Robert Kraft Sex Spa Video Blocked Again ... Prosecutors Lose Appeal

Another huge victory in court for Robert Kraft ... video allegedly showing the Patriots owner receiving sex acts in a massage spa has been ruled INADMISSIBLE once again.
The 79-year-old's dream team of attorneys had successfully argued last year that Feb. 2019 footage of Kraft inside a Jupiter, Fla. day spa violated his rights and should NOT be allowed to be used in the case against him.
But, prosecutors appealed the decision to the Florida Fourth District Court of Appeal ... and said at a June hearing that police had every right to roll on Kraft.
On Wednesday ... judges sided with the New England owner -- saying in a lengthy opinion that cops screwed up in the way they went about recording video inside of the spa.
In the opinion, the judges say Kraft -- and others who received legitimate non-sexual massages -- had a reasonable right to privacy inside the facility.
The judges also say officers didn't do enough in their surveillance to protect those innocent people who were inside the spa getting perfectly legal massages.
Prosecutors now have the option to appeal yet again to a higher court ... but this is likely the last stop.
In other words, seems the footage has been officially blocked for good.
It's a huge deal for RK ... officials have hit him with 2 charges of soliciting prostitution and he was realistically looking at a fine and community service if convicted -- but with no smoking gun video, it'll be much harder to get a conviction.
A spokesperson for Kraft tells TMZ Sports the Pats owner is "pleased" with the ruling -- noting that it effectively blocks footage "that should never have been taken."
"In doing so, the appellate panel unanimously agreed with every judge who has examined these issues and ruled that law enforcement acted unconstitutionally when conducting their investigation."
"This ruling protects the constitutional rights and civil liberties of all the men and women who were illegally spied on in this case. More broadly, this ruling will further protect the civil liberties of all Americans, by helping prevent future 4th Amendment violations like those that occurred in this case."

Uncle Sam is shutting down Jeff Lowe ... suspending his license to show off wild animals at Joe Exotic's old zoo ... at least for now.
A rep for The U.S. Department of Agriculture tells TMZ ... the 'Tiger King' star's exhibitor license for the Greater Wynnewood Exotic Animal Park -- formerly known as the G.W. Zoo under Joe's command -- was suspended this week for 21 days.
We're told the suspension is the result of "recent inspections" at the zoo that were less than favorable. As we reported, investigators said several of Jeff's animals appeared to be weak and neglected. There was also a 16-week-old lion cub who was so thin, she could barely stand ... and was immediately taken to a vet.
Jeff called BS on the inspection, but clearly, USDA officials felt strong enough about their findings to pull his license. An exhibitor's license essentially allows a zookeeper to display everything from big cats, bears, primates and other USDA-regulated species. Without it, Lowe can't really run the zoo.
As for his suspension, Jeff says he and his team are confident they will be able to produce evidence to prove his animals are healthy. He also tells us that once he's back up and running, he's putting together a virtual zoo that visitors can access from home to check on the animals.
As you'd expect, PETA's already dancing on Jeff's metaphorical grave. The org thinks the suspension should be followed by a permanent revocation of his license ... although, the feds aren't saying that's on the table.

Britney Spears is looking to make some big changes to her conservatorship -- and she's firmly against her father, Jamie, continuing to run the whole show.
Britney's court-appointed attorney just filed new court docs spelling out Britney's wishes -- she wants Jamie Spears out as sole conservator over her estate and appears to want the woman who since last Fall has been calling the shots to be the permanent conservator over her regular person.
In the docs, the lawyer says Britney "strongly prefers" keeping Jodi Montgomery in the position -- who has been assigned as the temporary conservator over Britney's person for nearly a year now. At this point, she says she wants to put her in that role permanently.
As for her business affairs, Britney's attorney says she doesn't want Jamie to be the only one handling her estate anymore -- which he's been managing exclusively since 2019 when his co-conservator resigned.
Instead, he says Britney prefers a "qualified corporate fiduciary" to manage the business affairs of her estate. But, what's unclear in the docs is if she's okay with keeping Jamie on as a co-conservator at all.
Sources with knowledge of the situation tell us conversations have been had about adding a corporate fiduciary -- which we're told would likely be a bank -- but that the talks have included Jamie staying on as co-conservator of the estate. The wording from Britney's side in the docs isn't clear if she's still open to that arrangement or not.
The docs also say what we told you last year ... Britney no longer wants to perform at this time -- as in, no more Vegas residency. The attorney says a major overhaul in how her conservatorship is run is needed to reflect her current lifestyle and her wishes.
Britney's attorney is seeking input on these matters from all others involved in her conservatorship. There's a hearing on the matter on Wednesday.

