The Walgreens security guard who fatally shot a shopfitter in San Francisco used unnecessary aggression, and it was not a clear case of self-defense ... so says a former prosecutor who's challenging the D.A.'s theory.

Attorney Tony Brass joined "TMZ Live" Tuesday shortly after San Fran's District Attorney Brooke Jenkins released the footage of the April 27 shooting to show why she was not charging security guard Michael Earl-Wayne Anthony for killing Banko Brown.

Tony says, on a human level, it is super clear the security guard used a high level of aggression when he confronted Brown, which he finds absurd considering it was a shoplifting case "at best" ... and not an imminent danger.

On top of that, Tony says he's super shocked the D.A.'s already decided it was self-defense and there should be no charges. From his perspective, Anthony should've just let the guy go when he tried to leave ... and the gun was not necessary at all.

As we reported, Jenkins shared the footage Monday of the violent encounter ... that ended with Anthony gunning down Brown as he fled the store with a bag of allegedly stolen items.

Tony also points out the election of Jenkins as D.A. was a direct response to the former D.A. Chesa Boudin, who helped build San Francisco's "soft on crime" rep.

There's no love lost between Johnny Depp and his international fans, who swarmed the actor with praise before the premiere of his first movie since the Amber Heard trial.

Depp was on hand for the Cannes Film Festival Tuesday for the premiere of "Jeanne du Barry." JD plays King Louis XV  in the flick, directed by Maïwenn ... and he was most definitely a fan favorite as he strolled down the red carpet.

You can see lots of folks crowded around Depp as he snapped selfies and signed autographs. He and Maïwenn even got a big standing O once they entered the building.

Of course, it's been one hell of a journey for Johnny Depp over the last year. As you know, he was involved in a very contentious defamation trial against his ex-wife Amber Heard last spring.

JD ultimately won the courtroom showdown, but at the time, the spotlight was anything but glamorous. As we reported, in the time since the trial, AH has seemingly retreated to a quiet life in Spain.

On the other hand, Johnny Depp has relished his legal win. Remember, he secured a three-year deal with Dior that's worth north of $20 million -- the most lucrative men's fragrance deal of all time.

Priscilla Presley is no longer beefing with her granddaughter Riley Keough ... they just settled their dispute over Lisa Marie's trust, and we're told Priscilla's walking away with fatter pockets.

Priscilla and Riley's legal teams were in court Tuesday, where they reached a settlement over who controls Lisa's trust, which reportedly includes the Graceland mansion and a stake in the lucrative Elvis Presley Enterprises.

Sources connected tell TMZ ... Lisa Marie's estate paid an undisclosed sum of money to Priscilla to settle the dispute. Our sources say it's in the millions.

TMZ broke the story ... a trust battle broke out in the wake of Lisa Marie's death back in January, with her mom Priscilla challenging an amendment to Lisa Marie's trust, which eliminated both Priscilla and Lisa's former business manager, Barry Siegel, as trustees and left Riley as the sole trustee.

Priscilla questioned the validity of the amendment. She claimed it was never delivered to her, the document misspelled her name, the date on the document was suspicious, and Lisa Marie's signature appeared "inconsistent with her usual and customary signature."

There was a ton of money on the line ... and now it looks like Priscilla's getting a chunk of change.

JoJo Siwa's swanky home was the subject of a terrifying break-in ... and those allegedly responsible are still on the loose as cops work to track them down.

Law enforcement sources tell TMZ ... officers responded to a call around 2:40 AM Monday from an alarm company about the break-in at JoJo's San Fernando Valley home -- but by the time they arrived, the suspects had already taken off.

We're told cops found an open door at the property, which is believed to be what they used to get into JoJo's house.

The total value amount of what was taken is still unclear, as sources say no one was home at the time -- we're told investigators are still waiting to hear from JoJo on what's missing.

The dancer shared the scary incident with her fans Tuesday, claiming the alleged suspects were armed when they got in. Police didn't confirm with us if the suspects had weapons.

Britney Spears' two sons want nothing to do with Los Angeles anymore and plan to move to the Aloha State for a more private life, away from the attention swirling around their mother ... according to sources with direct knowledge.

Our sources say Kevin Federline, Britney's ex-husband, had his attorney, Mark Vincent Kaplan, fire off a letter to Britney's lawyer, Mathew Rosengart, asking if she'd be open to letting Jayden James and Sean Preston relocate to Hawaii full-time with their dad and stepmom, Victoria Prince.

