Dijon Kizzee's Independent Autopsy Confirms He Was Shot 15 Times ... Lawyers Sound Off on L.A. Sheriff

GOING AFTER THE SHERIFF
Fox 11

Dijon Kizzee was shot at 19 times by police officers and struck 15 times -- most of which hit his body as he was already on the ground -- this according to an independent investigation by his family.

The legal team for Dijon’s family just revealed the autopsy findings and sounded off on law enforcement -- specifically L.A. County Sheriff Alex Villanueva -- claiming he and the entire department is trying to justify a blatant lack of humanity in Kizzee’s killing … which they call an execution.

Attorney Carl Douglas went first by repeating that Kizzee was shot at 19 times … which he claims shows the cops had no humanity for his life, along with poor training.

Douglas says Kizzee’s killing demonstrates a “warrior mentality” that permeates across police departments in the U.S. He adds that the 19 shots tell him the officers involved did not perceive a threat … but rather did what they felt they had to do to “maintain their integrity back at the office.”

Civil rights attorney Ben Crump referred to Kizzee’s death as an execution, and also rebuked Sheriff Villanueva for "trying to justify the unjustifiable." Crump says the shooting of Kizzee is the latest tragic example of what he calls the "1619 pandemic" … his term for the unjust killings of Black people due to systemic racism in America.

AUTOPSY REPORT
Fox 11

Douglas also revealed a detailed chart of Kizzee's 15 gunshot wounds, 7 of which he says were in his back as he was facing away from the cops. He says the doctor who conducted the autopsy says several of the wounds are elongated ... because Kizzee was on the ground when he was shot.

Douglas goes on to say witnesses describe hearing shots, then a pause, then a flurry of shots from the officers. The lawyer claims Kizzee was not holding a gun at any point while he was shot at by the cops. He also alleges Kizzee did not die right away, but kept getting shot at despite being unarmed.

Douglas then called for L.A. District Attorney Jackie Lacey to arrest and charge the officers who killed Kizzee.

As we told you ... Tuesday's press conference was in response to last week's claim by the Sheriff's Dept. that its investigation determined Kizzee picked up a loaded pistol that had fallen to the ground just before deputies fatally shot him on Aug. 31.

THE FATAL SHOOTING
@AttorneyCrump/Twitter

The LASD previously requested a security hold on Kizzee's county autopsy, which suggests the report won't be released until the Sheriff's Dept. has completed its investigation, which remains open.

BEFORE AND AFTER THE SHOOTING

As we've reported ... protests erupted following Kizzee's killing and have been ongoing in L.A. this month, resulting in multiple confrontations and arrests.

Video of the incident shows Kizzee -- who was initially stopped for an alleged vehicle code violation while riding a bicycle -- getting into a physical altercation with a cop, before deputies shot him multiple times as he ran away.

Cops say a handgun allegedly belonging to Kizzee was recovered at the scene. Crump has argued that even if Kizzee possessed a gun during the altercation, he didn't point it at them and was not a threat by the time he was running away.

Disney & Pixar Sued Nice 'Toy Story 4' Stunt Too Bad You Ripped Off Evel Knievel!!!

If the "Toy Story 4" character Duke Caboom reminded you of Evel Knievel, you're not alone -- the folks in charge of his image and likeness thought so too ... and now they're suing.

A company called K&K Promotions just filed suit against Disney, Pixar and whole a bunch of their subsidiaries ... claiming the stuntman driver toy that Keanu Reeves voiced in the latest 'Toy Story' flick is a clear and obvious rip-off of the legendary American motorcycle daredevil.

More importantly, K&K claims they own all the rights to Evel Knievel's likeness, persona, and brand and says the Mouse House did NOT get any type of approval to base one of their characters after Evel.

If you've seen the movie ... this one's easy to spot as far as the similarities go -- and it would appear critics and other junket interviewers thought so too, according to the lawsuit.

Per the docs, obtained by TMZ, K&K say that Evel's style, influence and even a nod to his famous stunt cycle toy from the '70s is clearly sprinkled throughout the film -- of course, Duke himself is dubbed as the greatest Canadian stuntman, and he even comes with an energizer to wind up and release his bike ... much like the Evel toy from back in the day. They attached photos ... it's a thing.

