Alice Glass is firing back at her former Crystal Castles bandmate, Ethan Kath, after he sued her for defamation, and she makes it clear ... she'll swear under oath her rape allegations are true.

Alice filed a declaration in court in response to the lawsuit Ethan filed against her last month, after she publicly claimed he'd raped and abused her.

In the docs, obtained by TMZ, Alice doubles down on her claims that Ethan had first raped her when she was around 15, and continued to sexually assault, abuse, and isolate her while they dated through the 2000s and early 2010s.

She says she learned after first posting her allegations in October that Ethan had allegedly harmed other women as well, adding she and two other women filed criminal complaints against him in November. She says the detective on the case confirmed Ethan's under investigation.

10:55 AM PT -- A rep for Cardi tells TMZ, the "sex video" isn't real ... it was all a joke. We're told they weren't actually banging, and were fully clothed in the video.

Cardi B doesn't seem to care about cheating rumors going around about her fiance Offset, because she just posted what REALLY looks like a live sex video of the two of them.

A video of what appears to be Cardi and Offset doing it doggy style -- which reportedly 1st aired on Cardi's Instagram Live -- has surfaced online. In the clip, Cardi says, "I don't got no more in me left. You gotta give a whole hour" ... as Offset's back there thrusting away.

Unclear if what they're doing is real or not -- you can't see the bottom half here, but it sure looks like they're banging. That seems to be what they want people to think, anyway.

Offset made some headlines this weekend after video allegedly belonging to him leaked, showing off a naked woman that many people said wasn't Cardi. She appeared to laugh that off though, saying she was still banging him.

A Harvey Weinstein project's the last thing most people want to go near these days, but one man fully embraced it ... Screech!!!

Dustin Diamond's getting back into acting in a debaucherous music video filled with sex, drugs, rock and roll ... and murder. He plays Weinstein in rock band TENLo's vid for their song, "Kill All the Things," and, as you'll see ... it doesn't end well for him.

We're told the vid was shot this summer in Milwaukee after band members Joey Zak and TomE LaBrosse reached out to Dustin and he dug it. However, the Weinstein angle was edited in recently ... for obvious reasons.

Actress Kelly Cunningham plays the vengeful nun, and the bandmates play the bellhop and bartender.

Harvey Weinstein will likely not be charged with a crime in L.A. ... TMZ has learned.

Law enforcement sources with knowledge of the multiple Weinstein investigations tell TMZ, detectives from LAPD's Sexual Assault Section of the Robbery-Homicide Division are trying hard to gather evidence in the various cases, but they are coming up short on all of them.

We're told there are numerous problems with the cases. As one source put it, "It's all one-on-one. The woman says she was sexually assaulted or raped and he denies it. Even if the woman told others after the fact, it's just not enough."

Our sources say the fact that most of the cases are extremely old makes it an almost insurmountable uphill climb. They say there doesn't have to be a smoking gun. As one source said, "If there was video of a woman leaving Weinstein's hotel room crying, that would be powerful, but most of the hotels back then didn't have video and if they did, it was erased a long time ago."

They also say, so far they don't have medical evidence -- such as vaginal tearing -- in a medical report that could help prosecutors prove their case.

The Sexual Assault Section is working closely with the L.A. County D.A. and we're told the D.A. has repeatedly said they didn't have enough evidence and needed more, but so far cops are coming up short.

What's more ... our law enforcement sources say it's looking to them like the D.A. will reject these cases outright, meaning they won't make it to the L.A. City Attorney for misdemeanor prosecution. We broke the story, the City Attorney desperately wants a case to prosecute to make a point.

Mind you ... other police departments, including Beverly Hills, New York City and London are also investigating Weinstein and we do not know the likelihood of prosecution in those cases.

And we're told ... most of the other cases the Sexual Assault Section is investigating have the same problems as the Weinstein cases. The one exception -- if the victims are minors. Our sources say in those cases, even if it's just the minor's word against the alleged perpetrator, they would go forward if the minor is credible.

Darryl Strawberry says his sex addiction was so bad during his MLB days ... he would take chicks into the clubhouse and nail 'em between innings.

The ex-NY Mets star opened up to Dr. Oz (the full interview airs Thursday) and said he used to get away with it because teammates would cover for him when he would go MIA.

"It was pretty crazy," Strawberry says ... "I would go between innings, and stuff like that and run back and have a little party going on."

Strawberry has since sought treatment for his addictions and says he's a changed man -- noting that his old behavior is "not good for anyone."

Sylvester Stallone is ready to demand police investigate a woman who, he's been told, filed a report claiming he raped her 27 years ago ... TMZ has learned.

Stallone's attorney, Marty Singer, tells us he believes the woman recently filed a false police report with Santa Monica PD. Singer says this all started more than a month ago when a media outlet, not TMZ, informed him the woman was alleging Stallone raped her in 1990 in his Santa Monica office.

Stallone denies the allegation. He admits he had spent 3 days with her during a 1987 movie shoot in Israel. He was single, she was not a minor and he says there was never a rape. He also denies he saw her at all in 1990.

Sources with direct knowledge tell us the media outlet that contacted Singer refused to publish the woman's story due to a lack of corroborating evidence, and because, at that time, she had not filed a police report -- not in 1990, and not at any time since then.

We're told the woman finally did file a police report with Santa Monica PD in mid-November. However, the media outlet still did not publish. Our sources say it appears she filed the report in an effort to get the story out to the public, but failed.

