Olivia Munn Sued For Wrongful Death ... Worker Fell From Roof

A man replacing the roof at a house owned by Olivia Munn fell to his death ... and now she and her mom are being sued by his family.

According to a new lawsuit, obtained by TMZ, Olivia and her mother, Kim Schmid, hired Celso Merida to work on replacing the roof at the home back in May, but on his 4th day on the job he fell from the roof and suffered a bunch of injuries.

The suit says the man died a couple weeks later, the cause of death was blunt force traumatic injuries.

According to the docs, Olivia and her mom hired an unlicensed contractor named Fernando, who in turn hired Merida ... and the late worker's family says Olivia and Kim were negligent in pawning things off to an unlicensed contractor.

The man's family also claims Olivia and her mom instructed him to work on the roof, even though the required safety guards and fall protection were not in place ... creating what the family claims was an unreasonable risk of injury.

Olivia actually featured the home in a 2014 project with Vogue.

According to the suit, Olivia and her mother did not give Merida the proper tools for him to work safely on the roof, and they didn't participate in a workers' compensation program.

The family is suing Olivia and Kim for wrongful death ... and going after them for damages.

We reached out to Olivia's camp ... so far, no word back.

'Dolphin Tale' Star Dead at 16

UPDATE

7:56 PM PT -- The aquarium says Winter passed away around 8 PM as a veterinarian was prepping her for what they hoped would be a lifesaving surgery.

UPDATE

Clearwater Marine Aquarium said a team of 15 vets and technicians were going to attempt to treat the gastrointestinal blockage, but they noticed vital signs declining. We're told a necropsy will be done to determine the cause of death, but at this point, they believe it was heart failure.

UPDATE

Winter was 16-years-old.

UPDATE

RIP

Winter, the dolphin that grabbed global attention after being the focus of the movie "Dolphin Tale" is fighting for her life after developing a serious infection.

Winter, who lost her tail in 2005 at just 2 months old when it became entangled in a crab trap, had been cared for at The Clearwater Marine Aquarium in Florida for her entire life. Her caretakers announced that while they treated her for what they thought was a gastrointestinal infection, her condition got worse this week ... and she's now in critical condition.

"Dolphin Tale" -- released in 2011 -- was based on Winter's journey from her injury as a calf to the prosthetic tail that was made for her, and her progress after.

Among the movie's stars were Harry Connick Jr., Morgan Freeman, Ashley Judd and Kris Kristofferson.

The aquarium announced they'll be closed until at least Saturday "to create the best possible environment for her medical team."

A statement from the Clearwater aquarium team says, "We thank everyone for the incredible outpouring of love and support you have shown Winter since her rescue in 2005 and especially these last few days.”

They continue, “Many are inspired by her resiliency and this amazing response reminds us of how deeply she has affected millions, including so many on their own health journey.”

Raiders Owner Mark Davis Attends Tina Tintor's Funeral ... Henry Ruggs Car Crash Victim

SHOWING SUPPORT
KTNV 13 Action News

Mark Davis was one of about 100 people who attended the funeral services for Tina Tintor on Thursday ... paying respects to the woman who died in a car crash that authorities say his former player, Henry Ruggs, caused.

The Las Vegas Raiders owner showed up to the somber ceremony in a black suit, white-collared shirt and a tie ... and sat in a pew at the local church where the services for Tintor went down.

Davis stayed for the entire hour-long event ... and did not speak with media members afterward.

As we previously reported, Tintor died along with her dog, Max, after cops say Ruggs crashed his Corvette into the back of their Toyota on a street in Las Vegas on Nov. 2.

Officials say Ruggs had been speeding prior to the wreck -- going 156 MPH just seconds before the crash -- and claim the former Raiders star was drunk at the time, too.

Ruggs has since been hit with five charges over the incident -- including four felonies -- and prosecutors say he's facing over 50 years behind bars if convicted on all counts.

As for Tintor and her family, her attorney said in a statement following the crash that they're "devastated" over the loss of the 23-year-old.

