As far as Glenn Beck is concerned, Tomi Lahren is still an employee at his network, TheBlaze, and she's the one who breached her contract.

Beck and TheBlaze filed a countersuit against its former personality, Lahren. She had sued them claiming she was canned simply because she said she was pro-choice. In the new docs, Beck says Tomi was never fired or suspended, but they did bench her show for one week. He says they continued to pay her salary during that time.

They admit the show was temporarily taken off the air because her pro-choice comments were "offensive to many of the TheBlaze's supporters and followers." According to the docs, the real problem was, "Her comments were shocking and disappointing because they demonstrated Lahren was uninformed and unprepared to speak."

Translation: She's an idiot ... as far as Beck and TheBlaze are concerned.

Tomi's former employers think she was an awful mouthpiece whose "word choices on air had to be addressed repeatedly for bordering on the profane."

Prosecutors have dropped the rape charges against former SF 49ers lineman Ray McDonald -- after the accuser stopped cooperating, officials say.

McDonald had been charged with 1 count of rape on an intoxicated person stemming from a 2014 incident at his San Jose area home. He faced up to 8 years in prison if convicted.

The alleged victim initially claimed she met McDonald at a local bar on December 14 and went back to his home -- where she allegedly fell and hit her head near Ray's hot tub. She claims she later woke up in his bed.

The woman also claimed McDonald's teammate, Ahmad Brooks, groped her in a sexual manner while she was unconscious ... and said surveillance video would prove her story.

Ray admitted he had sex with the woman but insisted it was consensual.

Jackie Warner has been charged with assaulting a cop and DUI, but her lawyer says Jackie was "driving unconscious" so the charges are bogus.

We've learned the former Bravo star has been charged with felony assault on a police officer, misdemeanor DUI and misdemeanor hit and run.

The hit and run is based on Jackie clipping a cop car and then leaving the scene.

Cops tell us Jackie blew a .08 at the time of the incident. She says she had one martini earlier in the day and that's it.

Jackie has said she had taken an Ambien at home and the next thing she knew she was in the hospital under arrest. When she crashed her car she wasn't wearing pants.

Her lawyer, Shawn Holley, tells TMZ, "We have letters and reports from Jackie's doctors which prove a long history of insomnia and which strongly support our contention that Jackie was driving unconscious after taking Ambien, which had been prescribed to her."

Holley goes on, "I reached out to the D.A.'s Office weeks ago and was assured that deputies would review our reports before filing charges. We are extremely disappointed that the D.A.'s Office filed these charges without reviewing our evidence, as promised."

Chris Brown's nightclub appearance turned into an all-out brawl when he got into it with a photographer ... so claims the club owner.

Chris was at Aja Channelside early Monday morning in Tampa for a paid appearance. Management says their in-house photographer was snapping pics when Chris and his entourage arrived around 1:30 AM ... but Chris' team shut him down, saying no photos.

Later, while Chris was in the DJ booth, the photographer tells us he was taking crowd shots ... from behind Chris and when the singer noticed, all hell broke loose. The photog says Chris jumped over a couch and punched him in the face while he was cornered.

In the video, Chris is in red, his bodyguard is wearing yellow ... and you can clearly see punches thrown into the dark corner.

We're told police were called, but Chris had left by the time they arrived. The photog says his lip got split open and his jaw hurts. He's on his way to a hospital, and says he's pressing charges against Chris.

Tampa cops confirm they are investigating Chris for battery after the photog said he was "sucker punched."

Jennifer Garner and Ben Affleck have not even started the process of figuring out who gets what in the divorce, because they made a real attempt during their separation to work things out rather than just end things.

Sources on both sides say there's no animosity between Ben and Jen. We've learned Ben's now dating someone, though "not seriously." He's moving out of the family guesthouse and into a new home. As one source said, "He's ready to move on."

As for Jen ... we're told she cares deeply for Ben, but his stint in rehab was the culmination of a difficult period for the family and she too felt it's now the right time to end the marriage.

We're told Ben and Jen never discussed dividing assets because they were ambivalent about the divorce, so now they have to deal with a fortune in assets. As we reported, there is no prenup, so everything goes into one pot ... property, art and other items must be valued, sold or split.

It will take a minimum of 6 months before the divorce is final, and sources say because of the amount of property, it will probably take longer.

We now know why the woman injured at a Tyga concert persisted in collecting money even though Tyga's company has made it clear they don't want to pay her ... she got really messed up.

Shyanne Riekena already won a judgment against Tyga's company for injuries sustained when a light stand came crashing down on her, leaving a 4-inch gash on the top of her head.

