THEY GOT MY BACK

Greg Hardy is winning over some of the biggest female fighters in the UFC -- including Amanda Nunes and Rachael Ostovich -- and he tells TMZ Sports their support means the world to him.

Greg's past is no secret ... he was accused of domestic violence against a woman back in 2014 and initially convicted. The conviction was overturned in 2015.

There was a big controversy when Hardy fought on the same card earlier this year as Rachael Ostovich -- who was the victim of a brutal domestic violence attack ... with some saying it was unfair to Rachael.

But, she clearly didn't feel that way -- and told Dana White she was cool with the decision.

Now, 6 months later ... Ostovich is still supporting Hardy -- she "liked" a celebratory Instagram post Greg made after defeating Juan Adams on Saturday.

Plus, Greg says he's also getting support from stars like Amanda Nunes, Joanna and Kayla Harrison.

Greg says he appreciates those women giving him the chance to "get to know me" -- and wants to show he's not the monster some people think he is.

Inside the Octagon, however, Hardy is on a tear ... he destroyed Juan Adams to improve his MMA record to 5-1 -- and says he's excited to prove he's ready to take on the best heavyweights in the UFC.

Greg says he wants to be on the upcoming UFC card in Abu Dhabi and desperately wants to fight a ranked opponent.

Hardy also says he's still getting love from his old NFL teammates -- including Dez Bryant who reached out to him after the victory.

Hardy says he wants to make his friends and family members proud -- and feels he's doing that by succeeding in the UFC.

Greg says other teammates and coaches have also reached out -- and it means a lot to him.

We also asked Greg about that blood-licking celebration after the win ... and if he plans to do it again.

Cristiano Ronaldo Won't Be Charged In Vegas Rape Case

Prosecutors have announced they will NOT file criminal charges against soccer superstar Cristiano Ronaldo for an alleged sexual assault from 2009.

As we previously reported, Kathryn Mayorga claims Ronaldo raped her in a Las Vegas hotel room back in 2009.

She claims she met CR7 at Rain Nightclub in the Palms hotel in June 2009 and he invited her up to his penthouse suite to party and hot tub. There are photos of Mayorga and Ronaldo hanging out at the nightclub together that evening.

She had initially filed a police report describing the alleged crime -- but didn't identify Ronaldo by name.

Mayorga sued Ronaldo claiming she later accepted a $375,000 payment in exchange for her silence -- but recently announced she wants that agreement voided and went to cops to pursue a criminal case against Ronaldo.

In court documents, Mayorga described the alleged attack ... saying while changing her clothes in the penthouse suite, "Ronaldo entered the bathroom, exposed his erect penis and asked [her] to perform fellatio."

Mayorga claimed she refused and wanted to leave -- but Ronaldo "pulled [her] into a bedroom and onto a bed and attempted to engage in sexual intercourse."

Mayorga claims she tried to fight Ronaldo off -- but he turned her onto her side and sodomized her while she screamed "no, no, no."

Ronaldo had adamantly denied the allegations -- and said, "Rape is an abominable crime that goes against everything that I am and believe in."

Now, the Clark County District Attorney’s Office has made a decision to NOT prosecute -- claiming "the allegations of sexual assault against Cristiano Ronaldo cannot be proven beyond a reasonable doubt."

Prosecutors described the situation in detail ...

"On June 13, 2009, a female victim ('V') placed a call to the Las Vegas Metropolitan Police Department and reported that she had been the victim of sexual assault.  Members of law enforcement responded to her location to take a crime report.  Police transported V to the hospital so that a sexual assault examination could be conducted."

"A short time later, sexual assault detectives arrived at the hospital and made contact with V.  Although she knew who the person was who assaulted her, V refused to identify him or disclose where the crime occurred.  As a result, the police were unable to follow investigative protocols for sexual assault cases or to conduct any meaningful investigation.  Without knowing the identity of the perpetrator or the location of the crime, detectives were unable to search for and impound vital forensic evidence.  In addition, video evidence, showing interactions between the victim and perpetrator before and after the alleged crime, was lost.  The criminal investigation was closed."

