Mel's Babysitter: He Freaked Out Before Fight
Sources tell TMZ the babysitter for Mel Gibson and Oksana Grigorieva was front and center for the beginning of the now-famous January 6 blowup.
In the hours before the incident, Oksana went to a basketball game ... leaving Mel, baby Lucia and the babysitter at Mel's Malibu home.
According to sources connected with the case, the babysitter says Mel "began freaking out" while Oksana was gone, "slamming doors, cussing and screaming at someone on the phone." The babysitter says Mel was screaming to someone on the phone, "I want to f**king destroy you."
We're told the babysitter called Oksana and urged her to come home because Mel was losing it. The babysitter claims, "Mel was possessed and completely out of control."
Sources say the babysitter was present when Oksana returned home but left before anything physical occurred.
Other sources, however, question the babysitter's claims, because they say she never previously made any such allegations.
People connected with the babysitter tell us she didn't come forward with her story because she's fearful of Mel and is fighting stage 4 cancer and undergoing chemo.

Joe Jonas Ready to Fight Over Demi Lovato
Joe Jonas is prepared to go to war over a blog posting that insists he and his underage ex-girlfriend Demi Lovato are currently "friends with benefits" ... in fact, Joe's lawyers are already on the attack.
TMZ has learned ... Joe's attorney just fired off a letter to a Canadian entertainment blogger named Zack Taylor ... blasting the guy for a story he posted which implied that 20-year-old Joe and 17-year-old Demi "are involved in an illicit relationship."
In the letter, obtained by TMZ, Jonas' attorney claims the story is "completely false, offensive and defamatory" -- and accuses Taylor of a "malicious attempt to attack and devalue [Joe's] good name and reputation."
Team Jonas is demanding that Taylor pull the post ASAP ... or else a lawsuit may follow.
Taylor tells TMZ, "We are currently reviewing the situation & letter. However, at this time we
do stand by our sources and their claims."
Bristol Palin and Levi Johnston Strike Custody Deal
TMZ has learned ... Bristol Palin and Levi Johnston have reached a settlement in their custody case.
Under the deal, filed with an Alaska Superior Court, Bristol will get primary physical custody of Tripp. Levi will have visitation, between 9:00 AM and 4:00 PM on Saturdays and 12:00 PM and 6:00 PM on Wednesdays.
Levi has to pay Bristol child support. The amount isn't stated, but the agreement says the calculation is based on earnings of $72,000 a year.
And get this ... Under the agreement filed with the court, the parties agree not to "speak badly about the other parent in front of the child ... or allow anyone else to speak badly about the other parent or members of their family in front of the child."
And it goes on ... "The parties agree that they shall not allow the child to visit with, or interact with, any family member who publicly ... or in front of the child, criticizes the other parent or the other parent's family."

Oprah Co. Sued for MS Discrimination
A woman who worked for Oprah Winfrey's OWN network claims she was subjected to a hostile work environment ... because she suffers from Multiple Sclerosis.
According to a lawsuit filed today in Los Angeles Superior Court, Catherine Dunn was an assistant at OWN beginning in August 2008. She claims that during her time there, she was "subjected to a hostile work environment" because of her MS.
She claims she was forced to take a stress leave as well of a leave of absence because her MS symptoms were exacerbated because of the workplace stress.
When she was out on leave, Dunn claims she was replaced by "a non-disabled and younger employee."
Dunn is suing for wrongful termination, among other things. She is asking for unspecified damages.
So far ... no comment from Oprah & Co.

Fantasia's Reality -- Staged Encounter with Married BF
Fantasia Barrino was spotted outside her North Carolina home yesterday -- alongside the married man who she allegedly had an "adulterous affair" with ... but the two weren't alone.

