A Martina McBride concert got too rowdy for a California man who was roughed up and slammed to the concrete because he asked a security officer, "Are you an idiot?" ... according to a new lawsuit.

Michael Frydrych claims he and his wife were given complimentary tickets to the country singer's show at the Fantasy Springs Resort Casino. Once inside they moved up to sit with a friend who had better seats.

He says security came over and told them switching seats was prohibited. Frydrych says he then asked the guy -- in a "non-confrontational" way -- "May I ask you a question, are you an idiot?"

This pissed the guard off and, according to legal docs, 5 or 6 people swarmed in and grabbed Frydrych, zip tied his wrists and slammed him to the floor, causing his head to bleed.

Frydrych claims he was taken to a back room and interrogated ... then released and told it was his "lucky day."

The couple is suing the casino and wants hefty damages for Michael's injuries.

The bar where Jose Fernandez and his 2 friends were last seen partying and drinking before the fatal boat crash will NOT be investigated for possibly over serving the group ... officials tell TMZ Sports.

An ex-showrunner over at "Criminal Minds" has a situation on his hands that's less feet-kicking-legs and more teeth-biting-ass ... according to an alleged victim.

Construction worker Timothy Swing tells us he was working this week at the home of former "Criminal Minds" executive producer Edward Bernero when 1 of Ed's 3 Dobermans sank its teeth into his right butt cheek.

Tim says he got a tetanus shot at urgent care, and Edward offered him $3k to make the whole thing go away.

Here's the problem ... Tim says he was poised to rake in almost $13k from the 5 month gig before getting chomped on day 2 ... and Ed never made good on the payment.

Ed has a very different story. He says Tim called the dogs over and started playing with 1 before another jumped on him from behind and scratched him -- that's it. Ed says he felt bad and wanted to help with the bill, until Tim demanded $3k.

Meanwhile, Tim tells us Ed has reached out and offered him some cash ... in return for a promise not to sue.

Robert Durst has been extradited and is now in an L.A. County jail, awaiting a court hearing where he will be arraigned on the charge of first degree murder in the death of Susan Berman ... TMZ has learned.

Durst was the subject of the docuseries 'The Jinx,' where he made a statement some say was incriminating and others say a downright confession when he uttered the words, "killed them all."

Berman was murdered in 2000, and authorities believe Durst killed her because she knew something about the mysterious death of his wife, Kathleen, who disappeared in 1982.

We've learned Durst will plead not guilty to the charge when he is arraigned in L.A. Superior Court on Monday.

He has a powerful, multi-state legal team, which includes Dick DeGuerin, Chip Lewis, David Chesnoff and Don Re ... all of whom have won big murder cases.

We've learned he was taken from an Indiana federal prison to L.A. County jail, where he will await his court appearance.

Durst is being held without bail.

Oklahoma running back Joe Mixon didn't just rip up a parking ticket -- he threw it at the campus parking attendant's face ... this according to the police report obtained by TMZ Sports.

In other words ... assault with a paper weapon?

Mixon -- one of the top running backs in the country -- already admitted to the Nov. 1st incident on the OU campus and said he regretted tearing up the parking ticket in front of the attendant.

But according to the police report filed with the University of Oklahoma PD -- the accuser told cops Mixon "threw a torn up parking citation, which allegedly struck the victim in the face."

The university suspended Mixon for 1 game over the incident.

Dani Mathers -- the Playboy Playmate who secretly took a pic of a naked woman at an L.A. gym and then shamed her on social media -- has just been charged with the crime of invasion of privacy ... TMZ has learned.

As we reported, Mathers was at her LA Fitness and zeroed in on an elderly woman who was changing clothes in the locker room. She posted the pic and then tagged it, "If I can't unsee this then you can't either."

It took some hunting by LAPD detectives, but they found the victim, who was game to have Mathers prosecuted.

The L.A. City Attorney has now pulled the trigger. If convicted she faces 6 months in jail.

Mathers is also persona non grata at LA Fitness.

Dani's attorney, Tom Mesereau, tells TMZ, "I’m disappointed that she was charged with any type of violation. She never intentionally violated anyone’s privacy and never tried to break the law at any time."

Jared Fogle was a devious master at keeping his double lives separated ... according to his now ex-wife who's speaking out about his child porn conviction for the first time.

Kathleen McLaughlin says she was completely shocked the day FBI agents barged into their Indiana home with search warrants. She told "CBS This Morning" ... "He had 2 lives going on. He was able to keep those 2 very separate in a way I couldn't even fathom."

TMZ broke the story ... Kathleen sued Subway, accusing the sandwich giant of using him as its pitchman despite knowing he was a pedophile.

The Los Angeles County District Attorney officially has the case involving the man who vandalized Donald Trump's Hollywood Walk of Fame star, and law enforcement sources tell us ... felony prosecution is highly likely.

We're told the LAPD has completed its investigation into James Otis, and it wasn't all that difficult given there's video of him sledgehammering the star, and he confessed to boot.

We're told the case file was sent to the D.A. for possible felony vandalism, which is punishable by 3 years in prison.

ABC News lifted a photo of NYC's fattest cat and posted it without permission ... according to the photographer who's now suing the network.

Stephen Yang is a professional photog who typically licenses his pics, but in his lawsuit he says ABC News used his shot of Samson -- dubbed the largest cat in NYC at 28 pounds -- and never paid him a dime.

According to the docs ... Samson got famous for his size, and also because his owner, Jonathan Zurbel, takes the enormous pussycat all over Brooklyn in a pet stroller. So hipster.

