Mel Gibson's Lawyer Presents Case to Sheriff
TMZ has learned ... Mel Gibson's lawyer is meeting with Sheriff's investigators right now, presenting evidence she believes proves Oksana Grigorieva has fabricated the case against her client.
The meeting is being held at a courthouse in Los Angeles, in a conference room.
In addition to presenting evidence that Mel did not strike Oksana, we're told attorney Blair Berk will ask Sheriff's deputies to go after Oksana for extortion and falsifying evidence.
Berk's track record may be just what Mel needs. Last year she convinced New York prosecutors not to file felony assault charges against her client, Kiefer Sutherland, after he broke a dude's nose at a party. Berk also convinced an L.A. judge last fall to dismiss battery charges against Kanye West, who was caught on video breaking a camera.
After the meeting, we got video of Blair Berk and L.A. County Sheriff's Detective Tom Lewis. We asked Berk if Oksana was guilty of extortion and lying to the cops. She said it was an "inappropriate question." Lewis was mum.

Jennifer Aniston Allegedly Victim of Dangerous Stalker
TMZ has learned ... Jennifer Aniston just got a restraining order against a man who was arrested after prowling around a place she frequents -- and the man had a sharp object, duct tape and is considered violent.
According to the docs, Jason Peyton was found on July 15, "laying-in-wait in a location he believes she frequents with a 'sharp object, a bag, a roll of duct tape and written messages about [Aniston]."
Aniston's lawyer says in the docs ... Peyton spent 8 days trying to find her and when he was taken into custody cops found carved messages in the paint of his car saying, "I LOVE YOU JENNIFER ANISTON."
According to the documents, obtained by TMZ, "Peyton is an obsessed, mentally ill and delusional stalker -- with a history of violence and criminal stalking -- who drove cross-country in his delusional 'mission' to locate and marry [Aniston], with whom he believes he is in a relationship."
After being arrested, the 24-year-old Peyton was placed on a 5150 psychiatric hold. He is still being held.
According to the restraining order, Peyton must stay 100 yards away from her home, places of work and vehicles. Peyton must also stay clear of her employees, agents, managers and other reps.
The way cops found out Peyton was in L.A. looking for Aniston ... he left a note for his dad on June 25 in Pennsylvania, stating he was going to California which his dad knew meant he was looking for Aniston. We're told ... ultimately, it was the mother who gave cops a heads up.
As for Peyton's violent past -- it includes stabbing himself and hitting his mother with a golf club.
Peyton, who has been institutionalized before, was ordered to take antipsychotic drugs but authorities say he stopped taking them in March.
Peyton believes he's related to Oprah, Nelson Mandela, Jay-Z, Jennifer Lopez, Courteney Cox, Bill and Melinda Gates, President George Bush (both of them) and Donald Trump.
LAPD's Threat Management Unit is involved in the case -- translation, it's serious.

Lindsay Surrenders Cuffed and Headed for Jail
Lindsay Lohan just surrendered in Judge Marsha Revel's courtroom in Bev Hils, to begin her jail sentence.
A clearly upset LiLo sat and listened as Judge Revel ordered Lindsay's surrender. But before Lindsay was cuffed and taken away, the judge ordered all cameras to stop rolling.
Judge Revel made it clear -- no house arrest, and no early release. But that doesn't mean Lindsay will have to serve the full 90 days. The Sheriff's Department will use the 90 days to compute the actual time Lindsay will have to serve, and because of overcrowding, she will only serve 25% ... 23 days.
Lindsay didn't cry. When she was cuffed she was stoic.
Outside court, LiLo's lawyer Shawn Chapman Holley said Lindsay had "stepped up and accepted responsibility" -- and that LiLo was as scared as anyone would be who's heading to the slammer.

Rachel Uchitel must have picked "pill popper" out of the "Pick Your Addiction" hat -- because just a few days ago, she was telling people she didn't have any addiction of any kind.
Sources close to Rachel tell TMZ she was telling people in private -- as recently as Friday -- that she didn't have a problem with prescription medication. The one addiction Rachel would admit to? Married men.

