The elderly man in Buffalo who was shoved to the ground by an aggressive cop denies any ties to Antifa ... after President Trump suggested he was a member.

Kelly Zarcone -- an attorney for 75-year-old Martin Gugino -- tells TMZ ... POTUS is wrong to think her client is in any way involved with the radical left group, and to suggest otherwise is grossly irresponsible -- especially since the guy just got out of intensive care.

She says, "Martin is out of ICU but still hospitalized and truly needs to rest. Martin has always been a PEACEFUL protestor because he cares about today’s society."

Zarcone adds, Martin "is also a typical Western New Yorker who loves his family. No one from law enforcement has even suggested anything otherwise, so we are at a loss to understand why the President of the United States would make such dark, dangerous, and untrue accusations against him."

Yeah, a lot of people can't explain it -- including several Senators and Congressmen on Capitol Hill, who've refused to comment today about the President's tweet.

If you missed it, Trump openly pondered whether Gugino might've been an Antifa-tied provocateur ... who pretended to fall harder than he was pushed.

An LAPD cop who was caught on video giving a man a beating earlier this year is now going to court ... he's been charged with assault by the District Attorney.

Los Angeles County D.A. Jackie Lacey announced the charge Tuesday against Officer Frank Hernandez -- who video shows pummeled a man with his fists this past April out in Boyle Heights.  As we reported, the officer was responding to a call for trespass. Hernandez now faces one count of felony assault under color of authority.

At the time, Hernandez and his partner encountered the guy after seeing him on a lot he allegedly wasn't supposed to be on -- but after refusing to leave the area entirely on the officers' orders, things got heated ... and eventually, they came to blows.

According to the D.A., Hernandez is accused of repeatedly punching the man over a dozen times over the head, neck and body. The D.A. calls it "a disturbing case of the illegal use of force at the hands of a police officer. In this case, we believe the force was neither legally necessary nor reasonable."

D.C. Mayor Muriel Bowser is reminding Donald Trump exactly who is on whose turf ... and she's ready to stand up to his threats about putting dogs and soldiers on the streets of her city.

The mayor of our nation's capital joined us Tuesday on "TMZ Live" and made it clear ... the President is a guest in her city of 700,000 taxpaying citizens, not the other way around, and he's overstepping his bounds if he thinks he can threaten D.C. with federal muscle.

Mayor Bowser says Trump's bashing of the D.C. police, calling in the military and instructing law enforcement to open fire on peaceful protesters should be alarming to all Americans ... not just those who live in D.C.

She also tells us she's concerned Trump won't accept the 2020 election results if he loses to Joe Biden ... and says Trump's tweets attacking her and protesters are a clear signal the Prez is gung ho on intimidating the masses to bend to his will.

It's a pretty important conversation ... and part of the Mayor's growing feud with Trump. Remember, she's already poked the bear with the massive Black Lives Matter mural outside the White House.

Air Jordan has just conquered another element -- WATER -- 'cause Michael Jordan's Catch 23 boat just caught a 442.3-pound blue marlin in a fishing tourney!!

Jordan is currently dukin' it out in the 62nd Annual Big Rock Blue Marlin Tournament in Morehead City, North Carolina this week ... a big-time competition with $3.4 MILLION in prize money.

His Airness has participated in huge fishing comps in the past ... including the White Marlin Open in 2019.

MJ was all smiles when his crew brought in the huge blue marlin on Tuesday ... which is good enough to put them in 5th place for the heaviest marlin (the first place boat reeled in a 494.2-lb fish!!!)

Remember, MJ's Catch 23 ride is a beaut -- it's even got the signature elephant print from his Jordan 3's on the back.

Jordan did a "post-game interview" after getting off the boat ... saying he hopes to get back out on the water and bring back a bigger fish.

The crowd went wild when MJ pulled up to the dock ... and the legend even agreed to sign a few autographs after celebrating the huge catch.

George's family just paid their final respects, remembering their uncle, brother, son, cousin and nephew ... and it was super emotional.

His aunt, Kathleen McGee, spoke about the George the world doesn't know. His niece, Brooke Williams, called for justice and change. His brothers, Terrence and Philonise, said he was their Superman and talked about his final words, "I can't breathe."

Joe Biden’s pre-recorded message was just played at the funeral, and he addressed George’s killing -- and all the similar tragedies that have befallen black families -- by offering hope that Floyd’s death can be a turning point … one that finally helps America achieve true equality.

