Jussie Smollett's claim one of the Osundairo bros is homophobic -- and that motivated him to pull off the alleged attack -- is getting shot down in court by the brother himself, who brought Pride pics as evidence.

Ola Osundairo -- one of the prosecution's star witnesses, along with his brother Abel -- testified Thursday in Chicago, saying he respects the gay community and had worked as a bouncer in a gay club called Boystown.

He stopped short of dropping the old "I have gay friends" trope but did say he'd been knee-deep in Pride celebrations. The jury was shown a 2015 photo of one such time -- Ola said he was "handing out condoms and flexing" while dressed as a Trojan warrior.

Get it? Condoms? Trojan? Anyway, there are no cameras in court, so we haven't actually seen the pic in question.

As for Abel Osundairo ... he took the stand and got grilled by Smollett's attorney about his alleged sexual relationship with the "Empire" star. Shay Allen asked when they started dating, and Abel replied they never did. He also denied there being any sexual tension between them, and he only thought of Jussie as a friend.

For anyone else on the sidelines not willing to chip in at all, he's got a message for them too.

Dave Chappelle's first Q&A over his transgender controversy did not go well -- but it was honest ... because kids from his alma mater told him exactly how they felt.

According to Politico ... Dave paid a visit to his old high school -- the Duke Ellington School of the Arts in D.C. -- shortly before Thanksgiving this week and encouraged students who were angry with him to get on the mic and air their grievances during an assembly.

Interestingly, an event at this same school had previously been postponed ... over what many perceived was the backlash Dave was facing. Seems they came to an agreement.

Anyway ... things immediately got off to a rough start, as the packed auditorium of about 580 teens half cheered and half booed for the guy -- and when he exclusively invited the naysayers to speak, the discussion went downhill fast ... and got pretty contentious.

Politico reports one student stepped up and called him a "bigot," adding ... "I'm 16 and I think you're childish, you handled it like a child." Dave responded, "My friend, with all due respect, I don't believe you could make one of the decisions I have to make on a given day."

In response to another Q, Dave said ... "I'm better than every instrumentalist, artist, no matter what art you do in this school, right now, I'm better than all of you. I'm sure that will change. I'm sure you'll be household names soon." Apparently, that pissed off the kids more.

When one student yelled out, "Your comedy kills!" ... Dave reportedly said, "N****** are killed every day." Story goes, the rest of the convo went exactly like that -- no apology surfaced.

There was also a camera crew in tow ... and some of the students told Politico after the fact that they felt intimidated and that there was a power imbalance Dave was clearly aware of and exploiting. Funny enough, there were some students who were sour about not being able to express support for Dave -- remember, he only let those who were pissed speak.

Toward the end of the Q&A, Dave reportedly softened his tone ... when he disavowed threats some of the students have purportedly received for their outcry over Chappelle. He even gave each of them tickets to his new documentary film, but it's unclear if this squashed anything.

His rep told Politico ... "He said these kids deserve an F for forgiveness." She added, "Give them some space to grow. They are going to say things that are immature."

"I WOULD LIKE TO SUGGEST..."

Joy Behar has some advice for those struggling to share both their sexual orientation and political beliefs this year at Thanksgiving with the family ... just come out!

During Wednesday's episode of "The View" Whoopi Goldberg posed the question of the best way to avoid talking politics during this year's celebrations. While the cast believes politics might not be as controversial as year's before ... Behar had some other advice.

The host said, "Come out, just come out ... see what happens."

Not exactly sure what she meant, a confused Whoopi asked, "Come out ... of the door?"

But, Behar didn't mince words, saying, "Come out gay. Be yourself ... life is short." She continues, "Don't let anybody tell you what you have to be in this life."

While Joy's intentions were clearly positive, some certainly felt she missed just how difficult it can be for people to come out ... especially in non-accepting families.

One Twitter user wrote, "hey Joy I have a transgender son and am so proud of him however most parents are not like me some will resort to violence just because their child is gay so please don't tell people to come out just to see what happens that can be disastrous."

Another said, "It's incredibly dangerous to be telling people to come out to their families just to 'see what happens.' Many of our fellow community members face real threats to their lives if they come out to family."

Eventually, "The View" audience gave Joy a round of applause, though the moment was still somewhat awkward.

Kevin Spacey cost the creative forces behind Netflix's hit 'House of Cards' a crap ton of money due to his alleged sexual misconduct -- and now, the guy's been ordered to pony up millions over it.

