We've seen the photo -- which reportedly was taken two years ago -- and there is no mistaking it's Jesse. The hat Jesse is wearing is nearly identical to the one Michelle has on in the infamous photos, except for the rope across the front (see above).

In the photo, Jesse is holding up his right hand in a "Heil Hitler" pose ... and with his left hand he is sort of covering his mouth with two fingers (almost like mimicking Hitler's mustache).

The woman selling the photo told TMZ she didn't actually take the pic -- it belonged to a friend who worked with Jesse and the friend does not know she is selling it.

TMZ has obtained legal docs in Jesse's divorce from Janine Lindemulder. James filed several declarations, accusing Janine of various acts of brutality -- including punching him, bludgeoning him in the back of the head with a flowerpot, swinging a steel bone sculpture at him, trying to run him over with her car, socking him in the eyeball because he used her parking space, and going Naomi Campbell on him with a cellphone.

James says on one occasion, when Janine was pregnant, she began hitting and chasing him in their bedroom, and he grabbed her by the hair to hold her at bay.

Bullock will probably choose to bludgeon Jesse with a Beverly Hills lawyer.

Turns out McGee made the honor roll all four years of at Eastlake North High School in Ohio. According to her yearbook, she ran track, played soccer and was even a cheerleader.

TMZ has learned Brittany Murphy used her own name -- besides the alias Lola Manilow Murphy -- to secure an array of prescription drugs.

Sources tell us between 2003-2009, Brittany had scores of prescriptions filled for 32 different drugs ... and that was at just one L.A. pharmacy -- and it's not Eddie's Pharmacy, the one that cut her off 4 months before her death because the owner feared an accident loomed.

The drugs included Inderal and Propranolol (high blood pressure), Sarafem (a type of Prozac), chlordiazepoxide (sedative), promethazine (sedative), and four different drugs for asthma.

Also on the list --- a number of antibiotic and allergy medications.

Brittany had a prescription filled five times for Biaxin -- a drug used to treat, among other things, pneumonia. The Coroner ruled Murphy died an accidental death caused by "community acquired pneumonia."

A TMZ spy on the production crew for "Jersey Shore" tells us the cast was given its marching orders for season two last night -- they're headed for Miami.

And we have another source. At least one cast member told a TMZer he/she got the word over the weekend ... and the word is Miami.

Good luck, Miami. You're gonna need it.

The District Attorney in Brooklyn -- where Mike's pigeon show "Taking on Tyson" will be filmed -- tells TMZ they received a letter claiming the production violates New York's gambling laws ... because it profits off animal racing.

We're told they're currently looking into the claims.

Animal Planet tells us there won't be any wagering on the show ... but a rep for PETA -- who wrote the letter -- claims making any money off animal racing (including Tyson's salary) is illegal, so the point is moot.

TMZ has learned Brittany Murphy received no fewer than 200 pills every month from January 2008 through August 2009 ... and sometimes as many as 400.

As we first reported, Murphy used an alias -- Lola Manilow Murphy -- at Eddie's Pharmacy in Los Angeles for nearly two years before the pharmacy finally cut her off 4 months before her death.

Pharmacy records show Murphy was getting regular scrips for hydrocodone (Vicodin), clonazepam and Klonopin (anti-anxiety), and Vicoprofen (a Vicodin/ibuprofen combo) -- doubling up on some prescriptions on certain months.

For example, one month Murphy was prescribed 200 hydrocodone and 100 clonazepam; another month it was 300 Vicoprofen and 100 Klonopin.

All the prescriptions were prescribed by Dr. Richard Kroop. We're told investigators paid a visit to Kroop on Friday afternoon.

As we first reported, the owner of Eddie's Pharmacy told TMZ he cut Brittany and her family off 4 months before her death because, "We thought there was going to be an accident there."

We're told it was all over an argument between one of their neighbors (above left) and a member of the media. The neighbor was the one who called police. Deputies talked to the neighbor and no arrests were made.

The spokesperson for the Orange County Sherriff's Department says no citations were given and the gaggle of media in the area -- about 20 photogs -- are all legally parked in a public parking lot.

Uchitel's lawyers -- including glorious Gloria Allred -- just fired off a letter to Las Vegas showman Jeff Beacher, ordering him to remove comments on his Facebook page which refer to her as a "slut," "whore" and "hooker."