However, Singer says a different reporter called him Tuesday and stated, definitively, that the woman -- who sources say was once married to a convicted killer-for-hire -- had now filed a police report. Singer says he contacted Santa Monica PD late Tuesday night to confirm the report, but the investigations division was closed.

Cardinal Bernard Law -- the disgraced Boston archbishop at the helm during the Catholic church's sex abuse scandal, and prominently portrayed in the Oscar-winning movie "Spotlight" -- is dead.

The Vatican made a one-sentence announcement, "Cardinal Bernard Law died early this morning after a long illness." Law, who died in Rome Wednesday, was forced to resign as archbishop in 2002 after the Boston Globe's investigative reporting revealed he covered up for pedophile priests.

Law, who was never criminally prosecuted, was promoted to archbishop in 1984 by Pope John Paul II. That same year, a bishop brought forward concerns about a priest molesting kids. Law re-assigned that priest to another parish where the molestation continued.

The scandal and the Globe's investigation was the plot of "Spotlight."

Law was 86.

Porn's version of the Oscars announced Monday they've nailed down Wayne as the musical guest for the January event. It's going down at The Joint (naturally) inside the Hard Rock Hotel & Casino in Vegas.

12/16 7:30 PM PT -- Simmons has responded to the allegations, saying he intends to defend himself. He adds ... "For the record, I did not assault the person making these accusations in the manner alleged in the complaint or harm her in any way."

Gene Simmons is being sued for allegedly groping a woman during the opening of a restaurant last month.

The lawsuit -- filed by a Jane Doe -- claims she interviewed Simmons last month at the opening of a Rock & Brews in San Bernardino. The accuser claims during the interview, Gene reached over, grabbed her hand and forcibly placed it on his knee. She says it made her feel uncomfortable, but continued the interview.

The docs claim Gene grabbed the reporter's hand, commented on how soft it was and creepily suggested she must use lotion ... things got more weird when Simmons reached over and allegedly flicked the interviewer's throat.

The defendant says following that action, she did her best to stop the interview, but Gene tried to keep going. Finally, she claims he touched her ass when everyone posed for a group photo.

Taylor Swift's not quite the hero TIME magazine made her out to be, because she didn't want to take the stand in the "butt grabbing" trial ... she was forced to do so, according to David Mueller.

Mueller, the accused butt grabber, thinks Taylor didn't deserve the Person of the Year cover because he's the one who sued her for getting him fired. Plus, he points out Taylor fought at every turn to keep the case out of the public eye -- and only showed up to testify when the judge ordered it.

He thinks TIME was just trying to sell magazines, and overreached to connect Taylor to the nationwide flood of sexual assault victims coming forward.

Ronan Farrow's whistleblowing article on Harvey Weinstein opened the floodgates of sexual harassment allegations in and out of Hollywood -- and he says it's exactly what America needed.

We got Ronan catching a flight out of LAX Thursday and asked him about alleged sexual abusers starting to fight back. As we reported, PBS host Tavis Smiley believes he was railroaded by a "sloppy" investigation.

Ronan says even if some of the accused are pissed off, it's worth it because victims have had to be silent for decades -- and conversations about sexual misconduct are long overdue.

Warren Sapp's got another problem in his sexual misconduct case ... because his version about why he handed out vibrators to women at the NFL Network ain't exactly adding up.

Sapp went on the radio and claimed he has a friend who makes novelty vibrators that look like lipstick -- and when he shared pictures of the devices with the makeup team, they asked him to bring some in ... and he obliged.

Sapp went to social media Wednesday and posted a photo of the vibrator in question -- called the Womanizer 2Go ... made by a company called Womanizer.

Problem is ... we're told Womanizer has no relationship with Sapp and never has. One source says the company is confused as to why Sapp would make those claims.

Morgan Spurlock is coming clean about his history ... regarding sexual harassment, sexual abuse, and even an accusation of rape.

The famed documentary filmmaker posted a shocking list of confessions Wednesday, including a detailed description of a sexual encounter with a woman he had in college that led to him being accused of rape.

Spurlock also admits to paying off a former female assistant who he often called "hot pants" or "sex pants" about 8 years ago to settle a sexual harassment claim and keep it quiet.

The "Super Size Me" star says he's not been an innocent bystander amid the wave of sexual misconduct allegations in Hollywood and beyond, and has wondered ... "When will they come for me?"

He adds ... "If I'm going to truly represent myself as someone who has built a career on finding the truth, then it's time for me to be truthful as well."

Spurlock drops another bombshell too -- he says he was sexually abused as a boy -- before vowing to be part of the solution from now on.

Tavis Smiley is the next big star under fire for alleged sexual misconduct ... PBS has suspended the talk show host after an investigation uncovered "credible allegations."

Smiley is a veteran talk show host who focuses on politics and current events -- he has a star on the Hollywood Walk of Fame.

Smiley was allegedly banging multiple lower-level staffers who believed their employment status was dependent on their sexual relationship with them, according to Variety.

Now, PBS is taking action ... "Effective today, PBS has indefinitely suspended distribution of ‘Tavis Smiley," the network said in a statement.

"PBS engaged an outside law firm to conduct an investigation immediately after learning of troubling allegations regarding Mr. Smiley. This investigation included interviews with witnesses as well as with Mr. Smiley."

"The inquiry uncovered multiple, credible allegations of conduct that is inconsistent with the values and standards of PBS, and the totality of this information led to today’s decision."