The disgraced actor lost an arbitration case he's been involved in for the past few years now with a couple of companies called MRC II and Knight Takes King Productions -- a distribution company and production company, respectively.

The two companies claimed they were doing the heavy lifting on 'HOC,' especially for the 6th season they were producing for the streaming giant ... with Kevin, obviously, being a huge part of it.

An arbitrator ruled last year that Spacey's alleged behavior did, in fact, cause MRC and Knight substantial harm by essentially torpedoing the final season ... but KS had appealed that decision, only to lose again earlier this month.

DON'T RUSH TO JUDGMENT

Now, the companies are asking the court to confirm the arbitration award ... which would leave Spacey and his loan-out and producing companies on the hook for about $31 million. The lion's share of the award is for compensatory damages -- more than $29.5 mil -- and the remaining million and change cover attorneys' fees and costs.

MRC and KTKP argued that there was an internal investigation of Spacey's behavior -- which included claims he'd sexually harassed/assaulted production members working on 'House of Cards' -- and after doing a deep dive, they say they found many of those accusations to be true and terminated his contract. They say his conduct caused them to suffer substantial losses ... which led to the litigation.

BACK IN ACTION

Spacey has avoided criminal liability thus far ... but on the civil side of things, this is a big ding. He's remained mostly low-key since the allegations surfaced -- although, he is getting back to work slowly but surely.

Kevin Hart says standup comedy should change in the wake of all the buzz about Dave Chappelle's alleged transphobia -- but he insists most of the critics don't have a clue who Dave really is.

We got Kevin out Friday morning in NYC, and asked if he planned to change anything in his standup routines due to the backlash against Dave's "The Closer" -- and it sounds like he will. Kev said, "We all have to adjust. We all gotta make sure we're operating and managing in a respectful manner."

WALKING OUT

Watch how KH says it, because it comes off like a criticism of his pal Dave. As you know, Chappelle's been adamant his special was not transphobic, and he has nothing for which to apologize ... despite protests and a walkout staged by Netflix employees.

However, before ya start thinking there's a rift ... Kevin also came out swinging for Chappelle, telling us Dave is a very loving guy and "the narrative that's being attached [to Dave] doesn't necessarily have to be true without knowing the individual."

He also shouted out Chappelle directly, and sent him some love.

The takeaway here ... Kevin isn't gonna be as edgy or controversial as Dave the comedian -- never has been, really -- but he's still a ride or die for Dave as a person.

Colton Underwood I'm $elling My Colorado Crib

Colton Underwood is moving on from his bachelor pad ... we've learned he's selling his place in Colorado.

The former 'Bachelor' recently listed the 4-bedroom home for $1.35 million ... and we're told he accepted an offer from an interested buyer just 5 days after the home hit the market, though the deal hasn't closed yet.

It's a quick turnaround for Colton ... he only just bought the home back in December 2020.

The place is laid out with a ranch floorplan, complete with a gourmet kitchen, sprawling lawn and 2.5 car garage.

The primary bedroom is on the main floor, and it comes with an oversized closet with access to the laundry room!

The place, which is about 25 miles south of Denver, is decked out with a game room, media room and a home gym, outfitted with high-end fitness equipment.

The backyard is tricked out with an oversized gas grill built into the covered porch, plus a hot tub and a gas firepit.

We don't know where Colton is heading ... whether he's staying in Colorado or not.

IGNORING THE REAL MESSAGE

One of Dave Chappelle's best pals says most people don't understand "The Closer" or the controversy surrounding it -- nor do they get what people who are defending him really mean.

Check out what Donnell Rawlings had to say Tuesday at LAX -- we asked about the fact Jay-Z -- and others, including former Prez Barack Obama -- recently seemed to be backing Dave's special and/or vouching for his character.

DR believes folks are misconstruing all this "backing," because, as he put it, most celebs speaking out on behalf of Dave are not necessarily cosigning on his POV -- but, rather sticking up for freedom of speech and artists' rights.

At least that's what Donnell took from Jay saying "The Closer" made him cringe at times, but that's what "great art" makes you do sometimes.

It's a pretty interesting point he's making -- and he adds that despite all the controversy Dave is in great spirits right now. Donnell goes so far as to call it the "happiest point" of Chappelle's life.

Jay-Z was trying to walk a fine line while talking about Dave Chappelle's new comedy special -- but it's clear which side of the debate he lands on ... and that would be in DC's camp.

The rapper spoke on the controversy surrounding "The Closer" Friday on a Twitter Space audio conversation -- one that was being hosted by Netflix's Strong Black Lead account, no less. Somebody asked him point-blank about what he thought, and Jay shared.

