Mike Tyson - Free at Last, Officially
Mike Tyson will not be prosecuted for allegedly punching a photog at LAX, TMZ has learned.
The L.A. City Attorney officially rejected the case today, citing "insufficient evidence."
Tyson's lawyer, the ever-effervescent Shawn Chapman Holley, tells TMZ, "The City Attorney's office made the right decision given the harassing conduct of the paparazzo."
Tyson was arrested last month for battery after a bloody confrontation with a paparazzo outside the United terminal at LAX. Tyson claimed the photog was harassing him, his wife and child.
The photog was taken to the hospital and stitched up.
The City Attorney also declined to file charges against the photog.

According to sources at NewYearsEve.com, Fergie Ferg and the rest of the Peas will be kissing some serious green come midnight -- taking in more than $700,000 to show up and perform at LAX at the Luxor. As for the rest...
50 Cent -- $100,000 for a party at Pure at Caesars Palace.
LMFAO -- $75,000 to perform at a place called Silk in Temecula
Pete Wentz -- $30,000 to hang at Jet Nightclub in Vegas

'Austin Powers' Actress Fears for Her Life
Fabiana Udenio -- the actress who played Alotta Fagina in "Austin Powers" -- claims her husband could be armed and dangerous.
In legal papers filed in L.A. County Superior Court, Udenio claims, "I am frightened because there is a gun missing from one of his houses."
Udenio just won an extension of an existing restraining order, after alleging in court papers 65-year-old Robert MacLeod pushed her "extremely hard" after an argument on Dec. 5 in front of their 3-year-old son. MacLeod was arrested.
The restraining order has been extended until February 9th -- when the couple is due back in court.
Diddy to Landlord -- You're Costing Me Millions!
The storefront of the Sean John store in New York City is quite impressive ... or at least it was, according to a new lawsuit -- and now the company that runs Diddy's clothing line is suing the people who allegedly messed it up.
According to a lawsuit filed in New York, Diddy's company -- Christian Casey LLC -- leased a portion of a ground floor building on Fifth Avenue in NYC for its flagship clothing store.
Diddy lawyers claim sometime in 2006 the building owners put up sidewalk scaffolding and just left it there -- sending Sean John sales down the toilet -- down nearly 50%.
They claim the scaffolding "substantially obstructed the view of the clothing and furnishings displayed in the ground floor windows."
Team Diddy is suing for $2.5 mil in damages ... minimum. FYI, that's roughly 12,500 bottles of Cristal -- minimum.
Power Hour on Dale Earnhardt Jr.!
Dale Earnhardt Jr. was in one hell of a giving mood last night -- dude bought drinks for more than 800 people who walked into his North Carolina bar.
It all went down at the Whisky River bar in Charlotte -- which is owned by the NASCAR stud. We're told Dale decided to pick up the tab for every drink ordered in his place between 8-9pm.
Bartender Shawn Southern -- who was also on VH1's "Tool Academy" -- says the bill was "a ridiculous amount of money" ... but Dale made sure to treat the staff to a "very generous" tip.

Michael Jackson's Doc -- Ex-Employee Dies
TMZ has learned Dr. Arnold Klein, who treated Michael Jackson for decades, had an office employee who just died ... an employee who had a history of drug abuse, even while working for Dr. Klein.
Bruce Ayers, who worked for three years as Dr. Klein's research assistant and confidant, was found dead on a sidewalk on December 18 in Los Angeles.
Dr. Klein tells TMZ he fired the 44-year-old Ayers in February, after learning Ayers was allegedly stealing drugs and money from Klein's office.
We're told Dr. Klein stored certain drugs at a pharmacy he used to fill prescriptions for patients. When the drugs would expire, there was a protocol for destroying them. But Klein says Ayers would go to the pharmacy and get expired Demerol for his own use -- and the pharmacy gave it to him. Klein says the pharmacy violated protocol.
We're told Dr. Klein knew Ayers was a drug addict when he hired him but at the time Ayers was on the wagon. Klein says it became painfully obvious at the beginning of 2009 that Ayers' drug problem had resurfaced. Several members of Klein's staff told the Dr. they would quit unless he fired Ayers.
And, we're told, after Ayers was fired, Klein's staff realized 100 Percocet pills were missing.
We've learned Ayers, who met Michael Jackson many times while working for Klein, had a history of abusing pain meds.
When Ayers' body was discovered, authorities found hospital records showing that he had been admitted to three different hospitals since August, in each case for pain issues -- and in each case he was discharged with various meds.
The L.A. County Coroner has deferred Ayers' cause of death, pending toxicology tests.