In the letter, Rachel's lawyers say the comments are false and defamatory ... and threaten legal action if the mean words aren't immediately taken down.

What ever happened to "I am rubber, you are glue"?

Jason Wahler was arrested last night -- in the United States for a change -- for allegedly driving under the influence.

Newport Beach PD tells us Wahler was popped last night around 10:54 PM. He was driving a 2008 Chevy Tahoe and described himself to police as "an actor."

He was released this morning under his own recognizance.

As you may recall, Wahler was arrested in Cabo San Lucas, Mexico earlier this month after a bar fight.

Sources say MTV camera crews will start paying visits to the homes of Snooki, The Situation, DJ Pauly D, Ronnie, Vinny, Jwoww, and Sammie this coming weekend to tape them as they attempt to cram their giant egos into carry-on luggage.

We're told the cast is supposed to fly out to Season 2's mystery location some time next week.

No word yet on whether Angelina made the cut ... if anyone actually cares.

TMZ has obtained the shocking photos of Michelle McGee, which were taken almost a year ago. We're told the Nazi-themed layout -- complete with a swastika armband and backdrop -- was the photographer's idea, but that Michelle was very enthusiastic.

In child custody documents filed in January, Michelle's ex-husband says she "makes the Nazi salute," and has a swastika tattooed on her stomach (not seen in these pics).

In one photo the letter "w" is on Michelle's left leg, and the letter "p" on her right. We're told Michelle tells people it stands for "white power."

A Los Angeles pharmacy owner tells TMZ he cut off Brittany Murphy, Simon Monjack and Sharon Murphy just months before Brittany's death because he "thought there was going to be an accident."

Official records show Eddie Bubar, owner of Eddie's Pharmacy, has a list of more than 100 prescriptions he filled for Brittany, Simon and Sharon between January 2008 and August 2009, including Vicodin, hydrocodone, Klonopin, and other drugs under various aliases.

One of the aliases was Lola Manilow Murphy. Bubar tells TMZ the alias was Brittany's. Bubar told investigators a courier would pick the various prescriptions up in an envelope approximately every two weeks with the name "Lola" written on it. TMZ has already reported, such an envelope was regularly delivered to the house.

Bubar tells TMZ he cut off Murphy, Simon and Sharon four months before Brittany died, partly because he believed they were using multiple pharmacies to fill scripts.

Bubar tells TMZ, "We thought there was going to be an accident there."

And we've learned there were other aliases used for prescriptions from another pharmacy, including the names Kathelyn Moore, Trevor Williams and Faith Gosselin.

Simon Monjack confirms with TMZ that he used aliases, along with Brittany and Sharon, because, "You know how this town is." Monjack says, "We're the ones who cut Eddie's Pharmacy off."

As for using the alias Lola Manilow Murphy, remember Barry Manilow's lyric, "Her name was Lola."

Peter Falk has rich people's problems -- he claims a construction company did a lousy job on his Malibu remodel and wants some serious money.

According to a lawsuit obtained by TMZ, Falk and his wife hired Handy Andy Services to spruce up their beach pad. Falk claims, among other things, Handy Andy didn't pack the soil properly, didn't apply the proper paint, didn't re-install fire sprinklers, and didn't waterproof the house.

Peter and his wife are suing for unspecified damages.

We're told several dozen doctors are being investigated for allegedly prescribing meds without medical justification. The A.G. is also looking at various aliases that were used in prescribing powerful meds.

Sources say between 25 and 30 doctors are being "actively investigated."

UPDATE: The State AG officially now says they are investigating MJ and Haim but not Murphy. However, TMZ has confirmed that State investigators are indeed involved in the Murphy matter.

As we first reported, Octo didn't make a balloon payment of $450,000 on March 10. She's also behind $4,139 on monthly payments.

The person who sold the house to Octo and holds the note, Amer Haddadin, tells TMZ he will give her until Tuesday to pay the two amounts, plus interest and attorney's fees, or his lawyer will file to foreclose on the house.

Amer says he owes the bank the same amount that Octo owes him, and he's about to go under.

As for why Octo isn't paying ... it's a mystery to Amer -- he says it's been radio silence.
