Montana Fishburne Fingered in Brutality Case
TMZ has learned ... newly-minted porn star Montana Fishburne allegedly beat the hell out of her boyfriend's ex and is being prosecuted for assault with a deadly weapon.
Montana was arrested in February after allegedly barging into the alleged victim's home (the complaint does not give her name), forcing her into the bathroom and beating the crap out of her. We're told the victim had "significant injuries."
The L.A. City Attorney's Office has charged Fishburne with battery, and will be adding charges of false imprisonment and assault with a deadly weapon.
Montana, who's being repped by the effervescent Shawn Chapman Holley, has pled not guilty and the case is pending.
Fishburne's boyfriend, Jerome Greene, was also charged in the attack against his ex-girlfriend but already pled no contest to domestic battery.
As for Montana -- who is releasing her first sex tape through Vivid Entertainment -- she has big problems. She was arrested last November for prostitution. Montana pled no contest to the lesser charge of criminal trespass and was placed on probation. The judge could use the pending case to violate her probation.

Ice-T 'Outraged' Over Arrest ... Wants to Sue DMV
Ice-T is adamant that he will have his "revenge" for his arrest in NYC a few weeks ago, but he's not looking to get back at the cop -- he wants to take out his anger on the DMV ... with a big, fat lawsuit.
As TMZ first reported, Ice was busted on July 20 -- and dude tells us it was all because the cop found "something in the computer called an insurance lapse from 2008."
Ice claims the cop could have just issued a ticket and send him on his way -- but instead, the officer chose to arrest him simply, "Because he could."
Last night, Ice told us the whole thing is pure BS -- and that the computer reading was the result of an error made by either the DMV or his insurance company.
So what's Ice's next move?? Dude tells us, "At the end of the day, after I get this dismissed … I either can sue the DMV or the insurance company … and that’s when I have my revenge."

Oksana Claims Mel Targeted TMZ Exec in Death Plot
There's a story circulating that Oksana Grigorieva told authorities Mel Gibson plotted to break the kneecaps of a "Hollywood figure." Well that story is about TMZ's Harvey Levin, spoon-fed by Oksana's people.
The story is much wilder than reported. Earlier this week, Oksana's rep, Steve Jaffe, told Harvey that Mel had described to Oksana a plot to kill Harvey. Jaffe said Oksana claimed Mel told her he was furious that TMZ broke the story about the anti-Semitic rant following Mel's 2006 DUI arrest. Jaffe said Oksana told him Mel had said he wanted the "blood of Jews" on his hands.
According to Jaffe, Oksana said Mel told her he had someone do "surveillance" on Harvey earlier this year, having him followed to the gym at 4 AM.
The plan, Jaffe said, was to "kidnap" Harvey, strip him, take him deep into the desert, break his kneecaps and leave him to die.
Jaffe told Harvey the story on the heels of complaining that a particular TMZ post was not favorable enough to Oksana.
We checked the "kneecap" story out and determined it was false. For starters, Oksana had the wrong gym. More telling ... Oksana never mentioned a word of this to any of her lawyers while she tried negotiating a $15 million package in May during the mediation, using the tapes as her secret weapon. One person involved in the mediation laughed, saying Oksana brought out every piece of ammunition imaginable to score a financial package, so why was this story mysteriously absent?
Oksana claims to have told the Sheriff's Department the story. It seems deputies took it so seriously ... they never even contacted Harvey to give him a heads up that someone wanted him dead ... allegedly.
UPDATE: Sheriff's Department spokesperson Steve Whitmore tells TMZ, "We categorically deny that any such information was ever given to the L.A. County Sheriff's Department."

Indiana cops claim they found pot and other illegal drugs in two of Bret Michaels' tour buses last night.
The DeKalb County Sheriff's Office tells TMZ Bret was onboard one of buses when cops made the stop at around 11:30 PM. K9s found the pot. One of the buses -- not the one Bret was on -- had Schedule II controlled substances inside, and cops tells us they're illegal drugs.
Citations were issued but no arrests were made. The case is being forwarded to DeKalb prosecutors.
Michaels' rep gave us the following statement:
"Two of Bret’s tour buses were pulled over late last night. Officers on the scene claimed there were no trailer tag lights. No arrests were made. Mr. Michaels allowed an open search of the buses and everything was handled in a professional manner."

Michael's Rehab Plan for Lindsay: Get Medieval
Lindsay Lohan's life is hardly a fairy tale, but her father's rehab plan for her is straight out of Brothers Grimm -- because it involves locking her in a lavish castle in the middle of ... Long Island.
As we first reported, Michael Lohan asked the judge in Lindsay's DUI case to send LiLo to inpatient rehab in lieu of sending her to jail for missing alcohol education classes ... and the place Michael suggested to send her is the very pricey Oheka Castle.
Only two problems: First, the castle isn't a rehab facility, it's a lavish hotel and resort where celebs like Kevin Jonas get married.
Second, a rep for Oheka tells TMZ it would cost $10,000 a day to rent the top section of the castle -- the only part that's isolated enough to serve as a rehab getaway.
That's a little steep for Lindsay these days, but Michael claims, "several family members have come forward" to help pay for Lindsay's treatment. He's also hoping the castle's owner will give him a friends and family discount.
Once upon a time, indeed.

It's unclear exactly why the case was dismissed.