President Trump I'm Pardoning Susan B. Anthony ... For Voting in 1872
President Trump has revealed whom he's going to pardon this week -- and no, it's not Joe Exotic ... strangely, it's Susan B. Anthony.
DT made the announcement Tuesday after hyping up the fact the day prior he was going to pardon someone major, saying Anthony shouldn't have been found guilty for casting a vote in the presidential election of 1872 ... which was illegal for women to do back then.

Susan broke the voting law in protest that year when Ulysses S. Grant was facing off against Horace Greeley. Like we said, only men were allowed to cast ballots in those times -- but the women's suffrage movement was in full swing ... and Susan was leading the charge. She and about a dozen other women were given access to the booths.
She was one of many arrested and tried for voting -- but the judge presiding over her case actually directed the jury to hand down a guilty verdict, which they did. All she had to do was pay a $100 fine, but she resisted ... standing on principle she'd done nothing wrong.
Funny enough, the Supreme Court later ruled that it was wrong for a federal judge to direct a verdict out of a jury -- but Anthony's conviction still stood in the books ... until now, that is.

Remember ... the evidence in the case has recently been questioned and eyewitness have since recanted testimony pinning C-Murder to the crime. Jurors were also allegedly pressured to vote guilty.
Kim's joining forces with C-Murder's ex-girlfriend, Monica, and Master P tells us he appreciates them both coming forward to help his brother, as long as it's for all the right reasons. MP says it's important for the case to be dealt with respectfully, because it's near and dear to his family's heart.

Jam Master Jay 2 Men Indicted for His Murder After 18 Years ... Family has 'Mixed Emotions'

6:41 AM PT -- 8/18 -- Jay's family says their feelings are mixed upon hearing the news, but they hope these indictments truly lead to justice being served.
The Mizell family adds that for other families who have gone through years of suffering and "lingering pain" ... they pray Jay's case gives them hope for closure, and it "brings awareness to the fact that Black lives do matter."
12:41 PM PT -- The motive behind Jam Master Jay’s murder was that one of the suspects had been cut out of a drug deal … according to the U.S. Attorney’s Office.
According to federal prosecutors … the investigation revealed Jay had acquired 10 kilos of cocaine to be distributed in Maryland by Washington, Jordan and others, but Jay allegedly told Washington he was not going to be involved.
So, authorities allege the 2 suspects entered Jay’s studio around 7:30 PM armed with firearms, and Jordan fired 2 shots at close range … one of which hit the Run-DMC DJ in the head and killed him. The second shot struck another person in the leg.
Each man is charged with murder while engaged in narcotics trafficking and firearm-related murder for the fatal shooting. Jordan is also charged with one count of conspiracy to distribute cocaine and 7 counts of cocaine distribution.
Both men are facing 20 years to life in prison, or possibly even the death penalty, if convicted.
The murder of Run-DMC DJ Jam Master Jay has been a mystery for nearly 2 decades ... but 2 men are finally in custody for the crime, TMZ has confirmed.
Jay was shot to death on October 30, 2002, in a recording studio in Queens, and now federal prosecutors are indicting Ronald Washington and Karl Jordan, Jr. for the crime.
The 2 men have long been suspects, but the feds finally feel they have the goods to prosecute them on charges of murder while engaged in drug trafficking.
Federal prosecutors are expected to announce the charges some time Monday, as was first reported by the NY Times.
Washington is already serving a federal sentence for robbery, and Jordan was taken into custody Sunday.
JMJ, real name Jason Mizell, was just 37 when he was killed.