K&K even allege Disney instructed its 'T4' cast and other people involved in the production to go out of their way to avoid using Evel's name during interviews, as well as other trademarked items. For example, they claim Tony Hale was doing mental gymnastics in an interview about why they called his character Forky, when he looks more like a Spork.

According to K&K, it's because Disney was worried about running afoul of existing trademarks for the term "spork" ... and tried getting around using it, but still kinda used it in the end -- sorta like K&K claims they did with Evel.

Of course, there's also the merchandise aspect -- K&K say Disney cranked out a ton of products from "Toy Story 4," including Duke Caboom toys, and made lots of cash from it.

So now, K&K is dragging Disney to court -- and yes, ya better believe they're asking a judge for big-time damages.

Sizzler Stick a Fork in Us!!! Files for Chapter 11

UPDATE

5:32 PM PT -- 9/23 -- Sizzler says they are not closing their doors despite filing for bankruptcy.

UPDATE

The casual restaurant chain says their goal is to keep all locations open for biz while renegotiating leases, which they estimate will take about 4 months.

Sizzler's fallen victim to COVID-19 -- the pandemic is forcing the joint to file for bankruptcy in what could be a bad omen for lots of chain restaurants.

One of the country's first casual restaurant chains has filed for Chapter 11 ... forcing 14 company-owned restaurants to close their doors as they struggle to pay rent during the pandemic. Dozens of other locations -- including more than 90 franchised restaurants in America -- are not part of the bankruptcy plan.

Chris Perkins, Sizzler USA's president, said, "Our current financial state is a direct consequence of the pandemic's economic impact due to long-term indoor dining closures and landlords' refusal to provide necessary rent abatements. The hope, Perkins added, is for the company to exit bankruptcy in about 120 days and re-open the locations.

Sizzler started 62 years ago in Culver City, CA with $50 in the cash register. Del and Helen Johnson opened it as "Sizzler Family Steak House." Back then ... Sizzler's steak ran you a cool 99 cents. The good 'ol days, eh?

Sizzler is one of many large companies that have been forced into bankruptcy during the pandemic. J.C. Penny and Neiman Marcus have previously filed for Chapter 11.

Tom's hitching a ride on a SpaceX Crew Dragon rocket and capsule to the International Space Station in October 2021 to start filming in orbit ... according to the 2020-2023 ISS official manifest.

Mr. "Mission Impossible" will be joined by "Edge of Tomorrow" director Doug Liman as the pioneering film project gets underway.

As we reported ... Tom is working hand in hand with SpaceX honcho Elon Musk and NASA to film an action-adventure flick aboard the ISS. The film, which will become the first shot in outer space, is reportedly NOT a "Mission Impossible" flick.

Hopefully, Tom takes some sage advice from retired astronauts Scott Kelly and Roy Bridges Jr. ahead of his big adventure ... remember, the famous astronauts say boning up on toilet science is extremely important!!!

NFL Hits Gruden, Payton With $100K Fines ... Over COVID Masks

UPDATE

2:33 PM PT -- Well, you can't say you didn't see this one coming ...

UPDATE

The NFL has now handed down even more punishment for coaches flouting COVID mask policies ... with the league hitting Raiders' Jon Gruden and Saints' Sean Payton with $100k fines for their lack of face coverings on "Monday Night Football."

UPDATE

The Shield also fined Gruden and Payton's respective teams $250k each ... NFL Network's Tom Pelissero reports.

The NFL just put its foot down and HEAVILY fined Pete Carroll and two other head coaches for not following COVID mask rules ... and more punishments could still be on the way.

The league has had a serious issue with its coaches not properly wearing their face coverings during games ... and it got so bad in Week 1, officials issued a warning, saying if things didn't change, penalties would ensue.

Seems Seahawks' Carroll, 49ers' Kyle Shanahan and Broncos' Vic Fangio didn't care much ... because they were spotted throughout their Sunday games with no masks on.

On Monday, the league hit them all -- and their respective teams -- with serious fines for the rules violations ... with multiple reports saying each guy was docked $100,000.

Their teams, meanwhile, were reportedly hit with $250,000 fines as well.

