Milian is pissed over The-Dream's claim that they were legally separated when he filed the divorce docs back in February ... just nine days before she gave birth to their daughter.

In her legal response, filed last week in Georgia, Milian claims the marriage wasn't really kaput when he filed the divorce docs -- and subsequently had "marital relations on numerous occasions."

But Milian also claims that if the court does grant the divorce -- it shouldn't be based on The-Dream's claim that the marriage is "irretrievably broken" -- but rather because the The-Dream was cheating on her.

But it gets worse ...

In the docs, Milian admits that she signed a settlement agreement with The-Dream in which both parties waved any alimony or ownership rights to the other person's property.

The dude who wrote the book is Ryan Simkin -- who began shooting naked, drunk chicks for Joe back in 2002.

In his lawsuit, Francis claims Simkin -- like all of his employees -- was required to sign a non-disclosure agreement, which strictly prohibited him from "writing and publishing any tell-all books about their work."

So, according to the docs, when Francis heard that Simkin had a book on the way -- he wrote up a little something of his own ... a breach of contract lawsuit.

The story is much wilder than reported. Earlier this week, Oksana's rep, Steve Jaffe, told Harvey that Mel had described to Oksana a plot to kill Harvey. Jaffe said Oksana claimed Mel told her he was furious that TMZ broke the story about the anti-Semitic rant following Mel's 2006 DUI arrest. Jaffe said Oksana told him Mel had said he wanted the "blood of Jews" on his hands.

According to Jaffe, Oksana said Mel told her he had someone do "surveillance" on Harvey earlier this year, having him followed to the gym at 4 AM.

The plan, Jaffe said, was to "kidnap" Harvey, strip him, take him deep into the desert, break his kneecaps and leave him to die.

Jaffe told Harvey the story on the heels of complaining that a particular TMZ post was not favorable enough to Oksana.

We checked the "kneecap" story out and determined it was false. For starters, Oksana had the wrong gym. More telling ... Oksana never mentioned a word of this to any of her lawyers while she tried negotiating a $15 million package in May during the mediation, using the tapes as her secret weapon. One person involved in the mediation laughed, saying Oksana brought out every piece of ammunition imaginable to score a financial package, so why was this story mysteriously absent?

Oksana claims to have told the Sheriff's Department the story. It seems deputies took it so seriously ... they never even contacted Harvey to give him a heads up that someone wanted him dead ... allegedly.

Papa Lohan tells TMZ that if Lindsay won't approve him as a visitor, he'll reach out to the jail's chaplain to help broker some kind of meeting. There is of course the possibility the chaplain could refuse to meet with him too.

According to multiple law enforcement sources, staff at Lynwood and the L.A. County Sheriff's Headquarters Bureau have been getting bombarded by tons of fans ... who have been phoning in from all over the country ever since LiLo moved in.

Obviously, the fans are never connected to their incarcerated hero ... because she's in JAIL.

TMZ broke the story ... Oksana agreed during her mediation with Mel in May to a $15 million package. In return, she promised to keep all of the "evidence" confidential -- which included the secret tapes.

As we reported, Oksana and Mel signed a one-page agreement, but when the longer form document was later presented to Oksana, we're told she balked because it included a clause which gave Mel unsupervised visitation.

Our sources say Oksana felt Lucia was in danger and said she would turn down "any amount of money" to keep Mel from unsupervised visitation.

Sources intimately familiar with the case tell TMZ Oksana went to a pediatrician, Dr. Gordon, on January 8, complaining of headaches. She told the doctor her eyes were not tracking properly and he then ordered X-rays. Interestingly, the pediatrician was not her children's doctor. It's unclear why she chose a pediatrician.

The X-rays will be especially important because the dentist who saw Oksana the day before has made conflicting statements about Oksana being struck in the mouth. And the dentist's photos do not show any injury to Oksana's temple area. The dentist says Oksana covered the bruise with hair and makeup.

Oksana claims she was punched twice -- once in the head and once in the mouth.

And there's this ... we've learned in the mediation Oksana said she told the dentist and the pediatrician she had been hit but "refused" to say by whom. We know the dentist says she told him Mel had struck her but that she wanted to protect him.

The suit, filed by Gloria Allred, claims the sexual harassment began during filming on August 21, 2009. According to the suit, David was sending "sexually inappropriate text messages" to Kristina Hagan, who was an extra on the show.