"V and Cristiano Ronaldo, through their respective attorneys, eventually reached a civil settlement related to this matter in 2010.  For the next eight years, law enforcement heard nothing more from V regarding the crime or the perpetrator."

"On August 28, 2018, V contacted the Las Vegas Metropolitan Police Department, asking that her sexual assault investigation be reopened, naming Cristiano Ronaldo as the offender.  In spite of the passage of over nine years, Metro investigated her allegations."

"A Request for Prosecution was submitted to the District Attorney’s Office on July 8, 2019.  Based upon a review of the information presented at this time, the allegations of sexual assault against Cristiano Ronaldo cannot be proven beyond a reasonable doubt.  Therefore, no charges will be forthcoming."

A$AP Rocky Attacker Will NOT Be Charged

The man who attacked A$AP Rocky's crew will NOT be prosecuted for any crime, despite the fact that he incited the violence and persisted in harassing the rapper before A$AP finally snapped.

Swedish prosecutors just said they believe the guy who harassed Rocky attacked his bodyguard in self-defense, after being pushed and lifted by his neck. The initial video does not show anyone getting physical with the guy, but prosecutors have drawn that conclusion.

To the contrary, you hear Rocky in the first video trying to diffuse the situation, saying no one wants to go to jail.

Nevertheless, prosecutors say the guy was acting in self-defense when he hurled his headphones at Rocky's bodyguard, cutting his head.

Here's the bizarre part ... the bodyguard has already been CLEARED by Swedish authorities. So, on the one hand the bodyguard acted appropriately, and on the other he incited the violence and caused the other guy to act in self-defense. In other words, it doesn't make sense.

BRUTALLY BEATEN

The man was never taken into custody during the investigation, despite the fact that Rocky was detained a day after the incident and remains in jail 2 1/2 weeks later, and no charges have been filed.

It's clear Rocky will be charged with aggravated assault ... prosecutors mistakenly said as much last week. If convicted, he faces 6 years in Swedish prison.

The Swedish justice system is apparently an immovable force, because the Prime Minister has essentially told President Trump and the State Dept. to butt out after their attempts to free the rapper.

Formal charges are expected Thursday. Up to now, prosecutors and the judge have justified the detention by saying Rocky is a flight risk. It would seem he will continue to be held after Thursday, since authorities will be upping the ante.

Jay-Z's 40/40 Club Possible Attempted Break-In

Jay-Z's 40/40 Club in NYC appears to have been visited by some would-be criminals who left their mark ... and now have the venue on edge.

Law enforcement sources tell TMZ ... NYPD took a criminal mischief report over the weekend after the club's staff called cops and reported someone had jacked up their front door, in what the staff believed to be an attempted break-in.

We're told cops were shown photos of the damaged door, which looked like someone chipped away at it with some sort of instrument. However, officers noted the door had since been fixed.

Our sources also tell us that the police reviewed surveillance footage from the club, but found no clear evidence of a crime being committed. They're currently investigating whether this could've been an attempted break-in, and the case has been assigned to a detective.

Now, sources close to the 40/40 Club tell us the venue staff feels strongly this was a failed attempted break-in, based on what they've seen on their own cameras.

We're told the club is in possession of footage that shows two suspicious men hanging out in front of the building Friday afternoon, where one of them appears to come to the door in question ... according to the staff who reviewed it, anyway. The alarm didn't go off.

Our 40/40 sources also say that upon further review of more surveillance video, the staff noticed these two guys had been hanging around the club all week, with suspicious vehicles driving by around the same times as well. We're told the club feels they were staking the place out.

Now, it should be pointed out that the two men of concern are NOT suspects in the probe yet, as police didn't feel there was enough there to list them as such.

Either way, the incident has put 40/40 in a state of worry -- and we're told they've had round-the-clock security since Friday because of it.