As we reported ... Tyga's music company got slapped with a $236,000 judgment but failed to pay. Now, with interest, the judgment has swelled to $250k.

Shyanne says she's been suffering for 5 years and is indignant Tyga's business won't own up.

Jas Prince is following through on the promise his father made -- going directly after Birdman to get the millions in Drake profits the Cash Money honcho's been sitting on ... according to a new lawsuit.

In the new legal docs, obtained by TMZ, Jas calls out Birdman and his brother Ronald "Slim" Williams -- co-founders of Cash Money -- for failing to pay up on the Drake deal.

Quick backstory: Jas discovered Drizzy, hooked him up with Aspire Music Group to manage him, and Cash Money to be his label. As a result, Drake's Young Money contract calls for Jas and Aspire to get paid.

And that's the problem ... according to the suit, Birdman's blowing off his contractual duty to pay Aspire Music one-third of his Drake profits. He also signed Drake to an exclusive deal in January 2013, but according to docs ... that new contract breached Drake's original one, and cheated Aspire out of $4 million.

Aspire filed the new lawsuit, but sources connected to the case tell us Jas is calling the shots ... as he now owns a chunk of Aspire. He'd previously sued Cash Money, but we're told Jas is going harder than ever now to get the money straight from Birdman.

How hard? One of Aspire's attorneys is Marc Kasowitz, who also famously reps President Trump.

We've reached out to Birdman's reps, but no word back.

Just last week, Jas' father ... James Prince vowed he would get the money Birdman owes his son AND Lil Wayne. Based on his words, someone's ass is on the line in this case.

Justin Bieber's officially in the clear for allegedly headbutting a guy at a pre-Grammy party after his attorneys effectively stonewalled cops.

Law enforcement sources tell TMZ ... Justin's lawyers refused to let the L.A. County Sheriff's Dept. have a sitdown with him, and when the alleged victim went radio silent ... the investigation fizzled out.

Jeremy Jackson copped a pretty sweet plea deal for stabbing a woman, but he's still going to jail.

The former "Baywatch" star was sentenced to 270 days in L.A. County Jail and 5 years probation for the 2015 incident -- a woman said he stabbed her with a knife during an argument in the street.

The judge gave Jeremy 109 days credit, so he'll have 161 behind bars. Sounds rough, but he could have done up to 7 years without the plea deal. Plus, he'll most likely get out in May if he's a good boy in lockup.

Hobie will also have to complete 52 anger management and 52 AA meetings, and stay off drugs.

The woman 50 Cent punched square in the chest is now going full bore against the rapper ... lawyering up for a lawsuit.

Donnetta Derr has a law firm behind her that will sue 50 early next week. She'll also sue The Lox, with whom Fiddy performed, and the venue, Baltimore Soundstage.

TMZ broke the story ... 50 was performing last week when the woman grabbed his arm and pulled him off stage. 50 retaliated with a vicious punch.

Donnetta later went onstage and twerked ... leading people to believe the beef was squashed ... nope.

Attorney Warren Brown tells us Donnetta went to the hospital the next day and hired him Monday.

The 2 protesters who bum-rushed Ryan Lochte during his live season premiere of "Dancing with the Stars" have cut a deal to avoid time behind bars ... but it cost them a fortune.

Sources tell us the judge and the L.A. City Attorney's Office dropped the case after the protesters agreed to pay BBC Worldwide Productions -- which owns 'DWTS' -- and CBS -- where the show was filmed -- $20,000.

Here's the way the law goes ... there's something called a "civil compromise." It means if someone is charged with certain crimes, they can have the charges dismissed if they work out a deal with the victims.

The protesters faced 6 months in jail after being charged with leaving a spectator area and entering upon a stage as well as interfering with a performance -- both misdemeanors.

As we first reported, the protesters went to 'DWTS' because they felt Ryan's bad behavior in Brazil was the reason one of their family members got busted for something unrelated ... out of revenge for the U.S.

Aaron Hernandez's lawyer, Jose Baez, is adamant the ex-NFL star is "not a killer" -- and says the jury in his double murder case GOT IT RIGHT with the not guilty verdict.

Baez says there was "an abundance" of reasonable doubt in the case -- and tells us he's very happy for Aaron and his family now that the former New England Patriots tight end has been exonerated.

Rapper Cassidy did not get an Uber or a taxi, so instead he got arrested at an NYPD checkpoint.

Law enforcement sources tell us Cassidy was driving Thursday morning in Chinatown area when he pulled his 2011 GM van up a checkpoint. That's when cops ran his driver's license and it came back as suspended.

We're told the Philly MC was arrested and booked for driving on the suspended license.