"Family was everything to Tina," the lawyer said, "and she was the light of her parents' life."

Travis Scott Didn't Love Fans Enough to Keep 'Em Safe ... Victim's Attorney Says

Travis Scott was more concerned with his own safety than that of his fans, and the tragedy at Astroworld should have never happened ... so says an attorney repping one of the victims.

Attorney Tony Buzbee, who is repping the family of Axel Acosta, tells TMZ ... all signs are pointing to Travis and the rest of the festival lineup going to great lengths to protect themselves from the crowd, and not putting nearly enough resources into crowd safety.

TOO LITTLE TOO LATE
TMZ.com

Buzbee says Axel traveled all the way from Washington to see the Houston festival and loved Travis, but the feelings were clearly not mutual, because the 21-year-old is one of 9 who perished from injuries suffered at the concert.

The way Tony sees it ... Travis and other artists are full of it when they say they love their fans, because if they really did, they would implement better safety measures at shows. Especially when they're massive 50,000-fan events like Astroworld was.

While Buzbee says he's not singling out Travis from the festival lineup, which also included Drake, watch the clip ... he clearly seems to be laying blame at the feet of the headliner.

TMZ broke the story ... Travis vowed to cover funeral costs for families of the people who died at the show, and provide mental health services to anyone impacted by the events.

Buzbee thinks that's a hollow offer -- he says the Acosta family has not heard a peep from Travis' camp and isn't expecting to get any money for Axel's upcoming funeral.

Travis' camp tells us they have been "actively exploring routes of connection with each and every family affected by the tragedy through the appropriate liaisons" ... adding families of the victims can reach out to them directly too.

Meanwhile, Buzbee is conducting his own investigation, and claims police requested full riot equipment before Astroworld's gates even opened Friday morning -- and by 10 AM cops admitted they had no control ... even with an extra 300 officers coming in to boost the overall number to 500.

He also tells us what justice looks like for his clients, and if there's anything Travis can do to make amends.

Ahmaud Arbery Trial Defense Lawyer Grouses ... We Don't Want More Black Pastors in Court

UPDATE

He continues, "I respect the defense attorney doing his job but this is beyond defending your client, it is insulting the family of the victim."

The lawyer for defendant William 'Roddie' Bryan in the Ahmaud Arbery trial complained to the judge ... "black pastors" coming to court and sitting with the family is unfair.

Attorney Kevin Gough voiced his displeasure in open court after Rev. Al Sharpton showed up to sit with Arbery's family inside the courtroom.

Gough groused, "I've got nothing personally against Mr. Sharpton ... but if we're starting a precedent where we're gonna bring high-profile members of the African-American community into the courtroom to sit with the family during the trial in the presence of the jury, I believe that's intimidating and it's an attempt to consciously or unconsciously pressure or influence the jury."

And, he goes on ... " ... if their pastor is Al Sharpton right now, that's fine, but then that's it. We don't want any more black pastors coming in here. Jesse Jackson, whoever was in here earlier this week sitting with the victim's family trying to influence the jury in this case."

BTW ... Jesse Jackson was never in the courtroom. He may be referring to attorney Ben Crump, who was in court earlier in the week.

THIS JUST DOESN'T LOOK GOOD

The judge was less than receptive, interrupting Gough and shutting down his argument, after the lawyer makes a Colonel Sanders reference.

Shahani, who was a senior at Texas A&M University passed away Thursday after injuries sustained at the event Friday night in Houston ... according to a family attorney.

GROSS INCOMPETENCE

As we had reported, Shahani had previously been declared brain dead, and was on a ventilator. She had gone to Astroworld with her sister and cousin, but the two got separated during a crowd surge. Bharti had reportedly suffered several heart attacks after the crowd crush and was rushed to a local hospital.

In an emotional press conference Thursday, a rep for Bharti's family confirmed she was the woman in a video -- obtained by TMZ -- that was dropped on her head as she was carried out by first responders. The rep says they want justice for Bharti and her family ... and for whoever put profits over safety to be held accountable.

