Elon Musk's legal team was all set to grill Twitter CEO Parag Agrawal Monday -- but it never happened, and now EM's team is considering filing action to hold Agrawal in contempt.

Sources with direct knowledge of the case tell TMZ ... Elon's attorneys flew out to the west coast Monday to conduct Agrawal's deposition in Twitter's lawsuit against Elon for backing out of his purchase of the company. Sources close to Elon say Parag unexpectedly no-showed, but folks at Twitter say that's BS.

Our Twitter sources say both sides agreed on Sunday that Monday's deposition would be rescheduled for personal reasons, and will, instead, happen later this week.

Now, our Elon sources say his legal team might ask the judge to hold Parag in contempt for missing the depo ... which, if successful, could mean consequences even before the trial, which is set to begin Oct. 17.

Other reports suggested Elon was also supposed to sit for a depo Monday in Delaware, but Elon's attorney, Alex Spiro, tells TMZ, "It's a lie." He also insists the Parag's depo was still scheduled to go down Monday in San Francisco.

Remember, this is all about Twitter trying to force Elon to buy the company like he said he would ... only to then reverse course when he claimed Twitter wasn't being forthright about spambot data and security-related problems with the platform.

Poppy Montgomery and her husband are allegedly stiffing their former housekeeper ... and now she's suing.

The "Without a Trace" star and her hubby, Shawn Sanford, just got hit with a lawsuit from their hired help, who says working for the couple was anything but a dream job.

According to the lawsuit, obtained by TMZ, the housekeeper claims she worked for Poppy and Shawn in their Pacific Palisades home from 2014 until May 2022, and she says the couple still owes her a bunch of money.

Poppy and Shawn's housekeeper says they kept her so busy cleaning, cooking and taking care of their kids, she often couldn't take her legally required breaks ... claiming the couple owes her more than $48,250 for missed meal and rest periods.

The housekeeper also says Poppy and Shawn owe her more than $36,000 in unpaid wages plus nearly $7k in overtime.

On top of all this, she's looking for thousands more in various penalties under California's labor laws.

Two years after Brett Favre allegedly collected millions in welfare money to fund a volleyball arena at Southern Mississippi, a former state official claims the NFL legend wanted more cash for a football facility, new court docs show.

Ex-Mississippi governor Phil Bryant's attorneys say text messages show Favre reached out to Bryant again in 2019 regarding financing a potential indoor practice facility at his alma mater ... this, after already allegedly taking around $5 million for the volleyball arena.

Despite being warned of the serious legal risks, Bryant's legal team claims Favre "continued to press for state funds" ... and wanted up to $2 million for projects, according to ESPN.

The docs state Favre told Bryant via text ... "We obviously need your help big time and time is working against us. And we feel that your name is the perfect choice for this facility and we are not taking No for an answer! You are a Southern Miss Alumni, and folks need to know you are also a supporter of the University."

Bryant responded with caution, saying ... "We are going to get there. This was a great meeting. But we have to follow the law. I am to[o] old for Federal Prison."

Bryant also alleges he spoke with former Southern Miss prez Rodney Bennett, who claimed he "asked Brett not to do the things he's doing to seek funding from state agencies and the legislature."

Favre -- who is listed as a defendant in a lawsuit filed by the state of Mississippi over misspent welfare money -- has previously said through his attorneys he did not know where the funding for the facility came from.

Former Mississippi Department of Human Services director John Davis pled guilty to conspiring to defraud the State of Mississippi out of more than $70 million in federal funds on Thursday.

David Dobrik says he shouldn't be held responsible for any injuries suffered by a YouTuber in a social media stunt gone wrong ... claiming the guy knew what he was signing up for.

The influencer just responded to Jeff Wittek's lawsuit against him, with David claiming Jeff knowingly assumed the risks involved with the stunt and can't collect any damages from David just because he got hurt when it went sideways.

TMZ broke the story ... Jeff sued David back in June for more than $10 million, claiming David should have never been behind the controls of the massive excavator used in the stunt, which saw YouTubers being swung around from a rope attached to the excavator shovel.