Dina Lohan -- Lindsay Will Be Out 'Soon'
Lindsay Lohan was ordered to 90 days of rehab -- but, according to her mother, she won't be doing the full time.
Dina Lohan was just on "Today," where she said Lindsay will have a shorter stay at UCLA and will be out "soon" -- adding that Linds made friends with a lot of "alleged murderers" during her incarceration before rehab.
As TMZ previously reported, the inpatient program at UCLA typically lasts only 45 days, but doctors often repeat the program or stylize another program for the patient that could easily last 90 days.
Lindsay's lawyer, Shawn Chapman Holley, told TMZ doctors have not yet determined how long of a stay is appropriate.
Although the judge could let Lindsay out early, sources tell us it's very unlikely.

Mel Gibson Case: PR Witness Deposition Set
TMZ has learned ... Mel Gibson's lawyers have set their sites on someone who spent hours talking with Oksana Grigorieva about what Mel allegedly did to her and a lot more -- her publicist.
Sources tell us Steve Jaffe -- a master, veteran PR dude -- got subpoenaed to appear for a deposition during the last week of the month.
And we're told, a dogfight is inevitable between lawyers for Oksana and Mel ... over what Jaffe can and cannot say.
Jaffe -- who served as Oksana's rep for several weeks before resigning -- spent dozens of hours talking to Oksana about Mel, the leaked tapes, allegations that she tried extorting Mel, reports of inconsistencies in her story ... everything, we're told, to "clear up the inconsistencies in the media."
Mel's lawyers want to hear what Oksana said and whether it conflicts with her other statements. But we're told Oksana's lawyers are prepared for objection after objection, on grounds her lawyers hired Jaffe, and therefore many of the conversations he had with Oksana are protected by what's called the "work product privilege" -- part of the attorney-client privilege.
Sources say Mel's people, among other things, will argue that public relations has nothing to do with the legal case and therefore isn't protected.

"American Idol" sources tell TMZ ... the Jennifer Lopez deal isn't dead yet, but if it does flatline ... "Idol's" next choice is country star Shania Twain.
Shania was a hit on "Idol" this past season when she served as guest judge and mentor.

Fantasia May Be Sued for 'Stealing Husband'
Fantasia Barrino is preparing for a possible legal war with the scorned wife of her married lover ... because Fantasia's attorney tells us under North Carolina's "archaic" domestic laws, "women can sue women for stealing husbands."
As we previously reported, the "American Idol" champ had been in a relationship with a man named Antwaun Cook -- who is still married to Paula Cook. Paula recently filed for divorce ... and in the legal papers, cited an "adulterous affair" between Fantasia and Antwaun.
Cook has not taken any legal action against Fantasia yet -- but Barrino's lawyer, Gena Graham Morris, tells us it very well COULD happen ... because in NC there are certain "heartbalm torts ... where a wife can sue a third party for having a relationship with her husband" -- it's called alienation of affection.
Morris adds, "The heartbalm torts arise out of the notion that women were once property that could be stolen like televisions. It is a comical irony that in 2010 women can sue women for stealing husbands."
Morris says she "hopes" Paula Cook will choose not to sue -- but in case she does, Morris vows to "vigorously defend" Fantasia.

Bathroom Blowup Triggered 'Idol' Arrest
Asia'h Epperson was all smiles as she was released from jail early this morning -- as she and her sister told us their arrest was all over a bathroom blowup.
The "American Idol" Season 7 contestant and her sister claim they were in the restroom at the Colony nightclub when they encountered the alleged victim, who they say pushed her way past them, allegedly attempting to use the stall for other than ordinary purposes. That's when a brawl broke out and the sisters beat the woman up -- allegedly.
As "A.I." rejects often do ... Epperson used the cameras to plug her album and take a shot at Simon Cowell.

TMZ has learned ... Oksana Grigorieva's new lawyer has an immediate mission -- debug Oksana's house.
We're told attorney James Spertus -- who Oksana has hired to rep her in the extortion investigation and an almost certain civil lawsuit against Mel Gibson -- will hire experts who can sweep Oksana's home for bugs.
Sources say Oksana is worried either Mel or the media has planted cameras or wiretapping devices and the lawyer doesn't want to take any chances.
Spertus is a nationally recognized expert on computers and other electronic gadgets.

