Tom Sizemore was loaded on set before he ran over a stuntman ... according to a new suit.

Steve de Castro, who worked as a stuntman on the TV show "Shooter," claims he was within a hair's breath of death and suffered multiple broken bones after being run over and pinned under the SUV Sizemore was driving. The suit claims Sizemore was reckless and "intoxicated."

The suit makes it seem Tom was almost out to hurt the guy, claiming the actor "committed a willful and unprovoked physical act of aggression ... by intentionally ... running over his prone body."

De Castro claims producers protected Sizemore ... rather than immediately firing him, they let it slide.

He's suing Tom and the production for his medical expenses and other damages.

Sizemore tells TMZ, he was not under the influence, and even offered to take a urine test after the accident. He says, despite his history, producers said it was not necessary.

Donald Trump's Hollywood Walk of Fame star has been restored to its glory but is still under wraps ... and it may not be unveiled until AFTER the election.

Fact is ... the star is vulnerable given the incendiary nature of Trump's campaign -- at least that's the thinking of the Hollywood Chamber of Commerce, which is responsible for maintaining the star.

We're told a final decision hasn't been made, but Chamber officials are leaning toward exercising caution and barricading the 5 points of light until November 9th.

To be extra cautious ... law enforcement tells us the LAPD will ramp up patrols to protect the area from more ax star murderers and other vandals.

Speaking of vandals ... sledgehammer aficionado James Otis awaits possible felony prosecution for his handiwork.

Fetty Wap ruthlessly cut the lyrics written by a former Remy Boyz member for his mega hit "679" and cheated him out of major cash ... so claims Fetty's ex-homie.

Rapper P-Dice says he helped write the multi-platinum song, and Fetty cut a deal to give him 16.9% of the profits off the track, but in a lawsuit PD says he was scrubbed from the song to avoid the payout.

According to the docs, Fetty verbally agreed to give P-Dice writing credit -- but after they finished recording, Fetty deleted his entire performance and reduced his share of the profits to 5%.

P-Dice -- who appears prominently in the "679" music video -- says the edited version ended up on Fetty's album which debuted No. 1 on Billboard. The music vid alone has topped 238 million views.

P-Dice is suing for damages in excess of $7 million. A rep for Fetty had no comment.

More good news for Ezekiel Elliott -- all of the criminal charges from his December car crash case in Ohio have been dismissed ... TMZ Sports has learned.

The guy who played Darth Maul in "Star Wars: Episode I - The Phantom Menace" is under investigation for allegedly assaulting a woman ... TMZ has learned.

Raymond Park was a panelist at Super Megafest Comic-con in Massachusetts last weekend, and law enforcement sources tell us they got a 911 call early Sunday reporting an assault at his hotel. Park's rep says cops woke the actor in his room, and spoke to him about claims he struck a woman.

Park was questioned, but never detained or arrested. His rep says Park was partying with fans Saturday night at his hotel bar, but insists he never assaulted anyone. Witnesses tell us he seemed kinda wasted while throwing darts, but no one saw anything violent.

For what it's worth, Park was back at the convention Sunday. Cops say their investigation is still ongoing.

The makers of some 'Elf on the Shelf' merch awoke to find a lawsuit ... courtesy of the woman who literally wrote the book on the holiday craze.

Carol Aebersold, co-author of "The Elf on the Shelf: A Christmas Tradition" ... made a fortune selling gear based on the book. But in a lawsuit she says Maureen and Manus McGee have been hawking knockoffs, and even participated in the illegal download of 'Elf' movies.

In the docs, Carol says the McGees even bitch about eBay yanking their listings -- because they're unauthorized -- insisting they have a right to sell their version.

Carol's elf co. is suing for every dime the couple's made in the elf game -- and yes, they want all the "counterfeit" dolls hauled off shelves.

UFC star Anthony Pettis says he's "shocked" and "confused" over the fire attack at his home in Milwaukee -- claiming he has "no idea" why anyone would want to harm him.

As we previously reported, someone went to Pettis' home in the middle of the night and set his cars on fire. Cops are on the hunt, but have not made any arrests.

Now, Pettis' rep, Lindsey Deierling of EAG Sports Management, tells TMZ Sports, "Anthony has no idea who could be responsible for this incident or why someone would damage his property in such a way."

"He is shocked and confused as to who would randomly commit such a hateful crime like this to his family."

"He has no ongoing issues with anyone in his community, and he is very well known in Milwaukee for the work and dedication he has put in to helping his city and creating jobs and resources for the local citizens."

"Anthony is disappointed that this person(s) would compromise the safety of his family and destroy his personal property."

The vandal who went to town on Donald Trump's star has more than enough money to defend himself in court ... he has a massive Dr. Seuss art collection and, get this, his great great granddad created the Otis Elevator Company!

James Otis just got out of jail after being arrested for felony vandalism, and he has quite the pedigree. In addition to the lift ... James' great grandfather on his mom's side invented Listerine, and James himself boasts the biggest Dr. Seuss art collection in the country.

So ... he might write:

It's a case of too bad, so sad for Alec Baldwin ... according to the art gallery owner he's suing for selling him a "fake" painting.

Mary Boone responded to Baldwin's suit, saying the actor waited more than 6 years to file the suit over "Sea and Mirror" -- the Ross Bleckner painting Boone's gallery sold him for $190k. In docs, Boone's legal team says the statute of limitations has run out, so Baldwin's got no beef ... legally speaking.

