Francesca Eastwood knows her wham-bam-thank-you-ma'am marriage was a huge mistake ... but she's not blaming her bad decision on alcohol ... 'cause she says she doesn't drink. Ever.

Francesca -- who's already made up her mind to annul her week-old marriage to Jordan Feldstein -- was leaving Mastro's after dinner with friends (sans hubby) when she tried to set the record straight.

Problem is ... we're not really buying what she's selling.

As we previously reported, multiple sources tell us there was a TON of drinking involved when the couple decided to head to a Vegas chapel and tie the knot last weekend.

Plus, would a sober person really swap "I dos" in front an Elvis impersonator???

Miley Cyrus turned 21 years old this weekend ... and she celebrated with booze, celebrities, strippers and a guest appearance from a Dr. Seuss character ... and TMZ has the footage.

Miley -- now legal to drink alcohol in the U.S. -- partied at Beacher's Madhouse at the Roosevelt Hotel in L.A. on Sunday night, after the American Music Awards.

We're told Miley rented out the entire theater for the special birthday/AMAs afterparty.

Kelly Osbourne was one of the guests -- and took a pic with Miley with party hats, birthday cupcakes and a bottle of champagne.

Unclear why The Lorax was there ... but he no longer has to speak for the trees that have no tongues ... Miley's got enough tongue for everyone.

Francesca Eastwood's marriage to Jonah Hill's brother will end faster than you can say Britney Spears and Jason Alexander ... because she's getting the week-long marriage annulled ... TMZ has learned.

Sources close to the regretful couple tell us ... the notion of getting hitched was fueled by alcohol -- and lots of it. Francesca and Jordan Feldstein ended up in a cheesy Vegas wedding chapel and took their vows amidst faux greatness -- an Elvis impersonator.

Francesca had immediate regrets. We shot her the day after the nuptials and she wasn't wearing a wedding ring.

We shot Clint Eastwood a few weeks ago asking for marriage advice and he told our photog to not rush into anything.

Guess Francesca should have listened.

Richie Sambora's hasty departure from Bon Jovi was only temporary ... so claims the guitar player himself, who tells us his shredding days with the band are hardly over.

The 54-year old rock legend was blowing out of L.A.X. when we asked about his rift with the band ... and Sambora told us to keep the faith.

We broke the story ... Sambora pulled out of Bon Jovi's current world tour for "personal issues" -- Richie sources say it was a fight over money, but others in the band claim Richie was hitting the bottle again.

Lil' Scrappy could be on the hook for $2k in damages after a hotel room got TRASHED in an epic afterparty -- but like Shaggy ... Scrap tells TMZ ... it wasn't him.

Scrappy performed last Saturday in McAllen,Texas ... and the show's promoter claims after the gig there was a rager back in the hotel room he booked for Scrappy.

The promoter says cops showed up because of the noise, and found the room in shambles -- drink stains on walls, a hotel phone submerged in water, and the classiest combo ever ... wine and buffalo wing sauce spewed all over the carpet.

Here's the thing ... Scrappy tells us he was only at the party for a few minutes -- so he says the mess ain't his problem.

Lamar Odom admits he fell off the wagon last week ... but he insists he was s**faced drunk, and not cracked out.

Lamar told friends he's seen the video (above) we posted on TMZ, showing him slurring his words in an L.A. bathroom as he rapped with his fellow shirtless friend Jamie Sangouthai.

Lamar says it was a one time deal and NO drugs were involved -- he was specific about 2 drugs he's had problems with -- crack and coke.

Shifty Shellshock's baby mama is asking an L.A. judge to take away his visitation rights ... claiming he's a terrible father who once smoked crack in their kid's bedroom.

The "Celebrity Rehab" star's ex Jasmine Lennard filed suit last week against Shifty -- real name Seth Binzer -- seeking full custody ... and removal of his visitation rights.

Lennard says Seth hasn't seen their son since November 2011 -- nor has he paid child support -- so she wants a judge to make her the sole guardian.

