Brooke Mueller is on the attack ... gunning for Charlie Sheen, who called her a whore, drug addict and terrible parent on TMZ -- and if she gets her way Charlie could end up in jail.

We just received a subpoena from Brooke's lawyers, ordering us to preserve the video and audio interviews we did with Charlie last Friday. Where to begin. Charlie said Brooke has damaged their twins emotionally, to the point they're on the verge of getting kicked out of school. He says every time the kids visit with Brooke, they come home completely freaked out and suffer from night terrors.

Our sources say Brooke's lawyers will go to court with our video and audio and argue Charlie has violated the gag order and should be punished -- possibly with jail -- and have his visitation curtailed.

Charlie told us the L.A. County Dept. of Children and Family Services cares more about protecting and rehabilitating Brooke than protecting the twins. He also calls the judge in the case "The Dishonorable Judge Douchebag." Charlie also called him fat.

The subpoena orders us to hand over the video and audio interviews we did with Charlie. What ... they don't watch TMZ Live?

Josh Brolin says he's done drinking alcohol for good ... after Friday night's cabbie-raging bouncer-fighting debauchery.

We posted both videos over the weekend -- one showing Josh fighting with a cab driver after he rear-ended the guy, and the other showing Josh drunkenly fighting a bouncer for trying to move him outside a bar.

Now it appears Josh has learned his lesson, telling a photog today that this kind of nonsense will never happen again.

"Teen Mom" star Amber Portwood was just released from an Indiana prison ... almost a year-and-a-half after she begged a judge to put her behind bars ... and now she's ready to eat.

Amber was initially sentenced to 5 years in the big house for violating probation in her drug possession case.

The judge had given Amber the choice of going to a drug rehab program instead of prison -- but Amber decided she would rather serve time than do the program.

Now, we've learned the 24-year-old MTV star -- who began her sentence in June 2012 -- was released Monday morning (only 17 months into her sentence).

We're told Portwood was granted early release due to good behavior, time served and the fact that she completed two unspecified prison courses while serving her time.

She walked out of the prison today wearing a grey sweatsuit ... and a smile ... and says the first thing she wants to do as a free woman is "go get something good to eat."

A bouncer wasn't the only person Josh Brolin unleashed his wrath on this weekend -- TMZ has video of the actor going OFF on a taxi driver after rear-ending a cab ... and this time, there was no hugging it out.

The person who shot the video says this altercation went down at a Los Angeles Del Taco drive-thru, some time after midnight Friday morning -- and shortly before Josh fought a bouncer in Santa Monica.

We're told Josh rear-ended the cab while waiting in line to pay at the drive-thru, but when the cabbie tried to swap insurance info ... J.B. got pissed and yelled that there was only a minor scratch.

The cabbie didn't agree and that's when Josh really got angry ... screaming, "you suck as a cab driver" -- and accusing the guy of milking him for money.

We're told Brolin took off when the cab driver pulled forward to clear the drive-thru lane.

Brolin could be on the hook for hit-and-run, but as far as we can tell ... the cab driver has yet to file a police report.

If you're keeping score at home -- that's 2 incidents in one night that could have ended with Brolin in handcuffs.

Only Adam Lambert really knows for sure if that lit cigar he passed Miley Cyrus at his Halloween party contained the devil's weed ... and over the weekend, he dropped a pretty big clue.

Lambert was at LAX when a photog asked point-blank about the photo TMZ posted, showing the former "Idol" superstar handing Miley something that looks like (and probably was) a big, fat blunt.

You gotta see Lambert masterfully bob, weave and deflect when asked about it -- but then came the big moment ... when the photog said, "If it was a joint, say nothing."

The reaction pretty much says it all.

Josh Brolin has 2 things down -- fighting, and making-up ... and he did both in the most entertaining bar fight we've seen all year.

It's 2 AM Friday. The bouncers at O'Briens Irsh Pub in Santa Monica were closing up, but a VERY drunken Josh wasn't ready to call it a night. One of the bouncers maneuvered Barbara Streisand's stepson outside, but Josh wasn't having it ... and that's when the fun began.

Slosh was not exactly in top fighting form. You see his arms flail but few punches connect.

As you probably know, this isn't Josh's first bar fight. He famously got arrested in Shreveport, LA outside a bar while shooting a movie. He was also busted on Jan 1, 2013 for public intoxication.

The bouncer tricked Josh into believing that they had been hugging earlier, and that's when the fight turned into one, gigantic bear hug.

The bouncer attempts to hail a cab for the 47-year-old actor, but the video ends as Josh breaks loose and runs into the sunset.

We're told department officials told Richards they were pissed off that Charlie dared to tell TMZ Bob and Max were not being protected by the department. As you probably know, Charlie railed on DCFS Friday, telling us they care more about Brooke Mueller overcoming drug addiction than they do the safety of his kids.

Adam Lambert lit up the joint earlier this week ... and then handed it to Miley Cyrus.

TMZ obtained this photo -- taken at Bootsy Bellows nightclub in West Hollywood -- showing a costumed Adam and Miley passing what sure appears to be a blunt.

Miley -- who came as Lil' Kim -- is no stranger to puffin' trees, but Adam Lambert ... who knew?

Charlie Sheen says his ex-wife Brooke Mueller is a dangerous, EVIL whore who's putting their twin boys in SERIOUS DANGER ... and now, Charlie says he's on a mission to stop her before it's too late.