Our sources say they want a response from Britney by week's end. If Britney objects, Kaplan will go to court and ask permission from the judge ... and given Britney hasn't seen the kids in more than a year and the kids want to leave town, it's likely the judge will allow the move.

We're told it's unlikely the case will end up in court and Britney will acquiesce to the move.

Our sources say Victoria has a job offer at a university in Hawaii, Kevin has DJ opportunities there as well, and the kids are eager to make the move. We're told they plan to leave L.A. for Hawaii sometime in July.

16-year-old Jayden will continue taking classes remotely, and 17-year-old Sean Preston will have graduated high school by the time they move, though his plans are unclear.

The kids have been with Kevin and Victoria 100% for a long time, so the move would not be disruptive.

As we reported, Jayden and Sean weren't at Britney's wedding last year ... and months later, she addressed the difficulties in her relationship with the kids by scoffing at Jayden's wish that she gets better.

Fans wanting to pay their respects to Pelé will now be greeted by an epic memorial ... the soccer legend's tomb in Brazil has just opened to the public -- and it's lavish.

The shrine -- which is located inside the world's tallest cemetery in Santos, Brazil -- features a golden casket, turf on the floor ... and even life-sized statues at the entrance of the room.

On the ceiling, there's a painting of the sky ... and on the walls, there are images of thousands of fans cheering.

In total, the monument occupies roughly 2,000 square feet of space.

Fans can visit the tomb by signing a form on the Ecumenical Memorial Cemetery's website ... but only a select, lucky few will get in -- at the moment, only 60 visitors are allowed per day.

Pelé's son, Edson, was emotional at the unveiling of the tomb on Monday ... telling reporters he was thrilled with the memorial.

"It has the essence of what he was," he said.

Pelé -- a three-time World Cup winner -- passed away on Dec. 29 at 82 years old ... and tributes for the legendary footballer have poured in from all over the globe nearly every day since.

In fact, his name was just added to the Portuguese dictionary ... recognizing "that or someone who is out of the ordinary."

The good news?? Utopia is finally expected to drop soon ... and as Travis told reporter Mark Berman, it's "on the way" as he threw on some Air Jordan 1 "Black Phantom" sneakers in the dugout.

"I had to come here to play Utopia for the boys down in the locker room," Scott said. "Had to get them right for the game."

A clip of Jerry Springer has gone viral on Twitter, showing him reading a last will and testament with a bunch of juicy details ... and some fans think it's the real deal, but it turns out to be more fiction than fact.

The vid shows Jerry in a Zoom call, divvying up his assets to his children ... more specifically, leaving a good portion to 2 Black kids he had out of wedlock -- of course, this is in no way rooted in reality.

It's actually a pandemic-era virtual play called, "Blood Money." Jerry made a cameo in the production, which was featured in "REFRAMED 2020: A Festival of New Plays on Social Justice," presented by Tulane University ... the school where he once was a student.

It's a pretty interesting piece, but gullible folks online took it and ran ... with one saying, "Only Jerry Springer could go out like this."

Another person said Jerry "wrote" the best episode of his drama-filled reality show yet.

As if the evidence against this being legit wasn't enough, a source connected to Jerry tells us this obviously isn't real, adding he only had one daughter throughout his life.

You'll recall, Jerry was laid to rest earlier this month in a Chicago suburb ... after dying from pancreatic cancer.

Ariana Madix is not keeping quiet about how ugly the cheating scandal with her ex-Tom Sandoval and Raquel Leviss went down -- revealing the cheaters first had sex in the car, while she was mourning the death of her dog.

In a preview clip of the season 10 finale of "Vanderpump Rules," Ariana opens up about how she found out about the whole 'Scandoval' for the very first time ... and how the call went when she first confronted Raquel.

If you already thought things were bad, the story gets worse.

Ariana says, she first found a screen recording of them on FaceTime, and, "That's when I called Raquel and I started, like, making her, like, f***ing tell me, 'What the f***? When did this start?'"

To her surprise, Raquel explained it had all started after a girls' trip to Vegas last August -- a trip Ariana left early because her dog Charlotte died.

To make matters worse, Ariana says Raquel still didn't tell the whole truth -- only confessing to kissing -- but later Tom Schwartz revealed Sandoval and Raquel banged in the car.

