Amanda Bynes She's Mentally Unfit To Stand Trial

Amanda Bynes is mentally unfit to stand trial ... this according to her lawyer in her DUI case ... TMZ has learned.

Amanda was supposed to appear in court today for her DUI arrest in West Hollywood back in April, 2012. Amanda's lawyer, Rich Hutton, told the judge Amanda did not have the mental capacity to understand the nature of the legal proceedings.

The judge apparently had concern ... and transferred the matter to the mental health court. The judge in that court will conduct a hearing to determine Amanda's mental competency.

Meanwhile, Amanda is getting long-term treatment after being placed under a conservatorship.

Dina Lohan Pleads NOT GUILTY To DWI

Dina Lohan just showed up in court in New York a few minutes ago and pleaded not guilty to drunk driving charges ... but she wasn't just allowed to go ... because the judge suspended her license.

Dina showed up with her attorney, Mark Heller -- the same guy Lindsay used -- who argued that Dina didn't have a criminal record ... and the judge released her without bail. Then they faced reporters outside the courthouse.

As we reported ... Dina was stopped for speeding on a Long Island highway earlier this month and cops say she blew a .20 on a breathalyzer. She was ticketed for DWI and speeding.

No license? No problem. Dina was driven away ... in a silver Rolls-Royce.

She'll be back in court Oct. 23.

Michael Douglas' Ex-Wife 'I Stand By Michael... Let Me See My Son!'

Michael Douglas and his ex-wife -- who once battled bitterly -- are in lockstep over what they call the barbaric treatment of their imprisoned son ... TMZ has learned.

Diandra De Morrell Douglas tells TMZ ... their son Cameron has been treated like an animal while in solitary confinement at the Cumberland Federal Prison in Maryland. He's serving 10 years for heroin possession and conspiracy to distribute narcotics. Cameron failed a drug test in prison and was placed in solitary until recently.

As you know ... Michael talked about Cameron after winning an Emmy for "Behind the Candelabra," saying he wants to visit his son badly but isn't allowed.

Diandra tells us when Cameron got out of solitary he couldn't walk in the daylight, because his skin would burn because it couldn't adapt after living in an underground hole for so long. His hair is also falling out.

Diandra says even though Cameron is out of solitary, part of his punishment is no visitors.

We called prison officials ... they were very abrupt with us, and said everything's confidential.

Oscar De La Hoya Alleged Coke Binge Photos Being Shopped

Graphic photos of Oscar De La Hoya on an apparent cocaine binge during a party in Las Vegas are being shopped to the highest bidder -- they show just how scary his addiction had become and possibly explain the curious timing of going to rehab just before his epic fight as a boxing promoter.

We're told the photos were shot at a party in a Vegas hotel room a few weeks before Oscar announced he was back in rehab -- and they appear to show the ex-champ using a rolled up bill to do lines of a white substance off a plate on a table. According to the seller of the pics the substance is cocaine.

Another pic shows De La Hoya leaning back from the table with a grimace on his face.

We've seen the photos -- which are making the rounds to media outlets -- and they offer a possible explanation for why Oscar suddenly checked into rehab just 4 days before what was, arguably, the biggest fight of his career as a boxing promoter ... the Mayweather-Canelo bout.

Sources tell us Oscar was "off the hinges" at the party in the photos, and made the decision to check into rehab shortly after ... realizing just how reckless he'd been that night.

As far as we know, the photos have not yet been purchased.

We're told De La Hoya is aware of the pics. We reached out to his rep ... so far, no word back.

Emmy Winner Peter MacNicol Cory Tribute is Great ... For Drug Awareness

Emmy winner Peter MacNicol is not buying what Jack Klugman's angry son is selling because Peter thinks the tribute to Cory Monteith could actually save lives.

MacNicol -- who won an Emmy for "Ally McBeal" and also starred in classics like "Ghostbusters II" and "Sophie's Choice" -- tells TMZ tonight's tribute to Cory will create enormous drug awareness and possibly reach thousands of teens on a path of destruction.

Peter doesn't think it matters that Cory died without a single Emmy. He says, "If we are going to get into a merit system based on longevity then we are in trouble."

Tell that to Adam Klugman -- who is furious that his 3-time Emmy winning deceased father is barely getting a mention at tonight's ceremony.

But MacNicol says, "The memoriam is not only to honor those who completed a full marathon."

Emmy B.S. Honor a Drug Addict Diss a TV Legend

The suits who run the Emmys had to make a hard choice in deciding which dead actor to honor-- a TV icon who has won multiple Emmys, or a young actor with no Emmys who is now as famous for being a drug addict as a TV star. They chose door number 2.

It's interesting. We've spoken with several people who have won Emmys who are upset with the decision to give a special honor to Cory Monteith but not Jack Klugman, and they're all too scared to speak out ... for fear of some sort of retaliation.

