Cop Mistook Lindsay's Cocaine for Breath Mint

Published | Updated

Now we know why Lindsay Lohan's 2007 DUI case may have plea bargained so quickly -- the cop who took custody of the cocaine mistook it for a breath mint and threw it in the trash.

Pretty incredible, but according to the Santa Monica Police report -- obtained by TMZ -- the officer "discovered a folded Clinique sun care card with an unknown substance caked on to the surface of the card in Lohan's right rear pocket."

The report goes on: "Some of the white substance fell to the floor. I used my foot to see what had fell but thought nothing of it. I did not recognize the substance attached to the card and initially thought the substance was a wet crushed breath mint."

And now it gets good: "I put the card into the jail trash can next to the booking windows. I was looking at the floor and began to recognize the substance as resembling powder cocaine. I then recovered the card from the trash."

The cop says the coke was in the trash for about 2 minutes. He put the card in an evidence envelope, then scooped up the coke that had fallen to the floor and placed it in a separate evidence envelope.

In short -- EVIDENCE CONTAMINATION!!!

Lindsay ended up with a sweet deal and spent 84 minutes in jail ... for a drunken, cocaine-fueled chase on Pacific Coast Highway. Nice deal if you can get it.

Team Oksana: Mel's Untruthful on Child Support

Published | Updated

Oksana Grigorieva's lawyers are lashing out at Mel Gibson's lawyer for claiming Mel has been more than generous in supporting her and their baby.

Oksana's lawyer, Marci Levine, tells TMZ, "The statement released to TMZ on behalf of Mel Gibson is based upon complete distortions of the truth regarding Mr. Gibson's financial contributions toward the parties' child and conveniently ignores his obligations to the parties' child under California law."

Mel's lawyer, Stephen Kolodny had stated that Mel has opened up his wallet for Oksana, putting her up in a multi-million dollar house, buying her a car, providing health insurance and giving her "tens of thousands of dollars to support her and Lucia over the past months."

Levine would not specifically say how Mel has fallen short, but sources connected with Oksana claim the actor has not paid child support since the couple split.

Levine says, "Mr. Gibson persists in attempting to 'litigate' this matter in the media, and continues to launch false accusations against the mother of his child."

And Levine says, "Unlike Mr. Gibson, Ms. Grigorieva has not, and will not engage in this type of undignified banter in the press."

Stripper Claims She was at MJ's House with Murray

Published | Updated

TMZ has learned ... Joe Jackson's lawyer will interview a stripper who not only claims Dr. Conrad Murray was at a strip club hours before Michael Jackson died, but that she was at Michael Jackson's house after being invited by the doctor.

The stripper -- who claims she was working at Sam's Hof Brau on June 24, 2009 -- claims Dr. Murray was at the club drinking just before midnight.

Now we've learned Brian Oxman, who is repping Joe in his wrongful death lawsuit, has spoken with the stripper's "rep" who has scheduled a meeting. Among the topics -- the stripper claims weeks before Jackson died, Dr. Murray invited her to Jackson's home in Holmby Hills. She claims she went late one night -- after the club closed -- and Jackson was there, however he was in a deep sleep.

In Oxman's letter of intent to sue Dr. Murray, he accused the doc of drinking at Sam's Hof Brau before treating MJ.

Dr. Murray's reps have strongly denied he was at the club on June 24. And, they say, Murray doesn't drink.

Oksana: Mel Gibson Knocked My Teeth Out

Published | Updated

Sources close to Oksana Grigorieva tell TMZ ... Mel Gibson punched her in the face and knocked out her teeth in a fit of rage.

Sources connected with Gibson have told TMZ the actor did not get violent with Oksana during their January 6 confrontation, although they admit things did get physical. A source connected with Oksana, however, says, "Mel and his camp are spinning the facts in a desperate attempt to protect his reputation."

Sources in Oksana's camp say Mel's people are lying when they say she shook the baby. Instead, the sources say, "She tried to protect the baby during one of Gibson's violent episodes when he punched Oksana in the face two times, breaking her teeth and giving her a concussion."

As one source put it, "She tried to protect his reputation, depsite her fears of him and his verbal and physical abuse." And the source goes on, "She regrets having believed in his empty promises to obtain professional help to control his violent nature."

TMZ broke the story ... Oksana obtained a restraining order against Gibson last Monday, which prohibits him from coming within 100 yards of her.

Oksana's attorneys would not comment about the case, but did say, "The true facts will be brought out in a court of law. Oksana will continue to abide by the ethical obligations and rules arising from a confidential paternity action and will let the court decide the issue in this matter."

Mel Gibson: She's Lying and She Secretly Taped Me

Published | Updated

Mel Gibson's baby mama Oksana Grigorieva was bitter over a custody agreement she signed, and that's why she made up the story that Mel beat her up ... this according to sources connected with the actor.

TMZ broke the story ... Oksana's lawyers went to court last Monday and got a domestic violence restraining order against Mel after telling the judge Mel beat Oksana up last January.

According to sources connected with Mel, on January 6, 2010, Mel and Oksana were arguing at home when Oksana took baby Lucia, ran around the backyard, threw herself on the ground, came back inside the house and began shaking Lucia like a ragdoll. Mel followed and the sources acknowledge there was physical contact, but insist Mel did not punch her and was just trying to protect the baby.

