Kylie and Kendall Jenner have just fired back in the lawsuit where a guy who owns a photo of Tupac is going after the women claiming they ripped him off and plastered the image on the t-shirts they were hawking.

Kylie and Kendall say renowned photog Michael Miller has no right to sue because he himself committed some sort of fraud in copyrighting the photo. They say he's neither the author nor creator of the photos. They don't further explain, but it sounds like they're alleging he misrepresented ownership when he filed with the U.S. Copyright Office.

And there's this ... the women claim he's only entitled at best to "thin copyright protection" because his legal rights to the photo are so minimal it doesn't deserve full protection.

That all said, Kylie and Kendall removed the t-shirt from their online store.

Audrina Patridge's estranged husband just responded to her allegations in court docs, denying that he installed 5 cameras in their home in a fit of rage and in fact he says her dad became ominous and physically threatening.

Corey Bohan says in new docs, there were 2 existing cameras in the house and she knew all about them. Bohan says Audrina and her dad barged in through the garage door while he was there and made it clear ... they would not set a time for her to come get her belongings. He says they texted him only 15 minutes before showing up, and that wasn't enough time to arrange for the pickup.

He's also complaining the restraining order hearing was set on the very day he was supposed to have visitation with his daughter -- whom he hadn't seen in 2 weeks.

TMZ broke the story ... Audrina filed for divorce Wednesday and got a restraining order against Corey, which she says he violated just 1 day after it was granted. She says he called her a "f***ing c**t" and planted the cameras.

In divorce docs, Audrina said the violence started in August when they argued over accusations he was cheating. She also said Corey had threatened suicide in July when she was out of town on a business trip. There were other incidents in September -- he told her she's "f**ked up" because of her childhood -- which led to cops and child services getting involved.

Audrina said the breaking point came last weekend when Corey, an Australian BMX rider, followed her onstage at a beauty event and demanded to know where their daughter, Kirra, was and said he was going to take her.

Shia LaBeouf has a pretty simple response to the L.A. bartender who sued him after Shia called him a "f**king racist bitch" -- tough noogies, dude.

According to docs filed by Shia, and obtained by TMZ ... his defense in the slander lawsuit is that name-calling might be "obnoxious and vulgar, but it's not defamatory." The whole thing started with a bizarre scene in April ... when Shia went off on the bartender in Jerry's Famous Deli.

Shia, who witnesses said seemed drunk, went off on the bartender for not serving him French fries -- which seemed like an act of racism to Shia. As he put it that night, "You f**ked up!!"

In his docs, Shia says the bartender's lawsuit -- which seeks $5 million -- should be dismissed because he was merely expressing his opinion, and his right to free speech allows him to do so.

Beyonce seems to believe it's okay that her hit, "Formation," used a sample of a dead New Orleans rapper ... because she only used a tiny bit of his voice.

Beyonce just filed a response to the lawsuit from the estate of Anthony Barre -- and in the docs, her lawyers say the use of Anthony's voice is "reasonable and justified." You'll recall, Bey's hit track includes Anthony's voice saying "I like that," but his estate says it never signed off on the use ... and wants $20 mil in back royalties.

She's not giving up the dough that easily. According to the docs, Beyonce's team says Barre's estate has no case because the use of his voice was so minimal it doesn't require compensation. For the record, it's about 6 seconds long.

They also invoke the First Amendment as justification for using Anthony -- aka Messy Mya -- but that seems like a stretch, and makes us think Team Bey is just throwing everything but the kitchen sink at this lawsuit.

Kevin Hart's sex tape partner has big stripper moves ... and she's even armed with an official license to strip.

Montia Sabbag showed up some pretty impressive pole action at The Golden Banana strip club in Boston, where she bartended between 2011 and 2013. We're told the video was shot after hours and was just for giggles.

Montia said in her news conference Wednesday with her attorney, Lisa Bloom, she's not a stripper. Turns out, she has an official adult entertainment license in Nevada, which gives her the right to work in any capacity in a strip joint. So if she wanted to work the pole for more than just fun, she could.

