David Lynch, the man behind "Twin Peaks," "Mulholland Drive" and "Blue Velvet," is on the receiving end of a divorce petition.

David's wife, Emily, has filed to end their 14-year marriage, and it doesn't seem all that amicable.

The 77-year-old directing legend's wife is asking for sole legal and physical custody of their 11-year-old daughter. Emily wants David to have visitation rights, but that's it.

Emily is also asking for spousal support and attorney's fees.

There's no evidence of a prenup, but David has been a major force in Hollywood for decades. He's also directed "The Elephant Man," "Wild at Heart," "Lost Highway," and "Inland Empire."

Derek Chauvin -- the cop convicted of murdering George Floyd -- was stabbed 22 times in a brutal attack behind bars ... and the inmate responsible says he wanted Chauvin dead.

Federal prosecutors announced Friday inmate John Turscak was charged with attempted murder in the prison stabbing. Using an improvised knife, Turscak attacked Chauvin on November 24 in the law library at the Federal Correctional Institution in Tucson, Arizona.

According to prosecutors, 52-year-old Turscak told corrections officers he would've killed Chauvin if they hadn't intervened.

As we reported, Chauvin's family had been left in the dark in the days following the attack ... pissed prison officials hadn't offered them more info other than the fact Chauvin was in critical but stable condition.

Chauvin was convicted of Floyd's murder and sentenced to more than 22 years in prison. He was also given a 20-year term on a separate federal charge of violating Floyd's civil rights ... which is what he's serving in Arizona.

Jussie Smollett has lost his big appeal in his fake attack case, but that doesn't mean he's going straight to jail to serve his sentence ... not by a long shot.

As we reported, an Illinois appeals court ruled by a 2-1 vote to uphold his conviction for faking an "attack" on the streets of Chicago back in January 2019. He was sentenced to 150 days in jail, but only served 6 days before being freed pending appeal.

Well now the appeals court has spoken, but it's not the only appeals court. Jussie can, and has vowed, to file a petition with the Illinois Supreme Court to review his case. The High Court is not required to hear it -- it's discretionary -- but while he pushes for the Court to hear his case, he won't go back to jail.

We did some digging, and here's the way it works. Jussie has 35 days to file his appeal with the Illinois Supreme Court. It usually takes around 2 months for the court to decide whether it wants to hear a case. If they reject Jussie's, his appeals are pretty much over, and that would mean he'd be back in the pokey by late February or March.

Now if the appeal is granted, it would take around a year for the court to hear the case and make a decision. During that time, Jussie would be free. So if the Supreme Court hears the case and upholds the verdict, Jussie would go to jail, but that wouldn't happen until mid-2025!

In other words, Jussie could dodge jail for three and a half years after his conviction under that scenario.

Lil Wayne is being dragged to court a former bodyguard who is suing the rapper after telling cops Wayne allegedly brandished a gun and punched him in the ear.

According to new legal docs, obtained by TMZ, Carlos Christian claims Weezy threatened to shoot him with a semiautomatic rifle ... a threat he says he took seriously considering Wayne once spent time in prison on weapons charges.

TMZ broke the story ... Christian called cops back in December 2021, claiming Lil Wayne pulled an assault rifle on him during a dispute at the rapper's Hidden Hills, CA home.

The bodyguard told police an altercation escalated to physical violence and Weezy ended up brandishing an AR-15, but sources close to Weezy denied the incident ever happened and claimed Wayne didn't even own a gun.

In the docs, the guard says he incurred medical expenses, lost wages, and suffered emotional distress as a result of the alleged incident ... and he's going after Lil Wayne for compensatory and punitive damages.

11:51 AM PT -- Special prosecutor, Dan Webb, tells TMZ ... "The appellate court ruled on every issue Mr. Smollett raised in our favor and against him. This was a resounding and profound victory for us today. Having a dissenting voice in the ruling is not uncommon. The decision by the appeals court is final."

He concluded, "What happens next is Mr. Smollett can file a petition for a higher appeal to The Illinois Supreme Court. This is purely discretionary meaning the court does not have to hear this appeal. He lost all legal rights to an appeal with today’s decision. If the Supreme Court decides to hear his appeal, there will be briefs filed and a hearing date set. If not, then the case goes back to the trial court, which will execute his sentence."