Further, she claims Baldwin committed tax fraud. Boone's attorneys claim he should have paid $16,625 in NY city and state tax on the painting, but instead had it "shipped momentarily" to his Cali home, then back to his NYC pad.

Translation: He has unclean hands in this deal, and therefore shouldn't be pointing fingers at her in court.

Boone says she's not conceding Alec's counterfeit claims are true ... she's just not addressing it because his lawsuit's too late. She's asking the court to toss the case.

Miami Dolphins lineman Laremy Tunsil has finally fired back at his stepdad in court -- adamantly denying he attacked Lindsey Miller during an incident last year ... and shouldn't have to pay him a cent.

Miller sued Tunsil back in April -- claiming Tunsil beat him up on June 25, 2015 after he tried to warn the football star about the dangers of hanging out with agents while he was still a college player.

In his suit, Miller claims Tunsil "violently attacked" and "pounded the disabled American veteran severely, striking him with his fists multiple times."

Miller claims it took 4 men to pull the football star off of him. He sued Tunsil for unspecified damages.

But now, Tunsil has finally responded in legal docs of his own -- adamantly denying any sort of violent physical attack.

In the docs, obtained by TMZ Sports, Tunsil doesn't get into the specifics -- but claims Miller is lying and the judge shouldn't award him a penny in damages.

1:36 PM PT -- Blac just went off on Pilot, saying the photo in question was taken over 2 years ago. Blac's adamant she never slept with Pilot and adds that the entire ordeal is a ploy to drum up hype for his new track.

Rob Kardashian is under criminal investigation for allegedly threatening a man with some pretty close ties to Blac Chyna.

Law enforcement sources tell us ... Rob allegedly physically threatened Pilot Jones, who's been hanging with Blac Chyna. We're told Rob threatened to do Pilot harm.

The allegations come on the heels of photos that surfaced showing Blac and Pilot making out.

We're told Pilot is scared, partly because of a string of text messages, which include Rob telling Pilot, "Leave my wife alone. I'm not playing with you."

Our law enforcement sources say, there are other texts in which Rob generally threatens Pilot with physical harm if he doesn't stay away from Blac Chyna, although as one source says, the threat is "a little murky and general."

LAPD officers got their hands on a piece of Donald Trump's Walk of Fame star ... which had been stashed away after vandal James Otis destroyed it.

Cops recovered the brass emblem with the TV icon from Trump's star at a home in the San Fernando Valley. Law enforcement sources tell us Otis had given it to a family member for safekeeping. He gave up the location during questioning.

As we first reported ... cops nabbed Otis Thursday morning in West Hollywood and he's being booked for felony vandalism. The Hollywood Chamber of Commerce says the star is worth $30,000.

As for Trump's nameplate -- it was mostly obliterated during Otis' attack, and he says he did not take the pieces.

Kim Kardashian's concierge has told a story fundamentally different from the one Kim told cops ... raising the question, what really happened when the Paris robbery went down?

The concierge -- who was taken to Kim's apartment during the robbery -- appeared on "Entertainment Tonight" and said the robbers never asked for her ring or jewelry. Concierge Abdulrahman says the robbers kept asking for "l'argent" ... French for money, and Kim thought they wanted the ring.

Justin Timberlake may have skated by taking an illegal selfie of his ballot at the Tennessee polls, but if celebs in Hollywood snap their ballots they could be in peril ... as in FELONY peril.

Most people don't know it, but there's a dusty old California law that makes it illegal for a voter to disclose their ballot choices at the polls. The law was passed 125 years ago, but it's still in effect and the punishment is up to 4 YEARS IN PRISON.

The law Timberlake violated pales by comparison. If prosecutors went after him, the most he'd get is 30 days in the pokey.

Now here's the weird part. The good folks in Sacramento just passed a law that will allow people to take selfies at the polls and display their choices to the world. The logic ... it encourages people to vote. Problem is ... the new law doesn't take effect until January 1, 2017.

So, what to do? We did some digging and couldn't find a single case where a voter was prosecuted.

We called the L.A. County D.A. and asked if they would let celebs and others skate if they dare disclose their preferences at the polls. The D.A. would not say one way or the other ... an official said they will not comment on "hypotheticals."

So, Barbra Streisand, Scooter Braun, Ellen DeGeneres, Lady Gaga, Jamie Foxx and George Clooney ... snap at your peril.

Judge Mathis isn't exactly condemning the dude who took a pickax to Donald Trump's star on the Hollywood Walk of Fame ... in fact, he wants to give the guy a medal.

Hizzoner was leaving Catch in WeHo Wednesday night when our photog asked about self-proclaimed vandal James Otis, who will be arrested Thursday for felony vandalism.

Mathis doesn't seem to be a believer in equal justice ... for all.

The Kardashians' makeup artist is harassing her fiance's ex-wife and fat shaming his son, according to new legal docs.

Joyce Bonelli -- who flaunts her Kardashian ties on Instagram -- also used her social media to call Beth Taverniti a "handbag hoe" and a "ghetto bitch" ... according to Beth's request for a restraining order.

Beth also took their feud to court because she says Bonelli is bullying the son she has with Ben Taverniti, who's currently engaged to Bonelli. In the docs, Beth says Bonelli sent texts about the 5-year-old ... saying he's 45-60 pounds overweight and "the fat around his neck is getting so thick he doesn't breathe well."

Beth says Joyce has a huge following on social media -- including 1.7 million on IG -- because of her link to the Kardashians, which makes her posts way more humiliating.

Beth's restraining order request was denied, but there's a hearing later this month where she'll try to convince a judge she needs protection.
