Katie Holmes Driver Escapes Ticket In Beverly Hills
Katie Holmes' driver was pulled over yesterday in Beverly Hills -- with Katie inside -- but the driver was able to escape with just a warning ... TMZ has learned.
Law enforcement sources tell TMZ the driver was spotted doing a major no-no ... driving while talking on his cell phone. But when cops pulled them over (the black Mercedes, pictured above), we're told the driver escaped without getting ticketed.
Maybe the cop was a big "Dawson's Creek" fan?

Kim signed a TV deal with "American Idol" honcho Nigel Lythgoe -- to be the E.P. for an upcoming reality show about the "Pussycat Dolls empire" ... that will feature the launch of a "new" PCD group.
One source tells us the newbies are "10 times better than the original group."
We're told Kim has a good relationship with PCD founder Robin Antin -- plus Kim really enjoyed performing with the group in Vegas a few years back.
Kim is telling friends she's "super excited" to work with Nigel because "he's the best in the business."

Wrestler Matt Hardy Another DUI Arrest 'He Almost Hit Two Drivers'
More trouble for ex-WWE champ Matt Hardy -- the 36-year-old was arrested for driving under the influence in North Carolina this week ... the second time in the last couple of weeks.
According to the arrest report obtained by TMZ ... cops received a complaint of a "possible drunk driver" late Monday afternoon ... who almost "hit two drivers three separate times."
When the cop spotted Hardy, the wrestler's car, "swerved into the curb and then back onto the road."
Once Hardy was pulled over, the officer claims Hardy "had slow and slurred speech, sleepy eyes and a very lackadaisical demeanor."
According to the report, Hardy took the walk-the-line test -- but "after taking two steps, Mr. Hardy lost his balance and failed to stay on the line."
Hardy took a breathalyzer -- but when the results showed he wasn't drunk ... cops called in a "Drug Recognition Officer" to perform even more tests.
Eventually, cops believed Hardy was under the influence of something ... and arrested him on the spot.
Hardy is scheduled to appear in court on November 30.

Casey Anthony's attorney Jose Baez must love a challenge -- because he's been retained to help defend the main suspect in a Maryland woman's disappearance in Aruba.
Gary Giordano remains in jail on the Caribbean island ... held as the principal suspect behind the mystery of Robyn Gardner. Giordano has claimed Gardner got swept out to sea when the two went snorkeling on August 2 -- she hasn't been seen since.
We're told Baez is currently in Aruba -- and has already met with Giordano.
Baez will NOT be the lead attorney in the case -- but will consult with Giordano's trial team regarding the forensic evidence in the case.

We found out it was Marc Anthony who reached out to Will Smith ... inviting him into his luxury box at the Miami Dolphins game last night.
Dwyane Wade ... was also invited to hang with the superstars. After the game Wade told people that it was genuine friendship between Marc and Will, and not just mugging for the cameras.
That said, it's clear they wanted to make a very public point ... there are no hard feelings between them in the wake of rumors Marc had an affair with Jada Pinkett Smith.

Rappers Paul Wall and Baby Bash were arrested last night in El Paso, TX for possession of marijuana ... TMZ has learned.
According to jail records, the rappers -- real names Paul Michael Slayton and Ronald Ray Bryant -- posted $300 bond shortly after.
Paul Wall tweeted after being released, posting the above photo and writing, "Fresh out the El Paso County jail wit @BabyBash @BIGGROY in the same tank they held Willie Nelson/Johnny Cash."
'Bachelor Pad' Reject My Co-Star PUNCHED Me In the Face!
The bad blood between cast members on "Bachelor Pad" has spilled into real life ... so says one of the losers who claims Graham Bunn punched him in the face at a nightclub this week.
TMZ spoke with Justin Rego (aka Rated-R) -- who was eliminated from the reality show last month ... who says he was hanging out at the wrap party at a Hollywood nightclub Wednesday night when all hell broke loose.
According to Rego, two other members of the show -- Graham Bunn and Blake Julian -- had gotten into an argument ... and it started to become physical.
Rego says he went to break up the fight -- when Graham punched him in the nose ... and he started to bleed. Sources at the club tell us security rushed over to the scene and escorted Graham out of the building.
Justin tells us he does not plan on pressing charges -- but says he's still pretty pissed off at Graham. A rep for Graham tells TMZ, "It was nothing -- just boys being boys.”

Mark Sanchez Getting Help from Dad for 9/11 Fundraising Mission
NY Jets QB Mark Sanchez is marking the 10th anniversary of 9/11 with a new fundraising campaign to benefit the families of fallen NY firefighters ... with a little help from his dad (and Ron Howard).
Mark -- who moonlights as a GQ model -- has designed a new vintage-style designer t-shirt and has put them up for sale ... with 100% of the proceeds benefiting the families of fallen firefighters via the New York Police & Fire Widows’ & Children's Benefit Fund and the FDNY Foundation.
The shirt features the slogan "You Go, We Go" -- a line suggested by Mark's father Nick Sanchez ... a veteran firefighter ... and obvious fan of the Ron Howard movie "Backdraft" ... where the quote originated.

Reese Witherspoon STRUCK BY CAR, Taken to Hospital
Reese Witherspoon was rushed to a Santa Monica hospital around 11am this morning, after a car struck the actress while she was jogging.
Law enforcement tells TMZ, Reese's injuries were very minor -- nothing life-threatening.
According to law enforcement, the driver was an 84-year-old woman. We're told Reese was crossing the street at the time of the accident ... and the driver failed to stop.
The driver was cited for failure to yield to a pedestrian and released.
7:30 PM: A rep for Reese tells TMZ, the actress has since left the hospital and is now resting comfortably at home.