The sources say Oksana began traveling the world with Mel and made no mention to anyone about being the victim of brutality at the hands of M.G.

In May, after the couple split, there was a mediation in which Mel and Oksana got joint legal custody of Lucia -- Oksana got primary physical custody and Mel got visitation, which included overnights. The deal was ... the arrangement was eventually supposed to turn into 50/50 custody.

On one occasion, while Oksana was touring Russia for her singing career, Mel went to her house to see Lucia. Oksana's mother was there and told him to stay overnight with the child, which he did. Oksana's mother even let the bodyguard go for the night. Oksana had no problem with this, sources say.

Sources connected with the couple tell TMZ Oksana regretted agreeing to the mediated custody settlement and wanted to limit or even exclude Mel's contact with Lucia.

A week ago Friday, Mel's representatives got a call from Oksana's lawyer, saying Oksana would not allow Mel to spend time with Lucia on Father's Day ... something to which she had already agreed.

According to sources, at noon on Monday, Oksana's lawyer called Mel's rep and said she got a restraining order against him to stay 100 yards from her and couldn't even see Lucia until a hearing in July.

The next day, Mel's lawyer went to the judge and got the restraining order modified, allowing him to see Lucia -- just like it was agreed before.

During the hearing, it came out that Oksana had secretly taped arguments she had with Mel. The judge ordered the tapes sealed and also ordered Oksana not to talk publicly about the recordings.

And, we're told, the judge was extremely unhappy with Oksana's lawyer for not revealing that there had been a mediated custody agreement in place.

Joe Jackson's Wrongful Death Lawsuit

Published | Updated

UPDATE: The wrongful death lawsuit has been stamped by the federal clerk.

TMZ has obtained Joe Jackson's wrongful death lawsuit against Dr. Conrad Murray that Joe's lawyer, Brian Oxman, will file today -- Joe asks for unspecified damages in connection with the death of Michael Jackson. And, the lawsuit lists Katherine Jackson and Michael's three kids as "nominal" plaintiffs.

The lawsuit does not name AEG, though Oxman has alleged the company that produced "This Is It" was at least partly responsible for Jackson's death.

Oxman does not explain what he means when he lists Katherine and MJ's kids as "nominal" plaintiffs. He clearly does not have authority to sue on behalf of the children.

According to the suit, "Mr. Jackson believes there are other parties responsible for Michael Jackson's death but has not yet gathered sufficient information regarding their potential liability or responsibility." The suit says the complaint will be amended when sufficient info is gathered.

TMZ obtained a copy of the complaint, which will be filed in federal court this morning. In the complaint, Joe alleges Dr. Murray withheld vital information from the doctors and EMTs who were trying to save Jackson's life -- information that he had administered Propofol.

The complaint -- much like the intent to sue document TMZ first broke -- states that Murray tried to "clean-up the scene" before EMTs arrived.

Something new ... Murray told cops he was monitoring Michael when he gave him Propofol with a pulse oximeter, which measures the level of oxygen in a patient's blood. But according to the suit, when police searched the scene, they found the oximeter "in the closet in the next room."

The complaint alleges Dr. Murray felt he could change his story -- from Jackson had no drug problem, to Jackson was addicted to Propofol -- because he kept no medical records, as required by California law.

The complaint alleges Joe Jackson has suffered more than $75,000 in damages, the minimum amount required to get jurisdiction in federal court. The case was filed in federal -- not California court -- because Dr. Murray's residence is outside the state.

The suit claims Dr. Murray administered a "polypharmacy" of drugs to Jackson for months before his death.

Interestingly, Oxman does not allege in the lawsuit -- like he did in the notice to sue -- that Dr. Murray was at a strip club, drinking, hours before Jackson died.

The complaint says Jackson had a week pulse while he was being worked on at UCLA. The strong intimation -- had Dr. Murray told UCLA doctors that Propofol was a factor, they could have taken steps to save Jackson's life.

And something else that's interesting. It was widely reported that Joe Jackson introduced Michael to Dr. Murray in Las Vegas, after Jackson needed a doctor for his children in 2006. But in the lawsuit, it says, "Defendants Murray, Acres Home (Murray's clinic in Houston) and Global (Murray's clinic in Nevada) solicited Michael Jackson to take care of his individual health needs."

And this sidenote -- When Jackson was taken to the UCLA Medical Center on June 25, he was admitted under the alias, Soule Shaun.

Dr. Conrad Murray Saves A Life on MJ Anniversary

Published | Updated

How's this for irony? TMZ has learned Dr. Conrad Murray may have saved another life ... almost one year to the day after Michael Jackson died.

Sources tell us, yesterday Dr. Murray received a call from a Las Vegas patient who was complaining of chest pains. Dr. Murray told the man it sounded like he was having a heart attack and he needed to call 911. The patient resisted, but Dr. Murray persisted and the man eventually made the call.

The patient was taken to the emergency room at Desert Springs Hospital in Las Vegas, where doctors confirmed it was indeed a heart attack. The docs placed a stent in the man's heart.

Today, Dr. Murray visited his patient at the hospital. He reviewed the angiogram film. The patient is doing well.

Before going there the doc had a private moment at St. Joseph Husband of Mary Catholic Church in Vegas. Murray also went to Barnes and Noble bookstore this AM. And he got a frappuccino at Starbucks.

Remember, a few months back it was Dr. Murray to the rescue on an airplane after a passenger fell ill.
