Kelly Rutherford burst into tears and freaked out after a judge shut down her last ditch effort to keep her kids in the U.S.

Rutherford claimed another judge had illegally awarded custody of her 2 kids to her ex-husband, Daniel Giersch, who lives in France. Rutherford claims the judge effectively deported the kids.

So she was in federal court Wednesday ... asking a judge to step in, but the federal judge said he didn't have the power. Outside the courtroom, Rutherford broke down, saying "My own country won't save my children and I pay taxes!"

The judge gave Rutherford a ray of hope, saying although he didn't have jurisdiction over custody, he would set up a conference call Friday with him, Rutherford and Giersch's lawyer ... to figure out a way for Giersch -- who has immigration issues -- to come back to the U.S. to live.

The clock is ticking ... if the judge's Hail Mary doesn't work ... the kids go to France August 19.

Ramona Singer -- who stars in "Real Housewives of New York City" -- has gone to the NYPD ... claiming her estranged husband's mistress has been stalking her ... TMZ has learned.

Law enforcement sources tell us ... Ramona called 911 Wednesday afternoon, claiming the woman had followed her to a restaurant.

Ramona revealed last week she was leaving hubby Mario Singer, although she didn't say why. Other members of the cast dimed Mario to the media ... at least they alleged he was cheating.

But now we know ... Singer herself believes Mario was cheating, and for some reason she believes the mistress is obsessed with her.

Katharine McPhee's hubby claims his estranged wife is a cheater and a liar.

Nick Cokas has filed new divorce docs -- obtained by TMZ -- which squarely contradict Katharine's version of the timeline of their separation ... which is relevant because of the photos showing her making out with "Smash" director Michael Morris.

Katharine claimed in her divorce docs they separated in March, 2013 -- months before pics surfaced in October showing Katharine and Michael sucking face.

But Nick begs to differ, claiming the separation was actually in May, 2014 ... long after Katharine hooked up with Michael.

Nick has some pretty powerful evidence to back up his version, including emails and texts about their relationship. Family sources say Nick can show he and Katharine were in marriage counseling AFTER the pictures surfaced.

The separation date is important because it determines when Katharine's money becomes hers alone.

Kelly Rutherford claims her children are being illegally deported by a renegade judge who has ordered them to live with their father in France ... and if things don't change she'll break the law and keep her kids right here in the U.S. of A.

The former star of "Gossip Girl" was in a bitter custody battle with ex-hubby Daniel Giersch. He now lives in France and an L.A. County Superior Court judge ruled he had a right to primary custody of the children -- ages 5 and 7.

In new legal docs -- obtained by TMZ -- Rutherford claims sending her kids out of the country creates an immigration issue -- and that's beyond the scope of a state judge's power.

Rutherford wants a federal judge to invalidate the state order and give her custody so the children can remain in the U.S.

Sophie B. Hawkins is about to become a single mom ... her longtime partner has filed to end their domestic partnership and is giving up custody of their son.

Hawkins -- whose song "Damn I Wish I Was Your Lover" was a hit in 1992 -- has been in a partnership with her manager, Gigi Gaston since Sept. 2008. According to court docs ... they've been separated for the last year and a half.

In her docs, Gigi says she wants Hawkins to have physical custody of their 5-year-old son, Dashiell ... she's asking for visitation.

Gaston's not looking for a payday ... she didn't ask for spousal support.

It's been a lousy week for Da Band singer Sara Stokes -- her husband just slapped her with divorce papers ... two days after she was thrown in jail.

Emanuiel "Tony" Stokes filed docs in St. Clair County, MI to end their 18-year marriage. He claims "the objects of matrimony have been destroyed."

They've been at each other's throats for years ... she was even charged with stabbing him in 2009.

Sherri Shepherd claims estranged hubby pilfered around $20K from their joint bank account before he split ... and the money could end up as a key piece of evidence in their custody war.

Sources close to the couple tell us Sherri was in the dark until she looked at a recent bank statement and saw the money was gone.

The fired "View" host is disavowing the contract she and Lamar Sally signed with a surrogate on grounds Lamar defrauded Sherri -- that the only reason he wanted the baby was so he could divorce her and collect child support. We're told Sherri will use the $20K withdrawal as proof Lamar was purely money-motivated.

Sources tell us Lamar used the money for baby expenses ... including trips he took to Pennsylvania to be with the surrogate. He also claims Sherri knew full well he took the money out of their joint account.

David Duchovny has divorced Tea Leoni ... TMZ has learned.

