Oksana Alleges Violence Against Mel Gibson

TMZ has learned it was Oksana Grigorieva who got a domestic violence restraining order against Mel Gibson, and not vice versa ... and she claims the actor was violent toward her.

We've learned Oksana's lawyers went to the family law court in downtown L.A. last Monday for an emergency hearing, and told the judge that Mel allegedly got violent with her -- two sources say Oksana claimed Mel was "extremely violent."

Sources tell TMZ the judge issued a restraining order prohibiting Mel from having any contact with Oksana. We're told the next day, Mel's lawyers went back to court and got the order modified so Mel could see their daughter.

We're told Mel also got a restraining order against Oksana, but only with respect to prohibiting her from releasing certain information.

A source connected with Mel Gibson scoffed at Oksana's allegations, claiming the alleged incidents occurred this past January and she traveled with him afterwards -- all over the world. As the source put it, "In these cases, when somebody cries wolf, the judge is mandated to assume there's a wolf, until a full hearing can be held."

A source connected with Oksana confirms the alleged violent incidents occurred in January, but added, "There were other acts after January that were not physical but still constituted domestic violence."

Lindsay Lohan's Spray Tan Could Set Off SCRAM

Lindsay Lohan is flirting with danger by spray tanning, after being warned it could trigger a positive alcohol reading with the SCRAM people.

Multiple sources say people have told Lindsay she can't get a spray tan while she's wearing the bracelet, because a chemical in the tanning solution can create a reading which would show the presence of alcohol.

Lindsay's response to that warning -- we're told she's still getting a spray tan 1 to 2 times a week.

And it gets worse. We're told the famous probationer is "climbing the walls" ... and is "filled with anxiety" because of the mandatory accessory.

Sources tell TMZ Lindsay was OK with it the first week, but the bracelet started digging into her skin, irritating it. As one person put it, "She's made life hell for the people around her, since she is in pretty bad pain."

And Lindsay's 24th birthday is July 2, and she doesn't like the accessory.

Lindsay wants the bracelet off, we're told, even before her July 6 hearing. Ain't no way Judge Marsha Revel would even hear of it.

On the eve of the anniversary of their father's death -- Michael Jackson's three children Prince, Paris, and Blanket spent the day on a beach in Maui.

As we previously reported, Katherine wants to bring the family back to Michael's hometown of Gary, Indiana for the actual anniversary tomorrow -- where they plan on honoring MJ's memory as a family.

Dr. Conrad Murray: The Strip Club Story is BS

A rep for Dr. Conrad Murray's defense team tells TMZ Joe Jackson's lawyer is flat-out wrong when he claims Dr. Murray was drinking at a strip club hours before Michael Jackson died.

TMZ broke the story ... Joe Jackson's lawyer, Brian Oxman, has served Murray

as a prelude to a wrongful death lawsuit. In those papers, Oxman claims Dr. Murray was at Sam's Hofbrau -- a strip club -- on June 25, 2009, prior to treating Jackson.

The rep for the defense team tells TMZ Dr. Murray was not at a strip club when Oxman claims, nor was he there the night before. As the rep put it, "In the weeks before Michael died, Murray barely had time to take a shower."

The rep also says Oxman got it wrong when he claimed Dr. Murray was drinking, because "He does not drink."

As for whether Murray has ever frequented the club, the rep did not know one way or the other. But one of the waitresses at the club tells TMZ Dr. Murray was at the club sometime in June of last year. A stripper who works at the club tells TMZ she vividly remembers the night before Michael died because she's a big MJ fan, and says, "It was dead that night. Dr. Murray definitely was not there."

The club's owner tells TMZ ... at least twice in the last 6 months, a private investigator came to the club and asked various employees a bunch of questions about Murray and if they remembered seeing him at the club.

Interesting note -- we're told Quentin Tarantino liked Sam's Hofbrau so much, he used it in the movie, "Jackie Brown."

