relationship.

“Sometimes we would have sex six or seven times a day," she raved ... calling him a confident lover who knows what he wants.

But a source close to George tells TMZ ... the singer isn't flattered by the public libido worship ... he's upset about it because he feels Anley only released the details to make Keegan feel worse about the breakup.

Katherine Jackson SUPPORTED TJ Jackson's efforts to obtain temporary guardianship of Michael Jackson's 3 children ... so says TJ in court docs obtained by TMZ.

TJ filed the docs with the court before today's hearing -- and in the papers, TJ claims Katherine was being manipulated by family members who were hellbent on controlling Katherine.

In fact, TJ claims one of his aunts -- either Janet or Rebbie -- arranged for a person to IMPERSONATE A DOCTOR to convince Katherine to blow off a concert series and instead fly with her conspiratorial children to Arizona.

TJ claims he had been assisting with the care of MJ's children since MJ died ... and even before Katherine disappeared, she placed them in his care.

According to the docs, TJ claims he finally spoke with Katherine on July 24 -- and during the conversation, she "indicated to me that she supported me in taking steps that I deemed appropriate to protect [MJ's children]."

TJ was eventually awarded temporary guardianship over Paris, Prince and Blanket.

DC Comics is forbidding comic book retailers from selling the upcoming issue of a Batman comic book ... because it "contains content that may be perceived as insensitive" in the wake of the "Dark Knight" shooting in Colorado.

TMZ obtained an email DC sent comic book retailers last night asking them to HOLD the new issue of "Batman Inc." -- a fairly new comic book line featuring the Caped Crusader.

In the email, DC explains ... "Out of respect for the victims and families in Aurora, Colorado DC Entertainment has made the decision to postpone the release of BATMAN INCORPORATED #3 for one month because the comic contains content that may be perceived as insensitive in light of recent events."

TMZ has obtained the unedited full video of what turned into a confrontation at the Jackson family compound Monday in Calabasas, CA.

It starts out friendly enough, with MJ's kids Paris and Prince getting out of their SUV and shaking hands and hugging a few of Michael's siblings who arrived in the SUV behind them.

But moments later, things turned ugly.

The footage shows Janet confronting MJ's daughter Paris ... and during the standoff, Janet swipes for Paris' cell phone twice.

Paris charges past Janet ... and when Janet attempts to go after Paris, Janet is restrained by her brother Randy.

Randy and Janet proceed to hold up their cell phones and record Paris.

After the video ends, there was a physical altercation at the home between two family members. Cops arrived to the scene and took a battery report.

L.A. County Sheriff's Deputies went to the Jackson family home in Calabasas and took a battery report ... after family members reported a disturbance.

Steve Whitmore tells TMZ ... Lost Hills deputies from the Sheriff's Dept. showed up this afternoon at the compound and someone inside accused someone else present of a physical assault.

Deputies took a report but no arrests were made.

Whitmore tell TMZ ... Lost Hills Sheriff's deputies have been on the Jackson case since April, when a business associate of the Jackson family alleged that Katherine Jackson was being emotionally and financially mistreated by family members.

Rick Ross' tour bus was left in ruins Saturday ... after a burglar (or burglars) broke into the massive vehicle, plundered thousands of dollars worth of stuff, and practically destroyed it in the process.

Detroit law enforcement sources tell TMZ, Ross' camp filed a police report early Saturday morning, claiming the bandits made off with thousands of dollars worth of jewelry, clothes, and other personal property.

We're told no one was inside the tour bus when it was burglarized. Ross and his entourage were staying at a nearby hotel at the time.

Tennessee Titans wide receiver Kenny Britt has been arrested ... again ... this time for driving under the influence in Kentucky ... TMZ has learned.

The NFL star was taken into custody by the Fort Campbell Police Department at 3:30 AM Tuesday while attempting to drive on to Fort Campbell -- a U.S. Army base located on the border of Kentucky and Tennessee.

We're told Britt was with a soldier at the time of the arrest.

Britt's cherry red 2008 Dodge Challenger was taken to a nearby impound lot (pictured below).

It DEFINITELY ain't Kenny's first brush with the law ... the 23-year-old was busted back in April 2011 for careless driving ... and in June 2011, he was popped in New Jersey for resisting arrest.

A rep for Fort Campbell tells TMZ the incident is "under investigation."

It only took a few hours for the fallout to hit Fred Willard after being arrested for lewd conduct ... because PBS just gave him the heave ho.

TMZ obtained the email that PBS honchos sent to affiliates informing them he has been fired from "Market Warriors."

According to the email the network is telling affiliates not to air any of the unaired episodes featuring Willard.

L.A. Kings star Drew Doughty has been officially cleared of raping a woman he hooked up with in a bar ... TMZ has learned.

As TMZ first reported, the NHL defenseman had been investigated after the woman accused him of forcibly having sex with her at his home back in March ... after bumping into each other in a Hermosa Beach, CA bar.

According to the the L.A. County District Attorney's Office ... the alleged victim "told the investigating officer that she had consensual sex with suspect" a few months prior to the March incident.

The D.A. says there is insufficient evidence to prove the case beyond a reasonable doubt -- and as a result Doughy will not be prosecuted.

Tom Cruise capped off his first day back with Suri with a fancy sleepover at his swanky Manhattan hotel ... and now the father-daughter duo is all set for another day of fun, excitement and helicopters.

Tom just left The Greenwich Hotel ... with Suri wrapped up in his arms. Seems Cruise is doing everything in his power to make sure Suri feels comfortable:

We're told Tom rented out 3 suites for himself and staff ... so they had all sorts of room to play and hang out.

Authorities found baggies of white powder in the room where Sage Stallone died ... TMZ has learned.

Our law enforcement sources confirm detectives found "several little baggies in the bedroom." One law enforcement source says the powder is being tested and suggests it could be cocaine or crushed Vicodin.

We're told there were no obvious signs of white powder on Sage's body when he was found.

As we first reported, authorities found "huge" empty prescription bottles in Sage's bedroom. A law enforcement source has now elaborated, telling TMZ they found "more than 60 gigantic bottles, like the ones in pharmacies."

Authorities know the bottles contained Hydrocodone -- generic Vicodin.

Investigators are baffled at the quantity of the bottles and are trying to figure out where Sage may have gotten them. They say it's possible he got them online, but they're also looking at several doctors.