These likely won't be the last of the punishments this week either ... because both Raiders' Jon Gruden and Saints' Sean Payton didn't wear their masks properly on "Monday Night Football."

In fact, Gruden wore his mask so little during the game ... he was asked about it afterward -- and that's when he revealed he's actually had the coronavirus and is prepping for a fine nonetheless.

"I’m doing my best," Gruden said. "I’ve had the virus. I’m doing my best. I’m very sensitive about it, but I’m calling plays. I just want to communicate in these situations and I apologize and if I get fined I’ll have to pay the fine, but I’m very sensitive about that and I apologize."

Stay safe out there, people!

Dr. Dre's Biz Partner Accuses Nicole of Grand Theft ... Stop Taking Our Cash!!!

Dr. Dre's estranged wife had the gall to dip into a well-funded cookie jar not just once, but TWICE ... at least according to Dre's biz partner, who's now accusing her of grand theft.

Attorneys for Larry Chatman -- who co-founded Record One studio with Dre in 2015 -- just fired off another letter to Nicole Young ... accusing her withdrawing an extra $30,000-plus from the business account, despite no longer being legally authorized.

We already told you about the $353k Larry claims Nicole embezzled from the account in late August. The company accused Nicole of criminal conduct in draining the account and fired off a letter to that effect. After receiving the letter, Chatman says Nicole siphoned another $31,457, two days AFTER she was given the boot and removed in any official capacity.

In Larry and his attorneys' eyes ... that amounts to grand theft ... on top of the alleged $353k embezzlement from earlier.

And, yes, they're threatening legal action.

Nicole's attorney called their first accusation a "low-grade PR stunt" meant to embarrass his client and take the spotlight away from a recent lawsuit she filed against Dre himself ... in which she accused him of hiding assets she feels entitled to in the divorce.

Nicole's lawyer, Bryan Freedman, tells TMZ, "This is a clear attempt to smear Nicole's name.  As people are well aware, banks do not give out money to people who are not authorized to receive it."

This has become an epically-nasty divorce. Nicole claims Dre tore up the prenup she signed right before getting married. He calls BS on that. She also wants nearly $2 mil a month in temporary spousal support while the divorce winds its way through the legal system.

Bishop Talbert Swan Trump Blowing 'Anarchist' Smoke ... Distracting Voters from Racial Equality Issue

WE'VE GOT TO REFOCUS
TMZ.com

President Trump's trying to keep voters' eyes off the prize of racial equality -- at least that's how NAACP leader Bishop Talbert Swan is viewing Trump's latest defunding threat.

The President of the NAACP's Springfield, Massachusetts chapter, joined us Tuesday on "TMZ Live," and ripped POTUS for threatening to pull federal funds from Seattle, Portland and NYC ... cities he's now labeled "anarchist jurisdictions."

Swan pointed out the term "anarchist jurisdiction" has never existed in America, and believes the Trump administration made it up to rationalize his threat to cut federal funding to those cities. That threat is already facing legal challenges, but the Bishop told us it's also creating a distraction ahead of the election -- and he thinks that's exactly what the President wants.

He's imploring Americans to not lose sight of the mounting issues that truly matter -- racial inequality, coronavirus, the economy and the possibility of a Supreme Court he believes will "attack every Civil Rights gain made in the last 100 years."

As you know by now ... Trump's set to nominate Ruth Bader Ginsburg's replacement on the Supreme Court following RGB's sudden death.

'Cheer' Star Jerry Harris FBI Seeking More Potential Victims Following Child Porn Arrest

The FBI's not done building its case against Jerry Harris -- federal agents in Chicago are asking for any individuals under the age of 18 who may have been victimized by the disgraced "Cheer" star to come forward.

The feds have launched a "Seeking Victim Information" webpage related to the investigation of Harris, who was arrested last week and is facing a federal child pornography charge for allegedly enticing 2 underage teen boys to send him sexually explicit images of themselves.

The FBI says it's seeking the public’s help in identifying any additional minors who may have been contacted by Harris and asked to produce or view graphic images or engage in sexual contact.

Victims may have communicated with Harris via Snapchat or Instagram ... according to the feds.