10:05 AM PT -- Jussie Smollett and his team aren't going to go down without a fight, a rep tells us, "We wish to highlight that the decision was divided, with Justice Lyle offering a detailed analysis in favor of Smollett. We are preparing to escalate this matter to the Supreme Court, armed with a substantial body of evidence."

Jussie Smollett just took a big L in court ... because his conviction for his hoax attack was just upheld.

An Illinois appeals court handed down the ruling Friday, with the three-judge panel voting 2-1 to uphold Jussie's conviction ... according to new legal docs obtained by TMZ.

The key to Jussie's appeal is the argument he could not be prosecuted because after the initial indictment, Cook County State Attorney Kim Foxx decided not to prosecute the case. That drew enormous criticism, and a special prosecutor was appointed who ultimately went to the grand jury that indicted him again.

The 2 justices who upheld the conviction said the decision not to move forward with the case was not equivalent to an agreement never to charge him. The 1 dissenting justice said Foxx's decision to not prosecute was in effect a promise to Jussie the case was over.

With the ruling, Jussie appears likely to return to a Chicago jail to complete his 150-day sentence.

Remember ... Jussie was initially convicted in 2022, spending 6 days in Cook County Jail before being released while trying to get his sentence overturned.

Now, Jussie's come up empty ... but his legal team has the option of appealing this decision to the Illinois Supreme Court, which would then decide on whether to hear the case.

During his appeal, Jussie dropped new music, directed a film with Vivica A. Fox, worked out with Taraji P. Henson, went to rehab and shaved his head.

It will be interesting to see if Jussie appeals again, or heads back to jail ... stay tuned.

Felicity Huffman is finally speaking out about the college admissions scandal that landed her in prison, and she kinda sorta is still justifying what she did, in the name of her daughter's future.

Felicity sat with KABC's Marc Brown and explained she had hired a highly recommended college counselor coach Rick Singer for a year, trying to secure a spot at the college of her choice.

The actress says after a year, he gave her bad news ... she wasn't up to speed and would not get into any of the colleges. Felicity says Singer "slowly" rolled out a criminal scheme which she ultimately bought.

Felicity ended up paying Singer $15k to bribe a proctor into changing her daughter's wrong SAT answers. As for why, she says it felt like the only option to give her daughter a future.

At one point she says, "It was sort of like my daughter's future, which meant I had to break the law."

Huffman spoke of the FBI raid on her home ... "They came into my home, they woke my daughters up at gunpoint - again, nothing new to the Black and brown community - then they put my hands behind my back and handcuffed me."

She continued, "I asked if I could get dressed. I thought it was a hoax. I literally turned to one of the FBI people in a flak jacket and a gun and I go "is this a joke?"

Huffman served 11 days for the crime.

Her daughter, Sophia, was not aware of her mom's shenanigans. Sophia is now studying drama at Carnegie Mellon in Pittsburgh.

As for Felicity, she's now working with A New Way of Life, an org helping incarcerated women to re-enter society.

Tiffany Haddish needs to be barred from consuming drugs and alcohol after her latest DUI arrest in California ... at least that's what prosecutors want in Georgia, where she also has a DUI case.

According to new legal docs, obtained by TMZ, state prosecutors in Georgia want a court there to modify the bond conditions from her open DUI case to restrict her from using booze and drugs.

They're asking for this change due to Tiffany's latest DUI arrest on the other side of the country ... which happened last week in Beverly Hills.

As we first told you ... Tiffany was arrested early last Friday morning -- after a Thanksgiving night gig at the Laugh Factory -- with Bev Hills PD officers putting Tiffany in handcuffs and arresting her. They'd gotten a call around 5:45 AM about someone stopped in the middle of Beverly Drive, allegedly slumped behind the wheel of a car with the engine running.

Remember ... Tiffany was previously busted for DUI in Georgia back in January 2022, when she was also allegedly asleep behind the wheel after smoking marijuana.

Eden Sassoon is a bad dog mom who allowed her Australian Shepherd, Winston, to bite a woman and her pooch ... this according to a new lawsuit.

'The Real Housewives of Beverly Hills' alum is being sued by a woman named Olga Mill, who claims Winston savagely attacked her and her dog, Gus, while on a walk in Los Angeles.

