Meek Mill Appeals Judge Brinkley's Decision ... to PA Supreme Court

Published | Updated

Meek Mill's legal team just filed new legal docs asking Pennsylvania's highest court to remove Judge Genece Brinkley from his case ... on the heels of her denying him a new trial.

The appeal to the PA Supreme Court comes just 3 days after Brinkley ruled Meek's side failed to meet its burden of proof. It was a shocking decision given even the D.A. had repeatedly stated Meek deserved a new trial, considering his arresting officer -- the only witness in Meek's 2008 trial -- is a key figure in a massive Philadelphia police corruption scandal.

In legal docs, obtained by TMZ, Meek's lawyers are adamant Brinkley had made up her mind before Meek's hearing concluded earlier this week. Lawyers cite the transcript which they claim shows Brinkley lacking impartiality because "she acted like a prosecutor, not a judge." Interesting ... even the real prosecutor thinks Meek deserves a new trial.

As we reported ... Meek's team accused Brinkley of laughing at one of their key witnesses, but they also point to another fiery exchange triggered after Brinkley said, "... because obviously we know that it's going to go to another court after here." Meek's lawyer, Brian McMonagle, asked if she's implying she'd already made up her mind and realized her decision would be appealed to a higher court. She denied it.

Meek's lawyer, Joe Tacopina, called Brinkley's ruling a "miscarriage of justice."

Ed Sheeran Sued for Ripping Off Marvin Gaye 'Let's Get it On' ... In Court

Published | Updated

Ed Sheeran is on the receiving end of a monster $100 million lawsuit by a company claiming the singer ripped off a Marvin Gaye classic.

A company called Structured Asset Sales filed the lawsuit, claiming Ed's song, "Thinking Out Loud," is a carbon copy of Gaye's "Let's Get it On."

According to the lawsuit, Sheeran's song has the same melody, rhythms, harmonies, drums, bassline, backing chorus, tempo, syncopation and looping as "Let's Get it On."

Gaye's song was written by a guy named Edward Townsend and Gaye in 1973. Townsend died in 2003, and Structured Asset Sales bought one third of the copyright. So, take that in ... the claim is that just 1/3 of the song is worth $100 MIL!.

Sheeran's song was a huge hit ... nominated for a Grammy for Best Record, Best Performance and Song of the Year in 2016.

And, according to the docs, Ed's single and the album it's on -- "X" -- sold more than 15 million copies and the song has been played on YouTube more than a billion times.

Sheeran has already been sued by Townsend's heirs. He called BS on that suit. No word if the Gaye family might also sue.

The Bergen County Prosecutor’s Office says the investigation is ongoing and notes that the charges are "merely accusations. Defendant presumed innocent."

DON'T BITE THE HAND THAT FED YOU ...

Damon Dash says Lee Daniels had no problem asking him for money and exploiting his goodwill, but he has a major problem keeping his word to pay it back ... and Dame's sick of it.

The Roc-A-Fella mogul told us Wednesday on "TMZ Live" ... Daniels ended up millions in the hole to him after making 2 movies -- 2004's "The Woodsman" and 2005's "Shadowboxer."

According to Dame ... Daniels promised him he'd get his money back no matter what, but then blew him off -- which is why Dash started suing Daniels in 2014. As we reported, they struck a settlement deal, but Damon tells us Lee's sticking to his "culture vulture" ways ... and still hasn't squared up.

THE HEATED ARGUMENT

Before he filed a new suit, Damon confronted Lee at a Diana Ross concert about getting stiffed ... and Daniels appeared to be contrite. Apparently, not enough to please Damon and keep their issue out of court.

Dash is suing Daniels -- again -- this time for $5 million.

According to court docs, obtained by TMZ, an L.A. jury awarded Steven Lamar a whopping $25,247,350 Wednesday ... after ruling the music moguls hadn't paid him for design work he did on 3 models of Beats headphones -- the Studio 2 Remastered, the Studio 2 Wireless and the Studio 3.

Dre and Jimmy had previously argued Lamar was only owed royalties on the first model. Lamar sued and the jury agreed he had fulfilled his end of the bargain with the Beats honchos.

$25 mil checks can't be easy to write ... even when you're as rich as Dre and Iovine.

'Braxton Family Values' Cast Walks Out Over I$$ue$ ... Show on Hiatus

Published | Updated

"Braxton Family Values" is on an indefinite break after the sisters and their mother made a family decision -- no taping until they're paid what they're worth.

Sources connected to the show tell us the entire cast -- Tamar, Toni, Towanda, Traci, Trina and mom Evelyn -- was scheduled to shoot in Atlanta last week, but only Traci showed up ... so WE tv sent the crew home and pulled the plug on taping.

Our sources say the Braxton women are refusing to return to work until the network and Magical Elves production company renegotiate their contracts for the second half of season 6.

The major bones of contention, we're told -- the cast feels their wardrobe and travel stipends are so low it's laughable. They also want their salaries increased to an "appropriate" level.

WE tv declined to comment, but sources close to the situation tell us the Braxtons are under contract through season 9. We also reached out to Magical Elves ... no word back so far.

Ronnie Ortiz-Magro Friends Afraid He'll Be in Danger If He Goes Back to Jen

Published | Updated

Ronnie Ortiz-Magro's friends are warning the 'Jersey Shore' star to cut ties with his baby mama, out of fears her latest domestic violence arrest is a bad omen of what's to come if he stays with her.

Sources close to Ronnie tell us he's been trying hard to have a good relationship with Jen Harley because he's worried she'll take full custody of their daughter. We're told that's the only reason he was at a BBQ with her Sunday, hours before she allegedly dragged him outside their car.

