The Duggar Family's 19th child is confined to an incubator -- but she's still ready for prime time.

TMZ has obtained a first look at 15-weeks-premature Josie getting wheeled into Michelle Duggar's hospital room for the first time after the delivery ... as it went down in front of the "18 Kids and Counting" TV cameras.

She looks tiny, but the Duggars tell TMZ "Josie is 7-weeks old today and absolutely beautiful ...she is growing and getting stronger each day ... she has a long road ahead, we are encouraged about her progress to date."

Her progress will be chronicled on the show's new season -- which starts with a special Sunday night.

'Jersey Shore' Cast Starting to Fold

Two of the cast members of "Jersey Shore" have agreed to MTV's offer of $10,000 an episode, but the others are still holding out ... sources connected to the negotiations tell TMZ.

Ronnie and J-WOWW have accepted MTV's offer. A well-placed MTV source tells TMZ the network is drawing a hard line at the close of business tomorrow -- the rest of the cast members must either accept the offer or MTV replaces them.

Earlier in the week we told you MTV's original deadline was Monday night -- but the network continued negotiations and now they say it's do or die.

Spencer Pratt Busted for Mud Flaps

Spencer Pratt is a dirty mud-slinger -- and according to the police, dude needs to fix the problem stat.

Heidi Montag's other half was pulled over by the LAPD last night because his monster truck lacked mud flaps -- which are required on massive rides so mud and debris doesn't get shot back at other vehicles.

During the stop -- in which Spencer invited the cops to go clubbing with him -- the officers nailed Spencer for not having proof of insurance.

Spencer was eventually sent on his way with merely a fix-it ticket, which requires him to get his vehicle up to code by March 15.

Britney & K-Fed -- $50,000 Up for Grabs

Britney Spears and Kevin Federline still have one huge asset to settle -- according to the Louisiana State Dept. of Revenue, the government owes the ex-couple over $50,000 from when they were still married.

The money is from an unclaimed interest fund earned from either a joint property the ex-couple sold back in Louisiana, or some shared income tax filed several years ago. The government's just waiting for Brit and K-Fed to step forward and say it's theirs.

But here's the point -- because the refund is jointly owned, K-Fed and Brit Brit will have to figure out how to divide up their surprise loot.

Pauly D's DJ Fee -- Spinning Out of Control

Pauly D isn't just trying to land $10,000 an episode for Season Two of "Jersey Shore" -- it's also become his going rate for a night's work on the turntables.

TMZ has learned the Cadillac tattooed "guido" is trying to solidify DJing residencies across the country. His plan: To provide the fist pump soundtrack once every six weeks at three different clubs -- for anywhere between $10,000-$25,000 a gig.

FYI -- Before becoming The Situation's summertime wingman, Pauly D was pulling in $1,000 a night, 4-5 nights a week in Providence, RI.

Tila Tequila Drops the Ball in Lawsuit w/ NFL Star

Tila Tequila just lost the first round in a ferocious legal battle with her ex-boyfriend Shawne Merriman -- and all because she's refusing to play defense.

It's all over a $2 million lawsuit filed by Merriman back in December, in which the San Diego Chargers star claims Tila made a series of horrific -- and untrue -- statements about him in an attempt to ruin his career.

Tila never officially responded to Merriman's suit -- so the court has entered a default judgment against her.

But the decision doesn't mean Tila has to fork over the money just yet -- she will probably move to set aside the default and duke it out in court.

'Kyle XY' Star in Clone Suit

As if the cancellation of "Kyle XY" wasn't enough ... Matt Dallas' manager is now suing the actor over the scratch he made while playing a belly buttonless clone.

Enzo Lamblet
filed the lawsuit in L.A. County Superior Court, claiming he was supposed to get a 10% cut of Dallas' "XY" paycheck for providing the actor with management services.

Lamblet claims Dallas made $582,986.75 for the lead role, but only paid him $24,255.

Lamblet is suing for $34,043.68.

Lawyer: Brooke Mueller At Rehab, Not In Rehab

Charlie Sheen's wife, Brooke Mueller, is at a rehab facility but isn't in rehab, according to her lawyer.

TMZ has confirmed Mueller and her mom are at Two Dreams Outer Banks in North Carolina. Mueller's lawyer, Yale Galanter, tells TMZ categorically Brooke is not being treated for addiction -- she is convalescing from her bout with pneumonia.

The mission statement of Two Dreams reads, "Two Dreams is a comprehensive wellness program providing exemplary care for individuals who dream of recovery from addictive disorders or co-dependent behaviors."

Galanter says he has personally spoken with staff who say the facility is also used for people who are not in rehab. The facility also told us they do non-substance abuse recovery.

Galanter says Brooke and her mom plan to stay a week or less and that, he says, is not consistent with rehab.

Brooke Mueller Not In Rehab - Lawyer Says

Charlie Sheen's wife Brooke Mueller is not in rehab, contrary to an Internet report -- according to her attorney.

TMZ just spoke with Brooke's lawyer, Yale Galanter, who told us Brooke is convalescing from her pneumonia and the infection she's been battling.

Brooke is not there for drug rehab, Galanter says. She is at a place that cares for patients convalescing from serious illnesses. Galanter is clear ... this is not a rehab facility.

Galanter says Charlie Sheen and the nannies are taking care of the couple's two kids at the family house.

Galanter confirms what we first reported -- that Brooke should be in North Carolina about a week.