UFC's Jon Jones Accused of Slapping Woman's Vagina ... Denies Allegation

UFC champ Jon Jones is denying allegations he slapped a cocktail waitress at an Albuquerque strip club back in April ... and telling fans, "I'm definitely not in any trouble."

According to police, the alleged victim claims 32-year-old Jones not only slapped her inside TD’s Eubank Showclub, but kissed her neck without consent ... and then put her in a chokehold that was so powerful, he lifted her off the ground.

The woman told police Jones continued to put his hands on her until he left the club, according to KRQE in New Mexico.

The woman called police to her home after the incident to report the alleged crime. Jones was later charged with misdemeanor battery and a bench warrant was issued for his arrest.

A spokesperson for Jones told the media Jon was unaware of the case against him -- and didn't know about the warrant because the paperwork was sent to the wrong address.

Jones later paid a $300 bond and the arrest warrant was rescinded.

"Today, the media told Mr. Jones about a false accusation launched against him and that paperwork had been sent to an incorrect address," a Jones spokesman said Sunday night.

"However, after receiving the documents from the press, Mr. Jones immediately went to pay the small fee, and he, and multiple witnesses, stand ready to factually refute the malicious lies being told about him to the public."

Jones later tweeted about the allegations -- telling one fan, "I’m definitely not in any trouble my friend, don’t be so quick to believe everything you read on the Internet."

He told another user, "I know there’s a whole bunch of people hoping for my downfall but there’s even more who are proud of me and love seeing me do well. And screw staying inside, I love this community.. excited to keep climbing, haters going to be mad when I win in December."

Young Dro Pudding Popped Arrested for Attacking GF w/ Banana Dessert

Well, this is a first ... a rapper was arrested in Georgia for weaponizing banana pudding.

Seriously.

Law enforcement sources tell TMZ ... Young Dro was arrested on July 5 for allegedly throwing a plate of banana pudding at his girlfriend during an argument at their Atlanta-area home.

We're told the two had been arguing over money -- but things got heated and the food started flying ... with both sides launching whatever delicious items they could find at each other.

Cops were called to the scene -- and despite the fact his GF made it clear she didn't want to press charges, they arrested Dro anyway.

He's now facing 2 counts of misdemeanor battery/family violence.

He's still in jail too -- according to law enforcement sources -- because he's also being held on a child support contempt order. The legal docs say he owes almost $41k in back child support, and needs to pay $10k to be released from custody.

Our Young Dro sources say the child support case involves another baby mama -- not his current GF who he had the pudding spat with -- and the rapper claims he's all paid up ... so it's a clerical error.

Young Dro's best known for his 2006 track "Shoulder Lean" featuring T.I. ... and had another hit single in 2013 called "FDB."

A$AP Rocky N.Y. Rep. Welcomes Trump's Help ... Kim K's Too For That Matter

A$AP Rocky's hometown congressman isn't sure if President Trump is genuine in wanting to help free him -- but he says it doesn't matter ... as long as the end goal is achieved.

We got Rep. Adriano Espaillat in NYC Sunday -- where he represents A$AP's home borough of Harlem -- and asked what he made of Trump saying he'd guarantee Rocky's bail if need be.

As we reported ... Trump tweeted out an update on the legal sitch in Sweden -- where A$AP's been jailed for about three weeks now -- and said he spoke the Prime Minister, assuring him the rapper wasn't a flight risk, and that he'd even vouch for his bail.

Rep. Espaillat says Trump being willing to put his own rep on the line for A$AP's bail is somewhat irrelevant, 'cause as he points out ... money's not really the issue here.

Our guy asks if DT's just using this as a re-election tactic to tap into a new demographic of potential voters come 2020, but the congressman won't go there. He tells us he doesn't wanna speculate on potential motives -- but what he is sure about is that those wanting to get A$AP freed will take any help they can get at this point, including from 45.