As we reported … Biden met with George’s grieving family privately for over an hour Monday and listened to them express their pain. The family lawyer, Ben Crump, said the gesture “meant the world” to them, and added …  “Listening to one another is what will begin to heal America.”

George Floyd's loved ones will pay their final respects in Houston Tuesday ... which has officially been declared George Floyd Day in the area.

Floyd's hometown funeral is the last of four services held for him over the past few days. The ceremony will be held at Fountain of Praise Church -- just like Monday's public viewing -- and then he'll be buried in a grave beside his mother's.

TMZ will be live streaming the event at 11 AM CT. Among those in attendance will be Ahmaud Arbery's mother. As we reported ... Ahmaud's father spoke during Monday's public memorial, along with parents of Eric Garner and Michael Brown.

George's family also spoke and delivered a powerful message, saying they believe if he had known he needed to sacrifice his life to bring the world together ... he would have done it.

Floyd was honored last week in Minneapolis, and then again in his birth state of North Carolina over the weekend.

Of course, George's death has touched millions of people around the world, sparked international protests and demonstrations in his name ... and could lead to an overhaul of policing across the U.S., as evidenced by what's happening with the Minneapolis PD.

The cops involved in his killing have been criminally charged. Derek Chauvin is facing second-degree murder for having his knee on George's neck for nearly 9 minutes. The other 3 officers -- Thomas Lane, J. Alexander Kueng and Tou Thao -- have also been charged with felonies, aiding and abetting second-degree murder and aiding and abetting second-degree manslaughter.

George was killed on May 25. He was 46.

Kimberly Jones says her powerful, eye-opening speech about the plight of black people in America came from feeling broken and hopeless -- but says it's exactly what everyone needs to hear.

The activist joined "TMZ Live" Tuesday to discuss her now-viral video, in which she passionately explains the history of black oppression in America in a way she believes many before her had been afraid to say out loud. Frankly, that fact alone is a symptom of the oppression.

If you haven't seen it yet ... do yourself a favor.

As her message continues to spread -- LeBron James, Janelle Monae and Trevor Noah have reposted it -- Kimberly tells us it's important to keep in mind why she said what she said. She says black people have been "exceptionally forgiving of the atrocities we face in this country," but the time has come to fight for TRUE equality.

Kimberly's also an author, and her new novel, "I'm Not Dying with You Tonight" focuses on race relations in America. As for why things finally seem to be shifting in real life -- she says we're in the perfect storm of national crises.

The "Vanderpump Rules" cast just got leaner ... Bravo is booting 4 of its leads over past racism that recently resurfaced, and 2 of the fired stars were there from the very beginning.

The network that airs 'VR' dropped the hammer Tuesday -- announcing Stassi Schroeder, Kristen Doute, Max Boyens and Brett Caprioni would not be returning for any future seasons, citing inexcusable racist comments and behavior that have come to light.

Stay with us, this is a doozy. Long story short, a former costar of theirs named Faith Stowers -- one of the only black women to ever appear on 'VR' -- recently recounted her time on the series, bringing up a story about how Stassi and Kristen once called the cops on her.

She says they lied to police, saying Faith fit the description of another woman who was robbing men in L.A. in 2018 -- and the 2 of 'em even copped to doing it. Luckily, nothing ever came of it for Faith, but no one really knew about this until last week ... when she spilled the tea.

Fast-forward to now ... and Stassi and Kristen have been on an apology tour that's proving to be too little, too late. Not only were they fired, but they lost a lot of outside business deals and endorsements as well ... and their publicists quit too.

Stassi and Kristen were series regulars since the launch of 'VR' in 2013.

As for the guys ... people online dug up a bunch of old racially insensitive tweets between them. They were rookies this past season, and were supposedly hated among the fan base. So, no love lost there!

Now, if you're wondering what Lisa Vanderpump had to say about this ... she half addressed the scandal, as it relates to the fellas, on the reunion episode last week, saying she kept them on her restaurant staff -- after knowing about their tweets -- because, well, we've all made mistakes.

"As a brother with a good heart, I say 'f*** you' if you racist or white staying quiet, you disabling the changes."

NBA superstar Damian Lillard -- AKA Dame DOLLA -- is sending a strong message about police brutality and the recent peaceful protests across the country ... dropping a spoken word track titled "Blacklist," in honor of George Floyd.