Taylor Armstrong & L.A. Coroner We Don't Believe Russell Was Murdered!
Taylor Armstrong and the L.A. County Coroner both agree -- Russell Armstrong's death does NOT appear to be the result of a murder.
The L.A. County Coroner's Office released Russell's toxicology results moments ago -- and Assistant Chief Coroner Ed Winter insists, all evidence surrounding Russell's death points to a tragic suicide.
Winter also tells TMZ, he has just advised Taylor of the results and the "Real Housewives of Beverly Hills" star concurs ... it appears her husband killed himself.
But as we previously reported, Russell's family disagrees, insisting someone else is responsible for his death -- and they're even putting a private investigator on the case.
According to the toxicology results, neither alcohol nor drugs were found in Russell's system at the time of his death.
The L.A. County Coroner released Russell's official cause of death last month -- suicide by hanging.

Sources close to Evelyn tell TMZ -- Lozada made up her mind yesterday, after VH1 posted a blog implying Evelyn may have cheated on Chad Ochocinco with his former teammate Terrell Owens.
We're told Evelyn is furious -- claiming the rumor is simply UNTRUE -- and she feels betrayed by the network. VH1 has since pulled the blog -- but Lozada has already decided enough is enough ... and she's told producers she won't be returning.
Sources tell us Evelyn is now looking for other opportunities -- and will focus on planning her upcoming wedding to Ochocinco.

Russell Armstrong's Family He Was MURDERED
Russell Armstrong's family isn't buying suicide as the cause of death ... they believe he was murdered, and they're putting a private dick on the case.
Although the L.A. County Coroner ruled Russell's death was a suicide by hanging, sources close to the situation say the family is convinced ... Russell's money problems caused him to get involved "with the wrong people." They believe Russell may have screwed someone over out of desperation and that person or persons retaliated by killing him.

Military Stores We're BOYCOTTING Soulja Boy
A system of stores run by the United States Department of Defense will NOT be stocking Soulja Boy's upcoming album -- so long as it contains the rapper's army-bashing song lyrics.
LTC Thomas Shrader from the Army and Air Force Exchange Service -- an agency run by the USDOD -- tells TMZ, Soulja's "Respect My Hustle" will have no place on the shelves of its 3,100 facilities ... whose MILLIONS in profits go to benefit armed services programs every year.
As we previously reported, the outrage is all over the rapper's new song "Let's Be Real" -- in which Soulja raps, "F**k the FBI and the army troops." Soulja has since apologized.
Shrader tells TMZ, Soulja's lyrics "are unacceptable and not the kind of thing we would want to market.”
But there's still hope for SB -- if the song ultimately gets cut from the album ... we're told the Exchange will reevaluate the ban.

The Game Restaurant BOOTED Me Because I'm Black
The Game claims he's just been kicked out of a famous L.A. restaurant because he's BLACK -- even referring to the manager as a "slave master" ... but the restaurant insists they were simply enforcing the dress code.
Sources close to Game tell TMZ, the rapper dropped by Hillstone's in Santa Monica -- formally known as Houston's -- wearing a white tank top ... when the manager refused to seat him.
According to sources, the manager told Game he was in violation of the dress code, which requires men to wear sleeves. But Game's pals tell TMZ ... there were two white males in the restaurant with sleeveless shirts ... and it wasn't a problem.
Game believes the 86'ing was racially motivated -- and took to Twitter moments ago -- telling his 644,000 followers, "Houston's just went from my favorite resturant to the "RACIST-URANT" !!!!"
The rapper added, "Hillstone's racist-urant formerly known as Houston's & their slave-master manager Valerie has just made #1 on the RACIST resturant list !"
A rep for the restaurant tells us ... Game only pointed to a lone sleeveless woman at the bar -- NOT two men -- and says the sleeve rule does not apply to females.
The rep says the restaurant would love to have The Game back ... when he's wearing the appropriate clothing.

Kurt Angle I Was NOT Drunk
Kurt Angle apparently believes he's been FRAMED in connection with his drunk driving arrest Sunday morning ... this according to sources connected with the famous wrestler.
As TMZ first reported, Angle was popped in Virginia after he was allegedly seen driving erratically on I-66.
But Angle's lawyer tells TMZ ... his client passed a breathalyzer test. The lawyer tells us, "We understand Kurt will be entering a plea of not guilty in response to any infractions and/or offenses."
Sources connected with Kurt tell TMZ ... cops are just trying to make an example of him.
The cops are mum, saying the case will be tried in court.
FYI ... someone who is not legally drunk (i.e., someone who passes a breathalyzer test) can still be arrested for driving under the influence if drugs or alcohol -- even minimal amounts -- impair the driver's ability to navigate the road.

Jay-Z's 40/40 Club Union Protests Have Turned Racial
Jay-Z's 40/40 Club is undergoing a remodeling in New York City and a local union is protesting the fact they aren't using union workers for the job -- but Jigga's people tell us some protestors have gone too far ... by hurling racial slurs.
The New York City District Council of Carpenters erected giant inflatable rodents outside the club as part of their protests, claiming the company that was hired to do the job does not meet "area labor standards" and is paying their workers a "substandard wage."
A rep for the club tells TMZ they are in a non-union building and are not required to use union contractors. The rep tells us some protestors have been using racial slurs against the workers they are using, which the rep called a "poor tactic" to try intimidate people and scare away business.
The club is scheduled to re-open on November 1.
Calls to the NYCDC were not returned.