Robert Shapiro Quits Lindsay Lohan!
TMZ has learned Bob Shapiro informed the judge in Lindsay Lohan's case, he's no longer representing her.
It is unclear who will represent Lindsay tomorrow when she turns herself in.
We do not know why Shapiro has left the case. He said publicly he would represent Lindsay only if she agreed to jail and followed his instructions.
Interestingly, Shawn Chapman Holley never signed the substitution of attorney form last Friday to get out of the case. So Shawn may be on the hook.
We're told tomorrow is going to be crazy!

Oksana Signed, Then Rejected $15 Mil Deal
TMZ has learned ... Oksana Grigorieva signed an agreement with Mel Gibson for a $15 million package, which would have kept the Mel tapes secret, but she ultimately walked away from it.
Sources tell TMZ, during the child custody mediation in May, lawyers for Mel and Oksana worked out a financial deal for Oksana -- she would get a total of $15 mil, which included child support, a house and other assets.
But sources intimately familiar with the mediation tell us Oksana promised something in return -- that all "evidence" associated with the case remain confidential.
We've learned the "evidence" includes the tapes. Oksana's lawyers had played some, but not all of the tapes for Mel's lawyers. We're told Oksana's lawyers did not play the tape in which Gibson used the N word and made a reference to "wetbacks."
As one source put it, "The tapes loomed large in the mediation. The word 'tapes' was never used in the agreement, but it was central to the deal."
Oksana and Mel both signed a "short form agreement" -- a bare-bones contract outlining the broad strokes of the deal. The lawyers then drafted a long form agreement which contained specifics of the deal, but we're told Oksana refused to sign the long form, claiming she felt coerced.
We're told Mel never paid Oksana under the deal because the short form didn't spell out the specifics of payment and Oksana refused to sign the longer agreement which contained the details.

Rep: 'Situation' Strikes Secret 'Jersey Shore' Deal
It could be the first time "The Situation" has ever done anything quietly -- his manager says Sitch steathily struck a new deal late Monday night and thinks it will end the "Jersey Shore" strike.
According to the manager, Mike "The Situation" Sorrentino "believes he and MTV have reach [sic] a great new arrangement." No mention of dollar amounts, but interestingly, the manager says the deal was sealed (though he never says it's been signed) with MTV, and not JS producers 495 Productions.
TMZ broke the story ... MTV offered The Sitch anywhere between $27,500 to $45,000 per episode over a period of time -- he was making $10k for season 2, so not bad.
But move over Moses -- Sitch's manager says, "Mike decided in order to get season 3 done he was going to have to lead the pack and wants to encourage the rest of his cast to follow his lead."
MTV had no comment about a new contract for "The Situation." We're betting his castmates will have plenty to say about it.

Sandra Bullock Gets Restraining Order ... Again
Sandra Bullock's attorney went to court this afternoon and got a temporary restraining order against a man she claims is stalking her -- and it isn't the first TRO she's gotten against him.
Bullock's attorney, Ed McPherson, got the TRO against Thomas Weldon -- who was first busted for stalking Bullock across the country back in 2003.
At the time, Weldon's family admitted he suffered from mental illness. Weldon was institutionalized in 2003.
According to docs, in July, 2010, Weldon told mental health workers he drove from Tennessee to Wyoming, "just to meet with [Bullock] at her home in Jackson Hole," adding his "delusions and fixations concerning [Bullock] had not subsided."
And this is interesting ... Sandra lists Jesse's kids -- Chandler, Jesse Jr. and Sunny -- as people who live with her part time.

Lindsay's New Lawyer: She's Going to Jail
Lindsay Lohan has officially hired Bob Shapiro to represent her in her ongoing DUI probation case ... but only on condition that she goes to jail.
TMZ broke the story earlier this week that Shapiro was stepping in after Shawn Chapman Holley quit. Shapiro, who repped O.J. Simpson, tells TMZ, "I have agreed to represent Ms. Lohan on the condition that she complies with all the terms of her probation, including a requirement of jail time that was imposed by Judge Marsha Revel."
Shapiro added, "Ms. Lohan is suffering from a disease that I am all too familiar with." The lawyer's son died of a drug overdose in 2005.