Even worse ... Lennard claims Seth is still addicted to a whole slew of drugs ... and his problem is so out of control he once left a crack pipe in their son's room after freebasing.

Jasmine claims she tried to establish Shifty as the son's legal father last year -- but Binzer acted like it wasn't his kid to get out of paying child support, even though he admitted it was his kid on "Celebrity Rehab."

So now, she wants the judge to officially give her full-time custody ... and she wants him to pay up, stat.

Josh Brolin is trying to live up to his promise ... he's reportedly checked into rehab after telling TMZ he was swearing off booze for good.

Brolin checked into a rehab facility recently in Northern California ... a source told Us Weekly he realized he needed help and is committed to his sobriety.

TMZ broke the stories ... Josh got into into a drunken barfight in Santa Monica earlier this month that was caught on video ... and that same weekend, he tangled with a cab driver after rear-ending the guy.

Lamar Odom's drug problem is only getting worse -- at least that's how it looks in this video, shot this month and obtained by TMZ, showing Lamar incoherently rapping without his shirt on ... talking about drugs, making money without the NBA, and cheating on Khloe Kardashian.

Lamar appears out of it, rapping about making money off his fragrance "Unbreakable," and how he smokes drugs to make "the pain go away." He even drops Kanye's name.

But the crazy part -- Lamar raps, "And when Khloe's out of town / I still be on the DL." His friend then follows up, "You know what it is / We the QU [Queens] pimps / Ask any of these shorties / We ran through their cribs."

Translation: when Khloe's away, Lamar will play.

As we reported, Lamar's currently training hard in Rhode Island, trying to get his ass back in shape for the NBA -- but drugs are still obviously a big part of his life.

Lamar Odom was the life of the party last night in Rhode Island -- buying shots for an entire bar, including a bunch of hot college chicks -- and we got a pic of Lamar with his brand new friends.

Sources tell TMZ, Lamar and a couple buddies dropped by Charlie O's in Narragansett -- where one of Lamar's signed jerseys hangs tall on the wall -- and some sorority girls asked him for a picture.

We're told Lamar declined, saying he couldn't take pics with anyone, but then bought the entire bar shots of Hennessy ... an interesting move for someone who's trying to stay sober.

On their way out, around 12:30AM, we're told the girls asked Lamar one more time for a picture ... and this time he obliged (above). According to sources, Lamar bought the shots and was extremely talkative all night ... but he did NOT drink a drop himself.

Dina Lohan has something going on in her head, and the judge in her DUI case wants to know the contents ... because he just ordered a full psych evaluation.

Dina was in court this AM for her DWI case. Her lawyer, Mark Heller, claims she's alcohol free but the judge isn't necessarily buyin' what he's sellin'.

So now Dina has to get her head shrunk by a court-appointed shrink.

Lohan pled not guilty to DWI in Sept. ... after blowing a .20. Heller blamed Dina's legal predicament on the paparazzi ... claiming Dina is stressed out by the mob of photogs that follow her ... and that's what caused her to flee in a drunken state.

The judge did not impose a sentence today -- he'll wait for the psych report -- but he did say he's considering a stiff penalty -- revoking her driving privileges for 12 months ... and 100 hours of community service.

THAR SHE BLOWS!!! Erin Brockovich is officially in the clear after her BUI arrest this summer -- that's BOATING under the influence -- because she's finally paid up with the court.

TMZ broke the story, Erin was arrested on Nevada's Lake Mead in June ... after cops found her drunkenly piloting her boat, while allegedly slapping her husband and tossing a cell phone into the water.

Erin pled no contest to BUI, and was ordered to complete 25 hours of community service, a mandatory Boater Safety School, and pay a $750 fine ... all of which she did.

Victory ... ex-Disney star Jake T. Austin has escaped DUI charges stemming from his arrest last month ... but he's not completely off the hook.

Austin was popped for drunk driving in October just blocks from his devastating 4-car crash this week.

Austin was initially charged with two counts of DUI, but his lawyer, Jay Jaffe, got the two charges dismissed in exchange for a measly speeding charge ... to which Austin pled no contest.