Joe Jackson to Sue Dr. Murray for Wrongful Death

TMZ has obtained a copy of a legal document that Joe Jackson has sent to Dr. Conrad Murray -- a prerequisite to filing a wrongful death lawsuit ... in which Joe claims Dr. Murray had been drinking at a strip club hours before he allegedly administered a fatal dose of Propofol to Michael Jackson.

, "On June 25, 2009, prior to treating Michael Jackson, defendant was at a 'strip club' called 'Sam's Hofbrau' in Los Angeles where he had been 'drinking.'" The doc goes on: "It was reckless for him to 'drink' prior to administering anesthesia to Michael Jackson. He concealed his conduct from Michael Jackson."

The doc, written by attorney Brian Oxman, outlines Murray's treatment and the medical emergency that ended in Michael Jackson's death.

According to the document, Michael had "neurological, pulmonary, and anemia signs over several weeks prior to his death. In May and June, 2009, Michael Jackson was confused, easily frightened, unable to remember, obsessive, and disoriented." Oxman goes on: "He had impaired memory, loss of appetite, and absence of energy. He was cold and shivering during

for his show ..."

Oxman claims these problems were caused by Dr. Murray administering a "polypharmacy" of drugs (multiple meds) to Michael. And Oxman claims, Dr. Murray "ignored the signs of Michael Jackson's pulmonary inflammation, brain swelling, and anemia."

Oxman alleges Murray repeatedly lied about the drugs he administered to Jackson and withheld vital information from EMTs and doctors who were trying to save Jackson's life. He repeated all of the alleged inconsistencies that have been previously reported.

Oxman says of Dr. Murray, "His conduct was inhuman. It was an extreme violation of the standard of care."

We're told Dr. Murray received a copy of the document in March. Dr. Murray's legal team tells TMZ, "The allegations are absolute, utter nonsense."

And people close to Dr. Murray insist he does not drink ... ever.

We're told the document was served on Dr. Murray on March 27, 2010. According to California law, Joe Jackson must wait 90 days from the date the document is delivered before filing an actual wrongful death lawsuit. The 90-day period is up Friday, the anniversary of Michael's death.

Batista's MMA Deal Hits Big, Green Speed Bump

Former WWE champ Batista may have jumped the gun when he told us he was joining the Strikeforce MMA league -- TMZ has learned dude hasn't signed a contract ... and the holdup is cold, hard cash.

Sources involved in the negotiations tell TMZ, Batista and Strikeforce CEO Scott Coker have already hammered out most of the details in their contract -- but Batista's salary is still a major sticking point.

Coker and the former WWE star are also stuck on scheduling issues -- because according to sources close to the fighter, Batista's calendar has been jam-packed with TV and movie deals since his wrestling contract expired.

We're also told Batista's camp is pissed off over Booker T.'s comments yesterday that Batista would get beat down by fellow WWE-star-turned-MMA-fighter Bobby Lashley ... telling us Batista will fight anyone, Lashley included.

Hopefully, we'll get to see for ourselves ... if Batista can ever work out a deal.

Lindsay Lohan -- Extremely Late, Very Irate

Lindsay Lohan is declaring war on a reality TV show -- claiming she's being unfairly portrayed as an irresponsible slacker who almost sabotaged a photo shoot for her own line of leggings ... problem is, it's all true.

It's all over tonight's episode of the Bravo reality show "Double Exposure" -- which is centered around Lindsay being several hours late to a NY photo shoot that went down back in September. The episode is titled, "Is Lindsay Here Yet?"

Lindsay -- obviously pissed about the way the episode is being promoted -- went to her Twitter page a few hours ago and claimed everything on the show is, "UNTRUE" -- adding, "Sucks when 'friends' use you(in this case for ratings) even if they're lyin."

But sources close to the production tell us Lindsay really was 11 hours late for the shoot -- which was scheduled for 10 AM. We're told Lindsay's excuse was that "she woke up late."