Blackstreet Singer: I Would Never Beat My Kids
Teddy Riley, a singer from the group "Blackstreet," claims he never carried out any sort of attack against his daughters -- but admits the only thing he's guilty of ... is over-spoiling his kids.
As TMZ first reported, one of Riley's adult daughters obtained a restraining order against him, claiming the singer beat her and her sister and threatened to hurt them with a guitar from the video game Rock Band earlier this month.
But in a statement to TMZ, Teddy flat-out denies the allegations -- and insists the entire situation arose because his parenting techniques allowed his kids to have "an inflated sense of entitlement and expectation."
Here's the statement in its entirety:
Due to recent events, I am compelled to respond in detail to accusations made against me, by my daughters.
I love my Daughters, but I will not allow my children to disrespect me in my home. Contrary to what I have been accused of, I would never beat my children.
Perhaps, I should have been a stronger disciplinarian as they were growing up. I worked very hard so that my children would want for nothing.
Charlie Sheen's Wife Wants to Reconcile
Brooke Mueller has lawyered up in case prosecutors decide to charge her with making a false police report, TMZ has learned. And Brooke and Charlie Sheen both want the court to modify the protective order so they can have contact with each other and try and save their marriage.
We've learned Brooke has hired famed criminal defense lawyer Yale Galanter, who represented OJ Simpson for years. Galanter tells TMZ Brooke did not recant the story she told cops on Christmas Day -- that Charlie allegedly held a knife to her throat and threatened to have her killed. But, Galanter says, Brooke did "minimize her story, like many wives in a similar situation do, when they realize their husband could go to jail."
Galanter tells TMZ he will file papers with the Aspen court this morning, asking the judge to allow Brooke and Charlie to resume contact with each other "so they can work on resolving the conflicts in their marriage." Galanter says Brooke and Charlie love each other very much, calling what happened on Xmas, "one bad night."
Galanter, who is currently in Aspen, says he was specifically hired to make sure prosecutors don't "overreact" and charge Brooke with lying to cops. He says, like many women who find themselves in similar circumstances, Brooke didn't realize that Charlie would be arrested after she called 911. So, Galanter says, Brooke soft-pedaled her story to a female cop hours after the 911 call but insists she did not recant.

UNICO: Snooki's an Embarrassment to Humans
Snooki is an "embarrassment to the human race" -- at least according to one pissed off group of Italian-Americans.
It's the latest insult in a furious back-and-forth between the "Jersey Shore" star and UNICO -- the Italian American organization pressuring sponsors to bail from the MTV show.
Snooki had lashed out at the group during an interview with Steppin' Out magazine, saying "I just have one thing to say to Domino's, Dell, UNICO and all the other haters out there ... F**K YOU! If you don't want to watch, don't watch. Just shut the hell up! I'm serious. F**K YOU!"
Re-enter UNICO, who proclaimed, "She is not an embarrassment to Italian Americans -- she is actually an embarrassment to the entire human race!!!!"

Beverly Johnson's Ex Claims He Was a Kept Man
You would think a supermodel like Beverly Johnson wouldn't have to hire a boyfriend -- but that's exactly what he claims in a new lawsuit.
According to a lawsuit filed yesterday in California, Mark Burk claims he had an oral agreement with Johnson in which they would essentially act like husband and wife -- and in return Burk would get half of whatever Johnson earned while they were together.
In addition, according to Burk, Johnson agreed to support him "for the rest of his life in the same style and manner that was established" during their relationship. Translation -- Mark wants palimony.
Burk claims they broke up in December 2008 and Johnson hasn't lived up to the deal. He's asking for $5 million in damages.
Shoe Co. to Paris Hilton -- Put a Sock in It
Paris Hilton wants people to take a walk in her shoes for once ... but it could cost her in court -- a New York shoe company says the heiress' new line of footwear is a complete rip off.
According to docs filed last week in Seattle, a company called Gwyneth Shoes is suing Paris over part of her new shoe design -- a heart-shaped pad on the insole -- claiming the idea was theirs first.
Gwyneth Shoes claims they filed to patent the heart cushion idea back in 2007 -- months before Paris' shoes launched in February 2008.
Gwyneth Shoes is suing for trademark and patent infringement ... and get this: they want Paris to hand over every last one of the allegedly infringing shoes -- which probably number in the thousands.
