11:15 AM PT -- A senior member of the D.A.'s office tells TMZ the Grand Jury story is "100% false."

A criminal case against Harvey Weinstein in New York City is reportedly being presented to a grand jury very soon ... this after he was accused of raping an actress.

Manhattan District Attorney, Cy Vance, is expected to take a criminal case against Weinstein to a grand jury next week in an attempt to indict the fallen movie mogul ... this according to WNBC. Vance declined to comment.

The news come about a week after actress Paz de la Huerta accused Weinstein of raping her in NYC in 2010 ... and the NYPD launching an investigation. The NYPD's Chief of Detectives said last week an arrest was imminent, but the D.A. walked that back.

Weinstein is under investigation by a number of other law enforcement agencies, all tied to alleged sexual misconduct.

Look up in the sky -- it's a bird, it's a plane ... oh wait, it's E-40 suing someone over "Captain Save a Hoe," mayne!

40 Water just filed suit against author Erika Kane and her publishers for a book she recently started selling, which is titled "Captain Save a Hoe" ... ya know, the same name he used for his hit 1993 song. Safe to say, 40's not having it.

In the docs, obtained by TMZ, 40 says he owns the rights to "Captain Save a Hoe" and Kane using it word for word on her book is straight-up ripping him off, not to mention unfairly profiting off his song and the character he created with it.

He's asking a judge to yank the book from shelves and for any dough she's made from it so far.

We've reached out to Kane for comment ... so far, no word back.

The so-called 'Catwoman' Jocelyn Wildenstein and her boyfriend have to stay away from each other after their arrests for assault -- which won't be easy, since they live in the same building.

Jocelyn and her boyfriend, Lloyd Klein, were each issued protective orders following their weekend fight which ended with them in handcuffs. Klein's attorney, David Moreno, tells TMZ his client and Jocelyn have 3 separate apartments in their building ... which will help them keep their distance.

Moreno says the court gave them enough leeway they should be able to make it work -- but they have to avoid taking the same elevator. Coincidental passing in the hallway is okay.

We're told Jocelyn and Lloyd have access to different entrances and plan to steer clear of each other.

"Sharknado" is big business and its producers aren't about to let some theater company bite their style ... so they're suing to shut down a stage version before its first run swim.

The Asylum Co. just filed suit against Theatre Row Studios and several other people for allegedly attempting to put on a staged reading/rendition of the instant cult classic TV movie series. Asylum says the stage folks are promoting their version as "Shark-nado" ... and planned to perform it in Southern Cali.

According to the docs, obtained by TMZ, Asylum says Theatre Row's take is a straight ripoff which could hurt the real McCoy's bottom line if the court doesn't shut it down, stat.

The stage company isn't promoting the play right now on its website, but Asylum says the damage has been done with previous ads ... to the tune of $10 million!

We reached out to Theatre Row ... so far, no word back.

Meek Mill is back behind bars because the judge has a long-standing vendetta against him, partially related to a Boyz II Men hit ... according to a member of his legal team.

Meek was sentenced to 2 to 4 years for violating probation, but one of his attorneys, Joe Tacopina, tells TMZ ... even prosecutors had recommended no jail time. According to Tacopina, Meek and the the judge are from the same part of Philly and know some of the same people.

Tacopina says the judge suggested to Meek -- during a meeting in chambers last year -- he do a remake of Boyz II Men's, "On Bended Knee" ... and give her, the judge, a shout-out. Meek thought she was kidding and laughed.

Tacopina claims she said, "I'm not kidding," and when Meek refused to do it, she replied ... "Okay, suit yourself."

Meek Mill's most recent arrests didn't sit well with the judge, who's sending the rapper to prison for a minimum of 2 years for violating probation.

Meek was in a Philadelphia court Monday when the judge ruled he'd violated probation from his 2008 drug and weapons case by getting busted for a St. Louis airport fight ... and his reckless driving arrest in NYC.

Even though both cases were dropped, the judge said the arrests alone were violations -- and gave Meek 2 to 4 years in prison. He was immediately remanded into custody.

Didn't help Meek's case that he'd previously violated probation in 2015. He got off with house arrest for that one. No such luck this time.

Johnny Depp could see 5 homes vanish from his portfolio as his ex-business managers try to get him to pay back a massive loan.

The Management Group filed docs Monday to force a sale of Depp's properties -- all of which are in L.A. -- in order to cover the $5 million TMG says it gave the actor in December 2012.

In the docs, TMG says it agreed to bail out Johnny when he owed that huge chunk of change to City National Bank ... thereby saving him from an embarrassing financial collapse. TMG says the 5 houses were collateral for the loan, and since he's stopped paying ... they want the properties.

Depp's beef with TMG started in June when he sued the company claiming it mishandled his money, and took out loans in his name ... to the tune of $40 mil.

As for the foreclosure -- first reported by Deadline -- a judge still has to sign off before TMG can give Johnny the boot.

Tony Gonzalez says Colin Kaepernick doesn't have a snowball's chance in hell of making it back to the NFL -- not this season, and not ever.

"He's done," Tony told TMZ Sports. "I don't think he'll ever get a chance. Never again."'