Lillard also calls out President Donald Trump for saying, "when the looting starts, the shooting starts" ... calling POTUS a "clown" and a "trust fund baby."

Lillard has personally taken the streets of Portland to protest the recent deaths of Floyd, Breonna Taylor, and Ahmaud Arbery ... vowing to bring change to the country.

Travis Scott's "Highest in the Room" has a catchy guitar melody that appears throughout -- but one producer claims Travis and his team lifted it.

The guy's name is Benjamin Lasnier, who says he's a Danish music producer who's made beats for lots of people, especially rappers like Trippe Redd, Desiigner, Don Toliver and if he's right ... you can add Travis Scott to his resume.

According to the docs, obtained by TMZ, Lasnier says he wrote and recorded the guitar refrain featured in Trav's hit song, 'Highest,' back in early 2019 ... which he then started shopping around to different producers, engineers and even artists themselves.

He says he also posted this guitar recording on his IG stories 3 different times -- although it's unclear if he still has them up or not for reference. Either way, Lasnier says he put it out there to more than 700k followers.

Welp, around springtime ... Lasnier claims he got in touch with a guy who works with Travis named Jamie Lepr -- who goes by Jimmy Cash on IG, and apparently solicits beats. Lasnier says he sent Lepr a beat pack, which included the guitar melody in question -- and with no formal deal struck between them ... Lasnier claims he eventually heard a slightly tweaked version of his melody on Trav's new song in late 2019. He says a strikingly similar arpeggio appears around 24 times, which he says makes it the meat of the song.

Of course, Lasnier says he never explicitly authorized Lepr to use the music -- and now wants his cut of the loot for what the song has gone on to make -- which is a lot, BTW. He claims "Highest in the Room" has generated north of $20 million for everyone involved in making it -- it's even had crazy success on the charts ... reaching No. 1 on Billboard's Hot 100 chart.

If you know, you know it's one of Travis Scott's most popular songs to date, without question. Now, Lasnier's asking a judge to give him an accounting of the profits, damages, and a running royalty share too.

We've reached out to Travis' team ... so far, no word back.

The NYPD police officer who shoved a female protester to the ground -- on camera -- has now been arrested and charged with assault ... among other crimes.

Officer Vincent D'Andraia surrendered to authorities at the Downtown Brooklyn precinct Tuesday morning. He was booked for assault, criminal mischief, harassment, and menacing. He appeared for his arraignment by a video feed, due to coronavirus concerns. He was released on his own recognizance.

D'Andraia has been ID'd by city officials as the officer seen in a video pushing a woman to the ground in late May near the Barclays Center ... where she was participating in a George Floyd protest. She says she suffered a concussion and a seizure.

The cop was suspended without pay shortly thereafter, and his supervisor was reportedly transferred to another precinct. The case is already being reviewed by Internal Affairs.

Brooklyn D.A. Eric Gonzalez says of the case, "I fully support the long-held American tradition of non-violent protest. As District Attorney I cannot tolerate the use of excessive force against anyone exercising this Constitutionally guaranteed right."

He adds, "This is especially true of those who are sworn to protect us and uphold the law. I am deeply troubled by this unnecessary assault. We will now seek to hold this defendant accountable."

Fight Island officially opens on July 11 -- and Dana White is telling TMZ Sports who will have the honor of breaking in the new venue!

"The first fight that we're looking at is Alexander Volkanovski vs Max Holloway," White says.

Of course, the two fought back in Dec. 2019 -- with Volkanovski beating Max by unanimous decision.

Now, Max gets a shot at redemption on Fight Island ... which has also been revealed as Yas Island in Abu Dhabi.

Other fights taking place ... Petr Yan vs. Jose Aldo and Jessica Andrade vs. Rose Namajunas.

White also says Kamaru Usman will fight Gilbert Burns.

White says the UFC is working on locking in more fights for Fight Island ... including Fabricio Werdum vs. Alexander Gustafsson, Antonio Rogerio Nogueira vs. Shogun Rua and Robert Whittaker vs. Darren Till.

White says there are more fights in the works.

As for the safety issue re: COVID-19, White says there will be "Lots of testing, lots of quarantining and lots of fighting."

UFC has also "secured" its own airline -- "We're going too be flying guys in from all over the place on our own airline."