So it's possible she'll be in Aspen for the hearing on February 8 to relax the protective order.

Date Set in John Travolta Extortion Retrial

A date has now been set in the retrial of the people accused of conspiring to extort John Travolta over the death of his son, Jett ... TMZ has learned.

The judge in the Bahamas set the retrial for September 6. The trial is expected to last 4 weeks.

Pleasant Bridgewater and Tarino Lightbourne are both accused of demanding millions of dollars from John Travolta, in return for keeping a document related to Jett's death secret. Ironically, the document -- a medical waiver -- is of no real import.

The case had been tried last year but the judge declared a mistrial during jury deliberations because of jury misconduct.

Gilbert Arenas -- The Mug Shot

Gilbert Arenas was formally booked on a felony gun charge yesterday over the infamous locker room showdown -- and TMZ has obtained the NBA star's mug shot.

Arenas pled guilty January 15 to one count of carrying a pistol without a license -- a felony.

Arenas will be sentenced March 26.

'Heroes' Star Busted for DUI

Adrian Pasdar -- the guy who plays the flying Senator Nathan Petrelli on "Heroes" -- was busted for DUI early this morning after cops say he was burning rubber and swerving all over a Los Angeles freeway.

TMZ has learned 44-year-old Pasdar was arrested at 2:59 AM after cops clocked him going more than 90 mph on the 405 Freeway in L.A. We're told cops also noticed Pasdar was "failing to maintain his lane."

According to

, when cops approached Pasdar's ride, they detected the odor of alcohol -- and decided to give him a field sobriety test. Pasdar was eventually placed under arrest for suspicion of DUI.

Pasdar -- who is married to Dixie Chicks singer Natalie Maines -- was taken to a nearby jail, where he was booked and placed behind bars. He's listed at 5'10" and 175 lbs.

His bail was set at $15,000 -- we're told the bail amount was so high because the actor refused to take a breathalyzer.

Cops: Kiefer Was Steered Into Ponzi Scheme

Kiefer Sutherland's cow deal gone bad is more diabolical than first thought -- authorities in California believe the "24" star was the target of a sinister con man who trapped Kiefer in an elaborate Ponzi scheme.

Before Kiefer was allegedly ripped off to the tune of $869,000 -- Sutherland actually profited more than $100,000 in a previous deal with the suspect -- a deal that, cops say, was made to bait Kiefer into dropping the mother lode.

According to court documents, obtained by TMZ, Kiefer fronted the suspect -- Michael Wayne Carr -- $550,000 for a cattle deal in 2006 in which Carr claimed he would buy cattle in Mexico and sell them in the U.S. for a profit.

Kiefer told investigators that within 30 days of the initial investment, Carr wired him $685,000 -- a $130,000 profit, according to the documents.

Just a few months later, Kiefer claims Carr approached his financial advisers with a similar deal -- one that required an $869,000 investment.

Kiefer -- who claims he has never met or even spoken with Carr -- told authorities his financial team vetted and approved the deal ... so he was happy to fork over the cash. Kiefer says he never saw a single cent.

According to the court docs, Carr later admitted that he "doctored" the paperwork to dupe Kiefer's financial team into signing off on the deal. Investigators claim Carr also said that he used the money to pay off a huge bank debt.

Carr -- who also allegedly ran the scam on several other investors -- is charged with 12 felonies, including grand theft and embezzlement.

Christina Milian Sued over Vicious Dog Attack

Christina Milian's 81-year-old neighbor claims he was mauled by one of her dogs back in 2008 -- and now the man wants Christina to pay for the canine's alleged brutality.

Leo Skolion filed a lawsuit against Christina and family earlier this month in L.A. County Superior Court, claiming the family's negligence lead to the attack that left him with "severe personal injuries."

Leo tells TMZ it all started in October of '08, when Christina's home had "flooding problems" which caused a gate between their properties to become damaged.

Leo says he went over to speak to the family about repairing the gate when one of their dogs escaped ... then attacked him from behind and bit "a huge chunk" out of the back of his arm.

The 81-year-old claims it took 19 stitches and 9 months of rehabilitation to get back to normal -- and that he still has to receive psychiatric help for fear and depression.

Leo is suing Christina -- real name Christine Flores -- her mother Carmen and her sister Danielle for an undetermined amount.

Calls to Christina's camp have not been returned.

Nancy Grace Must Appear on Camera for Depo

Nancy Grace will appear on video, and she's none too happy about it.

Grace has been ordered to sit for a deposition on Thursday with a camera rolling .. according to a judge's order obtained by TMZ.

Grace and CNN are being sued by the parents of a woman who committed suicide after appearing on Grace's TV show. The parents claim Grace accused the woman of being responsible for the disappearance of her son.

The parents sued Grace and CNN for wrongful death, but Grace did not want her deposition taped because she feared clips would appear on TV and online, taking her out of context and splicing bits and pieces together to make her look bad -- sound familiar?

The judge ruled that Grace's depo can be videotaped, but the tape cannot be released to the media or anyone else without the court's permission.

The judge said since the parents' lawyer agreed not to release the video to third parties without court approval, there was no need to address "the evils" Grace complained of -- that "disclosure of the videotape of Ms. Grace's deposition" was designed to "harass, embarrass and intimidate Ms. Grace and corrupt the jury pool."

The deposition will be taken in Atlanta on Thursday. Makeup!
