According to the suit, the plaintiff -- who also is not named -- met the celebrity in Las Vegas April 1. The suit claims the celeb -- a male who is worth in excess of $100 million -- "entered into a nefarious plot designed to lure Plaintiff into his luxurious hotel room to serve his prurient desires."

The suit claims the celeb told the plaintiff he had "no venereal diseases." At that point, they watched porn and engaged in "mutual oral copulation, mutual self-gratification, rubbing and massaging each other, play-wrestling, licking and (unprotected) intercourse." And, it was all videotaped!

According to the lawsuit, filed by attorney Keith Davidson, it didn't end well, because the plaintiff contracted herpes. The suit claims the celeb knew all along he had herpes and lied to the plaintiff in order to satisfy his desires.

The plaintiff -- not identified as either a man or a woman -- is suing for more than $20 million.

According to the probation report, Lindsay's probation officer wrote, "Substance abuse is the root of the defendant's problems."

Judge Stephanie Sautner begged to differ this AM, saying she did not believe Lindsay's problem was drug related.

The Probation Report lists the drugs Lindsay has been taking: Trazadone (for depression), Nexium (for heartburn), Yaz (birth control), Zoloft (anti-depressant), Doxycycline (antibiotic), Zyrtec (allergies) and Zythromax (antibiotic).

The Probation Report mentions Lindsay failed an alcohol test on February 8, 2011 -- this is about a month AFTER Lindsay left the Betty Ford Clinic.

As for that alleged attack at Betty Ford, the report also states that cops have interviews with restaurant employees, hotel employees, and nightclub employees saying that Lindsay was drinking that night.

Lindsay's attorney Shawn Holley entered the plea a few minutes ago -- Lindsay wasn't in court.

Judge Stephanie Sautner said during the hearing, she doesn't believe Lindsay's problem is substance abuse, but rather her problems are more deeply rooted and she is self-medicating to relieve those problems. As a result, Judge Sautner is not requiring Lindsay to undergo substance abuse counseling.

Lindsay will not get additional time for the theft. She will be required to serve 120 days for her probation violation, and we've learned the Sheriff's Department may allow Lindsay to do the time at home, with an electronic monitoring device.

In reality, the 120 days will amount to 14 days. But during that time, Lindsay cannot leave her home, even to do community service.

Lindsay must complete psychological counseling and a shoplifters alternative class -- seriously.

Sources connected to the negotiation say Charlie wants his daughters Sam and Lola for weekends ... but Denise has had deep concerns about the welfare of the children and under current circumstances, she does not want Charlie to have the kids.

When the two faced off yesterday -- we're told there were "neutral third parties in the room" who agreed with Denise that Charlie should not have the kids.

Sources connected with Lindsay tell TMZ ... Lindsay wants to show up for the plea, but the cost and craziness associated with a Lindsay Lohan appearance is just too much -- what with extra Sheriff's deputies, court disruption, etc.

So Lindsay's lawyer, Shawn Holley, will appear before Judge Stephanie Sautner to enter the plea.

TMZ broke the story ... Lindsay will plead no contest, and in such cases it's routine a defendant can serve the sentence with an electronic monitoring device at home, rather than doing jail time.

As we first reported ... both Sheriff's Department and the Probation Department sources tell us ... Lindsay would be eligible to serve her 120-day jail sentence with electronic monitoring at home.

Judge Sautner has made it clear ... she's treating Lindsay like any other defendant, so it's likely the judge will allow her the electronic monitoring option.

And, a defendant who serves time at home with an monitoring bracelet gets the same time off for good behavior and jail overcrowding as someone who serves time in the pokey. And we're told 120 days translates into 14 DAYS. So 14 days with a bracelet and she'll be off the hook with the necklace!

TMZ will be in court tomorrow.

Bieber just went to his Twitter page and without mentioning Marg by name ... said, "it's kinda lame when someone you met briefly and never worked with comments on you. I will continue to wish them luck and be kind."

As we previously reported, Marg went on a French radio show and said JB was "kind of a brat" when he guest starred on the show earlier this year.

Leakes tells us her feud with Star Jones was REAL -- and says she was legitimately upset with Trump when Donald changed the teams on last night's show to "accommodate" the former "View" chatterbox.

NeNe tells us, "Trump was doing things to accommodate Star and not me."

Leakes says she felt producers were constantly trying to "provoke" her ... noting, "All of the manipulating ... was very toxic. It was a very toxic situation."

She adds, "I'm not a quitter or a loser ... I had to walk out of the show for my own sanity."

Charlie tells TMZ ... it's the first time he's been able to spend a weekend with Bob and Max since the judge took custody away from him back in March.

According to law enforcement sources, Beckham was driving a black Cadillac on the 405 Freeway near Torrance, CA yesterday morning ... when he rear-ended a gold Mitsubishi that was broken down in the carpool lane.

We're told the driver of the Mistubishi, who was inside the car and wearing his seatbelt at the time, had to be taken to the hospital -- but Beckham did not require medical attention.

Law enforcement sources tell us Beckham was not arrested or cited on the scene.

A call to Beckham's rep was not returned.

Sources close to Lindsay tell TMZ, the actress has no plans whatsoever to become a Scientologist -- she hasn't taken any classes with the Church ... and hasn't even been asked to visit by current members.

We're told Lindsay has nothing against the Church -- but she was raised Catholic and plans to stay Catholic ... in fact, she remains an avid practitioner to this day.

TMZ spoke with a source extremely close to Lusk ... who tells us Jacob never wanted to perform the Jordin Sparks /Chris Brown duet, "No Air" on Wednesday's show ... but Iovine pressured him into it.

We're told Lusk really wanted to perform the Gnarls Barkley hit, "Crazy" -- but Iovine was so insistent on "No Air" that he basically "beat it into his brain" until Lusk finally gave in and agreed to perform the song.

During the show, Randy Jackson told Lusk, "I don’t think that’s the direction for you ... I don't think anybody on this stage should be doing duet songs."

Kelly -- who's now married to John Travolta -- was leaving Mr. Chow after a dinner date with Kirstie Alley when she explained what REALLY happened that night ... and it syncs up perfectly with Charlie's explanation.

Earlier this week, Charlie gave his version of the shooting during a performance of his "Torpedoes of Truth" tour in Vancouver ... and told the crowd ... he knew he would be blamed for the shooting.