In the lawsuit, obtained by TMZ, Mills claims she was walking Gus on a leash on a street back in August when Eden's dog viciously and savagely attacked without provocation. Mills says a man named Ed Munoz was walking Winston, not Eden.

Mill claims Winston bit her so badly she was covered in cuts and bruises, resulting in a severe infection requiring an overnight stay in a hospital. She claims Winston bit Gus so badly he needed treatment and hospitalization at a veterinary clinic.

In the suit, Mills claims Winston had known violent and vicious tendencies from previous attacks on people ... but she says Eden still let Winston out on the streets "knowing that Winston would seek to attack and bite anyone in his view."

Mills claims the alleged dog attack left her with permanent disability, scarring and disfigurement ... and she's going after Eden for a ton of money.

John Oates says he's gutted by his estranged musical partner's allegations ... that he tried to secretly sell his half of a Hall & Oates enterprise.

John filed a declaration in a Tennessee court, saying he's "deeply hurt" that Daryl Hall took a private dispute they were having and made it embarrassingly public.

As we reported, Hall has gone to court over what he claims was a move by Oates to sell off his share of "Whole Oats Enterprises," the company they formed to control some of the group's assets.

Hall claims Oates ambushed him by finding a buyer whom Hall does not want. Hall got a temporary restraining order, halting the sale until a judge could determine whether Oates had the right to make the deal.

In his declaration, Oates says, "Daryl has consistently and publicly been adamant about being perceived as an individual rather than as part of a duo or group."

It was clear last year when Hall appeared on Bill Maher's "Club Random" podcast, there was no love lost between the two.

Oates says he can't talk about the specifics, but acknowledges "Daryl and I have not seen eye to eye." Thing is ... he wants those peepers to be private eyes.

Oates insists he's trying to maintain the integrity of Hall & Oates, but he's having trouble because Hall will not work with him.

Kelly Clarkson continues her winning streak in her divorce from Brandon Blackstock ... this round a labor commissioner ruled Brandon had overcharged her by millions when he represented Kelly as her manager.

According to legal docs, obtained by TMZ, a California labor commissioner ruled Brandon crossed the line as a manager when he booked gigs and inked deals for Kelly on "The Voice," Norwegian Cruise Line, Wayfair, and as host of the Billboard Music Awards. Aside from a few exceptions, only agents -- not managers -- can lawfully secure roles for talent.

Apparently, Brandon collects fees for booking the gigs, and the labor commissioner ordered Brandon to fork over those commissions to his former wife ... totaling $2,641,374.

BTW ... fun fact -- Brandon scored $1.98 million for commissions from her role on "The Voice." By contrast, he only got $93.30 in commission for Kelly hosting the Billboard Music Awards.

Brandon says he'll appeal the ruling. One bright spot for him ... Kelly also wanted the money Brandon got for scoring her the gig on her talk show, "The Kelly Clarkson Show." The labor commissioner begged to differ, so Brandon keeps whatever he got on that one.

Kelly filed for divorce back in 2020 after 7 years of marriage. The divorce was final in March 2022. She got the hotly-contested Montana ranch in the settlement.

Kelly had to pay Brandon $1.3 million and is on the hook for $45k a month in child support for their 2 kids, ages 9 and 7. Brandon also gets $115,000 a month in spousal support, but that ends in January 2024.

Hall & Oates are dunzo ... at least in the eyes of Daryl Hall who's accusing John Oates of intentionally going behind his back to sell his half of their partnership to a third party that Daryl doesn't trust.

Hall lays out his beef with Oates in legal docs the judge is now unsealing ... and they reveal exactly why the legendary duo is at war. As we reported, Daryl got a restraining order last week against John, and we now know he got it to block the sale of John's half of Whole Oats Enterprises (WOE) -- a company they'd formed to control some of the group's assets.

In the docs, Daryl explains they'd agree to a business divorce, of sorts, in 2022 ... where they'd start splitting up assets. Where things went south, according to Daryl, is when John secretly decided to sell his half of WOE to a company called Primary Wave.

Daryl says he was "blindsided" by this decision -- which was revealed to him 2 days before he was leaving on a tour ... and he thinks John's timing was intentional. According to the docs, John knows he needs Daryl to approve that sale, and Daryl says, "I have no intention of becoming partners with Primary Wave, and [Oates] cannot be permitted to thrust a new partner upon me in this outrageous fashion."