Jeff says when it was his turn, David started swinging him around too quickly before abruptly slowing down, causing Wittek to slam into the side of the excavator, resulting in broken and fractured bones, plus a torn ligament.

There's been more said about the off-set shenanigans on "Don't Worry Darling" than the actual movie -- and it looks like that'll actually help it at the box office ... go figure!

The early numbers are in, and all the whispers have apparently attracted the public's attention ... based on estimations thus far -- 'DWD' is on track to rake in about $21 million this weekend, a huge W for WB, seeing how the movie only cost around $35 mil to make.

On Thursday alone, the movie pulled an impressive $3.1 million in previews (with limited screenings). When it opened wide on Friday, however ... it cashed in another $6.3 mil.

As of now, the movie's made about $9.4M total ... and at this rate, it'll have beat projections -- which had this thing fluctuating in the mid-to-high-10s, considering all the negative publicity surrounding the project ... particularly between Florence Pugh and Olivia Wilde.

Speaking of FP ... she actually went out of her way to post some behind the scenes shots from her days on set, and her collection make it seem like everything was super chill.

There's a photo of her and Olivia in there as well ... but it should be noted, it's a still frame from a scene in the movie -- as opposed to a true BTS shot, of which she has several with other castmates. At any rate, it seems Florence is trying to put out the fire here too.

She shouted out some crew members from the film -- not Olivia though -- and went on to say, "This film was such an epic story on such a large scale to shoot, all while during peak Covid times. For that I will always be grateful. To all of you who helped make this, your dedication and love was seen daily - thank you."

The timing of her post is interesting, because a bombshell report from Vulture on Friday alleged that all the rumored drama between Florence and Olivia was, in fact, real ... and it did, indeed, have to do with Olivia supposedly being absent a lot, going missing with none other than Harry Styles. Per Vulture, FP and OW got into a "screaming match" on set.

The report says it left Florence fuming ... and she had to go into negotiations with Warner to make sure she'd promote the movie at the absolute bare minimum -- which she has.

That -- coupled with #SpitGate and suggestions that Harry and Olivia have split (which don't seem to be true) -- is the ultimate cherry on this messy sundae. And yet, it's cleaning up!

Never mind the terrible reviews ... and the so-so plot/performances from everyone except Florence. Box office is still king in this town, and Warner probably loves to see it. 😮‍💨

Jake Paul is being sued by Eddie Hearn -- one of the most powerful people in boxing -- after The Problem Child claimed the promoter paid off a judge in two recent, high-profile bouts.

In a newly filed lawsuit, obtained by TMZ Sports, Hearn and his company, Matchroom Boxing, claim their reputation was damaged after 25-year-old Paul "made outrageously false and baseless allegations" during an interview on Sept. 20.

In the talk, Paul claimed Hearn's Matchroom Boxing paid off judge Glenn Feldman in the August Oleksandr Usyk vs. Anthony Joshua fight. Paul claimed that same judge was also paid off by Matchroom in the April Katie Taylor vs. Amanda Serrano fight.

Taylor won by split decision over Serrano, while Joshua lost by split decision to Usyk.

"Glenn Feldman shows up in Saudi and scores Anthony Joshua to win the fight when everyone who watched the fight said it was not a split decision," Paul said ... before adding, "Clearly, this guy is getting paid money by Matchroom Boxing."

Hearn included Paul's video interview as an exhibit in the lawsuit ... filed by attorney Frank Salzano.

Paul, in the interview, also acknowledged that it was "a bold statement and an accusation that I don't take likely, but it's just blatantly obvious. And they're not even trying to hide it."

Hearn -- who's suing Paul for defamation -- called the comments "outlandishly false."

Waka Flocka Flame and DJ Whoo Kid are teaming up ... challenging AEW stars Swerve Strickland and Keith Lee to a match -- with a twist -- loser has to donate $100K to donate to a charity!!

TMZ Sports spoke with Whoo Kid, who attended AEW Dynamite at Arthur Ashe Stadium in NYC on Wednesday ... and he broke down the beef between him and Swerve.

The famous DJ said he was supposed to walk out with Strickland and his partner, Lee, but he switched places with NY-born rapper Fabolous at the last minute, leaving the tag team duo pissed off.