However -- when Lindsay did eventually show up, one source tells us, "she was fantastic to work with ... it's the 'getting there' that's another story."

Vienna Girardi & Gregory Michael Hand In Hand

Just hours after Vienna Girardi moved her ass out of Jake Pavelka's home -- she was already partying with the man she was rumored to be hooking up with on the side ... Gregory Michael.

Vienna and the "Greek" actor were dancing with each other -- hand-in-hand -- at the Reality Cares CHOC Children's Hospital Prom on Saturday night.

As we previously reported, sources close to the production of "The Bachelor" tell us Jake eventually pulled the plug on the relationship with Vienna because he thought she was "stepping out" with Gregory on the side.

But Vienna claims she never cheated on Jake -- and her stepmom claims the split was all Jake's fault ... because he's a fame-whoring fraud.

London's Wife: Family Served with Cease & Desist

The wife of Jeremy London tells TMZ the actor's mother, brother and his brother's girlfriend have all been served with cease and desist notices in order to keep them from talking about Jeremy's ongoing kidnapping case.

London told police earlier this month that he was kidnapped at gunpoint in Palm Springs, and forced to do drugs. One suspect was arrested, but two more are still at large.

Now London's wife Melissa tells TMZ she's nervous that Jeremy's family has been talking about the case to various media outlets -- thinking that the family blabbing to the media would somehow hamper the case.

Jeremy's rep tells TMZ lawyers for Jeremy served the family members with cease and desist letters on Friday night.

Tiger's Alleged Baby Mama -- He Gave Me Gifts!

The woman who claims Tiger Woods is the father of her 9-year-old son says Tiger knows all about the kid ... and he has even sent presents for the boy in the past.

As we first reported, Devon James filed a paternity action against Tiger in Florida on Thursday. But a rep for James tells us the filing shouldn't surprise Tiger -- she told him about the kid back in August 2008.

James' rep tells TMZ after James got pregnant in 2000, she didn't see Woods again until 2006. The rep says James was scared to tell Woods about the kid at that point because she thought Woods would take her son away from her.

They began seeing each other again from 2006-2008, the rep says, and James told Tiger about her son -- and that he was the father -- in August 2008. The rep says Tiger didn't really acknowledge James' claim -- but when they saw each other in September 2008, Tiger brought a golf club, a hat, and a bracelet that Tiger said was "for your son."

James' rep says that was the last time James saw Tiger.

Katherine Jackson: Michael's Kids Have No Friends

Katherine Jackson says Michael Jackson's kids are isolated and miss their father desperately ... this according to her first interview since MJ's death.

Katherine tells the Daily Mirror, "They don't have any friends. They don't go to school, they have private lessons at home -- but that will change in September, when they are due to enroll at private college."

According to the interview, the kids spend hours listening to their dad's music.

She says Paris has turned her bedroom into a shrine to her "Daddy"and that Prince and Blanket talk often about trying to make him proud.

Katherine says she wanted to decorate Paris' room with pictures of flowers or ballerinas -- but "Paris went into a closet and she brought out seven or eight pictures of Michael, and she told me, 'No, I want daddy hanging in my room'. So she goes to bed looking at him and wakes up looking at him. She said, 'I always want to be able to see him.'"

Michael's mom goes on to say Paris is the most musically-inclined of the three and that Prince wants to produce movies.

This new interview comes days before the anniversary of Michael's death ... and in conjunction with a new book Katherine is selling (pictured above) containing pictures and Katherine's memories of Michael.

She says, "Michael was so misunderstood ... I treasure my memories of him and wanted to share them with his fans in my book. I remember when he brought gifts for me -- a watch, a necklace and a ring. I'll never forget how he smiled when I opened each one. He was so generous. I want the world to know that real Michael Jackson -- a loving person."