Sheen just called TMZ and told us ... his 4-and-a-half year old twin boys Bob and Max have already suffered physical and emotional damage from the time they've spent in Brooke's care. In fact, he says they're very close to getting kicked out of school.

Charlie says the boys are deathly afraid of Brooke's house -- which is covered in pet lizards, various insects and other critters -- and they suffer night terrors after spending time at the home.

Charlie also says Bob suffered a bad rash on his face after recently spending time with Brooke -- a rash that "looked like somebody burned him."

Charlie says he's complained to L.A. Child Services -- but they refuse to help. Instead, Charlie claims, Brooke is getting MORE custody ... and he doesn't understand why.

Sheen ripped Child Services on a Twitter rant last night -- calling them "doosh bags" who have done nothing to protect his children. He also called Brooke an "evil and pathetic über loser" and a "whore."

Sheen says Brooke is supposed to get her first unsupervised overnight visit with the twins tonight -- and Charlie says he's very afraid of what could happen.

Charlie says he's not sure if Brooke is back on drugs, but he is sure about one thing -- "She's as awful a parent and a person as you can possibly draw up."

Lamar Odom was drunk -- very drunk -- at Beacher's Madhouse in Hollywood Wednesday night ... eyewitnesses tell TMZ -- and it's a dramatic, depressing turn in his life.

People who were present tell us ... Lamar showed up with several guys. In short order Lamar was hanging at the bar doing shots of Patron. For the next 3 hours, Lamar could not be seen without a glass of champagne.

Our sources say he was "hammered." One witness -- who knows the difference -- says Lamar didn't seem like he was on drugs. It appeared to be alcohol-fueled.

Lamar stayed until closing at 2 AM. By 2:30 AM he was in the valet area talking about where to go for the "after party."

David Ortiz wasn't chugging cheap champagne during his crazy World Series celebration last night -- the stuff Big Papi was pounding runs $100,000 per bottle ... TMZ has learned.

You've seen the pics -- Ortiz hoisting a giant gold bottle of bubbly, while the rest of his Boston Red Sox teammates celebrated their victory over the St. Louis Cardinals.

Now, we've learned ... the booze was a 15 litre bottle of Armand de Brignac Nebuchadnezzar Champagne, also known as "Ace of Spades" ... and it runs between $100k and $150k in the club scene.

These bottles are SUPER rare -- a Russian billionaire once splurged on a bottle for Zac Efron and Heather Graham when he spotted the actors at a bar in Chicago.

Michael Jackson would be appalled at the way people are disparaging Conrad Murray .... so says the doctor who just got out of jail for killing the singer.

Dr. Murray -- who clearly uncapped a tube of Just for Men since his release from jail -- says unequivocally -- "I never harmed him [Michael]."

Well the Jonas Brothers finally explained absolutely ... NOTHING about why the band is dunzo during a bizarre GMA interview this morning.

Nick Jonas came closest to breaking down their issues when he acknowledged, "We've had some complications in the group for a long time, without addressing them."

Nick seemed to be talking about disagreements over music -- but it's hard to say for sure since he was so damn evasive!

As we've told you ... Joe Jonas was spotted around Hollywood with a well-known addiction specialist days after the guys pulled the plug on their concert tour. Joe and his bros never addressed that -- though to be fair ... GMA never asked.

Pauly D's got his work cut out for him with his new baby mama -- so claims the daddy of her 1st child ... who has some serious words of warning for the "Jersey Shore" star.

Meet 33-year-old Lance Gerbino, the father of Amanda Markert's 5-year-old son. His friend just posted this video on Instagram, where Lance calls Amanda a crazy "drug addict stripper" -- something she strenuously denies.

Lance is no angel himself -- as we reported, one reason Pauly wants full custody is because there's a felony drug arrest warrant out for him, and he thinks there's a danger if Lance comes in contact with the baby.

As for Amanda, her lawyer tells us, "Amanda is an extremely wholesome young lady who is goal oriented." He adds she's never been a stripper and has absolutely no drug issues.

BTW ... Lance's friend has taken the video off Instagram.

Lindsay Lohan wasn't reaching for a wine bottle in the photo that surfaced Wednesday morning ... it's an optical illusion ... that's Lindsay's story, anyway.

Sources close to Lindsay tell us, Lindsay was actually reaching for her purse and cell phone on the same counter top, and the photo angle (above) was set up to make it look like she was grabbing the wine bottle instead.

Lindsay is adamant she has NOT fallen off the wagon -- in fact, she's telling friends she's been faithfully attending multiple AA meetings per week, and has continued therapy since leaving rehab.

The photo was taken at a friend's house ... who clearly had wine while Lindsay was visiting. Sounds like a bad idea, but we're told Lindsay has overcome her desire to drink, and has no problem hanging with boozers.

In fact, as we reported, LiLo thinks she's doing so well ... she's ditched her sober coach, insisting she can handle sobriety on her own.

Lindsay Lohan has more legal woes -- TMZ has learned she's just been sued over the accident where her Porsche rammed into an semi-truck.

You'll recall, Lindsay was late for a Malibu shoot for the movie "Liz and Dick" when she roared up Pacific Coast Highway in a black Porsche 911S at speeds that exceeded 60 MPH.

As we first reported, Lindsay lied to cops and said she was a passenger in the car and tried to frame the person who was driving with her. We also reported cops discovered pills in her purse and a water bottle that reeked of booze. Witnesses also said there were pills scattered in the trunk.

The truck driver, James Johnson, claims he was injured and suffered great physical, mental and nervous pain.