As we reported ... the feds claim Harris admitted to many of the allegations against him, including soliciting and receiving child pornography on Snapchat from at least 10 to 15 other individuals he knew were minors.

The FBI's now focused on finding any other alleged victims.

Matt Thompson at Thompson Woodworks in Garden City, MI is the man who made it all happen ... and we gotta say, his contraption is pretty ingenious.

The Four Seasons OG Member Tommy DeVito Dead at 92 From COVID Complications

Tommy DeVito -- one of the original members of the iconic Doo-Wop group, The Four Seasons -- has died from coronavirus.

'Casino' actor Alfredo Nittoli confirmed the news Tuesday in a Facebook post, saying Tommy had died Monday night at a Vegas area hospital, where he'd recently been admitted after contracting COVID-19.

Nittoli says Tommy's daughter, Darcel, informed him of Tommy's passing, and went on to say that there'd be a service held soon in his native New Jersey.

DeVito was one of the founding members of The Four Seasons, along with Frankie Valli, his brother, Nick, and Hank Majewski. Before the Seasons, they were originally known as the Variety Trio, but evolved to The Variatones after adding Frankie, and later went as the Four Lovers before eventually settling on the Four Seasons. Obviously, the last one stuck.

The group had a lot of misfires in their early days -- but after some members fell off and others were added (with Frankie and Tommy remaining as part of the core) the Four Seasons finally found success with their single, "Sherry," and later ... "Big Girls Don't Cry," "Dawn," "Walk Like a Man" and many others.

The Four Seasons went on to churn out hit after hit throughout the '60s, and were going to toe-to-toe with the Beach Boys as far as chart-topping songs at the time in their respective genres. Tommy stayed with the group until 1970.

Of course, the Four Seasons and their story went on to be cemented in pop culture history with the 'Jersey Boys' play, and afterward ... a film of the same name. He, along with other members of TFS over time, was inducted into the Rock and Roll Hall of Fame in 1990.

Tommy was 92.

RIP

Vanessa Bryant Sues L.A. County Sheriff Over Leaked Photos at Helicopter Crash Site

UPDATE

12:14 PM PT -- The L.A. County Sheriff's Department tells TMZ ... "shortly following this tragic crash, Sheriff Villanueva sponsored legislation which now makes it a crime for public safety personnel to take and share non-official pictures of this nature."

Vanessa Bryant is suing the L.A. County Sheriff and his department, claiming they caused her severe emotional distress ... when deputies allegedly took personal cellphone photos of the bodies of Kobe and Gigi Bryant at the scene of the helicopter crash that took their lives.

According to the lawsuit, obtained by TMZ, "no fewer than 8 sheriff's deputies at the crash site, pulled out their personal cell phones and snapped photos of the dead children, parents and coaches. The deputies took these photos for their own personal gratification."

The lawsuit goes onto allege the photos were the subject of conversation within the sheriff's dept ... with deputies showing their colleagues the pictures that had no investigative purpose.

The lawsuit notes how the photos were exposed ... when a deputy was at a bar and showed the photos to a woman he was trying to impress. The bartender heard the conversation, blew the whistle and called the sheriff's department.

Vanessa says in the suit ... that's when Sheriff Villanueva tried to cover it all up by going to the Sheriff's substation that responded to the crash and telling deputies if they deleted the photos they would not face discipline. The suit claims the purpose of his talk was destruction of evidence.  The lawsuit claims Villanueva did not tell the families about the photos and they only learned of it in the media when the story broke that deputies took the photos.

The lawsuit claims the Sheriff never gave the family straight answers and now Vanessa is in constant fear the photos will leak ... "Ms. Bryant feels ill at the thought of strangers gawking at images of her deceased husband and child, and she lives in fear that she or her children will one day confront horrific images of their loved ones online."

The lawsuit seeks unspecified damages, including punitive damages.

We reached out to the Sheriff's Dept. ... so far, no word back.

Cardi B & Sister Sued for Defamation Over 'Racist MAGA Supporters' Jab

Cardi B and her sister are getting sued after labeling a group of beachgoers as "racist MAGA supporters" ... this according to a lawsuit.