She adds, "And he didn't have a key to get in so he had to ring the doorbell and I had to let him in" ... yikes!

As you know, it's been a whole lot of drama involving the entire cast after TMZ broke the news Ariana had discovered the cheating was going on ... blowing up her 10-year relationship with Sandoval.

It's a special week for Conor McGregor -- it's the UFC superstar's youngest son's birthday ... and to celebrate the occasion, The Notorious decided to take a trip to Los Angeles ... with a new look!!!

Ditching his signature beard for the first time in months ... McGregor was thrilled to carry around baby Rian throughout the streets of Beverly Hills on Monday -- just hours before the toddler turned two years old.

McGregor was in great spirits while holding the kid -- making sure TMZ Sports' photog was well aware of Tuesday's big day.

"That's it, that's it," McGregor said, grinning ear-to-ear. "Birthday boy tomorrow! He's two tomorrow!"

Conor also talked a little fighting in between showing love for his baby boy ... telling us he and the UFC will be announcing an official date for his return fight against Michael Chandler "very soon."

He appeared to add that his UFC comeback won't just stop with a tilt against MC either ... telling us he's got his sights set on recording a few more knockouts to break the UFC's all-time career KO record.

"I'm only five KOs to go," the 22-6 fighter said. "So I'm almost there already!"

McGregor has not fought since he badly broke his leg against Dustin Poirier in July 2021 ... but he's been working like a madman to get back -- and, clearly, we're now just a few months away from the return.

A security guard fatally gunned down a shoplifter at a Walgreens in San Francisco ... and the entire violent encounter was captured on surveillance video.

San Francisco District Attorney Brooke Jenkins released the footage Monday to show why she declined to bring charges against Michael Earl-Wayne Anthony for killing Banko Brown at the store on April 27 in what Anthony says was self-defense.

The video starts off with Anthony blocking Brown -- carrying a bag of alleged stolen items -- from exiting the store. Anthony then goes after Brown, repeatedly punching him and placing him in a chokehold.

At one point, Anthony lifts Brown off his feet and throws him to the floor, getting on top of him as the two thrash around. Finally, Anthony lets him up, prompting Brown to grab the bag of merchandise and start for the exit. At the door, Brown whirls around and appears to make a move at Anthony, who then pulls a gun and opens fire, killing the alleged thief.

Anthony told cops that he ordered Brown to give back the stolen goods, but Brown refused and became aggressive. He also told police Brown threatened to stab him, although it was later determined Brown did not have a knife. Anthony said he ultimately shot Brown after he thought Brown -- upon turning around at the exit -- was going to take a run at him.

D.A. Jenkins clearly believed Anthony's story of self-defense because she did not charge him with a crime and released the security footage, police reports and witness accounts to prove to the public that she made the correct decision.

But not everyone was convinced.

Alec Baldwin is officially wrapped on "Rust" ... following the production screeching to a halt with the death of cinematographer Halyna Hutchins -- and the actor's sending off the project with a clean shave.

Baldwin showed off his back-to-normal look late Monday night, writing, "God, it felt good to shave off that beard…" You'll recall, the actor was rocking a ton of scruff for the low-budget Western.

He also gave a shout-out to his costar Patrick Scott McDermott, who's previously been featured on an episode of "Chicago Med" and a 'Please Don't Destroy' sketch on 'SNL' ... and it sounds like Alec's singing his praises.

As you know, production of the film stopped completely after the fatal shooting of Hutchins back in October 2021. It was unclear for a while if they'd even finish the movie, but production was up and filming again last month.

The crew high-tailed it out of New Mexico, where Hutchins' death took place, and relocated to Montana to finish up -- finding what appears to be an identical Western town.

We've seen production going down out there in its final weeks, including Alec's character being marched to the gallows for what seems to be the gunslinger's death.

We also saw him handling firearms out in Montana, which was eerie, considering the tragedy of Halyna's death.

Of course, Alec had always denied pulling the trigger on the prop gun, which discharged and killed Hutchins -- and prosecutors dropped the involuntary manslaughter charges against the actor before filming picked up again.

Looks like "Rust" is in the can, and it will be interesting to see what kind of attention it gets once it's ready to be shown to the world.

Sorry, Fernando Tatis Jr. and Juan Soto ... Steve-O was the star of the show at the Padres' game on Monday night -- throwing out an epic first pitch that featured a fireball!!!