Last week, Kaepernick's lawyer predicted the QB would get picked up ASAP -- but Gonzalez literally laughed at the idea ... saying Kaep's not "good enough for the headache."

Richard Simmons just got the tab for the National Enquirer lawsuit -- which he lost -- and it could set him back well over $200,000 ... TMZ has learned.

National Enquirer, and its parent company American Media, just filed docs detailing how much their attorneys charged for the defamation case, and they say the grand total exceeds $221,888 ... as of October 29.

You'll recall, Richard sued the tabloid, claiming it defamed him with a story saying he was transitioning to becoming a woman. When the court ruled in favor of the Enquirer ... Richard was ordered to pay their attorney's fees.

The highest bill for one lawyer was just under $50k for services rendered over 95 hours. The lowest tab was $600 to a paralegal who put in 2 hours of work. Not too shabby.

Of course, he also has to pay HIS attorneys. We broke the story, Richard plans to appeal ... which will cost him even more dough.

David Hasselhoff's ex-wife has clapped back at his claim she needs to get a job ... she says it's tough when you're a 55-year-old actress.

Pamela Bach has just responded to David's petition to cut her off from spousal support. He's currently paying her $10k a month but claims she's perfectly capable of finding work and supporting herself.

Pamela says in new legal docs ... she's made "good faith and reasonable efforts" to land work as an actress but, given her age, "the current market for actresses" and the time she's been a homemaker ... it's been next to impossible.

She says she did find some work ... notably on "Celebrity Big Brother," but that's it.

Pamela also says it's a travesty to cut her off, claiming David makes around $1 million a year. She says she spent her prime earning years taking care of their home and raising their 2 daughters so David could pursue his career.

In the docs, she adds David never forked over a $1 million payment to balance their separation of assets when they divorced. She says he got a boat, jetskis, 2 trusts with a lot of assets and their home -- while essentially all she got was $325,000 out of the house.

8:55 AM PT -- Weiner is officially in custody. We're told he was dropped off Monday morning at the prison in northern Massachusetts.

Anthony Weiner will begin serving his prison sentence Monday for sexting with a 15-year-old girl.

Weiner was sentenced to 21 months for the crime of transferring obscene material to a minor. He'll serve his time at the Federal Medical Center in Devens, Massachusetts. The facility offers treatment for sex offenders.

Weiner reportedly spent hours Sunday with his 5-year-old son. As you know, Weiner's wife, Huma Abedin, filed for divorce on the heels of his latest scandal.

Finally, some good news for ex-Seattle Seahawks star Brandon Browner -- officials decided not to move forward with charges in his domestic violence case ... despite allegations he threatened his ex with a gun.

TMZ Sports broke the story ... 33-year-old Browner was arrested back in Sept. after allegedly making criminal threats to a female.

Now, we've obtained official documents laying out the case against Browner -- which show Brandon's ex-GF told police things got scary during a FaceTime conversation.

"He showed her a gun and said he would kill her," the docs say.

But Browner told police she was lying and he never had a gun. Prosecutors couldn't prove the gun threat actually happened ... so they dropped the case.

Dave Bautista is a liberal kind of guy ... who likes his guns.

We got the wrestler-turned-big actor at LAX Saturday where he told our photog he's a big second amendment guy, with limits. He thinks it's insane bump stocks are not illegal.

Kate Hudson's online retailer just cleared one of its legal headaches by settling its lawsuit against her.

Talitha Peters -- a former exec at Fabletics -- filed new legal docs obtained by TMZ to have her lawsuit against the retailer thrown out after striking a settlement for an undisclosed amount.

Kate is an owner of Fabletics.

As we reported ... Peters sued Fabletics and parent company JustFab last October claiming Fabletics gave her the ax because she went to rehab to treat her Ambien addiction.

Peters said the retailer was all good with her taking time off at first, but then stuck their nose in her biz and 86'd her the day she was supposed to return.

Case closed.

Tamar Braxton and her estranged husband Vincent Herbert have two very different views on the subject of reconciling ... he wants to make peace and she wants to peace out.

Sources close to Tamar tell us there's absolutely no chance she'll go back to Vince now that she's filed divorce papers. We're told Tamar's had enough. Their 9-year marriage had been tumultuous for too long and she's hellbent on ending it for good this time.

She's surrounding herself with family and friends to keep her focused on both her career and her personal life.

She's already moved out of the family home. Vince had been telling friends he's willing to try counseling, but Tamar's not receptive. As for their TV show, "Tamar & Vince", she's still doing the press tour but she's doing it solo.

As our source puts it ... she's done with Vince, and so is the family.

Jessica Alba's Honest Company is going after a baby toy manufacturer for ripping off its brand name AND its floral pattern ... according to a new suit.

Alba's company claims another Delaware company -- JAKKS Pacific -- started cranking out baby and toddler toys and strollers under the name, "Honestly Cute" ... in an attempt to make customers think the products are associated with Honest Company.

Even worse -- the JAKKS products include a floral design on the packaging that Honest Company says is way too similar to one it has trademarked ... according to the docs.

Alba's company wants JAKKS to drop the "Honestly Cute" name and get a new design ... and it's going after damages.