Australian Cop Flung Trying to Cling to Car Door ... During Crazy Getaway
One Australian cop can now say he does his own stunts -- because that's exactly what it looked like as he went flying through the air trying to stop a guy who allegedly jacked a car.
A Victoria police officer got roped into an action movie scene late last week in Melbourne, while attempting to detain a man who cops say was making an escape in a stolen car -- allegedly, because he was breaking the country's stage four lockdown restrictions.
The man didn't wanna talk though, and according to authorities ... hopped into this whip and tried driving off. This one cop wasn't about to let him off easy, as he tried yanking the dude out through the driver side, but things went left when they started going in reverse.
Because of his position on the door, the officer was flung back when the car hit another one behind it on impact. His body was thrown at least 10 feet or so, and he hits a parked car incredibly hard before springing back up and continuing to give chase to the getaway driver.
We gotta say, the cop here is pretty tough all things considered. He's said to have only suffered minor injuries from the scary encounter. As for the suspect, he was reportedly apprehended and booked on several charges. Also ... they say he contracted COVID-19.

Kim writes, "On January 18, 2002 a tragedy occurred when a young man was killed. The next day Corey Miller was arrested for the murder." She went on to say he was convicted on a ruling of 10-2, and that if his trial happened today ... it would have to be unanimous.
She says true justice means catching the actual killer -- C-Murder was accused of fatally shooting a 16-year-old at a Louisiana club -- and that in light of these new developments over the past several years, it's time to get him out, or have him retried at the very least.
Right now, C-Murder is serving a life sentence at the Louisiana State Penitentiary.

Connecticut Prison Inmate Suicide by Hanging ... Used Own Face Mask
A prison inmate in Connecticut hanged himself behind bars, and officials say he did it with the very face mask they provided him to fight off COVID-19.
32-year-old Daniel Ocasio was found dead Wednesday at the Corrigan-Radgowski Correctional Center in Montville, with a ligature tied around his neck. That ligature was from the cloth mask issued to every inmate to prevent the spread of coronavirus from inside.
The Connecticut DOC says he was discovered in his cell around 5 AM, after which life-saving measures were administered ... before he was transferred to a hospital and later pronounced dead. The Medical Examiner's Office there ruled his death to be a suicide by hanging.
Ocasio had been at the prison since August 5 on a 3rd-degree burglary charge ... held on a $10,000 bond. Usually, paying 10% of that amount up front will get someone sprung.
The DOC says it's conducting an investigation into Ocasio's death. Also of note, upwards of 1,300 inmates in their system have tested positive for COVID-19 ... at least 7 have died.

According to the divorce judgment, the judge signed off on Ewan and Eve's split of the property from their 22-year marriage ... and they'll be splitting royalties and residuals from the projects Ewan worked on during the marriage. According to the docs, Ewan will keep THIRTY vehicles, and Eve gets to keep a $6.62 million L.A. crib ... plus all of her jewelry, some bank accounts, along with a mere 5 vehicles. She'll also get $501,704 in cash to even out the asset split.
Eve will also get base child support of $14,934 per month and base spousal support of $35,868 per month ... plus additional kickers if Ewan earns more money than usual in a given year. The exes are sharing joint legal and physical custody of their 9-year-old daughter, Anouk.
As we first reported ... Ewan filed for divorce back in January 2018.

2:51 PM PT -- Carole is shooting down allegations her missing husband is buried on her property under or inside a septic tank.
CB claims the rumors were started by a disgruntled employee, who was fired 3 years after Don's disappearance.
Carole says she would have looked inside the septic tank to see if he fell in if the theory held any water.
Speaking of water, she also says there wasn't much rain the year Don went missing and doubts he drowned.
Carole says she doesn't recall the septic tank needing to be filled with dirt, and posits the dirt could have been used for something else on the property.
The case of Carole Baskin's disappeared husband, Don Lewis, is going the route of 'Don't F**k with Cats' -- with an online group claiming it's dug up a massive, and crappy, clue about where his body might be.
Jack Smith -- the spokesman now repping Don's family -- tells us he and a group of internet sleuths joined forces earlier this year after the premiere of 'Tiger King' and formed a Facebook group to search for the truth about Don's still-unsolved disappearance in 1997.
Welp, we're told the group believes it discovered a new lead, tied to an existing theory about Don -- namely, that he was allegedly buried on his and Carole's animal sanctuary property under a septic tank system.
According to Jack ... the research team has obtained the actual receipts and permit paperwork for the septic tank's installation. Carole has publicly acknowledged two septic tanks -- one that she claims was installed well before Don's disappearance, and another installed well afterward.