FAMILY'S FRUSTRATIONS

Bharti marks the latest victim in the tragedy, and it's possible more could come. As we reported, 9-year-old Ezra Blount is still hospitalized and fighting for his life. His family, with the help of civil rights attorney, Ben Crump, sued Travis and Live Nation for injuries they say were caused when Ezra was trampled.

Travis has vowed to pay for the funeral costs of the show's victims and to provide mental health services to those impacted by the events.

A rep for Travis tells us, "Over the last week, Travis Scott and his team have been actively exploring routes of connection with each and every family affected by the tragedy through the appropriate liaisons. He is distraught by the situation and desperately wishes to share his condolences and provide aid to them as soon as possible, but wants to remain respectful of each family’s wishes on how they'd best like to be connected."

Gene Simmons Politics & the Unvaccinated Are Enemies!!! COVID Really Killed 5 Million

ANTI-VAX ENEMIES
KISSmas Show with Gene Simmons/Talkshoplive

Gene Simmons is going scorched earth on anyone who's still not vaccinated against COVID-19, and says he's sick of people using politics -- on the left AND the right -- as their rationale for remaining unvaccinated.

The KISS icon went on Talkshoplive's Rock 'N' Roll Channel Wednesday and went off about the lingering pandemic. Keep in mind, both Gene and KISS frontman Paul Stanley caught COVID earlier this year ... and one of the band's touring crew members died from it.

That's most likely why Gene has no patience for non-believers. He directly targeted folks who think "people died because they were fat or died because they smoked. No bitch, they died because they got COVID!!!"

And, in case anyone thought Simmons was getting political, he added, "The far left and the far right, they are both evil. They both spread all kinds of nonsense. Politics are the enemy."

Gene lamented the fact a lot of their European fans were unable to join the band for a recent KISS cruise vacation, but said those are the breaks when people don't wanna get the shot.

As he put it, "If you're willing to walk among us unvaccinated, you are an enemy."

Henry Ruggs Crash 911 Callers Distraught 'All I See Is Flames'

"ALL I SEE IS FLAMES"
Las Vegas Metropolitan Police

TMZ Sports has obtained multiple 911 calls made moments after Henry Ruggs allegedly caused a fatal car crash ... with one witness telling an operator she believed a person was trapped in the burning truck.

A female caller who said she lives near the scene of the accident claimed she was in bed when she heard the crash, and when she looked at the crash site, all she saw were flames.

"It's almost all gone," she said of the fire-engulfed vehicle, continuing, "and I think someone is in it."

The man horrifyingly said he also thought he heard yelping coming from a dog inside of the burning vehicle.

Of course, in addition to 23-year-old Tina Tintor dying in the wreck, her golden retriever, Max, also perished.

The second caller also speculated that he suspected Ruggs and his GF were under the influence ... though he didn't elaborate why he suspected they were impaired.

Astroworld Festival HPD Chief: Production, Artist Had Ultimate Authority to End Show

THEY KNEW THE SITUATION
Houston Police Department
UPDATE

3:07 PM PT -- HPD just put out a statement claiming that once CPR started on a concertgoer is when cops told "personnel in charge of the event to shut down the performance." They do not specify what time that happened, or if event organizers obliged.

UPDATE

2:04 PM PT -- Houston PD's Chief of Police just gave an update on where things stand with the Astroworld Festival investigation -- and he made 2 things very clear ... his agency apparently DID communicate something was seriously amiss to production during the show, and that he believes Travis Scott and his team were ultimately responsible for pulling the plug.

UPDATE

Chief Finner did not get into too many specifics, citing the need for the investigation to play out -- but he did clarify that HPD, which was on the scene by the hundreds, relayed to at least one production member that CPR was being rendered ... this while Travis performed.

UPDATE

He did not explain at what point this happened, though ... and frankly, stayed away from timelines in general -- noting times were becoming key in the investigation, as he described them as "shifting." Still, he made sure to note ... a message and/or an alert was relayed.