Check it out ... Jay-Z says Dave is "super brave," going on to say if you spend time with him, you'll see he's "brilliant." Now, Jay does admit Dave pushed a lot of buttons -- ones that apparently made HOV squirm, as he describes -- but in the end, he considers it "true art."

He goes on to say we're in a time now where people can't have discussions with others who disagree with them -- emblematic in the reaction to Dave's stand-up -- and Jay thinks ... that kinda sucks.

Eventually, the person seemingly moderating the convo asks Jay if he thinks the special was divisive -- and Jay tries to dissociate Dave's special with what he considers great art, which he describes as oftentimes being divisive. While he tried to separate the two, it's clear he thinks Dave's show might fall into that "great art" category.

It's also obvious Jay has no real problem with Dave, evidenced in the fact that he invited him to be one of the keynote speakers at his Rock and Roll Hall of Fame induction a week ago ... and was more than happy to pose and smile with the guy.

So, while Jay is trying not to comment specifically on the content of the special -- he may as well be cosigning it. Hard to decipher this any other way, really. 🤷🏽‍♂️

DaBaby Rolling Loud Backs New Tour ... Says He's Grown From Homophobic Rant

DaBaby is going back on tour after his homophobic comments, and it's all backed by Rolling Loud -- the festival where he made those remarks -- which believes he's a changed man.

Here's the deal ... DaBaby just announced a 22-show tour presented by Rolling Loud called "Live Show Killa Tour." The rapper's touting it as "THE SHOW YOU THOUGHT YOU'D NEVER SEE AGAIN" ... clearly jabbing at people who wanted him canceled.

A rep for Rolling Loud tells TMZ ... RL supports second chances and believes DaBaby has grown and learned from his experience, and everyone will be welcome at the shows.

THE HOMOPHOBIC COMMENTS

As you know ... there was a massive backlash against DaBaby after the homophobic rant at Rolling Loud in Miami -- he was dropped from the lineup of a few festivals.

But, he returned to a Rolling Loud stage last month in NYC, where he joined his buddy 50 Cent as a special guest.

Sources close to DaBaby tell TMZ ... he inked the tour deal with RL prior to his appearance with Fiddy, but no earlier than a month ago.

Bottom line, DaBaby is not canceled ... at least not by Rolling Loud. Based on the reception he got in NYC, a large number of fans would agree.

Kevin Hart Sit-Down Chat with Ted Sarandos ... Amid Chappelle Drama

Kevin Hart isn't one to embrace controversy for kicks -- which is why a one-on-one between Netflix's CEO and him is all the more interesting ... especially as the Dave Chappelle drama's still swirling.

Check out this photo TMZ obtained of the rock star comedian chopping it up with Ted Sarandos Monday evening in Beverly Hills. They were at the Waldorf Astoria, where eyewitnesses say the duo had dinner and talked extensively for quite some time.

Although you can't see Sarandos' face in the pic ... other entertainment big wigs who were around confirmed it was him.

What they talked about remains a mystery, but the mere fact they had a private little chat like this, especially amid all the Chappelle drama at Netflix, can't be ignored ... as Dave and Kevin are good friends, and anyone cozying up to Ted right now (especially comics) might as well be cosigning what DC had to say and what Netflix decided to do.

Of course, Kev already has a major relationship with the streamer -- a multi-year deal for movies and specials -- so maybe this had absolutely nothing to do with Dave at all ... but something tells us the topic came up.

There's also this ... Kevin himself was embroiled in an LGBTQ-related controversy a few years ago -- one that ended up costing him his Oscars hosting gig, this after he waffled on apologizing for years-old tweets that some considered offensive and anti-gay.

Not saying one thing has to do with the other ... but that history also exists in this context.

DaBaby is A-OK to hit live stages again, because he's come a long way since his homophobic rants ... so says one LGBTQ org which is OK with his performing, but NOT Dave Chappelle.

The CEO for Relationship Unleashed, Gwendolyn D. Clemons, tells TMZ ... she and her cohorts at the nonprofit approve of DB's appearance at Rolling Loud NY last week -- and any future concerts -- as they feel he's learned a lot over the past few months.

Clemons says DaBaby met with them as well as 100+ other orgs that advocate for the LGBTQ community -- and insists they got through to him on why his diatribe about AIDS was hurtful and harmful.

RU gave DB a history lesson of sorts and educated the guy ... including how HIV/AIDS affects people in his native Charlotte, NC -- something Clemons thinks resonated with DaBaby, whom she believes did not understand what he was saying.