Hard to tell if POTUS' involvement is going to help A$AP, because the Swedish PM says he made it clear that their judicial system is independent and won't be subject to outside lobbying.

Doesn't hurt to have the right people in your ear though. Speaking of that, we ask Rep. Espaillat if Kim K and Kanye's political power is worrisome. Watch ... the guy defends 'em.

'The Chi' Star Sonja Sohn Arrested for Cocaine Possession

'The Chi' star Sonja Sohn was arrested for cocaine possession ... TMZ has learned.

Sohn, who also starred in "The Wire," was arrested Sunday at 2 AM in North Carolina for cocaine possession, possession of marijuana and drug paraphernalia.

The paraphernalia charges are misdemeanors, but the cocaine charge is a felony.

Police tell us ... she was arrested and brought into the station at 2 AM and bailed out 6 minutes later.

She posted $1,500 bail and left the station.

She will be arraigned Tuesday.

Sonja played Detective Shakima Greggs on all 5 seasons of "The Wire." She plays Brandon's mom, Laverne, on "The Chi."

We reached out to Sonja's rep ... so far, no word back.

Jussie Smollett's Lawyers Toss Osundairo Bros. Suit, Judge ... Wrong & Made-Up Quotes!!!

Jussie Smollett's lawyers say the Osundairo brothers misquoted alleged defamatory statements they thought his team made, but turns out ... their own attorney said 'em.

Mark Geragos -- who repped Jussie during his criminal trial when he was still in the hot seat in Chicago -- filed legal docs asking a judge to toss the Osundairo Bros.' defamation lawsuit against him, one of his colleagues and his firm, which they filed in April.

One of the main quotes the brothers were suing over in their initial complaint was something they alleged attorney Tina Glandian -- another one of Smollett's attorneys -- said to the media that implied they were part of "illegal" Nigerian steroid trafficking.

The quote the Osundairos attributed to Glandian in their lawsuit read, "platform ... is all about being steroid-free ... Their whole thing is, you know, all-natural bodybuilding. It's ridiculous."

Welp, Geragos points out in his court filing that Ms. Glandian never said that at all -- in fact, it was their attorney, Gloria Schmidt, who said that to the Chicago Tribune in early April ... word-for-word. That alone, Geragos argues is enough grounds for dismissal -- but there's more.

Geragos and co. say that the brothers also paraphrased something they claimed Geragos said on a podcast he does with comic Adam Carolla, alleging the celeb attorney dragged their reps through the mud by indicating they'd attacked Jussie, committed perjury and conspired to make false statements to clear their names.

Geragos submitted transcripts of his podcast during the time of the criminal legal proceedings, and he notes ... he never said the brothers' names, nor did he say or indicate what they attributed to him. Another example Geragos cites for nixing this thing.

Long story short ... Jussie's attorneys say the brothers can't get their quotes straight, and by falsely attributing statements to Geragos and co. ... the suit should be axed, and the Brothers should also be punished with sanctions for allegedly lying to the court.

The Osundairo brothers' attorney, Gloria Schmidt, tells us ... "They're grasping at straws, cherrypicking through my statements and any reasonable person reading the entirety of my statements will conclude that I was upset at the false accusations of illegal steroid use by the brothers."

As A$AP Rocky rots in a Swedish jail for weeks without being charged with a crime, you gotta wonder how another rapper -- a white rapper -- accused of the same crime and more spent a relative nanosecond behind bars before being allowed to go on his merry way and leave the country.

You may recall a story TMZ broke a year ago in May, when G-Eazy was arrested in Stockholm after punching a security guard in a club and snorting coke using a $100 bill.

G-Eazy was arrested for assault, possession of drugs and use of narcotics. There was no video of the attack, yet prosecutors allowed him to strike a deal a day-and-a-half later ... he pled guilty to violent resistance, a crime of violence against an official and illegal drug possession. His sentence -- a $10k fine and probation. He was also ordered to pay the security guard $900.

That was it ... G-Eazy was allowed to leave the country, no muss, no fuss.