Katherine & MJ's Kids -- Pilgrimage on Anniversary

TMZ has learned Katherine Jackson and Michael Jackson's three kids will not be in L.A. to commemorate the one-year anniversary of MJ's death.

Sources connected with the family tell TMZ the gang will be at Michael's birthplace -- Gary, Indiana -- where they will observe the day.

We're told Katherine is set on Gary because she feels it is a "family point of connection" -- and it's just too crazy in L.A.

Our sources say Katherine, Prince, Paris, and Blanket will keep things private with relatives and friends in Gary.

Jesse Plans Move Close to Sandra

Jesse James tells TMZ he's moving to Austin at the end of July ... partly so his children can continue their relationship with Sandra Bullock.

Jesse spoke with Harvey Levin this morning and said he already has a house in Austin, but needs to finish up a History Channel special with the network. Part of the special shows Jesse's time on a kibbutz in Israel.

Jesse says the "first and foremost" reason for moving is because his children love Sandra and want that relationship to continue.

Jesse says he will continue working at West Coast Choppers part-time in Long Beach, but he will work full-time in Austin at the Austin Speed Shop.

As for any future relationship with Sandra, Jesse says, "Whatever happens, happens."

And Jesse tells Harvey he plans on opening a Cisco Burger in Austin -- good news for Texas.

Lindsay's Favorite Tea -- Possible SCRAM Risk

Lindsay Lohan's biggest sobriety aid -- a kind of tea called Kombucha that usually contains harmless traces of alcohol -- could get LiLo in serious SCRAM trouble ... because it might be more alcoholic than she thought.

According to the label, the tea contains less than 0.5% alcohol -- a negligible amount -- but Whole Foods recently yanked all the teas from their shelves over concerns the label isn't so accurate.

The guy behind Kombucha, GT Dave, admitted there are concerns over alcohol levels in the drink -- but tells TMZ, "Although we are not familiar with the technology or sensitivity of SCRAM bracelets, we think it would be highly unlikely that our products would trigger an alarm."

Bottom line, Lindsay would probably have to drink a ton of this stuff to set off her SCRAM-shackle -- but that's not to say she couldn't do it.

Katherine Jackson to Release MJ Book

Michael Jackson's mother, Katherine Jackson, is preparing to release a coffee table book dedicated to her late son ... this according to a new report.

According to Showbiz411.com, the book will be released next week and is called "Never Can Say Goodbye: The Katherine Jackson Archives." The book will reportedly consist of photos on one page and Katherine's thoughts and memories on another ... and will be sold through a website, www.jacksonsecretvault.com.

The site also says Katherine gave an interview with former MJ confidante Marc Schaffel in an effort to promote the book -- a curious decision because Schaffel was heavily involved in Michael's life at one point, but the two had a huge falling out which resulted in several lawsuits.

As we first reported, Katherine plans on taking Michael's kids -- Prince, Paris, and Blanket -- to Michael's hometown of Gary, IN on the anniversary of his death.

Michael Jackson B'Way Play Opens ... in Court

A huge Broadway theater group is suing the executors of Michael Jackson's estate ... claiming the estate is blocking them from making an MJ Broadway musical.

Nederlander Presentations claims it entered into a contract in 2008 for the rights to create and produce a musical stage play based upon MJ's most famous songs, including hits from "Thriller" and "Off the Wall." Among the songs -- "Beat It," "Billie Jean," and "Wanna Be Startin' Somethin.'"

According to the suit, filed in L.A. County Superior Court and obtained by TMZ, Nederlander claims the estate won't provide the rights to use the songs for the play.

Nederlander has already filed a creditor's claim but so far they've gotten nothing.

The suit names co-executors John Branca and John McClain as defendants.

Howard Weitzman, attorney for the MJ estate, tells TMZ, "The contract provides for certain approvals by Michael on a number of important elements. Unfortunately, Michael is not available to participate in the process, and therefore I don't think the contract is enforceable. The lawsuit has no merit."
