David Tutera -- the host of "My Fair Wedding" -- followed the biblical path in his split with Ryan Jurica -- he gets one of their twins, and Ryan gets one.

The two men had a 10-year domestic partnership that blew apart in January ... and it got UGLY. And there was a big complication -- they had fraternal twins through a surrogate in July, and that triggered a bitter custody battle.

Now here's the complication. Each man fertilized an egg that was then implanted in the same surrogate, who gave birth to the two babies at the same time. It appears the eggs are from the same biological mother.

Sources familiar with the situation tell TMZ ... a judge has issued a temporary custody arrangement in which David gets custody of his biological child, baby girl Cielo, and Ryan gets custody of his biological child, Cedric.

We're also told the two men are getting along. It's unclear if they will each get visitation rights of each other's kid. So we gotta ask ...

The cowboy from the Village People has found his huckleberry ... and the two will marry later this week in a 3-day celebration in NYC ... so says the PRESS RELEASE the singer just sent out to the media.

According to the release, Randy Jones -- "Multi-platinum recording artist and American Music Award winner" -- will wed his partner Will Grega during "three days of New York events" beginning tomorrow.

Day 1 -- the public proposal ... Randy will pop the question in front of friends and family in Columbus Circle, followed by a celebratory dance to Andrea Bocelli's "Septiembre Amor."

Day 2 -- the ceremony ... Randy and Will will swap "I Dos" at City Hall in front of their mothers. After, they're headed to a trendy rooftop bar to party with special guest host Warrington Gillette -- who the couple credits as "Jason" from "Friday the 13th Part 2."

Day 3 -- the post-wedding banquet ... the couple will invite guests to "honor the Italian heritage of Will Grega" with a "true Italian banquet" at a restaurant in Little Italy.

Of course, no wedding press release would be complete without quotes from the groom and the groom ... so:

Randy: "As a Village Person, New York is IT! We LOVE New York!"
Will: "I now have a lifetime membership to the YMCA!"

Jane Lynch scoffs at the notion that gay people have hastily jumped into marriage ... this in the wake of what has become a contentious divorce between her and wife Lara Embry.

TMZ broke the story ... Embry is now trying to nail Jane to the wall with spousal support ... she wants more than $93k a month.

Embry says she wants Jane to support her in the lifestyle to which she has become accustomed during their 3 years of marriage. Shockingly, Jane isn't blanching at that.

Jane Lynch and Dr. Lara Embry's "amicable" divorce just turned "unfriendly" ... because Embry is making a full-court press for Jane's bank accounts -- to the tune of $93,809 a month in spousal support!

In new legal docs, obtained by TMZ, Embry says for the last 3 years, Jane's average monthly income has been $234,688. Embry also says when she married Lynch, Jane told her she had $400,000 in her savings and 401K combined, and owned her home.

Embry says of her "Glee" wife, "Her income, investments and assets increased dramatically with her newfound acting success."

Embry -- who says she wants Jane to support her in the lifestyle to which she gladly became accustomed -- says during their marriage Jane paid for everything, including lavish vacations.

Embry says she and Jane typically racked up $40k a month on their credit cards.

According to Embry's docs, she currently earns pennies, but still spends in the neighborhood of $40,900 per month -- including an average of $6,500 on clothes, $12,000 on entertainment/gifts/vacation, and $4,500 on eating out (hehe).

Sources tell us ... Jane is already providing Embry with support. In fact, Embry and her daughter are living in the house Jane bought and Jane temporarily moved elsewhere. But the house is a big sticking point. Embry says they sunk $3 mil into the house for renovations and from the docs it seems she either wants the house or a 50% cut.

Sources tell us the couple did not have a prenup, which means assets acquired during the marriage will probably be split 50/50.

Jane filed to end her three-year marriage to Lara in July, citing "irreconcilable differences." The two first met in 2009 at a fundraiser in San Francisco. They were married a year later in Massachusetts.

Jane said recently the financial negotiations have been friendly, adding, "It's just money." Right.

Wentworth Miller tried to commit suicide multiple times because he couldn't handle keeping his sexual identity a secret.

Miller revealed his dark secret at the Human Rights Campaign Dinner in Seattle Saturday night, saying his first suicide attempt was when he was 15.

The "Prison Break" star says he downed a bottle of pills at home, and he wasn't crying out for help, because "you only cry for help if there is help to cry for."

Wentworth also talked about the torture of working in Hollywood as a closeted actor ... explaining he wanted to be the role model he never had ... "to be the someone else, that no one was to me."

Craig James -- a star at SMU and a former member of the New England Patriots in the '80s -- ran for a senate seat in Texas. During a 2012 debate, he had some choice words: Gay people "would answer to the Lord for their actions," and being gay was a choice.

James was hired last month by Fox Sports Southwest and then reportedly fired after just one appearance. According to the Dallas Morning News, an unnamed Fox Sports honcho said, "We just asked ourselves how Craig's statements would play in our human resources department."