Mel Gibson Won Big In Court
The judge in the Oksana Grigorieva/Mel Gibson custody war does not believe that Mel poses any danger to his daughter ... sources tell TMZ.
Sources connected with the case say Robyn Gibson's declaration was "powerful evidence" in yesterday's hearing. TMZ broke the story ... Robyn swore under oath Mel never physically abused her or their kids in the 28 years she was married to him ... and we're told it had an impact on Judge Scott Gordon.
Before becoming a judge, Gordon was a prosecutor in the L.A. County D.A.'s Office, specializing in domestic violence. The D.V. Unit has a mantra ... a man who commits domestic violence against one woman does it to everyone he's involved with. We're told Robyn's declaration resonated in the courtroom.
Sources say in the end, Judge Gordon felt Mel posed no danger to his daughter and allowed the status quo to stand. So Gibson continues to have visitation rights with baby Lucia as well as one overnight a week.
There is a report out that Judge Gordon issued an order yesterday, requiring Gibson to surrender all firearms. That is not true. Last month, when the court issued a restraining order against Mel to stay away from Oksana, the judge followed standard procedure -- ordering the surrender of firearms. That automatically happens when the court issues a temporary domestic violence restraining order. We're told Gibson's firearms were turned over immediately.

Wesley Snipes' Appeal Denied Must Serve 3 Years
Wesley Snipes just got his ass kicked by a federal appeals court -- which denied the actor's claim that his 3 year prison sentence for tax evasion was "unreasonable."
Translation -- dude will definitely serve hard time.
Back in 2008, Snipes was found guilty of not filing tax returns from 1999 to 2001 ... and consequently failing to pay the government nearly $12,000,000.
Snipes was sentenced to 36 months in prison -- but appealed the case claiming, among other things, that his sentence was "unreasonable."
But today, the appeals court backed the original ruling -- shooting down Snipes' claims that his punishment was way too severe.
No word on when Snipes will officially check in to the big house.

Dentist's Story In Direct Conflict with Oksana
The dentist who treated Oksana Grigorieva does not believe she was struck in the mouth as she claims ... and his evaluation raises serious questions about her injuries ... TMZ has learned.
Sources familiar with Dr. Ross Shelden's medical charts, photos and examination notes tell TMZ ... Dr. Shelden saw no evidence Oksana was struck in the mouth. TMZ broke the story ... Oksana told Sheriff's deputies Mel Gibson struck her in the mouth twice, knocking one tooth out and chipping another.
Although Dr. Shelden sees no evidence of a strike to the mouth, he does have a different scenario. We've learned Dr. Shelden believes Oksana was struck in the left temple, which caused her to bite down so hard, one veneer was completely knocked out and another was damaged. The charts reflect that Oksana's teeth were fully intact.
Dr. Shelden observed a bruise on Oksana's left temple, however, we know the photos he took in his office show no such bruising. The doctor's explanation -- Oksana was reluctant to have her picture taken and covered up the bruising with her hair and makeup -- plus she was looking off to the side. As we previously reported, Oksana told the doctor Mel had hit her.
As for the mouth area, Dr. Shelden's charts reflect two bite marks on the inside of the lower lip. The doctor says there was no swelling or bruising consistent with a punch to the mouth but believes instead the bite marks are consistent with "a chain reaction" after allegedly being hit in the temple.
There is nothing in the records indicating whether the doctor believes Oksana's wounds may have been self-inflicted.

The-Dream: I Tried to Kill Myself After Breakup
R&B mogul The-Dream just posted an open letter on his website -- in which he claims he tried to commit suicide when he realized his marriage with singer Christina Milian was doomed.
The-Dream wrote, "I’ve cried about this for months, after interviews, after prayer and I’ve tried to take my own life at a point because of the failure that was looming." The two announced their split earlier this week.
But in his letter, The-Dream also apologizes to fans for "misleading everyone" into believing his marriage was fine ... when in reality he was, "simply scared and embarrassed to let everyone know we were failing."
Dream concludes the letter, "This too shall pass! And everything will be fine!"

Levi and Bristol Gunnin' for Reality Deal
Levi Johnston and Bristol Palin are already looking to bring outsiders into their upcoming marriage -- in the form of a reality TV crew ... this according to a source very familiar with the negotiations.
TMZ has learned the couple has been shopping "multiple reality shows" around town -- some of the ideas involve the couple AND their two-year-old son, Tripp.
We're told the leading concept involves all three people -- and will focus on "parenting issues."
It's unclear if the show would be based in Alaska ... or if Bristol's mom, Sarah Palin, would be involved in some capacity.
It looks like the couple could strike a deal in the near future -- we're told negotiations are "ongoing."
