Daniel says in his declaration, Joanne once came into the bedroom and said she had just watched a documentary on women who kill their husbands, saying, "Now I know how to do it, I understand why they did it. You have been warned." Daniel says their daughter heard the comment and asked him, "Is Mommy going to kill us?"

According to the declaration, Daniel says Joanne is "highly intoxicated in our home," adding, "She screams over money and proceeds to wake both children up by screaming and throwing objects around the house."

Daniel says, "Due to recent events in our home and for the safety of my children and myself, I have made this decision."

Daniel adds, "I have had my share of problems with drugs and alcohol many years ago and know first hand how difficult a position she is in."

The couple married in 2007. They have 2 kids. The judge who issued the restraining order gave Daniel temporary custody.

As TMZ first reported ... Brooke was photographed last week holding what appeared to be a crack pipe. And there are other problematic images as well -- like the one recently in Hawaii, when Brooke walked up to a parked car in a seedy area with cash in hand.

The two rehab veterans each have selfish reasons to avoid drug testing, but Brooke is especially worrisome because she is the primary caregiver of the twins. Although Brooke's parents step in when she goes to rehab -- and she goes a lot -- Brooke ultimately calls the shots.

So the question -- who is looking out for the kids. The judge hasn't called a hearing to determine if the parents are unfit, and the L.A. County Department of Children and Family Services has not visited either Charlie or Brooke for more than 6 months.

We're told there will be no issue ... All of the assets in the marriage are community property, which means Arnold and Maria have a 50/50 interest. But we're told Arnold, Maria and their reps are "in the very beginning stages" of deciding who gets what.

As we first reported, there is no prenup. We're told when Arnold and Maria married, they had "very little in the way of assets compared to what they have now." The combined wealth of the former couple is estimated at around $400 million.

And, as we reported, Maria is in escrow to buy a home valued at around $10 million. The house is also in Brentwood, approximately 3 miles from the family home. Maria wanted to be close so the kids could easily go back and forth.

As for the exact percentage of the spoils Arnold and Maria will ultimately walk away with -- it hasn't even been discussed. "It's very early in the process" says one source with direct knowledge.

TMZ has obtained the divorce papers, in which Justin Williams states that Kari Ann is pregnant -- and wants a judge to order genetic testing to determine if "this is a child of the marriage." The docs were filed in L.A. County Superior Court by Williams' lawyer Marlo Van Oorschot.

Kari Ann has been treated for sex addiction in the past -- even appearing on "Sex Rehab with Dr. Drew" back in 2009.

The couple has only been married for a few months -- they tied the knot back in February.

Sources connected with the deal tell us ... the home is in Brentwood -- not too far from where O.J. Simpson lived at the time he killed Nicole Brown Simpson and Ron Goldman.

Maria had been actively looking at homes for 6 months on the west side of L.A., but has now settled on a home near the one she shared with Arnold.

We're told the couple is determined to keep their divorce amicable, with both Arnold and Maria getting joint custody of their two minor children. The proximity of the two homes will make shared custody easier.

From what we can tell, the deal is still in escrow, but we're told it's solid and will close soon.

Cage -- who has only been married since April -- went to his Facebook page to break the news ... saying, "Made my choice. getting divorced."

As for the whole pregnancy thing, Weston believes the news only SUPPORTS his claim that he never laid a hand on Nikki before the two were both arrested for domestic violence this weekend.

Cage wrote, "Never hit my wife. why would i start abusing after she was positive after taking a pregnant-c test."

Weston added a bizarre, cryptic message -- "Have fun killing my child Breyan Prescott."

Arnold Schwarzenegger and Maria Shriver will split around $400 million, and legally it's supposed to be divided up 50/50, because we know there's no prenup.

TMZ broke the story Friday that Maria filed for divorce and the division of property is yet to be determined. Because there is no prenup, under California law, all earnings and other property acquired during the marriage is considered community property, which means a 50/50 split.

Arnold's worth is estimated at $300 million, while Maria's is around $100 million. Since the couple has been married for a quarter century and it's probably impossible to separate what they each had before they tied the knot, it's likely the entire pot of money will be considered community property.

But here's the twist. This divorce will never go to trial. It is going to settle out of court, and nothing requires Arnold and Maria to agree on a 50/50 split. Typically in these cases, there's a lot of horse trading ... Maria gets this house, Arnold gets that one, etc.

Maria's lawyer, disso-queen Laura Wasser, and Arnold's attorney, Bob Kaufman, will be hashing out the property settlement agreement -- probably for months.

One final point. We will never know the terms of the final property settlement agreement, because it's going to be confidential. Standard operating procedure for high-profile divorces.

Kevin's grandfather, Earl Story, has put a slew of items up for auction on eBay from back when Brit and K-Fed were a happy couple. The highlights include: the wedding invitation, an invite to Brit's baby shower, a hat K-Fed once wore to an awards show (signed by Brit and K-Fed) and 14 wedding pics, some of which didn't make the tabloids.

K-Fed's aunt tells TMZ she is helping put the items up for sale because Earl's wife recently passed and the family encouraged him to sell off a few things and use the money to take a trip and help take his mind off things.

In the divorce petition, obtained by TMZ, Shriver cites "irreconcilable differences" as her reason for ending the 25-year marriage.

Shriver is asking for spousal support and wants the judge to deny Arnold the right to ask for support for himself-- though it's highly unlikely he would.

Shriver is asking for joint custody of their minor children, who she names in the document as 17-year-old "Patrick Arnold Shriver Schwarzenegger" and 13-year-old "Christopher Sargent Shriver Schwarzenegger."

And, in the petition, filed by disso-queen Laura Wasser, Shriver is asking Arnold to pay the attorneys' fees of both parties.

As for the date Arnold and Maria separated ... it isn't specified in the divorce papers.

According to the docs, the property accumulated during the marriage will be divided at a later date. And, sources tell TMZ, there is no prenup, so all of Arnold and Maria's earnings over the past quarter century will be divided 50/50.

Sources close to the couple tell TMZ ... Arnold and Maria are on speaking terms and Arnold knew beforehand that she was filing divorce papers. Maria is telling friends she hopes this will be an easy and amicable divorce.

Final divorce papers were just filed in L.A. County Superior Court.

Sources tell TMZ ... the divorce was amicable. Neither Scarlett nor Ryan asked for spousal support and there was no prenup, so they divided the property and earnings accumulated during the marriage 50/50.

The papers were filed by Ryan's lawyer, Laura Wasser, this afternoon.

Serrano had filed for divorce back in November -- citing "irreconcilable differences" ... and according to court documents filed this afternoon, the marriage is officially over and out.

Patricia's lawyer, Samantha Klein of Wasser, Cooperman & Carter, filed for divorce in January, 2009, but Patricia had a change of heart a few months later and called it off.

But in August, 2010, the couple separated and the divorce was back on.

The couple married in 2006. They have an 8-year-old daughter.

Deighton -- who's been married to the "Survivor" villain since 2008 -- tells TMZ ... "I work 40 hours a week at a daycare to support us, yet he would still want me to come home and cook and clean for him."

"I left because I was tired of feeling like I had two children instead of a husband and a daughter."

She adds, "I just want out of this unhealthy relationship. I have tried to work this out but he refuses to speak to me."

Fairplay -- real name Jon Dalton -- says Michelle Deighton called it quits a couple of weeks ago ... but she didn't give him a REAL reason for the split ... only that she just doesn't want to be with him anymore.

Jonny tells us, he already filed for legal separation in North Carolina -- and plans to fight for full custody of their daughter.