Now, compare that to A$AP. There's VIDEO of the assault -- actually 2 videos, the other being the alleged victim assaulting Rocky first -- yet prosecutors and the judge have kept him in jail for more than 2 weeks as they continue to "investigate" and decide if he'll be charged. As we reported, prosecutors mistakenly played their hand Friday and said he was going to get indicted.

A$AP faces 6 years in prison for his alleged assault. G-Eazy spend less than 2 days behind bars.

And, one more thing. Remember, back in 2015 Snoop Dogg was arrested in Sweden after being snatched out of his car because cops believed he was driving under the influence. He was forced to pee in a cup and was released after cops determined he was clean. Snoop, who was there for a concert, said it was a case of DWB and he would never return to the country.

Jussie Smollett Special Prosecutor is BS!!! And, The Judge is Prejudiced

Jussie Smollett is pushing back against the appointment of a special prosecutor for his criminal case in Chicago ... and he's doing everything he can to stop it.

The actor's legal team filed three motions Friday, obtained by TMZ, seeking to overturn the appointment of a special prosecutor ... arguing it would expose Jussie to double jeopardy.

According to the docs, Jussie is trying to reverse the order issued last month by a Chicago judge, who faulted Cook County State's Attorney Kim Foxx and laid the groundwork for Jussie possibly facing prosecution for allegedly faking the now infamous "attack."

Jussie's attorney, Tina Glandian, takes issue with the judge's apparent conclusion Jussie is guilty of staging a hate crime. In the docs, Jussie's legal team claims the Osundairo brothers attacked Jussie, got caught and then blamed him.

According to the docs, Jussie's attorney is floating the idea Abel and Ola Osundairo were motivated by homophobia, and she cites text messages from Ola degrading another man as a "fruit." His legal team is seeking grand jury testimony from the two brothers.

It's another twist in the ongoing Smollett saga ... as you know, the charges against Jussie were essentially dropped, even after the grand jury indicted him on 16 felony counts of lying to cops.

We broke the story ... Jussie claimed he was attacked by 2 masked men who beat him and put a rope around his neck while screaming homophobic and racial slurs. Police called BS.

A$AP Rocky Judge Orders Rocky to Stay in Jail ... Says He's a Flight Risk

9:40 AM PT -- Rep. Adriano Espaillat says Swedish authorities are using "KGB tactics" by keeping A$AP in jail.  He echos what A$AP's team knows ... they are going to indict him.

7:53 AM PT -- A$AP's lawyer, Slobodan Jovicic, tells TMZ, it is unjust to hold his client in jail because prosecutors believe he's a flight risk. Jovicic says there's no way A$AP would go on the lamb, because he's an international star and fleeing Sweden would torpedo his ability to tour and maintain his career.

The lawyer also says given the circumstances -- that there's video of the alleged victim attacking A$AP and his crew before A$AP took action, that A$AP tried to de-escalate the situation and that this was really a case of pushing and shoving ...  at most he should get probation.

5:34 AM PT -- A judge just sided with prosecutors and ordered that A$AP stay in jail for another week while prosecutors continue their investigation. They say they'll make a final decision next Thursday ... although given their original press release early Friday, it seems the die is already cast -- they're going to indict A$AP. Prosecutors say they must keep the rapper behind bars because he's a flight risk.

Again, the man A$AP allegedly assaulted -- the man who assaulted him and others first -- hasn't spent a minute in custody. As for why prosecutors need more time when it's all on video ... beats us. That means Rocky will be in jail for 3 weeks before any charges are even filed.

3:20 AM PT -- Now check this out ... Swedish prosecutors just issued a REVISED press release and have taken out the original statement that they will indict A$AP Rocky. Now it just says they need more time to investigate so he should stay in jail. So the question, was it a mistake, or was it a mistake that they just inadvertently played their hand?

