Justin Bieber got busted calling in sick for a deposition ... or so claim the lawyers who say they have proof he stood them up due to a night of heavy partying.

The attorneys are repping a songwriter who claims Bieber jacked a sample for "Sorry" -- and had scheduled a Feb 8 depo with Justin. According to docs, obtained by TMZ, Justin's team informed the lawyers just hours beforehand ... he wouldn't be able to because he was "ill."

Mind you, the lawyers say they'd flown to L.A. from Nashville to make it easier for Justin.

They got pissed when they found YouTube videos of JB chugging beers at Bootsy Bellows in the early morning hours of the very day he was supposed to be at the depo. The videos, apparently posted by Beliebers, show Justin drinking at a house party as well as the nightclub.

In docs, they say Justin rubbed their noses in it by posting Instagram pics drinking with friends ... hours after he played hooky.

They're willing to let him make it up, but now they want the court to force Justin to fly to Nashville in early March, and do the depo on their turf.

We reached out to Justin's team ... no word back.

Prosecutors presented a new witness they want to testify in the Robert Durst murder trial, claiming the star of 'The Jinx' confessed to the woman he's accused of murdering that he killed his wife.

The witness is Nathan "Nick" Allen Chavin, who showed up in court with bodyguards. He's the former boss of Susan Giordano, who prosecutors implied was Durst's lover.

Chavin just testified Susan Berman told him Durst confessed to her he had killed his wife.

Durst is facing trial for allegedly murdering Berman back in 2000. Prosecutors say Berman was about to blow the whistle on Durst, claiming he confessed to her he killed his first wife back in 1982. Durst was never tried for the death of his wife.

11:35 AM PT -- A rep for Serafina tells TMZ the person Bieber allegedly headbutted was not an employee. They also tell us, contrary to law enforcement, no one from the staff called 911. Law enforcement told us the person who called was not the alleged victim but a member of the staff. The restaurant adds, "We always have a pleasant experience with Mr. Bieber whenever he comes to Serafina."

Justin Bieber allegedly headbutted a guy at a pre-Grammy party last weekend, and cops are now investigating the incident as a possible crime.

Law enforcement sources tell us the alleged incident went down at 2 AM Saturday at L.A.'s Italian eatery, Serafina ... where Justin's producer pal, Poo Bear, was hosting a shindig.

Several eyewitnesses tell us Bieber was "play fighting" with Kyle Massey when he realized someone from the restaurant staff was recording the action. We're told Justin asked the guy to stop recording and delete the video. The staffer apparently resisted and some partygoers started recording as well ... that's when the eyewitnesses say Justin lunged at the guy.

We're told a restaurant employee -- not the alleged victim -- called the L.A. County Sheriff's Dept and reported the alleged headbutt. When deputies arrived ... Justin had already left. We got a shot of him on his way out.

We're told the alleged victim doesn't want to press charges -- but the misdemeanor battery investigation is still going forward.

Justin has not been in trouble with the law for more than a year, although a guy filed a police report against Justin Wednesday over a fight after an NBA finals game last June in Cleveland.

NY Jets player Austin Seferian-Jenkins has cut a plea deal in his DUI case from last year and won't spend any time behind bars ... TMZ Sports has learned.

The 24-year-old tight end was arrested on September 23 in Florida after a cop pulled him over for a traffic stop and thought he seemed wasted. Dashcam footage from the incident showed him slurring.

The Tampa Bay Buccaneers cut him after the arrest.

According to court docs, Seferian-Jenkins pled no contest to a reckless driving charge and in exchange, got 1 year probation and 50 hours of community service.

He also has to attend DUI school and pay a $500 fine.

Fun fact -- smokin' hot LFL player Adrian Purnell bailed him out jail.

Ellen DeGeneres' wisecrack about boob piercings forced a judge to actually break down the English language for the woman suing Ellen's show ... before tossing the case out of court.

You'll recall a Georgia woman sued the show producers in June after Ellen -- during a segment called "What's Wrong with These Signs?" -- pronounced real estate agent Titi Pierce's name like "titty" instead of "Tee Tee."

In the docs, the judge articulated exactly why Ms. Titi's got no case:

"The letter 'i' in the English language can be pronounced in several ways. While Titi chooses to pronounce her name with "e," there is nothing demonstrably false in pronouncing it with "i" as DeGeneres did."