Apparently Fox didn't fully vet the dude. The question -- should he be sacked for statements he made before coming on board?

Melissa Etheridge's twins are free to hang with as many breast-baring, weed-smoking groupies as their 6-year-old hearts desire -- a judge just gave Melissa the thumbs-up to take her kids on tour ... TMZ has learned.

TMZ broke the story ... Melissa's ex, Tammy Lynn Michaels tried to block the children from going on the road by filing an emergency request to modify their child visitation agreement back in July.

Tammy Lynn's main concerns: 1. Melissa's female fans whipping out their boobs to throw bras on stage ... 2. marijuana smoke backstage and on tour buses ... and 3. the kids getting vaccinations.

Well, the judge must have a rock and roll heart -- or just didn't buy Tammy Lynn's argument -- because the request was denied on Aug. 30.

However, now that the kids are cleared for the road ... Melissa only has 7 U.S. tour dates left.

Well, remember kids ... it's quality of boobs time, not the quantity.

Tyler, the Creator is adamant ... he didn't go splitsies on a strawberry milkshake with Justin Bieber during a burger run this week telling TMZ, "That's gay."

He also says he doesn't even like strawberries.

Tyler and Bieber posted photos of their late night food fest at a Fatburger in L.A. earlier this week. Sources inside the restaurant told TMZ they 100%, for sure, split the milkshake.

Honey Boo Boo hit up a popular gay hamburger joint in Florida this week for her very first drag show … then stuck around for the ballsiest game of Bingo she ever played … and TMZ has the pics.

7-year-old Alana Thompson – along with Mama June and Uncle Poodle – hit up Hamburger Mary’s in Jacksonville on Tuesday for a couple of rounds of Drag Queen bingo … it’s just regular bingo, with a little more duct tape.

Sources at the restaurant tells us … the Boo Boo bunch had a blast – and were so popular inside the joint, people were hitting the gang up for pictures and autographs.

In fact, so many people wanted a piece of the reality stars – they decided to whip out a tip jar … and promised to donate any money they raised to a charity dedicated to fighting cyber-bullying.

"Prison Break" star Wentworth Miller has just revealed he's a gay man ... in a statement that reads as a giant "F YOU" to Russia.

The 41-year-old actor fired off a letter to the director of the St. Petersburg International Film Festival -- rejecting its invitation for him to travel to the Motherland for the event ... and in the letter, WM went public about his sexuality for the first time.

"Thank you for your kind invitation. As someone who has enjoyed visiting Russia in the past and can also claim a degree of Russian ancestry, it would make me happy to say yes. However, as a gay man, I must decline."

Miller continues ... "I am deeply troubled by the current attitude toward and treatment of gay men and women by the Russian government."

"The situation is in no way acceptable, and I cannot in good conscience participate in a celebratory occasion hosted by a country where people like myself are being systematically denied their basic right to live and love openly."

He added, "If circumstances improve, I'll be free to make a different choice."

A transgender reality star has been murdered ... and cops have a suspect.

According to the police report ... the badly beaten body of Domonique Newburn was found in her Fontana, CA apartment Tuesday afternoon. There were clear signs of a struggle inside the unit.

Domonique stars in a YouTube docu-reality series, "Hollywood Houseboys," that follows the lives of 4 gay friends.

Cops have a hot lead. A suspect was seen leaving the apartment in a Black 2004 Mercedes C240 sedan -- California license number 7AAY925. Apparently the car belonged to Domonique.

Cops believe the suspect knew Domonique -- and is in his 20s or early 30s, 5'8" and average build.

"Fred" star Lucas Cruikshank finally told all his fans he's gay -- which is, without question, a bold and brave decision to be applauded.

It's also something, millions of his fans apparently could've told him years ago.

The Miss Universe Organization believes the show must go on in Moscow ... and it doesn't matter that the Russian government is gay-hostile.

A rep from the MUO tells us the new, anti-gay law violates the core values of the organization ... nevertheless, they want to stay put in Moscow. They say they're hoping to change Russian minds. Good luck with that.

Here's the rub. If some of the women competing are lesbians, they better keep it to themselves, because they could end up in the pokey if they play their hand publicly.

Lucas Cruikshank -- the viral video star who played the ultra-hyper "Fred" character in a Nickelodeon movie and several shows -- has revealed he's gay ... and naturally, he posted his coming out video on YouTube.

The 19-year-old actor made the announcement during a short clip with his friend Jennifer Veal -- who starred in the Disney Channel show, "Jessie."

During the video, Lucas says his closest friends and family members have known about his sexuality for years ... but he never felt the need to make an announcement to the world.

At one point, Lucas turns to Jennifer and asks, "How come you didn't have to make a video saying you're straight?"

FYI -- Lucas shot to superstardom by creating several YouTube videos featuring his annoying "Fred" character ... who had a crush on a girl named Judy. For some reason, they never hooked up.



WWE legend Shawn Michaels is not impressed with the hoopla triggered by the coming out of the WWE superstar Darren Young this week … Michaels says for wrestling it’s very eighties.
