Andrea Constand repeatedly choked up as she testified Bill Cosby drugged and sexually assaulted her back in 2004.

She told the jury Cosby had given her 3 blue pills to relax ... herbal, so he allegedly said. But Constand testified 30 minutes later she was slurring with blurred vision ... her legs rubbery.

She says she was so out of it she couldn't fight him.

Constand testified for about an hour. During cross examination, Cosby's lawyers tried poking holes in Constand's story, pointing out inconsistencies in her story. The lawyers also confronted Constand, claiming she had 2 previous "sexual situations" with Cosby. She said they were merely suggested sexual situations.

Gloria Allred, who reps other women who claim they were also assaulted, looked on in the peanut gallery.

1:57 PM -- A spokesperson for the university tells TMZ it intends to vigorously defend its actions and it looks forward to "contesting this collection of false claims." The school adds, "We are confident that UCPD's actions will be vindicated against the plaintiff's uninformed allegations."

A Milo Yiannopoulos fan blames UC Berkeley for allowing protesters to attack her when she showed up to hear Milo's speech ... and now she wants the university to pay up.

Kiara Robles, a Berkeley student, says she showed up for the right-wing commentator's speech back in February, but it was canceled when protests erupted on campus. In docs, obtained by TMZ, she says 15 minutes after arriving ... she was attacked with "extremely painful pepper spray" by masked and unmasked assailants.

She claims there was zero police presence where the attack happened, and her attackers were able to escape.

Robles isn't just going after the university either. She's also suing Berkeley's president, chancellor, regents chair ... also the city's mayor, police chief, the California Democratic Party chairman and Congresswoman Nancy Pelosi.

Robles accuses school officials of "willfully withholding police manpower" because they disagree with conservative viewpoints. As for how Pelosi's been dragged into this -- Robles says she's suing her for assault because Pelosi advocates "violence toward President Trump supporters."

Robles wants damages in excess of $23 million.

We've reached out to UC Berkeley and Pelosi's office, so far no word back.

Bone Thugs-N-Harmony's Bizzy Bone is being accused of physically abusing and repeatedly harassing his now ex-fiancee, and she's gone to court to get protection.

Ranna Royce says back when she and Bizzy were still engaged, in September 2016, he attacked her in their NYC home. In court docs, Royce says Bizzy "strangled me and head butted me. I fell to the ground." She says she was afraid to report it to police.

Bizzy and Ranna ended their engagement in October ... but she says this past weekend he started contacting her again with harassing text messages -- saying he knew where she lived and he could track her down.

Ranna says she blocked his number, and filed a report with NYPD.

The judge granted her a temporary restraining order ... forcing Bizzy to stay away from her and her home. He's also blocked from contacting her by text or email.

Former San Francisco 49ers cornerback Tramaine Brock has been hit with a felony domestic violence charge after he allegedly attacked his GF in front of their 1-year-old child.

Officials say 28-year-old Brock -- who played with SF from 2010 to 2016 -- punched his girlfriend in the face on April 6 at a Bay Area home after a disagreement about what TV show to watch.

He then allegedly tried to strangle her multiple times -- one of the times she was holding the child. The 49ers cut Brock right after he was arrested.

Brock -- who was also charged with misdemeanor child endangerment -- faces up to 5 years in prison if convicted on both counts.

Three players from the Michigan State football team have been charged with rape over a January incident at an on-campus apartment ... officials say.

Officials say Josh King -- who played in 9 games during his rookie season in 2016 -- was the ringleader in the situation ... pulling the alleged victim into a bathroom and raping her.

King then invited Demetric Vance and Donnie Corley into the bathroom and forced the woman to perform oral sex on them, cops tell ESPN.

FYI, Corley was a star WR as a freshman in 2016 -- hauling in 33 catches for 453 yards and 3 TDs. He was also named to The Football Writers Association of America Freshman All-America team.

Officials say King snapped a photo of the woman during the alleged incident.

All 3 of the men were charged with 3rd degree sexual assault. King was also charge with 1st degree sexual assault and for capturing/distributing an image of an unclothed person.

All 3 players were officially kicked off the MSU football team Tuesday morning.

MSU Police Chief Jim Dunlap issued a statement saying, "The MSU Police Department has zero tolerance for sexual assault."

"I’m confident that this extensive investigation was completed thoroughly, and our detectives worked diligently and exhaustively in providing information to the prosecutor’s office."

David Spade got hit hard by burglars, who busted into his Beverly Hills home and walked out with his safe ... TMZ has learned.

The heist went down late last week. We're told the suspects got into his pad, and the only thing they took was the safe, but unfortunately it was filled with cash and jewelry ... including a wedding band that belonged to David's mom.

All told, they made off with about $80k worth of stuff.

Bev Hills PD was at Spade's house Monday, and he was as thrilled about it as you'd expect. We're told he has a security system, which was on ... but the suspects somehow disabled it.

Comedian Aries Spears is following through ... suing a radio host for unleashing a flurry of fists on him while he was a guest, and also the program -- The Corey Holcomb 5150 Show -- for letting the attack happen.

Aries filed the suit Monday, accusing co-host Zo Williams of assault and battery. TMZ first posted the video ... showing Zo go HAM on Aries back in April.

In the suit, Aries doesn't just blame Zo ... he goes after Corey Holcomb, and his entire staff, for standing back and doing nothing during the beatdown. He goes on to say both Williams and Holcomb later made light of the attack when they came on TMZ Live.

One thing Aries does not mention is how the hell the melee started in the first place. As we reported ... Williams went off when Aries cracked a joke, at Zo's expense, saying "light-skinned n****s" get loud. Williams attacked immediately.