Montana Fishburne Fingered in Brutality Case
TMZ has learned ... newly-minted porn star Montana Fishburne allegedly beat the hell out of her boyfriend's ex and is being prosecuted for assault with a deadly weapon.
Montana was arrested in February after allegedly barging into the alleged victim's home (the complaint does not give her name), forcing her into the bathroom and beating the crap out of her. We're told the victim had "significant injuries."
The L.A. City Attorney's Office has charged Fishburne with battery, and will be adding charges of false imprisonment and assault with a deadly weapon.
Montana, who's being repped by the effervescent Shawn Chapman Holley, has pled not guilty and the case is pending.
Fishburne's boyfriend, Jerome Greene, was also charged in the attack against his ex-girlfriend but already pled no contest to domestic battery.
As for Montana -- who is releasing her first sex tape through Vivid Entertainment -- she has big problems. She was arrested last November for prostitution. Montana pled no contest to the lesser charge of criminal trespass and was placed on probation. The judge could use the pending case to violate her probation.

Mel Gibson: Can You Hear Me Now?
Law enforcement sources tell TMZ ... L.A. County Sheriff's investigators are waiting on Verizon, AT&T and other carriers to supply them with the last bit of evidence before turning the case over to the D.A.
As we have previously reported ... text messages and emails between Mel Gibson and Oksana Grigorieva play a part in piecing together what happened on January 6, during the now-famous blowout. Although lawyers for both sides have anted up the texts and emails, Sheriff's investigators want to turn over the official records -- under the law, only official records from the carriers are admissible in evidence -- it's called the "best evidence" rule.
We're also told investigators may conduct several other interviews before turning the case over to the L.A. County D.A.'s Office -- possibly the week from next.
One more thing ... We've learned the domestic violence investigation is being handled separately from the extortion investigation -- the latter is being investigated by the Major Crimes Bureau of the Sheriff's Department. The goal, we're told, is for both investigations to be submitted to the D.A. at the same time.

Paris Hilton Sued for $35 Million over Hair Extensions
Paris Hilton is being sued by a hair extension company which claims the heiress signed a multi-million dollar contract to use and promote their fake locks ... and then totally blew them off -- causing $35,000,000 in damages.
According to a lawsuit, filed in L.A. County Superior Court, Hilton got just over $3.5 million since agreeing to become the spokesperson for Hairtech International's Dream Catchers hair extension line back in 2007.
But according to the docs, Paris didn't satisfy her end of the bargain -- when Hairtech claims she was "seen in magazines and on television not wearing [their] hair extensions and was in fact wearing competitors' hair extension products."
Hairtech also claims she screwed them over when she went to jail in June 2007 -- because there was "an implied" term in her contract that she would "obey the law."
In fact, Hairtech claims Paris served her time when she was supposed to be at a very important "launch party" for the hair extensions.
In the suit, Hairtech claims that "more than 600 hair extension professionals" were scheduled to attend at the party -- but because Paris couldn't make it, they lost opportunities which should have resulted in $6.6 million in revenue.
Now, Hairtech is accusing Paris of fraud and deceit -- and claims they ultimately lost $35 million because of her actions.
An attorney for Hilton tells TMZ: "There is no merit whatsoever to any of these claims. We will pursue all of our defenses vigorously and any potential counter claims."

Fantasia 911 Call -- She 'Took a Bottle of Aspirin'
TMZ has obtained the 911 call made on Monday night from somebody concerned that "American Idol" champ Fantasia Barrino had just ingested a "bottle of aspirin."
The caller -- who was outside of Fantasia's North Carolina home at the time -- informed the 911 operator that Barrino was slowly losing consciousness ... and had been moved into the shower.
The operator instructed the caller to remove Fantasia from the shower.
Cops arrived to the scene a short time later -- and Fantasia was eventually transported to a North Carolina hospital.
Fantasia's rep announced yesterday that the singer was in stable condition.
UPDATE: Fantasia's rep says the singer has been released from the hospital.