Clemons says DaBaby was coming from a place of ignorance, but she says now he gets it ...  and that's why Relationship Unleashed can cosign his latest Rolling Loud cameo, and others to come.

As for Mr. Chappelle -- she's not forgiving, telling us the comedian has not shown any empathy or remorse ... adding Dave knows exactly what he's doing. BTW, Dave would agree he knows exactly what he's doing, which is not to apologize because he says he is in no way shape or form transphobic.

Kal Penn says his ol' White House boss gave him props for announcing his engagement in a new book -- but it sounds like Barack and Michelle Obama had the tea long before the rest of us.

The actor and now-author shared some inside political baseball Tuesday on "TMZ Live," telling us the Obamas have, indeed, congratulated him on all the news from the past week ... including his coming out, and the fact he's engaged to Josh, his longtime partner.

Kal says he actually got some facetime with BO last week, while he was campaigning for NJ Gov. Phil Murphy ... so it sounds like they're still very much in touch, even all these years later.

Superman Bisexual Backlash Spurs LAPD Protection for Artists, Studio

Superman's bisexuality is having real-world consequences -- outraged fans targeting the folks behind the new comic series ... and cops stepping in to make sure things don't escalate.

Law enforcement sources tell TMZ ... LAPD officers were recently dispatched to patrol the homes of some of the illustrators/production staffers who created the latest iteration of Superman. The extra protection comes after major backlash that included some so-called fans making threats.

We're told the pissed-off comic book readers inundated the studios to voice their displeasure with the character's newly-announced sexuality.

Our sources say the studios called LAPD, requesting for patrols to keep an eye out -- both at the private residences of some artists, and at the studio itself.

While nothing legitimate came from the threats, our sources say cops still patrolled out of an abundance of caution -- and that the situation has since settled down.

Still, pretty scary and crazy ... considering Superman (and everything about him, including his bisexuality) is pure fiction -- and yet, some seem to have taken it very personally.

As we reported ... DC announced its new Superman, Jon Kent -- son of Clark and Lois Lane -- would be starting a same-sex relationship with a friend in forthcoming issues, and released drawings of them kissing.

While the move was celebrated by many, others clearly weren't happy about it at all.

Kal Penn Comes Out as Gay ... And I'm Also Engaged!!!

Kal Penn has come out of the closet in the most surprising of ways -- announcing he's gay in a new book of his, which reveals that he's actually getting married as well.

The actor shared the news through his forthcoming offering, "You Can't Be Serious," via excerpts that leaked over the weekend ... and which is due out this Tuesday. He makes no bones about it ... he's in a relationship with a guy named Josh, whom he's been dating for 11 years.

More importantly, they're on the road to matrimony ... because the couple is engaged. Apparently, Kal met Josh while he was living/working in D.C. under the Obama administration -- for which he worked in an official capacity -- and they've been together since.

He discusses his sexuality this way, "I've always been very public with everybody I've personally interacted with. Whether it's somebody that I meet at a bar, if Josh and I are out or we're talking to friends." He adds, "I'm really excited to share our relationship with readers. But Josh, my partner, my parents, and my brother, four people who I'm closest to in the family, are fairly quiet. They don't love attention and shy away from the limelight."

The guy is getting overwhelming support for finally sharing his truth -- one that's been kept as a secret for years now ... as no one really seems to have known Kal was gay.

Deon Cole That Chappelle vs. Gadsby Feud??? All I Can Say Is ... LMFAO!!!

Somewhere in Hollywood right now, Deon Cole is still laughing -- at least we think so, based on his reaction to a hot-button Dave Chappelle topic we threw out to him.

The comedian and "Black-ish" star was bolting from The Ivy Thursday afternoon in WeHo when we asked what he thought about Chappelle's (half-joking, we think) demand for Netflix employees to admit fellow comic Hannah Gadsby is not funny, before he agrees to meet with them.

Admittedly, that could be a tough question for Deon, who's friends with Chappelle -- but tours a lot of comedy clubs too, and could run into Hannah from time to time.

Nevertheless, he responded, but you really gotta see how. This isn't just top-notch deflecting -- it's straight-up funny!!!

You'll recall ... Hannah fired the first shot at Dave, describing "The Closer" Netflix special as his "emotionally stunted partial world view."

Dave's rebuttal came during his show last week in Nashville, and while he was most likely joking about the Hannah demand ... the joke landed hard for Deon.