Gotta say ... she could make a living.

As we reported ... Montia denies any involvement in the extortion plot against Kevin ... even though we're told her first lawyer requested hundreds of thousands from his team to take a lie detector test. Her new attorney says her client is now going to cops to help catch the real perps.

Mel B will not be prosecuted for intimidating a witness in her domestic violence case against Stephen Belaftone ... TMZ has learned.

The L.A. County D.A. says it will not move forward because the text messages Mel sent to rapper Siya were "too vague" to be clearly interpreted as threats. The messages also don't show that Mel was even aware Siya was going to testify against her.

TMZ broke the story ... Siya had filed a police report, claiming Mel sent threatening texts warning her not to take the stand in Mel B's divorce and domestic violence case.

Kim, Khloe, Kourtney Kardashian and Kris Jenner are being sued by a guy who ran a beauty company who claims they screwed him out of a cut of the profits ... and he wants as much as $32 MILLION.

Here's the backstory. John LaBonty was CEO and President of Boldface, a company that markets beauty products. According to the lawsuit, the Kardashians gave Boldface an exclusive deal to market all its beauty stuff. Boldface morphed into a different company, but LaBonty says it didn't affect his interest.

LaBonty claims he had a 5% equity interest in all products in the Kardashian Beauty line. He says the Kardashian women stopped making any effort to market, promote and support the line and thwarted the company's ability to make money off the products.

Cardi B's claim she was choked out by a cop doesn't pass NYPD's smell test -- at least for now -- 'cause they can't find any evidence of it ... TMZ has learned.

NYPD Assistant Commissioner Peter Donald tells us ... NYPD conducted a full investigation into the Bronx rapper's allegation an officer put her in a choke hold Tuesday and slammed her up against her SUV. He says they can't find any proof it happened.

Donald says commanders in each precinct around Columbus Circle, where Cardi claims the choke hold went down, looked into all records and surveillance video of the area and could not find a thing to support her account.

As we first reported ... although she's pissed off about the incident, she isn't talking about legal action.

We're told Cardi's refused to offer more details of the alleged incident, and because of that ... the department doubts it ever happened. They're asking her to come forward and talk.

Gatorade's gettin' some Hater-ade from the State of California -- which is suing the energy drink company for a star-studded smear campaign against water.

Drink that in.

It's all over a 2012 app launched by Gatorade called "Bolt!" -- it's a mobile phone game like "Temple Run" in which a Usain Bolt character runs through obstacles gathering Gatorade token to run faster.

The enemy in the game is water -- which is branded as "the enemy of performance." Players must avoid water at all cost. The game was reportedly downloaded more than 2.3 million times and promoted by huge stars like Justin Bieber and Mike Tyson.

So, why does the state of CA have a problem?

According to court docs obtained by TMZ Sports, the state attorney general believes the game violated California law by delivering a misleading message to consumers -- that water decreases athletic performance. California says that's just not true.

The State wants to block Gatorade from continuing the anti-H20 ad campaign -- and also seeks to hit the company with a serious fine.

Richard Simmons just got a financial injury added to the insult of losing his defamation lawsuit against the National Enquirer.

According to court docs, Simmons has been ordered to cover attorney costs and any other court fees incurred by the Enquirer. You'll recall, Richard sued the tabloid for defaming him with a story saying he was in the process of sexual reassignment.

He lost the case with the judge saying being misidentified as transgender doesn't expose someone to "hatred, contempt or ridicule."

Aaron Hernandez's fiancee, Shayanna Jenkins-Hernandez, says Aaron killed himself as a result of severe CTE he suffered during his NFL career -- and she's suing the the Patriots and the league for keeping him in the dark about the brain disease.

Shayanna filed the lawsuit in Mass. on behalf of the daughter she had with Aaron.

In the suit Shayanna says, "Aaron had stage 3 CTE usually seen in players with a median age of death of 67 years."

Shayanna claims the NFL and the Patriots were aware of the link between suicidal impulses and CTE and failed to share that info with Hernandez.