There's more ... we also asked about Conor McGregor and if White truly believes the Irishman will stay retired from combat sports,

"I honestly don't know," White said ... ""but that kid's got a ton of money."

White says he found out McGregor is likely making a fortune in his liquor deal with Proper No. 12 -- and adds, "The minute you even start thinking about retiring, you should retire."

White tells us he understands fighters can fall in and out of love with the sport -- and the pandemic isn't helping.

One of the accused ex-cops in George Floyd's murder case needs financial assistance, and believe it or not, he's hoping the public will lend a hand as he tries to mount his legal defense ... which is that he claims he tried to do the right thing.

The family of Thomas Lane is soliciting donations via a website they've set up. His bail's been set at a million bucks ... and if convicted, he faces a maximum sentence of up to 40 years in prison.

Lane, along with the 2 other ex-officers beside Derek Chauvin, was arrested and charged with aiding and abetting 2nd-degree murder, and aiding and abetting 2nd-degree manslaughter.

Through their website -- which reads more like a resume -- Lane's family tries pleading his case, arguing Lane did everything he had the power and authority to do to save George's life on May 25. They point out Lane suggested rolling him on his side ... which they -- and prosecutors -- say Chauvin refused to do.

However, Lane was also involved in pinning George on the ground. The vast majority of America, and several law enforcement veterans, think he and his comrades should have removed Chauvin.

Anyway, the family says Lane called for the ambulance prior to George losing consciousness, and when it arrived Lane "did not hesitate to jump into the Ambulance where he started performing CPR to try and save George Floyd’s life."

They say chain of command is the only thing that stopped him from doing more. Lane's defense attorney offered that same explanation last week during arraignment.

On top of that, they note he was brand new on the job ... just 4 days on the streets.

The attorney for one of the cops charged with aiding and abetting in the murder of George Floyd made a shocking, ridiculous claim -- that the civilian bystanders who watched Floyd die should have intervened. But, that argument will backfire in spectacular fashion.

Earl Gray, the lawyer for fired officer and current defendant Thomas Lane, told Chris Cuomo on CNN Monday night ... if the bystanders were so outraged they should have stepped in. Cuomo was indignant ... the notion bystanders would intervene against four armed police officers is outrageous.

Think about it though ... what Gray is conceding is that there was clear excessive force -- otherwise, why would he advocate for civilian intervention? If there is clear excessive force -- which there was -- then his client would have a greater duty than any civilian to stop it. To yank Derek Chauvin off George Floyd ... and that's precisely the reason Thomas Lane was charged.

The husband of the Phoenix "Karen" -- who went viral for making a racist comment to a woman, and getting a slap in return -- is explaining his wife's behavior and offering a tearful apology.

Bob Harrian appealed directly to Karina Rodriguez -- the woman who slapped his wife, Tamara, in the gas station altercation -- during an interview with FOX10, saying, "I'm just so sorry that this happened. You never walked into that store thinking something like this was going to happen. I understand, and I'm sorry. I'm sorry for what she said."

Bob didn't excuse Tamara's racist rant, but explained ... "I just have to tell you this -- it's her mental illness. A year ago she would never have done, never have even thought of that."

He claims his wife's actions are the result of a break-in at their home last year, and says she's developed paranoia and signs of fabrication. He hopes the slap video will be enough to convince Tamara to finally seek treatment for her issues.

A disgusting, bloody pig head on a spike was left in front of an L.A. police station ... now cops are trying to find out who left it.

Law enforcement sources tell TMZ ... the swine skull was discovered outside the LAPD's infamous Rampart station Saturday afternoon, and though the message is hardly subtle ... it's unclear if the gesture was intended as a serious threat.

We're told the department's looking into it further and reviewing surveillance footage in the area. Cops are also being advised to maintain a low profile right now while off-duty ... in order to avoid confrontations with a public that's heated about police practices. Cops are well aware that's why hundreds of thousands, in L.A. alone, have been marching.

As you know ... there have been several incidents of violence involving cops the past 2 weeks during the unrest over George Floyd's death, systemic racism and police brutality in the U.S.

Some of the more alarming incidents include a Chicago cop charging and punching a guy, cops in Buffalo pushing an elderly man to the ground and a vehicle running over an NYPD officer.

It's worth noting ... LAPD's Rampart Division made national headlines for a massive police corruption scandal in the late '90s with officers implicated in police brutality, drug deals and even bank robberies.