Conor Kennedy pled guilty to a misdemeanor in his Aspen nightclub brawl, but he's going to dodge jail time IF he keeps his nose clean.

Conor -- son of Robert F. Kennedy Jr. and Taylor Swift's ex -- had his lawyer enter the plea Wednesday, and the judge gave him a 6 month deferred sentence. That means the arrest will be scrubbed from his record if he stays out of trouble and abstains from booze and drugs over that period.

If not ... he could do time.

Conor was arrested Dec. 29 after getting into a fistfight outside Bootsy Bellows. He said the other guy had called his friend a homophobic slur.

Roman Polanski will make a move next week to return to the U.S. and end his child rape case for good, without serving additional jail time.

Polanski's famed lawyer, Harland Braun, has asked an L.A. County Superior Court judge to unseal a long-secret transcript of the testimony of the prosecutor in the Polanski case.

Braun believes the secret testimony supports Polanski's claim that he cut a deal to serve only 48 days behind bars for raping a 13-year-old girl in 1977, and the judge signed off.

Polanski actually spent 42 days in Chino State Prison and was released. But Judge Laurence Rittenband allegedly reneged on the deal and told prosecutors he decided Polanski should spend up to 50 years in prison. That's when Polanski fled the U.S. for Europe.

Polanski spent another 334 days in custody in Switzerland, while authorities tried to extradite him back to the U.S. A Polish court ruled Polanski has served his time under the plea deal, and now Braun wants the L.A. judge to honor that ruling.

We're told Braun wants to clear the way for the 83-year-old famed director and husband of Manson murder victim, Sharon Tate, to come to L.A. and resolve the matter, so he will no longer be a fugitive. He wants to freely travel in Europe and visit Tate's gravesite at Holy Cross Cemetery in Culver City. He has not been able to visit his daughter in London, either.

Amber Portwood was on the verge of getting booted out of her home, and even though she's settled the financial battle ... she's pissed the owner of the place smeared her good name.

Kisby Enterprises had filed docs to have the former "Teen Mom" and her fiance evicted, and claimed they owed $2,640 in back payments and damage to the crib.

Amber and Matt Blair tell us Kisby's full of it -- saying they never missed a single payment, plus they paid a $32,200 down payment ... and they've got the docs to back it up.

Kisby Enterprises admitted to us ... there was an "unfortunate misunderstanding" and it now intends to withdraw the eviction filing. Amber and Matt say the damage has been done to their reputations, and she has a theory on why Kisby even attempted to push them out.

A Porsche employee gleefully shared news with fellow employees of a slew of crashes of the Porsche Carrera GT -- the model in which Paul Walker died -- saying it would boost the value of the remaining cars.

In new legal docs obtained by TMZ, lawyers in Meadow Walker's wrongful death lawsuit against the car company revealed Porsche concealed emails from them ... emails about the Carrera.

One of the lawyers for Paul's daughter was reviewing company emails on his office computer that were heavily redacted. The lawyer was shocked when he reviewed the same emails on his iMac home computer and found he could see the portions that were not visible on the office computer.

Among the emails from 2006, an employee wrote as many as 200 of the 1280 Carrera GTs which Porsche had produced had been "totaled" in the first 2 years they were sold ... 2004 - 2006.

The Porsche employee who wrote the email goes on to say, "This would be great news to the remaining owners as the GT becomes more rare."

The employee also told this story ... "Another Carrera bites the dust as a bodyshop mechanic who claimed he was going less than 30 MPH smashed into a telephone poll. Looks like he was going more than 30 to me!"

There's another email from another employee who is reacting to the number of wrecks, saying, "This is in the back of my head every time I get behind the wheel of one of these. It's just hidden behind the shit-eating grin!"

Paul died in 2013 when he was a passenger in a Carrera GT that swerved out of control, hit a lamp post and tree and then burst into flames.

We reached out to Meadow's lawyer, Jeffrey Milam, who told us, "Any ethical company would have withdrawn the car from the market -- or, at the very least, warned the public about its dangers."

The lawyers are asking the judge to impose sanctions on Porsche for allegedly deliberately hiding the emails from them.

We called Porsche ... so far, no response.