Austin was subsequently sentenced to 24 months probation ... a pretty steep punishment for speeding, but at least he won't have a DUI on his record. Austin is also prohibited from driving with even a teensy-weensy amount of alcohol in his system.

And get this ... the judge didn't utter a peep about the most recent accident.

Amanda Bynes is mentally capable of understanding the nature of the criminal charges she faces, and as a result the road is now clear for her to stand trial for DUI.

Amanda's case was in Mental Health Court this AM, and the judge read the court-ordered medical evaluation of the actress, and determined she is now competent to face the DUI charges.

Amanda's lawyer, Rich Hutton, did not object to the findings so the criminal case -- which was put on hold -- will now go forward.

Sources say the ruling will have NO impact on her conservatorship. Fact is ... even though Amanda is capable of understanding the nature of legal proceedings, she is nowhere close to being able to care for herself.

As for the DUI case ... no way will it go before a jury. It has plea bargain written all over it.

As we first reported ... Amanda has been diagnosed with Schizophrenia and bipolar disorder.

Crap is about to hit the fan in CeeLo Green's felony drug case -- at least according to the L.A. County D.A., which just hinted it's on the brink of exposing the FULL story surrounding the singer's ecstasy charge, a story that involves allegations of rape.

CeeLo was back in court today -- when the judge set a date for a preliminary hearing in January -- and prosecutors said they expected the prelim hearing to last several hours.

The reason ... prosecutors said there's a lot more to the drug charge than meets the eye, insinuating they were preparing to delve into the nitty-gritty of the case ... i.e. the sexual assault aspect.

You'll recall, this whole thing started last year ... when a woman accused CeeLo of spiking her drink with ecstasy at a Downtown L.A. sushi joint. She claimed the next thing she remembered was waking up in a bed naked with CeeLo in the room.

CeeLo was eventually cleared of sexual assault due to insufficient evidence, but got hit with a felony drug charge instead.

But the funniest part of today's hearing -- CeeLo spent the entire time standing behind his lawyer Blair Berk, who was blocking him from the cameras. As we reported, Blair objected to cams in the courtroom because she felt they put CeeLo in the spotlight too much.

Overall, CeeLo didn't appear concerned today though -- he shrugged the whole thing off on his way out of court.

Ex-Disney star Jake T. Austin WAS the driver of the car that crashed into 3 other vehicles early Tuesday morning -- but because of some swift and clever legal gymnastics by his lawyer, Jake may actually avoid prosecution ... TMZ has learned.

Here's the way it went down -- sources intimately familiar with the situation tell TMZ, 18-year-old Jake and a friend were driving in Studio City around 3AM when he crashed into the 3 cars.

Witnesses say Jake tossed a Ciroc vodka bottle out of the car, but before cops arrived at the scene, we're told Jake ordered an Uber (Town Car service) ... and he and his friend high-tailed it out.

Cops suspect drinking was involved, but there's no way Jake could be prosecuted for drunk driving because police never located him. And, we're told, Jake denies he had been drinking.

But drinking aside, Austin is still in trouble for leaving the scene of an accident without providing identifying information ... which constitutes a hit-and-run. But Jake's lawyer pulled off some legal acrobatics that could get Jake off the hook.

We're told the lawyer called cops at 4am and told them Jake was the owner of the car. Cleverly, the lawyer did NOT disclose the fact that Jake was the driver ... so as not to violate the attorney-client privilege, especially important because leaving the scene is a crime.

And here's where it gets really good -- we're told Jake has an iron-clad excuse for leaving the scene: he and his passenger were injured and needed immediate medical attention. In other words, they didn't have time to leave a note.

We're told Jake had an injury to his mouth, and went directly to the ER and received stitches.

And the coup de grace, we're told Jake's lawyer has made it clear ... the victims will be fully compensated ... so there's really no need to prosecute.

The legal maneuvering might have saved the lawyer a huge headache on multiple fronts -- he's also repping Jake after the kid's DUI arrest last month.