Peter Caliendo, Pauline Caliendo and Manuel Alarcon are suing the rapper, her sister, Hennessy Carolina, and Hennessy's GF, Michelle Diaz, claiming they defamed them by labeling them as racist during a squabble at the Hamptons earlier this month.

9/6/20
BERATED AT THE BEACH
@hennessycarolina / Instagram

In docs, obtained by TMZ, the plaintiffs claim they were enjoying their time at Smith Point beach with their families when Hennessy approached them with rage ... spitting, insulting and threatening them just because one of them was wearing a MAGA hat.

At the time, Cardi tweeted a video of the altercation ... saying her sister was getting harassed because she and her friend are an Afro-Hispanic gay couple.

The group also claims Cardi B, Hennessy and Michelle edited the video and posted it on social media to falsely paint them as racists. Cardi had posted a video later that day with audio apparently showing Hennessy explaining that someone in the group told her to go back to her country.

Hennessy's side of the story was they were targeted because they "saw us parking here and we were speaking Spanish and we're mixed."

We've reached out to Cardi's team for comment, so far, no word back.

R. Kelly Attacker Moved to New Prison ... Feds Say Threat's Gone

R. Kelly's renewed plea to get sprung from jail is getting push back from Uncle Sam, who says his most recent concern -- getting attacked behind bars -- has been neutralized.

Federal prosecutors just filed a reply to R. Kelly's latest request to be released on bail after he was ambushed and beaten by a fellow Chicago MCC inmate ... a guy Kelly says could've cost him his life. The government's response? Relax, it was a one-and-done.

According to the docs, obtained by TMZ, the feds say the attack on R. Kelly was a one-time, isolated event -- and that it can't happen again, at least not with the same guy ... because he's been moved to a new facility in Michigan.

So, in their eyes, the threat has left the building.

The feds also dispute R. Kelly's claim the attacker allegedly told a doctor on site that he needed to attack the singer for attention on his own case -- claiming the doctor denied that convo ever happened. That said, they also point out that if R. Kelly's still sour about his injuries ... he can take it up in civil court.

Prosecutors claim R. Kelly continues to pose a threat to the public and is a flight risk, so he still shouldn't be released on bail.

Colin Kaepernick Ultra-Rare Card Sells For $20K ... Over $5K To QB's Charity

A SUPER RARE Colin Kaepernick football card just sold for over $20k at auction ... and at least $5 grand is being donated to the quarterback's charity!

As we previously reported ... the 2011 Topps Platinum Rookie Patch Autograph Red Refractor card featured a patch from Kap's rookie season jersey and his autograph.

The 1-of-1 card was put up on the block at Goldin Auctions ... and ended up selling for $20,400!!

Pretty awesome ... considering the card was originally part of a regular pack of cards. The anonymous seller picked up the card for less than $1,800 on eBay, before consigning it to GA.

Instead of keeping all the cash, the seller decided to donate a chunk of his profits to the Know Your Rights Camp -- Colin's charity.

BTW, the Kap memorabilia doesn't stop with the card -- the consignor is now selling a pair of game-worn, autographed Kaepernick gloves ... and you guessed it, KYRC is gonna get another check!

Autistic 13-Year-Old Shot by SLC Police Body Cam Footage Released

"TELL MY MOM I LOVE HER"
SLCPD

An autistic teen was shot by police in Utah, leaving him seriously injured ... and cops are now releasing the body cam footage of the incident.

13-year-old Linden Cameron's mother called the cops earlier this month, saying he was having a breakdown -- brought on by Asperger's syndrome -- and she needed assistance managing the situation.

On the body cam, you see one cop confront Linden on a dark sidewalk as he tells him to get on the ground. The kid doesn't obey the orders at first, and officers eventually open fire.

Eleven shots are heard on video -- it's unclear how many struck Linden, but he immediately went down and writhed in pain. He also seems to say "I don't feel good" and "Tell my mom I love her." Somehow, he survived the ordeal and was hospitalized.

Linden's mother had reportedly told cops he was easily triggered by law enforcement and that he may have had a BB gun, but she didn't think it was real. Cops allegedly told her they'd have to treat it like it was real.

Linden's mother says he suffered injuries to his shoulder, colon, intestines, ankles and bladder -- he remains in the hospital as an independent investigation into the shooting unfolds.