Ronnie's friends are telling him it's time to quit playing family man and look out for his safety and his daughter's, and they say that means staying away from Jen. We're told friends are also advising him to handle the custody situation in court, because there's no upside to reconciling with Jen at this point.

TMZ broke the story, Harley allegedly attacked Ronnie in their car on the way home from a Vegas BBQ. We're told their 2-month-old daughter, Ariana, was in the car at the time ... and there's growing concern she could be caught in the middle of any future fights.

Harley was also named the suspect in a battery investigation after she allegedly spit on and hit Ronnie 3 weeks ago during an argument over their daughter and dead dog.

'Jersey Shore' cameras weren't rolling during Jen and Ronnie's latest incident, but we're told their constant fighting will be a featured story line on the show.

Now, we've learned the case went to trial in front of a judge -- and, on Tuesday, Floyd Sr. was found not guilty.

Ron Jeremy Sued for Sexual Assault & Battery ... In Washington State

Published | Updated

Ron Jeremy is being called out again for allegedly committing sexual assault on a woman in Washington State, only this time he's going to civil court ... TMZ has learned.

The former porn star just got slapped with a lawsuit stemming from an alleged incident in September 2017 -- the same one for which he was criminally investigated earlier this year.

We broke the story ... the Tacoma City Attorney's Office declined to file charges against Jeremy after a woman claimed he'd sexually assaulted her at a radio promotional event where she was modeling for the station. It's unclear why prosecutors rejected the case.

Now, that same woman -- who only goes by K.B. in her suit -- is suing Jeremy for what she claims was sexual assault and battery ... and the details are quite graphic.

According to the docs, K.B. claims Jeremy assaulted her 4 times on the day in question. First, K.B. says she agreed to let Jeremy to sign her breasts -- but instead, she says he pulled down her shirt, reached under her bra and "violently groped" her breast.

She goes on to say he then squeezed her butt during a selfie, sucked on the back of her neck and pushed his finger inside her through her underwear ... allegedly asking, "Did that give you goosebumps?"

K.B. also says Jeremy's handler tried stepping in to stop him, adding Jeremy allegedly replied with, "I'll be done in a sec." She says the final assault occurred as she tried leaving, when Jeremy allegedly pulled down her shirt again and sucked on her exposed nipple.

The woman claims she's suffered PTSD since then, and even attributes a miscarriage she had to the alleged assaults. She suing for damages.

We reached out to Ron for comment ... no word back yet.

Terry Crews 50 Cent's Ignoring One Big Fact About Sexual Assault

Published | Updated

Terry Crews is refusing to fire back at 50 Cent with insults after the rapper trolled his sexual assault case against a Hollywood agent -- instead, he's dropping facts.

We got Terry in D.C. Tuesday and asked him how he felt about 50 mocking him on Instagram. He took the high road, saying he loves 50 and listens to his music when he works out.

As for the crude meme 50 posted -- which suggests it's not possible for Crews to be sexually assaulted because he's big and muscular -- Terry had a direct message for him, explaining why Fiddy's way off base.

Crews was on Capitol Hill Tuesday to testify for the Senate Judiciary Committee about his experience with sexual assault. As we reported, he got emotional explaining why he didn't physically respond when WME talent agent Adam Venit allegedly groped his genitals.

We broke the story ... the L.A. City Attorney's Office rejected the sexual assault case against Venit because Crews' allegation had fallen outside of the statute of limitations. Terry still has a pending civil suit against him though.

Terry Crews Here's Why I Didn't Get Violent ... During My Sexual Assault

The "Brooklyn Nine-Nine" star testified about sexual assault Tuesday in front of the U.S. Senate Judiciary Committee, giving insight into his own experience.

When CA Senator Dianne Feinstein asked Crews why he didn't physically respond to Adam Venit after the agent allegedly touched his privates at a party, he was blunt -- saying it's about consequences black men in America face every day if they resort to violence.

TMZ broke the story ... the L.A. City Attorney's Office declined to prosecute Venit because Crews' allegation had fallen outside of the statute of limitations.

Side note: Kei seems pretty ride or die. Mazel to the happy couple!

Meek Mill No New Trial!!! Judge Brinkley Slams Door Again

Published | Updated

7:43 AM PT -- Meek's attorney, Joe Tacopina, tells TMZ, "Judge Brinkley made clear during the hearing on June 18th that she had already decided the matter. We continue to believe that this miscarriage of justice will be corrected upon further review, and that the public’s confidence in the impartiality of the judicial system in Pennsylvania will be restored."

Meek Mill will NOT get a new trial -- Judge Genece Brinkley shut down his motion, despite prosecutors acknowledging he should get one.

Brinkley made her stunning ruling Monday, saying, "After an in-depth review of the record, court history, notes of testimony, and evidence submitted at the evidentiary hearing, this court hereby denies defendant's petition for PCRA relief as defendant failed to meet his burden of proof."

It's shocking because even the D.A. repeatedly stated Meek deserved a new trial due to the fact his arresting officer -- the sole witness in Meek's 2008 trial -- is at the center of a massive Philadelphia police corruption scandal.

In her ruling, the judge basically dismisses the notion the cop who arrested Meek, Officer Graham, is really dirty because the fellow officer who fingered him isn't credible. In other words, Graham can't be dirty because another dirty cop said he is. She also dismisses the fact Graham failed a polygraph test about pocketing money.

Judge Brinkley added ... even IF you believe Graham was a dirty cop, she believes it would NOT have changed the jury's guilty verdict in 2008.

You'll recall ... the PA Supreme Court released Meek on bail back in April, from his 2-4 year prison sentence, pending the hearing for a new trial.

If nothing else, Brinkley's been consistent, but it's a no-brainer -- Meek's team will appeal this latest ruling.