BUT, if you believe what Jack and co. claim these receipts show ... a septic tank system was, in fact, worked on and installed right around the time of Don's disappearance ... 23 years ago this month.
They claim the receipts show a permit to install the septic tank was pulled on August 4, 1997, and that work on such a system was completed by or before the 15th later that same month, with a mound of dirt delivered to Carole's address the day prior.
So, what does that all mean??? According to Don's family and this crack Facebook team of investigators, it points to the possibility that Carole wasn't truthful with her timeline ... and that Don may very well be under the ground, like Joe Exotic himself suggested in the docuseries.
We're told the group will turn this finding and others they claim to have over to the cops, in hopes of cracking the case wide open again.
We've reached out to Carole about the group's new findings ... so far, no word back.

Cuba Gooding Jr.'s lawyer is making what sounds like, on its face, an odd argument in his sexual assault case -- claiming women with small breasts tend to be delusional.
The actor and his legal team appeared in a Manhattan courthouse Thursday for a preliminary hearing in his trial, and things took a strange turn when one of his attorneys argued a woman's negative feelings about her breasts can directly affect her perceptions of reality ... specifically when it comes to sexual assault.
Now, some context -- the attorney, Peter Toumbekis, raised this because one of Gooding's accusers once blogged about women's self-esteem and body issues. It seems he used her words as a jumping off point for his theory ... but it's a risky, if not straight up offensive, legal maneuver.
There was no jury present today, but if Gooding's team uses that tactic later in trial ... it might backfire. Suggesting an accuser misperceived something as sexual assault due to the size of her breasts could easily be seen as victim shaming to a jury.
Reporters asked Gooding about it as he exited the courtroom, and he only removed his face mask to reveal a Black Lives Matter symbol. He didn't say a word.
As we reported ... there are at least 22 women who have accused the actor of sexual misconduct. Back in October, Cuba pled not guilty to 6 sexual abuse charges.
TMZ obtained security footage of an alleged butt-touching incident that relates to 2 of the 6 counts he's facing. Remember, Natasha Ashworth had claimed he pinched her butt while walking past her at TAO in NYC back in October 2018.
There's also the June 2019 incident ... in which a woman accused Cuba of groping her thigh and breast while at the Magic Hour Rooftop Lounge in NYC.

Gooding's other attorney, Mark Heller, tells TMZ ... the strategy for their opening statement to the jury will be to play video they believe shows absolutely no crime was committed.
Heller insists Gooding respects women and has never acted inappropriately toward them.

Breonna Taylor's family had a momentous meeting this week with Kentucky's Attorney General, and for the first time since her death, Breonna's family is hopeful justice will be served.
The attorney who reps Breonna's family, Sam Aguiar, tells TMZ AG Daniel Cameron did not play his hand and say if he'll charge the cops in her death, but he showed a real interest in Breonna and her mom, Tamika Palmer, says they walked out of the meeting feeling good about the case.
We're told Cameron was well versed on the case and asked a lot of questions about Breonna. He wanted to know about her life and promised an open line of communication as the review process continues.
Cameron said during the meeting, which lasted 45 minutes, he's waiting on the FBI's ballistic report. He believes the conclusions may unlock some of the mystery surrounding her death and will give him the information he needs to interview new witnesses and re-interview old ones.
Breonna's family has been met by radio silence for months, and their frustration grew to a fever pitch. Now, for the first time, Tamika feels optimistic Breonna's case is getting a fair review.

Again, Cameron didn't promise the cops would be charged for shooting Breonna 8 times in the middle of the night after barging into her apartment, but Tamika believes he's taking the case seriously.