Justin Bieber's been named in a police report for allegedly assaulting a man ... and the alleged victim might look familiar.

Law enforcement sources in Cleveland tell us Bieber is now the suspect in an incident back in June ... an incident captured on video showing Bieber fighting a guy after a Cavaliers playoff game.

The alleged victim told cops Justin grabbed his sunglasses. The guy then took a pic of Justin with the shades, which he says enraged the singer and sent him into attack mode. He claims Bieber's crew then got in on the action.

The alleged victim says he went to the hospital with various injuries, including a concussion.

As for why it took the victim so long to file ... people connected with him say he was trying to settle up with Justin but he just wouldn't play ball.

For what it's worth ... the alleged victim looks twice as big as Biebs.

Law enforcement sources say the investigation is ongoing and no charges have been filed.

Joanna Krupa's legal attack on a Florida strip club is ridiculous, because no reasonable person would expect to see her working the pole ... according to the club itself.

Pink Pony Tampa says, in docs obtained by TMZ, its use of her image to promote special events is NOT false advertising ... as she claims in her lawsuit. Say what you want about strip club patrons, but Pink Pony says they're not stupid enough to think the "pretty faces" in advertisements would be at the club.

As the Pony puts it ... no one expects Colonel Sanders to serve the chicken at KFC.

We broke the story ... Krupa's suing the club for slapping her image on "dance and shower" show ads without consent, and without paying her.

Pink Pony wants the case dismissed because it says Joanna hasn't proved she owns the photos it's using. Plus, as they see it, she's just too damn hot for their stage.

Plies was arrested for DUI by some pretty stonefaced cops, because it's borderline remarkable they didn't lose it as they gazed into the horrified eyes of one Kevin McCallister.

TMZ obtained the dash cam footage of the Florida rapper's January arrest ... the main attraction is definitely the "Home Alone" tee.

You hear the officer tell Plies he was driving the wrong way down a one-way street. Plies was cooperative ... calmly answering questions about a gun in the car.

Sofia Vergara's firing back at her ex, Nick Loeb, for putting her through the legal ringer for more than 2 years over their embryos ... hoping to put an end to the ordeal once and for all.

Sofia's asking the court to officially block Nick from trying to take control of their embryos with the intention of bringing them to term without her consent ... according to legal docs she just filed.

She says Loeb voluntarily dismissed his case against her in December -- after waging legal war with her since 2014 -- to leave the door open to refile his case again. She insists it would just be a waste of time.

According to the docs ... Nick signed a contract about their frozen embryos originally in which his rights were clear -- he CANNOT bring the embryos to term without MUTUAL agreement.

In addition to an order, Sofia wants some money for her troubles.

"The Howard Stern Show" aired a woman's phone conversation with an IRS agent -- revealing tons of personal information -- but she had no idea it was being broadcast and now she's suing.

Judith Barrigas filed a federal lawsuit over the phone call which aired in May 2015 ... she says by absolutely no fault of her own. According to the suit ... she called the IRS to discuss a pending tax case. The agent Barrigas spoke to -- Jimmy Forsythe -- had called into the 'Stern Show' as a listener and was on hold ... while he took her call.

She says 'Stern Show' producers overheard her convo with Forsythe and decided to put it on the air to 1.2 million listeners -- essentially eavesdropping on her very private and sensitive phone call.

Barrigas says she immediately got a barrage of harassing phone calls and texts ... as she had mentioned her phone number during the call with Forsythe.

Alanis Morissette, Kim Kardashian and a bunch of other celebs have turned their social media accounts into a Thomas Guide for criminals who are looking for the most expensive jewelry in town.

Law enforcement sources tell us they believe Instagram and other platforms have become the undoing of famous folks who show off expensive bling. TMZ broke the story, Alanis was just hit by burglars who made off with $2 mil in jewelry.

No surprise ... Alanis has been posting photos of her bling on various social media platforms and her blog. Some of the rings, bracelets and other jewelry go for thousands and thousands of bucks.

Kim learned her lesson, but a slew of celebs continue to flaunt their wealth on social media.

Alanis Morissette was hit by burglars in a big way ... they made off with $2 million in bling.

Law enforcement sources tell us the burglars broke into the singer's Brentwood home last Thursday ... in a very secure area.

It's unclear if the thieves got away with anything other than jewelry.