A$AP Rocky is going to be indicted ... that's what prosecutors just said in a press release -- so what makes this bizarre case even more bizarre and abusive, they say they want him to stay in jail because they still need to investigate to figure out what happened on the streets of Sweden. So, why the hell have they already decided to charge him if they haven't figured out the case?

It's the latest twist in an outrageous case. The judge will hear the matter in a couple of hours.

Prosecutors say A$AP and 2 others in his crew may face crimes of abuse, assault and attempted assault ... remember, the assault is against the Swedish guy who first assaulted A$AP and others.

Prosecutors say they need until next Thursday to figure out, which raises the question ... if they haven't figured it out, how have they already figured out they are going to indict him?

The statement comes on the heels of the Trump administration getting involved in helping free the rapper. TMZ broke the story ... Kim Kardashian and Kanye West lobbied the White House to get involved in the drama across the pond. It was actually Kanye who urged Kim to get on the horn and talk to President Trump's son-in-law, Jared Kushner -- with whom Kim is very familiar with from her previous White House work.

Members of the Congressional Black Caucus also got involved ... calling out Secretary of State Mike Pompeo for not doing more and claiming the State Dept. wasn't moving fast enough.

As you know by now ... Rocky had been held behind bars for more than 2 weeks now as prosecutors determined if the rapper should be charged with aggravated assault.

We broke the story ... Rocky's troubles began almost immediately after video surfaced showing the rapper and his crew pummeling a guy in Sweden ... leaving him battered and bloodied. Police then began investigating after a report was filed.

But, a second video then surfaced showing the alleged victim harassing A$AP and hitting his bodyguard with a set of headphones. The rapper actually tried to be a peacemaker .. telling the guy, "We don't wanna fight y'all. We don't wanna go to jail."

As we first reported ... Rocky was held in a Swedish jail with shockingly inhumane conditions. Our sources had said an official from the U.S. Embassy in Sweden told A$AP Rocky's team that the person from the U.S. Consulate who visited Rocky in the jail reported back, "Walking into that place was like walking into a toilet."

11:18 AM PT -- TMZ Sports has learned, as part of the plea deal, Crawford will have to complete an anger management assessment and keep his nose clean for the next six months.

Tyrone Crawford can head to Dallas Cowboys camp without the worry of a court case hanging over his head ... TMZ Sports has learned he's a cut deal to get his bar brawl charge dropped.

We broke the story, the defensive end wrecked several bouncers at a Panama City Beach, FL bar on March 15. In crazy video we obtained ... you can see the 6'4", 290-pounder mauling people.

We also learned later in the night Crawford shoved at least TWO officers when they were in the process of making an arrest.

But, Tyrone was only hit with a misdemeanor charge of affrays for the altercation ... and court records now show he entered into a pre-trial diversion program to get the charge dropped.

Unclear what the specifics of the deal are ... but it usually means Crawford will have to complete classes and/or pay fines and fees to uphold his end of the bargain.

It's good news for Crawford -- the Cowboys begin training camp in just EIGHT days ... but Tyrone ain't completely out of the woods yet. The NFL still has to make a ruling regarding their investigation into the incident.

Crawford is one of the Cowboys' most unsung players ... as a team captain in 2018, he started 15 games and recorded 5.5 sacks. He's expected to be a key player for Dallas this season.

Swedish Ambassador Black People Shouldn't Fear Visiting Country ... In Wake of A$AP Rocky's Detainment

The Ambassador to Sweden says her country does not have it in for black people, and as for A$AP Rocky, he's being treated fairly.

Karin Olofsdotter appeared on 'TMZ Live' Thursday and maintained A$AP Rocky has not been unfairly singled out after his detainment, more than 2 weeks ago, for allegedly assaulting a man on the street.

We challenged the Ambassador, because the man the rapper allegedly assaulted him first, and it's all on video. The Ambassador suggested A$AP's crime may be more serious, although she wouldn't elaborate.