Whoo Kid told us he didn't want to be booed by the fans, so he decided to walk out with Strickland's opponents, "The Acclaimed," made up of Max Caster and Anthony Bowens.

During the interview, Wacka Flocka (who happened to be with WK at the time) crashed the party and threw down the gauntlet ... telling Strickland and Lee, if they're looking for a fight, he's down to make it happen, no matter the time or place.

"We'll have a match right in the parking lot," Flocka said. "Wherever I see 'em, it's a match. Get the refs. It's going down."

As for what entrance music Whoo Kid and Flocka will use if/when they fight Strickland and Lee .. you guessed it, the 2010 hit song "Hard in da Paint."

Celeb jeweler Alex Moss tells TMZ Hip Hop, Rocky wanted to go all out with a special project that would be revered as more than just a simple, run-of-the-mill jewelry piece.

He commissioned Alex for a custom hand-crafted belt and blinged-out buckle that A$AP designed himself, which ran deep into Rocky's pockets ... $322k in total!!!

We're told the entire project took 4 months to complete, which isn't surprising considering it's loaded with VVS natural white diamonds, green diamonds, black diamonds and natural rubies.

The buckle itself is made of solid 18k white gold and Alex says it was no easy task to make but he handled the grueling process in his NYC shop.

Taylor Swift was, in fact, asked to perform at Super Bowl LVII, TMZ has learned, but turned the offer down ... and we know why.

Sources with direct knowledge of the Super Bowl halftime show tell us ... Swift was approached months ago by SB honchos, asking if she'd headline. We're told Taylor was clear ... she didn't want to perform until she finished rerecording all of her first 6 albums.

As you probably know, back in 2019, Scooter Braun was part of a group that acquired the rights to her first 6 albums. Taylor was pissed, saying she was "sad and grossed out." Braun has since sold the master recordings ... and Taylor vowed to rerecord them to, in effect, regain ownership. She's already rerecorded and released "Red" and "Fearless."

We're told Taylor would like to headline a Super Bowl halftime show, but now it's an issue of timing. It's possible she could finish the remaining 4 albums -- "Taylor Swift," "Speak Now," "1989," and "Reputation" -- in the next year. That would open the possibility of a 2024 appearance, but it all depends on finishing the rerecords.

Elon Musk isn't just tooting his own horn when he says he doesn't need to keep his technology top secret to succeed, he's actually making a totally "gangsta" business move ... according to Daymond John.

The "Shark Tank" star was on TMZ Live Friday explaining why Elon's unwritten rule of not patenting Tesla and SpaceX innovations is paying off for him ... and others. First off, Daymond says patents can slow down companies, and often it's all about speed when it comes to getting a good product to market to beat out the competition.

As we've reported, Elon dropped his "no patent" bombshell while on "Jay Leno's Garage" this week -- explaining he's not the least bit afraid of going head-to-head with other companies or inventors.

In fact, DJ points out Elon's said he won't sue anyone who wants to use Tesla technology in good faith, so he's walking the walk ... allowing others to build off his ideas and create better tech to advance society.

Tommy Lee is taking another shot at selling his home in Calabasas ... because he just put it back on the market.

The rock star drummer listed his picturesque estate this week for $4,599,000. It's the same price he listed the home for back in May 2020. It didn't sell the first time so Tommy took it off the market to lease it for a year and has now relisted it.

Barry Bonds is firmly in the corner of NY Yankees star Aaron Judge as he chases the single-season homerun record once set by him ... saying he wants him to break his record!

“The way he swings, he might as well hit one a day and get past me. I don’t care. Why not?” the former Giants slugger told Sportico.

Bonds -- who hit 73 home runs during the 2001 season, setting the MLB record for most ever in a single season -- also told the outlet he wants to see No.99 in a Giants uniform next season.

“I hope he signs here,” Bonds said. “Can it happen? I don’t know. It depends on what the Yankee payroll is. But we would love to have him, I’ll tell you that.”

The Yankees outfielder has been the best player in the Majors all season -- leading MLB in nearly every offensive statistical category -- and making a serious push for the Triple Crown.