The suit also claims David was driving with Kristina in September, 2009 and told her he was "the boss" and that he could "make things happen for her."

The suit claims David then parked his car, and "attempted to kiss her and touch her breasts but she pushed him away." The suit then alleges Boreanaz "unzipped his pants, pulled out his penis and began stroking it until he ejaculated."

Another encounter allegedly occurred with Hagan in David's trailer on September 29, according to the docs. Once again Hagan claims Boreanaz grabbed, kissed, and fondled her -- and then "masturbated in front of her."

Then the suit claims that in October Boreanaz told Hagan "he and his wife had argued because there were reports of his infidelity" coming out -- and that he and Hagan would have to "cool it."

According to the suit, Boreanaz continually told Hagan he was trying to find an acting role for her, but never delivered.

According to Kate's complaint she says, "My fiance Michael Lohan came home while I was sleeping in a sofa chair. He woke me up, yelling, 'Why didn't you pick up your cell phone, you stupid c**t.'"

Kate continues, "He then turned over the chair while I was still in it, tossing me to the floor. I crawled to the other side of the room to get away from him. He walked over to me, took his shoe off and kicked me in my face while I was still on the ground. He stood over me and said, 'I'm going to go back to jail cause of you, cause I will kill you.'"

Kate says, "He said all of this to me cause he is afraid I'm going to leave him. I am very afraid of him."

According to the police report, which parrots Kate's handwritten complaint, cops say, "Minor swelling observed on [her] lip."

Major said when she fell out of the chair she bumped her head into the wall and body on the floor and complained of a cut lip, a sore left collarbone and a scraped right knee.

Michael says there was an argument but denied touching Kate.

According to documents filed in Georgia and obtained by TMZ, The-Dream -- aka Terius Nash -- claims the marriage is "irretrievably broken."

The-Dream filed his papers on February 17, but the docs never surfaced until we found out.

Milian gave birth to their only child, a daughter, on February 26.

In the divorce docs, The-Dream declares, "There is no hope for reconciliation."

Our spies in North Carolina tell us Hough was in town for her birthday dinner at a Morton's steak house the other night with a bunch of friends ... and at one point during the meal, she was asked, "How did you and Ryan get together?"

Julianne responded, "He was after me since I was 18 ... he totally wasn't my type ... I thought he was gay."

But Hough continued, "After a few years, he was persistent ... so I went out with him on a date and I realized how much I liked him."

We're told Ryan and Julianne have been together for a couple of months.

As someone inside the jail told us, "She's not a mess at all. She's keeping to herself, better than yesterday and handling it pretty good."

We do not know if sleeping soundly in a noisy jail was Ambien induced.

Our jail source says she looks "stunningly beautiful."

As for what's on Lindsay's mind -- she wants to know when she's getting out.

Stephen Jaffe tells TMZ, "To specifically address the allegations, my client, Ms. Grigorieva, has repeatedly stated that there is no credible evidence whatsoever of extortion by her, and she stands steadfastly by that statement."

TMZ broke the story ... the L.A. County Sheriff's Department has launched an investigation into the extortion claim after Gibson lawyer, Blair Berk, presented her evidence to investigators.

We're also told deputies are investigating Berk's claim that Oksana lied to authorities when she filed her complaint.

We're told Kate Major claims ... on Monday at around 2 PM, just before Michael flew to L.A. for Lindsay Lohan's hearing, they began arguing and Michael allegedly shoved her over a chair, injuring her shoulder.

Sources say Major claims while she was on the ground Michael kicked her in the face.

Major claims she went to the hospital and has pictures of her injuries.

The L.A. County Coroner found prescription medications in Simon's blood stream but not enough to be lethal.

Ironically, Brittany died 5 months earlier of pneumonia, anemia and multiple drug intoxication.

We've learned Simon's family in England was advised of his cause of death earlier this morning by the L.A. County Coroner's Office.

UPDATE: Brittany's mom just released this statement:

Sheriff's spokesperson Steve Whitmore tells TMZ, "Extortion allegations have been brought to our attention and we are certainly going to be looking at that."

TMZ broke the story ... Gibson's attorney, Blair Berk, made a formal presentation to Sheriff's deputies yesterday, alleging she and her team have evidence of extortion and that Oksana lied to authorities about various claims.

Sources connected with Gibson have told TMZ they have "hard proof" of extortion.

Sources say deputies will also be investigating the allegations that Oksana made false claims.