Jack Klugman -- who has won 3 Emmys and starred in TV classics -- "The Odd Couple" and "Quincy M.E." -- has been overlooked and disrespected for special mention during tonight's ceremony. Instead ... Cory Monteith gets the honor. Jack's son thinks it's ridiculous and disrespectful, and he's right.

The Emmys are honoring 5 TV types who died in the last year -- 4 of whom have earned their stripes ... Jonathan Winters, Jean Stapleton, James Gandolfini, Gary David Goldberg -- and then there's Cory.

BTW ... Larry Hagman was also overlooked.

One TV type who has won multiple Emmys but wanted to remain anonymous scoffed and told TMZ, "Awards are like hemorrhoids. Eventually every asshole gets one."

Scott Thorson Persona Non Grata At Emmys

Scott Thorson -- a central character in the HBO movie, "Behind the Candelabra" which has 16 nominations -- is getting anything BUT fabulous treatment, because he's NOT invited to the Emmys.

An Emmy official tells TMZ -- it's simple ... Thorson -- who is played by Emmy nominee Matt Damon ... doesn't have a ticket and the event is sold out.

It's not as if Liberace's former lover -- who's currently in an outpatient facility for drug abuse -- didn't want to go. TMZ obtained a letter dated August 8th and written by Scott's drug counselor, asking a drug court judge to give him a weekend pass to attend the Emmys.

Rather than feeling snubbed, Scott now says it's a good idea that he stay away from Hollywood -- too tempting, and all that.

You may recall ... Scott recently tested positive for meth. He could have gone to jail on a probation violation but the judge showed him mercy and ordered him to continue outpatient drug counseling.

Zac Efron Big Smiles in Coke Capital of the World

Zac Efron chose an interesting place to escape this month ... jetting off to the mountainous cocaine capital of the world ... but he wasn't there for the skiing.

The above photos were snapped on September 11th in Peru, showing Efron smiling with fans. Sources tell TMZ, Zac flew to the South American country for some mountain climbing, as well as to see the ancient Inca ruins of Machu Picchu.

He was also mobbed by screaming girls a week later at an airport in Cuzco, not far from Machu Picchu.

We're not saying he did or did not partake of the local crop while he was there, but it's still ironic.

TMZ broke the story ... Efron entered rehab twice this year for a serious cocaine problem, most recently in April.

Fun fact: according to the White House drug czar (yeah, we got one of those) Peru overtook Colombia as the world's biggest cocaine exporter in 2011. Now that's what we call winning.

SF 49ers Aldon Smith Another DUI Bust Sunday Game In Doubt

6:03 PM PDT: Smith has been released from jail. The 49ers expect Smith to play on Sunday.

San Francisco 49ers linebacker Aldon Smith is on the defensive again -- legally ... he's been busted for DUI and pot possession.

Smith was popped after he crashed his pickup truck around 7 AM. He wasn't hurt ... but the breathalyzer almost was.

The 49ers say they're on top of it. San Francisco plays the Colts on Sunday ... Smith's status for the game is in doubt.

The All Pro linebacker works as a receiver off the field -- receiver of legal charges.

- Arrested in Miami last year for DUI -- later reduced to reckless driving.
- Stabbed during a party at his house in June 2012.
- Named in a lawsuit by a man who claims he was shot at Smith's house during a party.

Smith is currently being held on $5,250 bail.

Ex-Boxing Champ Arrested Cabbie Told Cops ... 'That Drunk F***' Ripped Me Off

Former middleweight boxing champ Kelly Pavlik was arrested today after allegedly stiffing a cab driver in Ohio -- and the police report is HILARIOUS.

The cabbie called cops immediately after Kelly allegedly bailed on his fare early Wednesday morning in Canfield, and when police arrived at the scene ... the cabbie told officers he had been "ripped off by that drunk f*** Kelly Pavlik."

According to the cabbie, he had picked Kelly up at a nearby bar and driven him home -- resulting in a $25 fare -- but Kelly didn't feel like paying, telling him, "F*** you guys. I'm not paying you. Go f*** yourselves." Pavlik then disappeared into his house.

Pavlik was eventually arrested today for failing to show up to court to answer to the cabbie's complaint.

For Pavlik's part, he reportedly said he refused to pay because the cabbie was driving like a lunatic and he feared for his safety.

We mentioned Pavlik is an ex-middleweight champ, right?

Ex-New England Patriots' Star Parents Threaten To Sue For Outing Hooligan Kids

A former star player for the New England Patriots has been threatened with a lawsuit by delusional parents who claim he's ruined the lives of their kids by exposing a drug/alcohol fueled party at his home.

Brian Holloway tells TMZ, "I blew way past furious" when he discovered several hundred teenagers broke into his vacation home outside Albany, NY over Labor Day weekend.

The kids started tweeting and Instagramming madly inside, posting photos of what looked like a scene out of "Animal House."