UPDATE

While Chief Finner tried to refrain from pointing fingers, he did appear to point the ultimate one at Travis and his team ... saying they had final say on when to shut things down. A few other notes ... Finner says there is no truth to the needle injecting theory, as the security guard who that purportedly happened to had a different story when they found him anew.

UPDATE

As for why the FBI is involved, Finner said he often partners with their local federal partners -- but insisted HPD was still heading up this case, and that that wouldn't change.

UPDATE

12:59 PM PT -- Houston PD is having a press conference to talk about their investigation into the festival at 1:30 PM PT. We'll be streaming on the site.

A victim in the Astroworld calamity has been declared brain dead.

22-year-old Bharti Shahani has been hospitalized since Friday's concert, clinging to life on a ventilator, but it appears Shahani will become the 9th fatality in the tragedy.

Kobe Bryant's Wife, Vanessa Files Trademarks For 'Mamba Vino' ... Getting In Wine Biz

Kobe Bryant's legacy could be entering the wine industry -- Vanessa Bryant just filed four new trademark applications for a wine named after the late NBA Hall of Famer.

TMZ Sports has confirmed ... Vanessa submitted docs on Nov. 5 to secure trademarks that indicate her aspirations to enter the wine business ... with "Mamba Vino," "Mamba Vino 2024," "Mamba Vino 8," and "Mamba Vino 24" among the phrases listed, as first reported by Josh Gerben.

Kobe Bryant, LLC -- which is run by Vanessa -- is listed as the applicant on the filing ... with Bryant signing off on all the paperwork.

This move is the latest in a series of business moves by Vanessa ... as we previously reported, last month she filed a trademark for digital collectible items, websites, training camps, broadcasting platforms, podcasts, TV shows, movies, documentaries and music ... as well as sports cards, food/drink containers and t-shirts.

All four new trademark names include one of Kobe's many nicknames, "vino" ... 'cause many people thought his game got better with age.

The names also pay tribute to the numbers Kobe wore -- 8 and 24 -- of course, both numbers are retired by the Lakers and hang in the rafters at the Staples Center.

Vanessa would be joining a growing industry ... a long list of former athletes such as Drew Bledsoe, Yao Ming, Jeff Gordon, Wayne Gretzky, and Terrell Owens all occupy space in the wine biz ... but like all things Kobe, we're certain this stuff could fly off the shelves.

'Rust' Gaffer Sues Baldwin, Armorer, Asst. Director ... 'Negligence' in Shooting

The key gaffer on "Rust" is now taking legal action against Alec Baldwin, Hannah Gutierrez-Reed and Dave Halls ... suing them over the fatal shooting that killed Halyna Hutchins.

Serge Svetnoy just filed suit against the above-mentioned individuals -- as well as others -- claiming the defendants' alleged negligence caused him severe emotional distress in the aftermath of it all.

According to the docs, obtained by TMZ, Svetnoy claims the bullet that struck both Hutchins and director Joel Souza actually zoomed by and nearly hit him too. Not just that, but the gaffer claims he was one of the first people on hand to tend to Halyna while she was profusely bleeding ... attempting to comfort her and keep her conscious.

As for why he's suing Baldwin, the suit claims he "owed a duty to the Plaintiff and other crew members and actors on the 'Rust' set to handle the Colt Revolver provided to him by defendant Halls with reasonable care and diligence for the safety of 'Rust' cast and crew." It goes on to say, "This duty called for Defendant Baldwin to double-check the Colt Revolver with Halls upon being handled to ensure that it did not contain live ammunition."

And, it goes on ... "This duty further called for him [Baldwin] to handle the Colt Revolver as if it was loaded and to refrain from pointing it at anyone." In other words, the suit claims negligence on Baldwin's part.

And, there's this ... according to the lawsuit, the scene Baldwin was rehearsing did not call for him to pull the trigger. According to the lawsuit, the scene called for Baldwin to draw the gun and point it in the general direction of the camera, but, "the scene did not call for Defendant Baldwin to shoot the Colt Revolver."