Yang says all that attention is why ABC News posted its story on Aug. 12th with his jacked photo. The story's been shared more than 900 times on Facebook, and Yang is suing for a cut of ABC's profits.

Texas Rangers pitcher Jeremy Jeffress has officially been charged with DWI stemming from his August arrest -- a charge that a carries a MINIMUM of 72 hours in jail.

Jeffress was pulled over in the early hours of August 26th -- and during the stop, cops say he admitted to drinking 3 to 4 cups of Hennessy and Coke before he got behind the wheel.

Also, cops say he peed himself during the arrest.

According to court documents, Jeffress has now been charged with DWI -- a class B misdemeanor -- and in Texas that's a big deal. We're talkin' a minimum of 72 hours behind bars ... and a possible 180 days if the judge throws the book at him (though unlikely).

Jeffress went to rehab after the arrest -- and rejoined the team after roughly a month in treatment.

He's due back in court on Dec. 15th.

The Philadelphia Eagles have released wide receiver Josh Huff -- just 2 days after he was arrested for DUI with a gun, ammunition and weed in his car.

Huff was the special teams player of the week on October 26th after returning a kickoff 98 yards for a touchdown on the 23rd.

Huff was arrested on Tuesday near Philadelphia -- he was originally pulled over for speeding and illegal window tinting. During the stops, cops say they found a handgun (that allegedly wasn't licensed) and hollow point bullets.

This topless pic of 'Real Housewives of Orange County' star Vicki Gunvalson has triggered an FBI complaint, and the agency is now looking into it ... TMZ has learned.

The pic was taken in Dublin, Ireland where cast members were on a retreat. Production sources say Tamra Judge took the pic and sent it to other cast members and producers with some snarky comments.

Somehow, the photo ended up on the social media account of a 15-year-old girl, who tweeted it out.

A woman named Rosalie saw the photo and filed a complaint with the FBI, saying "Tamara Judge ... sent a nude photograph of an acquaintance of hers (taken at a small gathering) to a FIFTEEN YEAR OLD girl & asked her to distribute it online in an effort to humiliate & harass one Vicki Gunvalson."

We reached out to Tamra ... sources close to her tell us she didn't leak the photo or in any way facilitate it getting into the hands of a minor.

The FBI is evaluating it but has not yet opened a formal investigation ... law enforcement sources tell us.

As for why Vicki posed topless ... fellow castmate Heather Dubrow was FaceTiming her hubby, "Botched" plastic surgeon Terry Dubrow, and Vicki wanted him to examine her nipples, which she felt were uneven.

Chris Brown got a judge to see eye to eye with him, for once -- he's scored protection from an obsessed fan who's been repeatedly busted for showing up uninvited at his house.

Danielle Patti must stay away from Breezy, his home and his shows for 5 years ... according to the judge's order. Chris' lawyer, Setara Qassim, was in court where it was decided Patti's not a high risk right now -- she's currently in a mental hospital as a result of her last trespassing arrest at Chris' house.

TMZ broke the story ... she was first arrested in December at CB's property, then again in April ... when Chris says she shouted some graphic sexual comments.

Unclear when Patti will be released, but Chris can rest a little easier now.

"American Idol" finalist Curtis "C.J." Harris is back behind bars -- and will be for the next month -- all because he claims he mixed up his dates.

Law enforcement officials in Alabama tell TMZ ... Harris turned himself in Monday after an arrest warrant was issued due to his skipping out on a court date last month.

Harris was supposed to be in court Oct. 27 for his drug arrest, but we're told he claims he confused that for another date. We broke the story ... Harris was arrested in an undercover drug bust for selling oxycodone and marijuana. He's facing 3 felonies.

Harris will now be held without bail until a hearing later this month.

12:25 PM PT -- A spokesperson for Lu's station, KTLA, tells us the arrest is a misunderstanding -- she noticed the earbuds were left behind, and picked them up, "intending to return them to the owner whom she had been speaking with while in line to clear TSA."

The spokesperson says when Lu was unable to locate the owner, she boarded her flight -- but she is fully cooperating with authorities.

Former Miss USA Lu Parker is under arrest for pilfering a pair of high-end headphones at LAX ... TMZ has learned.

The 1994 pageant winner, and current news anchor in L.A., allegedly lifted the headphones Wednesday morning at the TSA screening area in Terminal 6. Law enforcement sources tell us she walked to her gate and boarded her flight.

We're told cops saw Lu take the audio gear on CCTV cams, and tracked her down on the plane before it left. Officers hauled her off the jet and took her into custody. The headphones are worth $200, so she's looking at a misdemeanor theft.

Really bad luck for Parker -- we're told the owner of the headphones is an LAPD Robbery Homicide detective.

Parker famously dated former L.A. Mayor Antonio Villaraigosa several years ago, but they've broken up.

Stevie J is about to get some baby news he may not want, with the help of a judge and even a little bloodletting.

Joseline Hernandez just filed legal docs demanding that Stevie J take a paternity test, and she's so positive it will prove he's the father of her unborn baby ... she's also asking for child support and a parenting plan.

Stevie has been vague about the kid, not publicly saying it's his but not denying it either.

Joseline claims in the legal docs Stevie has privately agreed to pay her medical expenses associated with the pregnancy, although she does not say he fessed up to fatherhood.

It's now apparent she doesn't think she'll get any money from him, so she's asking a judge to extract it, and STAT.

Joseline's due in January, and now, based on some new medical advancements, all she needs to do is have some blood drawn and ... voila -- Stevie J will know his fate.