She claims the NFL and the Patriots "were fully aware of the damage that could be inflicted from repetitive impact injuries and failed to disclose, treat or protect him from the dangers of such damage."

In her suit, Shayanna says she and her daughter are seeking "redress for the loss of parental consortium she has experienced based on the negligent conduct of Defendants that deprived her of the companionship and society of her father, Aaron Hernandez."

Hernandez infamously killed himself in his prison cell on April 19 -- after he was found not guilty in a double homicide. Hernandez was already serving a life sentence for the murder of Odin Lloyd at the time of his death.

Shayanna says in her suit, "On April 19, 2017, Aaron succumbed to the symptoms of CTE and committed suicide."

Paris Hilton is ass deep, in the middle of a legal battle over this iconic pic of her wearing Juicy Couture.

A photographer named Jason Altaan owns the famous pic, which has become a big merchandising device for the apparel ... designer loungewear to be specific.

Altaan gripes in his suit Juicy posted the pic on its Instagram page without his permission and without compensation.

He wants all profits emanating from the photo.

That said, one thing's undeniable ... she looks awfully hot.

Audrina Patridge claims in divorce docs her estranged husband violated the restraining order she got against him just 1 day after she got it.

TMZ broke the story, Audrina got her restraining order this past Monday, but the very next day he refused to leave their house when she showed up to pick up some stuff. She also says he installed 5 video cameras inside the house to keep tabs on her. When she told him to leave she says he called her a "f***ing c**t."

The police actually responded but it's unclear if any action was taken.

As for the divorce, she wants primary physical and legal custody of their 15-month-old daughter, Kirra. She wants the judge to shut Corey Bohan down if he asks for spousal support. And, she wants an order specifically prohibiting Bohan from taking Kirra to his native land -- Australia.

1:03 PM PT -- Usher's attorney, Zia Modabber, tells TMZ, "Usher will defend himself vigorously in court against these opportunistic claims and we will not comment further on private legal matters."

Usher's male accuser who claims the singer exposed him to genital herpes says the 2 had sex in a Koreatown spa in Los Angeles.

The 2 women and the man suing Usher have filed new legal docs. The woman who has not divulged her identity now says she had sex with Usher at least twice and, after contracting herpes from him, her twins were stillborn. She says stillbirth is a direct consequence of giving birth while infected with herpes.

Audrina Patridge is divorcing her husband of less than a year, on the heels of running to court to get protection from him ... TMZ has learned.

The former 'Hills' star filed to divorce Corey Bohan on Wednesday, and according to docs the split appears to be triggered by a series of incidents she considers menacing and emotionally abusive.

In the docs, obtained by TMZ, Audrina says the violence began in mid August when they argued about her accusing him of cheating. She says she was holding their daughter, Kirra Max, when Corey pushed her back. Audrina says he then emptied out her backpack and purse, and began punching himself in the head ... and threatening to bash himself in the head with a metal canister if she left.

She says Corey had threatened suicide before -- in July while she was out of town on a business trip.

According to docs, on Sept. 6, Corey was at home watching KIirra, and when Audrina got home, he began calling her names and harassing her. Audrina says she grabbed Kirra and went upstairs, but he followed and told her she's "f**ked up" because of her childhood and her messed up mother. She says she started recording video of him, and he said, "Grow some balls and pull the trigger and file for divorce."

Diplo tried to turn up in the Hollywood Hills -- but the cops had a simple message for him and his party pals ... fool us once.

Diplo was throwing a house party Wednesday night just outside of WeHo, which included some celebs like Lil Dicky ... who you can see clearly in the DJ's Snapchat story.

Unfortunately, law enforcement sources tell us it became too much of a rager, 'cause cops had to be called twice -- with the 2nd visit shutting the whole thing down.

We're told cops first came out a little before 10 PM, and were told the music would be turned down and guests would be kept inside. They came back again at 11:30 PM and that's when they kicked everyone out ... but didn't cite anyone. Police never talked to Diplo.