She also scoffed at the notion black people might now be afraid to travel to Sweden, given what happened to A$AP and what Quavo told us about what happened to him. She said Sweden proudly is in the top 5 countries that enforce the "rule of law."

As for claims by the U.S. Embassy as well as members of A$AP Rocky's team -- that the jail where he was initially held was disgusting -- she says even A$AP's lawyer claims those reports are inaccurate. That, by the way, is just not true, because his attorney -- Alan Jackson -- has maintained the condition when A$AP was first jailed were deplorable.

Kevin Spacey Criminal Case Dismissed

Kevin Spacey just won a huge victory, because the criminal case against him in Nantucket, Massachusetts has been dismissed.

According to legal docs, obtained by TMZ, the case was dropped "due to the unavailability of the complaining witness."

As we reported, the man, who was 18 at the time, claimed Spacey repeatedly groped him in a bar, took the 5th Amendment earlier this month while testifying about the incident. Defense lawyer Alan Jackson grilled him over his cellphone and whether he deleted texts that were exculpatory for Spacey. He then took the 5th.

The alleged victim had earlier dropped his civil case.

Sources tell us the dismissal was at the behest of prosecutors.

The alleged victim claimed that back in 2016, when he worked at the bar, Spacey plied him with alcohol and then repeatedly groped his genitals. He also claimed he texted his girlfriend while it was happening. Those texts were the subject of last week's cross examination ... Spacey's lawyer had information the alleged victim selectively deleted texts and, when pressed, he invoked the 5th.

The alleged victim's mother, former Boston TV anchor Heather Unruh, who came forward with the allegations against Spacey back in November 2017, told investigators she was the one who deleted texts related to her son's "frat boy activities."

4:39 PM PT -- Cuba's attorney Mark Heller tells us he remains confident the judge will see what he's seen in the surveillance footage and dismiss the case.

He says, "The Court in its wisdom can review the video which, without exception, does not reveal any criminal conduct on the part of Cuba."

Cuba Gooding Jr.'s motion to dismiss his groping charges doesn't sit well with the D.A.'s Office, which is calling him out for using the alleged victim's mental health as an excuse to toss the case.

The Manhattan D.A. responded to Cuba's motion to dismiss the case, saying the Oscar winner and his legal team are jumping the gun. In docs, obtained by TMZ, prosecutors say the alleged victim's mental health and expert evaluations of the surveillance videos ... are matters to be addressed once Gooding is on trial.

Further, the D.A. basically calls out Gooding's team for victim shaming, saying her mental health history is irrelevant to whether the actor touched her breast that night in the NYC bar. Prosecutors added ... if the judge were to dismiss Gooding's case, it would send a horrible message to the public -- that the tactic of exposing an accuser's past works.

Essentially, it would create a chilling effect for alleged victims coming forward.

According to the docs, the fact Gooding is a "world renowned" Oscar-winning movie star who has no prior convictions bares no relevance to his guilt or innocence in the matter.

Gooding's lawyers filed the motion to dismiss last month, but the judge said she would not make any "rash decisions" ... and tabled the matter for August 14.

As we reported ... Gooding turned himself in last month a few days after a woman called 911 claiming he touched her breast without consent at a New York bar. He was charged with one count of misdemeanor forcible touching and one count of sexual abuse in the third degree ... Cuba pled not guilty.

ANOTHER CLOSE ENCOUNTER

We obtained video of the incident via the bar's security footage, as well as another run-in after the alleged groping incident.

The Oscar-winner's attorneys, Mark Heller and Peter Toumbekis, claim he's innocent and believe the video evidence is inconclusive. Their motion cited blog posts where the accuser allegedly said she was starving for attention and also suffering PTSD and anxiety disorder.

Cuba himself claimed she has a "warped mental state" and has denied any misconduct with her. His lawyers argued the case is plagued by inconsistencies and an alleged NYPD screw-up.

In the docs, prosecutors shoot down any claim of police misconduct ... saying Cuba's attorneys misrepresented the police report and NYPD's initial investigation of the case.