And here's a sign of how petty this is getting ... Daryl even thinks John timed the Primary Wave deal to coincide with start of Daryl's tour to "ambush" and distract him, potentially screw up his performance ... and intentionally "cause me the maximum amount of harm."

As for why Daryl's saying "I Can't Go For That" with Primary Wave -- in the docs, he says the company has a rep for exploiting copyrights and trademarks of artists after purchasing their catalogs. Bottom line, he doesn't want PW controlling his name and likeness.

He wants the dispute to be settled in arbitration, and until it is ... he wants a judge to block Hall's sale to PW.

If you wanna know just how nasty this split is, consider this -- it's almost a carbon copy of what Brad Pitt and Angelina Jolie are going through in the war over their French winery ... where she tried to sell her half to a Russian oligarch, pissing off Brad.

9:30 AM PT -- Unsurprisingly, Jonathan Majors arrived to court with Meagan Good by his side ... we've seen the two together a lot as of late, including Tuesday when they grabbed food together in NYC.

Jonathan Majors is finally going to trial for allegedly roughing up his ex ... and we might even hear about past allegations involving other women, if the judge allows it.

The actor's set to appear in court Wednesday in NYC, where the trial is scheduled to finally begin ... this after several delays. Remember, Majors was arrested and ultimately charged back in the Spring with misdemeanor assault and harassment.

His former girlfriend, Grace Jabbari, claimed they got into an argument in March, and he got physical with her in a car, which she says left her with injuries.

Of course, Majors has denied that from the beginning ... insisting it was him who got hurt in the spat -- which, several months later, resulted in Jabbari getting arrested by the NYPD ... although the D.A.'s office refused to prosecute her, maintaining she's the alleged victim here.

There's been a lot of info, photos and videos that have leaked out over the past several months leading up to the trial ... much of which, Majors' camp claims, depicts Jabbari, after the alleged attack, having a night out on the town and seemingly looking uninjured.

Another twist in this case is the fact a police report taken in London -- 6 months prior to whatever happened between Majors and Jabbari -- was entered into the court docket by prosecutors ... although it's remained under seal up until now.

Media outlets have filed motions in the case to have it unearthed, publicly, and a judge is expected to weigh that motion Wednesday before court proceedings kick off in Majors' trial.

It's unclear who the other party is in that London report ... but there have been rumors of other alleged possible incidents Majors might have been involved in before his March arrest.

Another element of this saga is what Majors has been up to in his personal life as this whole thing has been playing out -- namely, him starting a relationship with actress Meagan Good, which seems to have come out of nowhere ... but continues to go strong.

Good -- who hasn't addressed how she got involved with Majors, or any other details about why she's backing him -- has appeared alongside JM in a couple different high-profile court appearances ... and the two of them have been spotted in public all over the world too.

In fact, they were seen looking incredibly loving and cozy on Tuesday, cuddled up on the streets of NYC and putting on a united front.

Professionally, Major's career has been thrown into limbo -- he's lost film and TV opportunities since being accused by Jabbari, but he's been able to keep his Marvel job (for now) as Disney seems to be taking a wait-and-see approach to their leading man.

Other completed films of his have been put on pause ... so there's a lot hanging in the balance here for him. Now, we'll get to see what prosecutors believe they have against him in terms of evidence -- and more importantly, a jury's gonna be able to hear it as well.

Robert F. Kennedy Jr. hopefully won't have to worry about a guy he claims tried to break into his house -- 'cause the guy agreed to stay away, and the judge just signed off on an order to make it official.

Lawyers for the presidential candidate worked out a stipulation with lawyers for Jonathan Macht, requiring him to steer clear of RFK Jr., as well as his family, home, workplace, and vehicle. Earlier this month, RFK ran to court to get a TRO after Macht was arrested at the guy's house in October for trespassing.

You'll recall ... Macht was hauled away by cops twice in a short window -- this after Kennedy claimed he'd climbed the fence to his Brentwood property in an attempt to talk to RFK, although he never actually made it into the house.

Now court records show the judge signed off on extending the restraining order for the next 5 years.