FYI, the Triple Crown is super rare and means a player led the league in batting average, home runs, and runs batted in (RBI).

Judge tied Babe Ruth's single-season high the other night when he hit his 60th homerun against the Pirates -- pulling him within a dinger of tying Roger Maris' record of 61 homers in one season.

Judge -- who turned down a seven-year, $213.5 million extension from the Yankees -- will be a free agent at the end of the season, and Bonds wants him in a Giants uni.

“We in the Bay Area -- he’s a Bay Area boy -- we hope they don’t sign him, and we can get him,” Bonds said. “I would. He’s that good.”

As Judge closes in on Maris and chases Barry, he recently said Bonds hitting 73 home runs in a season is the record in his eyes, despite others who question the legitimacy of it.

"No matter what people want to say about that era of baseball, for me, they went out there and hit 73 homers and 70 homers, and that to me is what the record is."

A Roberto Clemente 1955 Topps rookie card just sold for $1,050,000 at an auction -- nearly breaking a record -- TMZ Sports has learned.

PWCC officials tell us the sale of Clemente's rookie card marks the second time a card from the legendary outfielder has passed the seven-figure mark.

As we reported, PWCC believed it could rival the previous mark for a Clemente card of $1.107 million -- and it came close.

"It's an exciting price and signals that collectors continue to see Roberto Clemente assets and vintage trading cards as a very desirable investment," said PWCC exec Jesse Craig.

"It's really amazing when these museum-quality pieces appear at auction because we not only get to curate and present the card, but we also get to discuss Roberto Clemente with new audiences."

MLB celebrated the 21st annual Roberto Clemente Day last week, with players, managers, and coaches in the Pirates-Mets game wearing No.21.

Clemente finished his Hall of Fame career with the Pirates as a 15-time All-Star, four-time batting champ, two-time World Series winner, and World Series MVP.

Brett Favre's alleged involvement in a multi-million dollar welfare scandal may have just gone from bad to worse ... 'cause a key figure in a criminal case has just made a deal to cooperate with the feds that could put the NFL legend in the crosshairs of the Justice Department.

Former Mississippi Department of Human Services director John Davis pled guilty on Thursday to conspiring to defraud the State of Mississippi out of more than $70 million in federal funds, which he was accused of misdirecting from the state's poorest people.

As part of his agreement with prosecutors, officials say Davis agreed to tell everything he knows about the massive scheme ... which could be problematic for Favre.

The former Green Bay QB has been under fire after he allegedly worked with Davis and other government officials to obtain $5 million from Mississippi welfare funds to help his alma mater, the Univ. of Southern Miss., build a new volleyball facility. Favre's daughter played the sport at the Univ. at the time Favre was accused of getting the money for the project.

Favre sent a text in 2017 to the woman who ran the nonprofit, seemingly acknowledging it was wrong to take the money ... "If you were to pay me is there any way the media can find out where it came from and how much?"  She responded, "No we never have had that information publicized."

A few hours later, the woman who runs the nonprofit texted Favre back, saying "Wow, just got off the phone with [then Mississippi Governor] Phil Bryant! He is on board with us! We will get this done!" Favre responded, "Awesome. I needed to hear that for sure."

Despite facing 15 years behind bars, Davis is being seen as an essential component in the ongoing federal investigation into the misdirection of the funds, as well as a corresponding state case. Prosecutors on both sides are eager to obtain information on other possible co-conspirators, including those connected to Davis.

The reality TV star tells TMZ ... the day after he was sued for sexual assault by two women, he lost 10 deals worth $25,000 ... with brands he's worked with for years quickly severing ties.

TMZ broke the story ... DeMario was sued Tuesday by two different women, who claim they went on dates with him that both ended with DeMario forcing them into nonconsensual sex.

DeMario's attorney, Walter Mosley Jr., says LAPD already investigated the alleged incidents and the investigations did not lead to criminal charges ... and he says DJ has evidence that will exonerate him in court.

For his part, DeMario claims he maintained a good relationship with his accusers over the years -- he says they even had plans to meet up the day after they went to the police with their allegations. His attorney characterizes the suit as a shakedown.