Holloway went ballistic, created a website -- helpmesave300 -- and started posting pictures of the damage, as well as the tweets from some of the partygoers -- and those tweets ID'd the kids.

Holloway tells TMZ ... he's been told by the Sheriff's Dept. some of the parents are furious because their poor kids have now been exposed. Some bitch that it will hurt their chances of getting into college. Others whine their poor kiddies are being harassed at school. And they actually have the audacity to threaten a lawsuit.

Holloway says there was plenty of evidence of drugs at the party, including crack and meth. And, of course, a river of alcohol.

He says it's gonna cost $20 - $40k to repair the damage.

The parents should try and bottle their chutzpah and sell it. They could make enough to pay for the damage.

Charlie Sheen Story He Partied With Zac TOTAL BS

Charlie Sheen says the media outlet that's reporting he had Zac Efron over for drug-fueled parties is totally making it up.

Sheen tells TMZ ... he hasn't even seen Zac for nearly a year ... specifically when Efron showed up to the set of "Anger Management" 11 months ago. Charlie says he showed up not to see him ... Zac was there because they share the same publicist who happened to be on the set.

The report claims Zac visited the set at least a dozen times. Charlie says it's all made up ... Zac was there that one time only.

As for the claim Zac spent a lot of time partying at Charlie's house and then strongly insinuating they were on cocaine binges ... Charlie says, "ridiculous." Sheen says Zac was at his home a grand total of one time -- nearly 2 years ago for a Super Bowl party. The next time Charlie saw Zac was when he visited the set 11 months ago.

Charlie is also angry the report claims he's on an uncontrollable cocaine binge. He says, "Consider the fact that I have completed 54 episodes of 'Anger Management' in a little more than a year ... something that would ordinarily take more than 3 years to accomplish."

Charlie calls the news outlet "adrift and unsalvageable."

Zac Efron 2 Rehab Stints This Year

Zac Efron has done rehab for cocaine addiction not once this year, but twice, after a major relapse ... TMZ has learned.

Sources familiar with the situation tell TMZ ... Zac has been doing cocaine for more than 2 years -- he was also into Molly. He tried to clean himself up in March by getting professional help. We're told he left California and stayed in a private residence where he received intensive outpatient care for several weeks.

In April he returned to L.A. and began shooting Seth Rogen's film "Neighbors." During the shoot Zac relapsed in a big way. TMZ broke the story ... Zac was not showing up on the set and it was common knowledge he was using again.

Our sources say after the film wrapped up he got a second dose of outpatient care.

As for how Zac plunged into the depths of coke, we're told there are 4 reasons:

-- Zac has significant issues with his parents, who are still trying to control his life and decision-making.

-- Zac is upset about his movie career, which was once white hot but after "High School Musical" he hasn't had real success.

-- Zac has "girl issues" ... although we're told it has nothing to do with his break-up with Vanessa Hudgens. That, our sources say, is ancient history for both.

-- Zac had been hanging around with "a bad group of friends" who introduced him to the world of cocaine. We're told Zac has 86'd most of them from his life in the last few months.

Zac Efron Rehab For Big Coke Problem

Zac Efron did NOT go to rehab for alcohol abuse -- it was far more serious, because multiple sources tell TMZ he had a serious cocaine addiction.

Zac completed his stint in rehab earlier this year. We're told the problem spiraled out of control during the filming of Seth Rogen's movie "Neighbors," which was shot during a narrow time frame beginning in April.

Sources tell us Zac -- who also starred in the movie -- was a no-show on a number of days. As one source connected with the film tells us, "It was common knowledge he was struggling with cocaine."

Three other sources confirm ... Zac's problem was rooted in cocaine, but say he also dabbled in Molly -- a pure form of Ecstasy, and a popular drug in clubs and raves.

We're told ... early this year, Zac and some friends went on a coke rager in a room at the SkyLofts at the MGM Grand in Vegas ... and caused around $50k in damage. No word on who took care of the bill.

We contacted Zac's rep ... she said, "Don't think we'll be making a comment."

Oscar De La Hoya TALKS TO TMZ 'Greatly Appreciated' Mayweather's Apology

Oscar De La Hoya tells TMZ he accepts Floyd Mayweather's apology -- after Mayweather's team posted an Instagram pic mocking Oscar's substance abuse problems.

Oscar -- who recently checked himself into rehab after falling off the wagon -- was out with a group in L.A. yesterday for a coffee run at a Starbucks and appeared to be in good spirits.

On his way out, we asked Oscar about Floyd's Instagram apology -- and the Golden Boy told us, "It was very nice of him. I greatly appreciated it ... so, thank you."

As we previously reported, Mayweather claims he never authorized anyone to publish the original Instagram image -- and insisted he would "never personally disrespect [Oscar] or anyone else who struggles with addiction."