10/30/21
"SHE WAS MY FRIEND"
BACKGRID

The suit also claims Baldwin was negligent as a producer on "Rust," saying, "... they attempted to save money by hiring an insufficient number of crew members to safely handle the props and firearms ..." It goes on to claim there were other lapses on the set, including violating industry norms, declining requests for weapons training days, failing to allow proper time to allow for gunfire, failing to send out safety bulletins and spreading the staff too thin.

The suit also claims the target practice that was going on shortly before the tragedy was "outrageous."

Svetnoy says he'd known Halyna for 5 years and considered her a good friend.

The ordeal was absolutely traumatic, so says Svetnoy, and has since left him in utter mental anguish ... to the point he feels he might not ever be able to get over it.

Svetnoy is asking for damages and a jury trial.

NRG Park Asked Houston to Block Roads ... Citing Past Astroworld Festival Issues

A staffer at Houston's NRG Park -- which hosts Astroworld Fest -- made a very specific plea to Houston city officials to establish a wide perimeter ... in anticipation of unruly behavior.

TMZ obtained permit and planning documents and correspondence between NRG and the City of Houston, and in them ... the guy in charge of the facility's parking emailed people at the mayor's office just days before the 2-day festival was set to start.

The message -- sent by parking rep Sandeep Prasad -- is pretty detailed on what NRG was going to need from the City before Astroworld, due to what he described as past "transgressions."

Specifically, Prasad wanted to see if Houston could accommodate having a couple main road lanes entirely blocked off just outside NRG Park ... as he felt it would allow for safer entry into the premises, especially considering what had happened in 2018 and 2019.

Prasad's email reads, "During the Festivals in 2018 and 2019, there were a lot of transgressions on the Main Street side of the Yellow Lot. Those included destroying property and various acts of violence."

He goes on to say due to those issues, NRG is requesting to have the City close the two outside lanes going northbound on Main Street starting November 3. Main is a road that borders NRG and a section of its lot.

Prasad also mentions this request isn't coming out of thin air ... but on the heels of many public safety meetings in conjunction with Houston PD, which apparently thought this would be in the public's best interest.

No word on whether NRG got what it wanted, but it's telling the request was made at all. We don't know for certain if Prasad was specifically referring to the massive stampeding that took place in 2019 -- which was well-documented -- as the park opened.

11/9/19
FAN FRENZY

You might recall, folks were trampled in 2019 -- the last time Trav held an Astroworld Fest at NRG -- with many climbing over barricades and breaking through security gates. Three people were seriously injured back then, and the email makes it seem like NRG honchos had that on their minds ahead of this year's concert.

And, that's what makes this document so important ... it shows NRG was aware of the risk for more violence and rowdiness, and attempted to take steps to curb it -- although, the tragedy still went down on the premises.

11/5/21
RUSHING SECURITY
Storyful

As we reported ... 8 people died, and many more are severely injured and hospitalized. And crazy enough, people STILL stormed in when the gates opened this year, well before Travis took the stage at night. So, NRG's plans went down the drain.

Drake Breaks Silence on Astroworld ... 'May God Be With You All'

Drake is speaking out for the first time since joining Travis Scott on stage at Astroworld the same night 8 concertgoers lost their lives ... saying he's devastated and vowing to be of service in any way he can.

Drake posted a lengthy statement Monday, saying, I've spent the past few days trying to wrap my mind around this devastating tragedy. I hate resorting to this platform to express an emotion as delicate as grief but this is where I find myself."

While it wasn't his event, Drake has still been named a defendant in injury lawsuits from those claiming the concert left them in serious physical and emotional stress.

TMZ broke the story ... Travis will cover the funeral expenses of the 8 people who died at the show -- without question -- and is teaming up with BetterHelp to offer mental health services to anyone who may need them.

The causes of death for those killed have still not been released ... victims ranged in age from just 14 to 27.
