Nintendo Sued Donkey Kong Costume Not a Barrel of Laughs

Dressing up as Donkey Kong was no monkey business for a guy who claims the poorly designed costume left him injured.

According to the lawsuit, obtained by TMZ, Nintendo of America hired Michael Oconitrillo to play the famous gorilla at a mall in Culver City, CA. He says even though the Kong suit was "poorly ventilated and unreasonably and dangerously hot" ... he had strict orders to keep it on.

It may sound like a typical Halloween, but Michael says he suffered permanent damage, as well as mental and emotional distress -- though he doesn't list any specific injuries.

Nintendo doesn't seem to be sweating the suit -- a rep says, "We have nothing to announce on this topic."

S.I. Swimsuit Model Concussion In Post Indy 500 Wreck

Sports Illustrated model Tanya Mityushina and Carls Jr.hottie Kara Del Toro got wrecked on their way home from the Indy 500 ... TMZ has learned.

Indianapolis cops tell TMZ ... Tanya and Kara were in an SUV on Sunday after leaving the race when a Volkswagen Jetta t-boned their ride.

Two other passengers in the SUV were taken to the hospital by an ambulance ... while Kara and Tanya went back to their hotel -- but once there, Tanya complained of a headache.

Sources close to the models tell us they both went to the hospital where doctors told Tanya she had suffered a concussion. Kara was okay.

Tanya's out of the hospital, but still experiencing head and neck pain.

Marc Anthony makes a crummy ship captain -- so says a former employee who claims he lost a finger working on the singer's boat.

Jean-Pierre Perret says in a new lawsuit he was a member of the crew back in March 2015 on Anthony's yacht "Seas The Day." Perret says he was helping repair the boat's busted anchor when something went terribly wrong ... and a digit on his right hand went overboard.

Perret says it was Marc's responsibility to make sure the boat was shipshape. He says he was never warned the anchor could be so dangerous.

Ship happens.

Amber Heard Claims Johnny's Violence Triggered by Drug, Alcohol Abuse

Amber Heard claims in legal docs ... during their entire relationship Johnny Depp was verbally and physically abusive, and she lays part of the blame on drug and alcohol abuse.

TMZ has obtained the legal docs Amber filed to support her claim that Johnny smashed an iPhone against her face Saturday night, which she claims triggered her move to file for divorce. As we reported, cops came but she declined to file a report.

Amber claims, before the alleged incident over the weekend -- during her birthday party at home last month ... Johnny showed up "inebriated and high." She says after the guests left, they argued and he threw a magnum-sized bottle of champagne at the wall and a wine glass at her. She says he grabbed her by the shoulders and pushed her onto the bed. She also says he grabbed her by the hair and shoved her to the floor.

Amber says she didn't see Johnny again for a month, until Saturday night. She says he was drunk and high again and they were talking about his mom's passing the day before. She says he "suddenly began obsessing" about something, got mad, grabbed the phone, "wound up his arm like a baseball pitcher and threw the cell phone at me striking my cheek and eye."

She claims he also pulled her hair and struck her, then she says he grabbed a magnum-sized bottle of wine, chugged some and then used the bottle to break objects around the house.

Cris 'Cyborg' Justino Visits Sick Kids In Hospital Donates Cyborg Blood

Cris 'Cyborg' Justino is usually the one drawing blood ... but the UFC star made an exception last week ... hitting up a Brazilian hospital to donate some of her own.

TMZ Sports has learned Cyborg visited Our Lady Of Grace Hospital in Curitiba (her hometown) ... and spent time hanging out with pediatric cancer patients and children with autism.

A spokesperson for the hospital says Justino "chatted and took pictures with our patients." She also "donated a pair of autographed gloves" ... and gave a pint of blood at the blood bank.

"The visit went great and our patients were really happy with the surprise."

Nyquist Pulled from Belmont ... Medical Complications

Nyquist -- the winner of the Kentucky Derby -- has been pulled from the Belmont Stakes ... after complications with his health, TMZ Sports has learned.

We spoke with Nyquist's assistant trainer, Jack Sisterson, who tells us ... Nyquist has an elevated white blood cell count, which can sometimes indicate an infection.

Nyquist was already battling a fever -- but Sisterson hoped Nyquist would overcome it in time for the Belmont Stakes next month.

Now, with this new complication, Sisterson says it's better to play it safe -- and not push Nyquist too hard.

"We just want to do right by Nyquist right now. We want to make sure he'll be back to 100% in the next few days."

As for his future -- "He's definitely going to race again this summer."

Paralyzed U.S. Olympian 'Getting Better Every Day' ... Moving Arm!

The former Team USA Olympic high jumper who was paralyzed in a training accident in California last month says he's making HUGE progress -- and can now move his arm!!!

As we previously reported, 2-time Olympic high jumper Jamie Nieto fell on his head while training Olympic hopefuls last month ... and suffered major damage to his spinal cord.

But in a new video shot from his hospital bed, the 39-year-old said he's "getting better every day. Just feeling a lot better."

Nieto -- who underwent emergency surgery following the life-threatening accident -- is also trying to walk again ... though it might take some time.

"It's been a tough experience, not easy. You know, learning how to walk again, move my hands and getting my feet moving again."

"But I'm getting stronger, so it's getting better. It's a process. I thank everybody out there for all their love and support."

Nieto's girlfriend has said he's a fighter who hopes to be jumping again as soon as possible.

Rick Fox doesn't think Draymond Green meant to go all Bruce Lee on Steven Adams' testicles ... saying ball kicking is one of the unwritten rules of the NBA you just don't break.

Fox was at LAX when we asked him about the kick ... which might end up costing Dray a game in the playoffs if the NBA thinks he did it on purpose ... so the question is ... did he?