The divorce went completely under the radar. We've learned it was filed in June and they settled all the terms themselves.

David filed the documents, citing an irretrievable breakdown of the relationship.

Under the terms of the divorce ... David and Tea have joint legal custody of their 2 kids -- ages 15 and 12 -- and she has primary physical custody.

They both live on the Upper West Side of NYC ... so shuttling back and forth won't be too complicated.

He's paying $8,333 a month in child support, plus all other expenses including summer camp, private school and college.

And he's paying $40K a month in spousal support.

The couple married in 1997 and briefly separated in 2008. They separated again in 2011.

Corey Dillon's ex-wife did not run for 11,241 yards, score 82 career touchdowns, or help the New England Patriots win Super Bowl XXXIX, but she was married to him when all that went down ... so she's getting exactly what she's entitled to under the law.

According to court docs obtained by TMZ Sports, Dillon's divorce from Desiree Antoine was finalized late last month. The two agreed to joint legal custody of their 3 kids and Dillon will fork over $1,421/month in child support. Antoine waived her right to spousal support.

As far as assets go, it's a pretty even split and the couple will sell off a lot of their stuff (their Calabasas home and several cars, including a few classic Chevy Impalas) and split the profits 50/50. Dillon does get to keep his 1971 Oldsmobile Cutlass.

Ex-MGM mogul Kirk Kerkorian just scored a knockout punch against his ex-wife Lisa Bonder ... a judge just shut down her request to up monthly child support from $100K to $565K.

It's a spectacular defeat for Bonder, who claimed their 16-year-old daughter Kira needed $491,000 a month just for equestrian expenses. Kira is an accomplished rider who has Olympic aspirations, but apparently the judge found Bonder's request ridiculous.

The judge felt Bonder could make do with $100,000 a month ... which by the way is the largest child support award on record in the U.S.

The judge scoffed at Bonder's request in his written ruling -- obtained by TMZ -- saying, "There is a difference between the 'needs' of a child and the 'wants' of a child."

Here's what's really amazing. Kerkorian and Bonder were married a grand total of 28 days back in 1999 and the child isn't even his ... when he agreed to pay support he didn't know Kira wasn't his biological child.

Robin Thicke was not cavorting with a chick on Lake Perris when he was supposed to be performing a concert ... he was with his son and his nanny.

There have been a slew of reports the chick might be Robin's new girl. But we've learned it's not. Robin, we're told, isn't dating anyone and has no interest in getting back on the saddle ... at least for now. He still wants Paula back ... but he knows it's probably not gonna happen.

As for why Thicke canceled his Indiana concert and hung out on the lake ... we're told he was having vocal issues, so he decided to make the most of a bad situation and spend time with his kid.

"Star Trek: Voyager" actor Robert Picardo says he way too old to experiment with Bill Nye the Science Guy ... in the bedroom.

Picardo is asking a judge to stop his soon-to-be ex-wife from spreading rumors he's in a gay relationship with Nye.

The actor says in court docs -- obtained by TMZ -- Linda Pawlik lured him over to her house on July 4th by falsely telling him the family dog was missing. While he was there, he claims Linda had a P.I. attach a GPS device to his car.

Days later ... Linda started telling family friends the P.I. reported back that Picardo and Nye spent 3 hours together in Nye's bedroom, which she believes is proof of an affair.

Picardo says in docs, "I'd made it to 60 without having sex with a man and a 'walk on the wild side' at this age seemed unlikely to anyone who knows me."

The actor acknowledges he and Nye have been friends for years and have taken many pics together ... but he says it's purely platonic.

Robin Thicke went camping with his son and a mystery woman the same day he was supposed to be performing in Indiana ... and this isn't the first time it's happened.

What was termed a "scheduling conflict" was in actuality a personal day ... deja vu, because he did the same thing back in February when he cancelled 2 back-to-back concerts because of illness, but ended up at Disneyland in Anaheim, CA with his son.

Get ready to interpret ... because Beyonce now obtusely reveals what went down in that elevator ... and one interpretation goes directly to her marriage.

Beyonce dropped a remix for her song "Flawless" with Nicki Minaj Saturday night ... and early in the track says, "We escalate, up in this bitch like elevators ... of course sometime s**t goes down when it's a billion dollars on the elevator."

So how's this for a theory. Multiple reports estimate Beyonce and Jay Z's worth between $900 million and 1 billion. So when she says "of course sometimes s**t goes down when it's a billion dollars on the elevator" ... could that mean there's a billion dollars on the line and they were arguing over something related to the heart of the marriage?

Just a theory.