Mischa Barton won't have to worry about a sex tape being leaked by at least one of her exes -- she struck a deal with him, and the judge just signed off on it.

Mischa and her ex-BF, Jon Zacharias, agreed he would NOT release any explicit videos and photos of the 'O.C.' star he obtained during their relationship. Jon must now hand over any material to Mischa's lawyer, Lisa Bloom.

As we reported ... Mischa got 2 temporary restraining orders against Jon and another ex, Adam Spaw. Mischa believed Jon originally captured her in intimate moments without consent, and thinks either Adam or Jon were peddling the material.

Shaw's still barred from releasing material -- under the temporary restraining order. There's a hearing set for Wednesday where Mischa will try to make that one permanent too.

Vivica A. Fox's former business partner says she ruined his "Black Magic" male stripper revue by bad mouthing him and stealing his dancers ... according to his lawsuit.

Jean-Claude LaMarre says his partnership with Vivica went south when she went on "The Breakfast Club" and said the "Black Magic" guys don't strip for gay men. The LGBTQ community blasted her, and LaMarre says Vivica got pissed at him when he distanced himself from her ... during a "TMZ Live" appearance.

According to docs, Vivica started plotting to start her own male revue -- recruiting 4 "Black Magic" dancers -- and bad mouthing LaMarre to sway them to join her team.

In the suit, LaMarre says Vivica actively tried to torpedo promotions for his show by calling it a "fake," and telling her fans to avoid "Black Magic" like the plague.

We've reached out to Vivica's reps, no word back yet. If this one goes to trial ... we smell a hung jury.

Former MMA fighter War Machine is going to prison for life, with possibility of parole, for the heinous 2014 beating of his ex-girlfriend.

The judge said he will be eligible for parole after 36 years ... when he is 71. As we reported ... he was found guilty of sexual assault, coercion, battery by strangulation, kidnapping and several other charges. The jury was hung on attempted murder charges.

During Monday's sentencing ... War Machine's ex, porn star Christy Mack, made a tearful plea to the court, saying ... "I do know that when he gets out he will kill me."

He also spoke during the hearing ... saying he hates himself for committing the beating. He compared himself to Aaron Hernandez, and reminded the judge of his own attempted suicide after he was arrested in 2014.

Derek Fisher says he's grateful no one was seriously injured in his DUI crash over the weekend -- and is adamant the situation will NEVER happen again.

The ex-NBA star was leaving Leo & Lily restaurant in L.A. with his girlfriend, Gloria Govan -- more than 24 hours after the SUV he was driving crashed and flipped on the 101 Freeway around 3 AM.

Fisher -- who was arrested for DUI -- was walking without a limp or a scratch (same with Gloria) and said he was grateful for everyone's thoughts and prayers.

Josh Duggar now wants his own pound of flesh from the police and city officials 4 of his sisters are suing for releasing investigators' reports on his molestation case.

Duggar filed documents to join the lawsuit Jill, Jessa, Jinger and Joy filed last month. In his docs, Josh says cops assured him his 2006 interview discussing the molestation of his sisters would remain private. He says since he wasn't charged, the information wouldn't have gone public ... if the reports weren't released to In Touch magazine.

Duggar says once the story came out, it caused him mental anguish and humiliation. He played up the sympathy card in the docs, saying he was "victimized and forced to relieve the painful and difficult circumstances of a traumatic experience as a juvenile."

Derick Almena, the landlord at the Oakland warehouse that went up in flames, killing 36 people, has been arrested for the fire.

Alameda County prosecutors announced Almena's arrest -- along with Max Harris, who was reportedly a tenant at the art commune known as the Ghost Ship.

Both men are being charged with 36 counts of involuntary manslaughter. The District Attorney says they "knowingly created a fire trap." His bond is set at $1,080,000.

The warehouse burned down in December during an EDM concert. Based on photos and videos, the building was packed with tons of old art pieces, furniture and wooden cargo pallets -- all of which fueled the flames.

Almena had angrily claimed the building was "up to code" during an interview on NBC's 'Today.'

Khloe Kardashian says she's the victim of theft and betrayal by her former friend whom Khloe considered part of her family.

Khloe took to Twitter over the weekend shedding some light on the incident and asking followers, "What would you do if you found out a friend was stealing from you?"

Khloe hasn't yet filed a lawsuit or police report, but, sources close to the situation tell us she's already talked to her lawyers, claiming the friend charged tens of thousands of dollars in designer clothes to Khloe's credit card ... clothes that didn't end up in her closet.

We're also told Khloe believes high-end designers sent her all sorts of stuff but the friend never turned it over to her.

In all, Khloe believes a small fortune was taken.

We're told Khloe's mulling over a lawsuit but hasn't decided yet. Her friends are urging her not to sue, because it will ruin the friend's career.

Bill Cosby just showed up for his sexual assault trial, and he walked in arm-in-arm with his former 'Cosby' co-star, Keshia Knight Pulliam.

Cosby faces 3 counts of aggravated indecent assault for allegedly drugging and sexually assaulting Andrea Constand in 2004 at his home.

The judge has allowed one other alleged victim to testify because prosecutors want to show Cosby had an M.O.

The jury of 12 has 2 African-Americans.

Kodak Black is a free man after completing a voluntary life skills course behind bars that made him eligible for early release.

Kodak was released Monday morning from Broward County Jail after serving 97 days of a 364 day sentence for violating house arrest. He's now back on house arrest for another year. He'll need to request permission from his probation officer and court if he wants to travel anywhere for work, even inside Florida.

As we reported, his trouble adhering to house arrest is what landed him in jail. He bolted without permission at least 2 times, once to hit up a strip club.