Check out the clip -- Fox says it didn't look intentional to him ... adding he doubts Dray meant to do it because there's a strict no groin kick code in the NBA.

NFL's Shaq Thompson Blamed Cell Phone In Head-On Crash ... Cops Say

Carolina Panthers linebacker Shaq Thompson told police he was reaching for a dropped cell phone when he lost control of his car and smashed into another vehicle head-on early Sunday morning ... cops say.

Shaq -- the team's 2015 1st round draft pick -- was behind the wheel of a 2016 Chevy SUV which slammed into a 2004 Lexus SUV driven by former Duke QB Anthony Boone at 7:45 AM.

When cops arrived to the crash scene near Shaq's Charlotte-area home, the NFL player was given a breathalyzer -- which turned up traces of alcohol ... but cops say it was well BELOW the legal limit.

"He had some residual left over from the night before, but nothing where it was impairing or anything like that,” Sgt. Ben Miller of the State Highway’s Union County told the Charlotte Observer.

TMZ Sports also spoke with law enforcement officials who say Shaq said he had been playing music off his cell phone but dropped it ... and that's when he made the ill-fated decision to reach down and pick it up.

Officials tell us Boone was not wearing a seat belt -- and was hospitalized for a broken pelvis and broken ribs.

Shaq told police he was not seriously injured. He was not arrested -- but was cited for crossing the center lane.

LSU's Tiger Beloved Mascot Diagnosed with Terminal Cancer

LSU's beloved Siberian-Bengal tiger mascot, Mike VI, has been diagnosed with an extremely rare form of cancer ... and vets believe he only has 2 years to live ... school officials announced.

The 10-year-old tiger has been receiving treatment from a team of specialists ever since his caretakers noticed a tumor on his face earlier this month.

Officials say Mike has spindle cell sarcoma -- which is unlikely to spread to other areas of his body ... but it's a fatal condition nonetheless.

LSU says Mike is receiving the best care possible -- and they've already drawn up a battle plan to make sure Mike lives out his final days as comfortably as possible. Without treatment, officials say Mike would only have 1 to 2 months to live.

Mike has been the official live mascot of LSU since 2007 -- and famously debuted at the legendary LSU vs Florida game ... when the Tigers defeated Tim Tebow's Gators.

Nyquist 'Plan Is to Run Belmont' ... Will Recover From Fever

Nyquist -- the winner of the Kentucky Derby -- is still battling a fever ... but his team believes he'll beat the illness and WILL compete at the Belmont Stakes next month.

We spoke with Nyquist's assistant trainer, Jack Sisterson, who tells us the champion thoroughbred still has an elevated temperature, as he did following the Preakness, but the team believes it's not that serious.

"Nyquist is going to be fine," Sisterson tells us ... "The plan is to run in the Belmont [on June 11th]."

"These fevers happen sometimes, but not often."

Sisterson says the team will obviously make sure Nyquist gets the best care -- and "will make sure he's 100%" before the race.

MMA's Wanderlei Silva Stitches, Scars, Broken Helmet ... After Brazil Hit & Run

MMA legend Wanderlei Silva is finally revealing the damage from his frightening hit-and-run in Brazil earlier this month -- showing off the gruesome scar on his leg and the cracked helmet that saved his life.

As we previously reported, Silva was hit by a car as he was biking home from a training session on May 11th -- in a crash that was so violent, Silva says he "could have died" if not for his helmet.

You can see the damage in the video ... along with stitches on his left leg, where doctors performed surgery to repair an injury suffered in the crash.

Silva has said the accident has made him rethink his life and grow as a person.

'RHONY' Star Carole Radziwill Boyfriend Survives Plane Crash

'Real Housewives of NY' star Carole Radziwill's boyfriend is recovering after he was lucky enough to walk away from a small plane crash.

Adam Kenworthy and his 65-year-old dad -- who was flying the plane -- made a crash landing Thursday in Iowa. Law enforcement tells TMZ ... Adam's father reported engine problems shortly before the plane went down on a hillside.

Carole tells TMZ Adam was released from the hospital a few hours after the crash, and his mom says he suffered a few abrasions but will be fine.

Adam posted a video to his Instagram Thursday from what we're guessing is the same plane that went down later in the day.

Rapper Curren$y Lil Wayne's Lean Didn't Leave Me For Dead!!!

Curren$y did NOT nearly die on Lil Wayne's tour bus after mistakenly downing Weezy's strong sizzurp concoction -- but he did sleep for 18 hours.

Curren$y tells TMZ he was just joking around with rapper N.O.R.E and DJ EFN on their podcast this week when he recounted the "near-death experience." He told them he thought the beverage was just purple Hawaiian Punch, and downed it during a tour stop in New Orleans.

The rapper says he doesn't mess with the stuff, so it hit him hard ... and he woke up 18 hours later in Miami. As for his claim Wayne left him on the bus because they thought he was going to die -- he says that's 100% jokes, and if it were true he and Wayne wouldn't still be friends.

Curren$y, a former Young Money artist, says they're like brothers.

Weezy OD'd on lean in 2013, about the time Curren$y says this all went down, and was spotted earlier this year with his signature cup back in his hands.

Waffle House Customer I'm A Huge Juvenile Fan But I'll Probably Sue

The customer Juvenile beat to a pulp at a South Carolina Waffle House says he's such a big fan he won't press charges ... suing is a whole other thing.

The customer -- who did not want to be ID'd -- tells us he's hired an attorney to give the rapper the 'ol ultimatum ... pay up or else. He says aside from facial cuts, he suffered kidney and rib injuries.

TMZ broke the story ... Juvie and his crew jumped the customer, who saw the rapper enter the eatery and cracked, "Here come all the hos."