The terms require Macht to stay at least 100 yards away from Kennedy and his family members -- not to mention his home, his workplace, etc. Macht also cannot contact RFK Jr. ... nor can he harass, intimidate, threaten or otherwise bother him.

Per the terms of the order, Macht can't own, possess or attempt to purchase firearms or ammo during this period.

Jonathan Majors is finding comfort in the arms of his girlfriend, Meagan Good, just one day before he's set to appear in front of a jury for the start of his criminal trial.

The embattled actor -- who's been charged with harassment and assault in the Big Apple after allegedly putting hands on his ex, Grace Jabbari, earlier this year -- was cuddling up with MG out in the streets of NYC Tuesday.

The two grubbed at Jack's Wife Freda ... and as you can see in these photos, obtained by TMZ, they were showing off a lot of love and PDA.

Meagan and Jon, who were both wearing all black, nuzzled one another in the street outside the restaurant ... and eventually switched positions a bit, to where JM had his arm draped around his lady with her back leaned up against him.

Safe to say, these pictures are worth more than a thousand words, especially ahead of such a big day for him and, arguably, his reputation and career down the line ... showing Meagan is standing by Jonathan amid this tumultuous time.

Meagan has been by Jonathan's side pretty much throughout his criminal case ... which is interesting, considering their relationship kinda came out of nowhere, right on the heels of the ugly allegations hurled against him.

Remember, Jabbari alleges she and Jonathan got into an argument back in March -- and claims things got physical ... to the point where she says he struck her, and caused injuries.

He's denied any such attack ... in fact, he claims it was actually Jabbari who got physical with him -- not the other way around. Jabbari actually ended up getting arrested and booked well after the initial incident ... but the D.A. refused to prosecute.

Majors' team has pointed to surveillance footage of Jabbari partying after the alleged beating she claims she took from JM ... and they say she looks completely uninjured/unbothered.

Kroy Biermann is being dragged to court by Chase over what the bank says is more than $10,000 in credit card debt ... and Chase wants a judge to make him pay.

Kim Zolciak's hubby just got hit with a lawsuit by the banking giant -- and in the docs, obtained by TMZ, Chase is alleging he owes a total of $13,071.88 ... which the bank says is way past due.

Chase attached Kroy's credit card statements in their complaint, which show the fat balances starting to rack up since summer.

Kroy and Kim's financial issues have been well documented ... starting with the alleged seven-figure sum they owe the IRS.

As we've told you, BMW just won a case against Kroy over non-payment of a Rolls-Royce ... and just this month a judge ordered Kroy to return the $400,100 SV to the car company.

Kroy was also sued by Sky Warrior over a $52,500 gambling debt from a bad run at a casino down in the Bahamas.

9:12 AM PT -- Sofia Vergara's attorney, Marty Singer, tells TMZ it was actually Sofia who first sent a demand letter to RCH on October 4 ... claiming the company was responsible for $5 million in damages for overcharging Sofia, doing substandard work and delaying the project.

Singer says RCH never disputed the claims, but has now filed a lawsuit of their own ... Singer says he's confident Sofia will prevail and receive significant payment.

Sofia Vergara skipped out on paying a contractor more than $1.7 million for a huge renovation of her luxurious home in Beverly Hills ... or so the contractor claims in a new lawsuit.

According to the suit, obtained by TMZ, the actress hired Reside Custom Homes in April 2022 to perform construction work on her $26 million mansion located in the Beverly Park neighborhood.

RCH claims Vergara agreed to pay for the work plus the contractor's fee, but claims she never followed through once the work was done.

RCH says the project was substantially completed by December 2022, but then Vergara allegedly asked for significant extra work beyond the scope of the agreement, which ended up extending the job until March 2023 ... when Sofia finally moved back into the home.

According to RCH, Vergara asked the contractor to install clay plaster in 3 powder rooms, an office, the dining room walls, the cabana bathroom and the guest house living room. She also wanted the company to remove and replace a flight of stairs.

RCH says it fronted the money for the additional work in order to finish the improvements and claims Vergara promised to pay the bill ... even allegedly telling RCH she'd approved one of the invoices for nearly $900K and "already" gave directions to her money manager to pay the bill.

But RCH says Sofia never followed through and now owes the company a whopping balance of $1,700,492.64.

We've reached out to Vergara's rep ... so far no word back.