San Diego's MLB team tapped the "Jackass" star for the pregame ceremonies at Petco Park just before the Friars took on the Royals ... and, in true Steve-O fashion, he wowed everyone in attendance.

The 48-year-old stuntman hit the field with a custom No. 62 "Steve-O" Padres jersey and a flaming glove ... before he spat a liquid that set ablaze above him.

Check out footage from the diamond -- the flames were nearly as tall as him!!

The entertainer then put the ball into the fire ... before he chucked it to San Diego's mascot at home plate for a perfect strike.

Steve-O was clearly fired up (sorry) over it all ... 'cause afterward, he gloated about the moment on his Instagram page.

"My first time throwing the first pitch at an @mlb game— I’m pretty sure it’s never been done like this, too!" he wrote. "Thanks so much, @padres!!!"

The Padres were stoked over the stunt too ... tweeting, "Yeah, dude Thanks for stopping by and throwing out an epic first pitch."

Steve-O's first pitch was a sign of good things to come for the home team ... the Padres shut out Kansas City, 4-0, and Michael Wacha brought the heat on the mound, striking out 11 batters in seven innings.

Taylor Swift and Matt Healy are inseparable and appear to be in love ... the two were seen exiting a Manhattan recording studio early Tuesday morning and they could hardly contain their excitement for one another.

The couple stepped out of Electric Lady Studios in the West Village and were greeted by a gaggle of photogs snapping pictures of them after they had pulled a late-night music sesh. As you can see, Taylor was all smiles being alongside her man, who gently placed his hand on her back.

Check out video, which shows the pair walking arm and arm to a car waiting in front. Matt, ever the gentleman, guided Taylor into the backseat and got in himself, before the vehicle drove off.

Of course, this was just the latest in a string of TS/MH hookups. Their budding romance first surfaced in the news after Taylor broke up with her longtime boyfriend Joe Alwyn.

As we reported, the 1975 frontman has been traveling all around with Taylor on her sold-out Eras tour to watch her perform. In fact, Matt clocked in some family time with none other than Taylor's father, Scott Swift, at her show in Philly on Saturday.

Taylor and Matt have also been hitting the town recently, going on a double date with Taylor's longtime collaborator, Jack Antonoff and his fiancée, actress Margaret Qualley, at Casa Cipriani in NYC.

The lovebirds -- Taylor and Matt, that is -- were seen sitting side by side holding hands.

Jimmie Allen's sweet deal with a "Shark Tank" powered ice cream company is apparently out the window ... this following recent rape allegations made against him.

Here's the deal -- it was announced back in March that the country singer was partnering up with The Frozen Farmer, a farm-fresh ice cream company backed by Lori Greiner and featured on the deal-making series.

Jimmie collabed with the biz and came up with Miss Angie's Peach Cobbler Frobert, inspired by a recipe from his mom of the same name ... but if you check out the company's page, the dessert is nowhere to be found and the social media posts promoting it have been deleted.

The pints were jam-packed with references to Jimmie's background, like a pic of him and his mom on the cover or the number 15 on the lid -- the number his dad wore when he played baseball. However, it looks like it's simply in his rearview mirror at this point.

As we reported, Jimmie's being sued by his alleged former business manager, who claims he raped her while she was working for him.

She says he continued to amp up the sexual harassment during her 18 months on the job ... before ultimately being fired from the company that employed her.

Jimmie told us the woman's claims have "no truth to them whatsoever" and alleges she hired a lawyer to ask him for money only after their 2-year consensual sexual relationship ended.

Gene Simmons' former estate looks like a brand-new property ... one he might not even recognize at first glance, but the new price tag -- more than double what it was -- will definitely catch his eye!!!

Real estate sources tell TMZ ... the Beverly Hills property, which sits on almost 2 acres of land, is now selling for a whopping $48 million and it's been completely transformed since the KISS frontman had the keys to this palace.

You'll recall, Gene sold the home to Max Nobel of Nobel Development Group back in 2021 for a mere $16 million. We're told the entire property underwent a massive 18-month makeover before returning to the market ... so much so, it's considered a brand-new property.

The new place is completely unrecognizable and was stripped to its studs ... with Nobel L.A. redoing every inch of the 79,948-sq-ft lot and estate that features 7 bedrooms and 11 bathrooms.
